का.आ. 5711(अ).—जबकि मेसर्स अवाडा आरजे बीकानेर प्राइवेट लिमिटेड जिसका पंजीकृ त पता C-11, सेक्टर-65, गौतम बुद्ध नगर, नोएडा, उत्तर प्रदेश-201301 में है, ने ट्रांसमिशन योजना "राजस्थान के बीकानेर में स्थित एम एस अवाडा आरजेबीकानेर प्राइवेट लिमिटेड की / 650 मेगावाट सौर ऊर्जा परियोजना तथा एम /एस अवाडा एनर्जी प्राइवेट लिमिटेड की 300 मेगावाट सौर ऊर्जा परियोजना की कनेक्टिविटी प्रणाली" के तहत ओवरहेड ट्रांसमिशन लाइन बिछाने के लिए विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत प्राधिकृ त करने हेतु आवेदन किया है।
और जबकि, विद्युत मंत्रालय, भारत सरकार ने पत्र संख्या 25-17/66/2025-PG दिनांक 14.07.2025 के अनुसार विद्युत अधिनियम, 2003 की धारा 68(1) के तहत ट्रांसमिशन योजना "राजस्थान के बीकानेर में स्थित एम /एस अवाडा आरजेबीकानेर प्राइवेट लिमिटेड की 650 मेगावाट सौर ऊर्जा परियोजना तथा एम /एस अवाडा एनर्जी प्राइवेट लिमिटेड की 300 मेगावाट सौर ऊर्जा परियोजना की कनेक्टिविटी प्रणाली" के अंतर्गत ओवरहेड ट्रांसमिशन लाइन हेतु पूर्व स्वीकृ ति प्रदान की थी।
मेसर्स अवाडा आरजेबीकानेर प्राइवेट लिमिटेड ने स्थानीय समाचार पत्रों दैनिक भास्कर )हिंदी (द ◌िनांक 05.08.2025, कामयाब कलम )हिंदी (दिनांक 31.07.2025, हिन्दुस्तान टाइम्स )अंग्रेज़ी (दिनांक 31.07.2025 तथा भारत के साप्ताहिक राजपत्र दिनांक 30.08.2025 में ट्रांसमिशन योजना के लिए प्रस्तावित ट्रांसमिशन मार्ग पर प्रकाशन की तारीख से दो महीने के भीतर आम जनता की टिप्पणियों अभ्यावेदन देने करते हुए नोटिस प्रकाशित किया था। / तत्पश्चात, मेसर्स अवाडा आरजेबीकानेर प्राइवेट लिमिटेड ने दिनांक 31.10.2025 को एक हलफनामा प्रस्तुत किया था, 8301 GI/2025
(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जिसमें घोषणा की गई है कि भारत सरकार के आधिकारिक राजपत्र एवं स्थानीय समाचार पत्रों में प्रकाशन की तारीख से 2 महीने के भीतर दो टिप्पणी / अभ्यावेदन प्राप्त हुई थी, जिसका उचित उत्तर दिया गया।
और अब आवेदक ने विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत "राजस्थान के बीकानेर में स्थित एम /एस अवाडा आरजेबीकानेर प्राइवेट लिमिटेड की 650 मेगावाट सौर ऊर्जा परियोजना तथा एम /एस अवाडा एनर्जी प्राइवेट लिमिटेड की 300 मेगावाट सौर ऊर्जा परियोजना की कनेक्टिविटी प्रणाली" ट्रांसमिशन योजना के तहत विद्युत लाइन बिछाने के लिए उसे वे सभी शक्तियां प्रदान करने का अनुरोध किया है, जो भारतीय टेलीग्राफ अधिनियम, 1885 के तहत टेलीग्राफ के प्रयोजन के लिए सरकार द्वारा स्थापित या अनुरक्षित किए गए टेलीग्राफ लाइन एवं खंभे या इस प्रकार की स्थापना और अनुरक्षण किए जाने हेतु, टेलीग्राफ प्राधिकरण को प्राप्त हैं। इस योजना के अंतर्गत निम्नलिखित ओवरहेड लाइनें शामिल हैं:
• अवाडा आरजेबीकानेर प्रा. लि. और अवाडा एनर्जी प्रा. लि. की सौर परियोजनाओं के लिए पूलिंग स्टेशन – बीकानेर-IV पीएस 400 के वी S/c लाइन D/C टावरों पर (16 किलोमीटर)
उपरोक्त योजना के अंतर्गत कवर की गई ट्रांसमिशन लाइनें आंध्र प्रदेश राज्य के निम्नलिखित गांवों, कस्बों और शहरों से होकर, ऊपर, आसपास और बीच से गुजरेंगी:

अब, सावधानीपूर्वक विचार करने के बाद, विद्युत मंत्रालय, भारत सरकार, विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत मेसर्स अवाडा आरजेबीकानेर प्राइवेट लिमिटेड को उपरोक्त ओवरहेड लाइन बिछाने के लिए वे सभी शक्तियां निम्नलिखित निबंधन और शतों के साथ प्रदान करता है, जो भारतीय टेलीग्राफ अधिनियम, 1885 के तहत टेलीग्राफ के प्रयोजन के लिए सरकार द्वारा स्थापित अथवा अनुरक्षित किए गए टेलीग्राफ लाइन एवं खंभों या इस प्रकार की स्थापना और अनुरक्षण किए जाने हेतु टेलीग्राफ प्राधिकरण को प्राप्त हैं:
i. यह अनुमोदन 25 वषों के लिए प्रदान किया जाता है।
ii. आवेदक को प्रस्तावित लाइन की स्थापना से पूर्व संबंधित प्राधिकारियों अर्थात् स्थानीय निकायों, रेलवे, राष्ट्रीय राजमार्ग, राज्य राजमार्ग आदि की सहमति लेनी होगी।
iii. आवेदक को विद्युत अधिनियम, 2003 के तहत समुचित आयोग के द्वारा तैयार किए गए पारेषण, ओ एंड एम, ओपन एक्सेस आदि के विनियमों/संहिताओं का पालन करना होगा।
iv. आवेदक कें द्र सरकार के विद्युत निरीक्षक/मुख्य विद्युत निरीक्षक के अनुमोदन के पश्चात ही लाइन का संचालन करेगा।
v. यह अनुमोदन आवेदक द्वारा विद्युत अधिनियम, 2003 के प्रावधानों और उसके तहत बनाए गए नियमों की अपेक्षाओं का अनुपालन किए जाने के अध्यधीन है।
vi. मेसर्स अवाडा आरजेबीकानेर प्राइवेट लिमिटेड को विद्युत निरीक्षण के समय विमानन एवं रक्षा प्राधिकरणों इत्यादि, से अपेक्षित अनुमति को प्राप्त करने के बाद, इसे कें द्रीय विद्युत प्राधिकरण को विद्युत निरीक्षण के समय प्रस्तुत करना होगा।
vii. यदि उपरोक्त, ओवरहेड लाइनों का मार्ग (या उपरोक्त ओवरहेड लाइन के मार्ग का कु छ हिस्सा) ग्रेट इंडियन बस्टर्ड (जीआईबी) क्षेत्र में आता है, तो आवेदक को ग्रेट इंडियन बस्टर्ड (जीआईबी) मामले के संबंध में 2019 की याचिका संख्या 838 पर माननीय उच्चतम न्यायालय के आदेशों का और माननीय उच्चतम न्यायालय द्वारा गठित तकनीकी/विशेषज्ञ समिति के निदेशों का पालन करना होगा।

ORDER
New Delhi, the 9th December, 2025
S.O. 5711(E).— Whereas M/s Avaada RJBikaner Private Limited , the applicant with its Registered Office at C-11, Sector-65, Gautam Buddha Nagar, Noida, UP-201301, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under the transmission scheme "Transmission system for providing connectivity to M/s Avaada RJBikaner Private Limited for its 650 MW solar power project and M/s Avaada Energy Private Limited for its 300 MW solar power project in Bikaner, Rajasthan".
And whereas, Ministry of Power, Government of India vide its letter no. No. 25-17/66/2025-PG dated 14.07.2025 had granted prior approval under section 68(1) of the Electricity Act, 2003 to M/s Avaada RJBikaner Private Limited for the overhead line covered under the transmission scheme "Transmission system for providing connectivity to M/s Avaada RJBikaner Private Limited for its 650 MW solar power project and M/s Avaada Energy Private Limited for its 300 MW solar power project in Bikaner, Rajasthan".
M/s Avaada RJBikaner Private Limited has published notice for transmission scheme in local newspapers Dainik Bhaskar (Hindi) dated 05.08.2025, in Kamyab Kalam (Hindi) dated 31.07.2025 & in Hindustan Times (English) dated 31.07.2025 and in Weekly Gazette of India dated 30.08.2025 for the public to make observations/representations on the proposed transmission route within two months from the date of publication. Subsequently, M/s Avaada RJBikaner Private Limited has submitted an affidavit dated 31.10.2025 declaring that two observation/representation were received within two months from the date of publication of public notice and observations received were suitably replied.
And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric lines under the transmission scheme "Transmission system for providing connectivity to M/s Avaada RJBikaner Private Limited for its 650 MW solar power project and M/s Avaada Energy Private Limited for its 300 MW solar power project in Bikaner, Rajasthan". The following overhead line is covered under this transmission scheme:
• Common pooling station of Avaada RJBikaner Pvt. Ltd. and Avaada Energy Pvt. Ltd. solar projects – Bikaner-IV PS 400 kV S/c line on D/c towers (16 km)
The Transmission lines covered under the scheme will pass through, over, around and between the following Villages, Towns and Cities in the state of Rajasthan:

Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Avaada RJBikaner Private Limited for laying above overhead line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely:
i. The approval is granted for 25 years.
ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line.
iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003.
iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government.
v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant.
vi. M/s Avaada RJBikaner Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection.

In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) area, the applicant has to comply with the orders of the Hon'ble Supreme Court in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, and the directions of the technical/expert committee constituted by the Hon'ble Supreme Court in this regard.
