का.आ. 5946(अ).— यतः, भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 2417 (अ), दिनांक 05 अक्टूबर 2010 द्वारा मेसर्स लार्सन एंड टुब्रो (एलएंडटी) कृ ष्णागिरी-वालाजाहपेट प्राइवेट लिमिटेड, (जिसे इसके पश्चात "कं सेसनेयर " कहा जाए) को तमिलनाडु राज्य में एनएच-48 (पुराना एनएच-46) के कृ ष्णागिरी-वालाजाहपेट खंड को किमी. 0/000 से किमी. 148/300 तक छह लेन का बनाने की परियोजना के लिए उपयोगकर्ता शुल्क उद्ग्रहीत/संग्रहीत करने के लिए प्राधिकृ त किया गया है।

और यतः, जारी बीओटी करार में, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसके पश्चात "प्राधिकरण" कहा जाए) ने अंबूर शहर के घनी आबादी वाले क्षेत्र में कार्यक्षेत्र परिवर्तन के अंतर्गत 762 मीटर लंबाई के वायडक्ट के साथ एक एलिवेटेड कॉरिडोर विकसित किया है। प्राधिकरण और कं सेसनेयर के बीच शुल्क संग्रहण के तौर-तरीकों और उक्त एलिवेटेड कॉरिडोर के लिए प्राधिकरण की ओर से शुल्क संग्रहण हेतु कं सेसनेयर को प्राधिकृ त करने हेतु एक समझौता करार पर दिनांक 10 दिसंबर 2025 को हस्ताक्षर किए गए।

अब, राष्ट्रीय राजमार्ग शुल्क (दर अवधारण एवं संग्रहण) नियम, 2008 के नियम 3 (जिसे इसके पश्चात "नियम'' कहा जाए) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 8ए द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्रीय सरकार एतद्द्वारा प्राधिकरण और कं सेसनेयर के बीच दिनांक 10 दिसंबर 2025 को किए गए करार के अनुसार 762 मीटर लंबाई वाले एलिवेटेड कॉरिडोर पर प्राधिकरण की ओर से शुल्क संग्रहीत करने के लिए कं सेसनेयर को प्राधिकृ त करती है और भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-खंड (ii) में प्रकाशित भारत सरकार के सड़क 8609 GI/2025

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परिवहन और राजमार्ग मंत्रालय की अधिसूचना का.आ. 2417(अ) दिनांक 5 अक्टूबर 2010 (जिसे इसके पश्चात "उक्त अधिसूचना" कहा जाए), में निम्नलिखित संशोधन करती है, अर्थात:-

i. उक्त अधिसूचना के बिन्दु संख्या 2 के स्थान पर निम्नलिखित बिन्दु प्रतिस्थापित किया जाएगा:-

2. उद्ग्रहीत और संग्रहीत शुल्क निवल सड़क लंबाई के साथ-साथ संरचना लंबाई (60 मीटर से अधिक) के लिए 10 के समकरण गुणक द्वारा समकक्ष राजमार्ग लंबाई में परिर्वर्तत होने पर निम्नलिखित शुल्क प्लाजाओं पर शोध्य और संदेय होगा: -

NOTIFICATION

New Delhi, the 22nd December, 2025

S.O. 5946(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 2417(E) dated 5th October 2010 Central government has authorized M/s Larsen and Toubro (L&T) Krishnagiri – Walajahpet Private Limited, (hereinafter referred to as the "Concessionaire") for levying/collecting user fee for the project of Six laning of Krishnagiri – Walajahpet section of NH-48 (Old NH-46) from Km. 0/000 to Km.148/300 in the state of Tamil Nadu.

And whereas, in the running BOT contract, National Highways Authority of India (hereinafter referred to as the 'Authority') has developed an Elevated Corridor with viaduct length of 762m under Change of Scope in the densely built-up area of Ambur town. A Settlement Agreement signed on 10th December 2025 between Authority and Concessionaire for modalities of fee collection and authorizing the Concessionaire to collect the fee on behalf of the Authority for the said elevated corridor.

Now, in exercise of the powers conferred by Section 8A of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules 2008, the Central Government hereby authorises the Concessionaire to collect the fee on behalf of the Authority on Elevated Corridor with viaduct length of 762m in accordance with the agreement entered into on 10th December 2025 between Authority and Concessionaire and makes following amendment in the Notification of the Government of India in the Ministry of Road Transport and Highways S.O. 2417(E) dated 5th October 2010 (hereinafter referred to as "said notification"), published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), namely:-

i. For Point No.2 of the said notification, the following point shall be substituted:-

"2. The fee to be levied and collected shall be due and payable at the following Fee Plazas for the net road length as well as for structure length (exceeding 60m) converted to equivalent highway length by an equalization factor of 10:-
