रेलवे (संशोधन) अधिनियम-2008 की धारा 20(ई) के तहत
का.आ. 6015(अ).—के न्रीय सरकार ने रेल अधिनियम, 1989 (1989 का 24) एवं रेलवे (संशोधन) अधिनियम 2008 (2008 का 11)(जिसे इसमे इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 20 'क' की उप-धारा (1) के अधीन जारी, भारत के राजपत्र, असाधारण, भाग 2, खण्ड 3, उप-खण्ड (ii), तारीख 22 सितम्बर 2025 में प्रकाशित भारत सरकार के रेल मंत्रालय (रेलवे बोर्ड) की अधिसूचना संख्या का. आ. 4254 (अ) तारीख 22 सितम्बर 2025 (जिसे इसमे इसके पश्चात उक्त अधिसूचना कहा गया है), द्वारा उक्त अधिसूचना से उपाबद्ध अनुसूची में विर्निर्दष्ट भूमि को महाराष्ट्र राज्य के नासिक जिले में विशेष रेल परियोजना अर्थात "देवलाली स्टेशन - कु ं भ मेला 2027 के लिए सी एंड डब्ल्यू परीक्षण और स्टॅबलिंग सुविधाओं का प्रावधान" की विशेष रेल परियोजना के निष्पादन, अनुरक्षण, प्रबंधन, और प्रचालन के लिए अपेक्षित है, ऐसी भूमि का अर्जन करने के आशय की घोषणा की थीI
और, उक्त अधिसूचना का सार उक्त अधिनियम की धारा 20क की उप धारा (4) के अधीन विशेष भूमि अधिग्रहण अधिकारी सहायक जिल्हाधिकारी तथा अनुविभागीय अधिकारी , नाशिक दैनिक सामाचार पत्रों अर्थात "दैनिक आपल महानगर (इंग्रजी ) में तारीख ०१/१०/२०२५", एवं "दैनिक साईमत (मराठी) ) में तारीख ३०/०९/२०२५" को प्रकाशित किया गया था I

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, इस गांव में आक्षेप प्राप्त हुए हे। उक्त अधिसूचना पर प्रभावित खाताधारकों की आपतियाँ समय सीमा के उपरान्त प्राप्त हुई हैं। प्राप्त उक्त आपतियाँ पर सक्षम प्राधिकारी विशेष भूमि अधिग्रहण अधिकारी
सहायक जिल्हाधिकारी तथा अनुविभागीय अधिकारी, नाशिक द्वारा दि.19/11/2025 को सुनवाई आयोजित की गई थी। इसलिए, स्तर निहाय कारवाई की गई है और खाताधारकों की मांग अस्विकार कर ली गई है।
और, उक्त अधिनियम की धारा 20ड की उपधारा (1) के अनुसरण में सक्षम प्राधिकारी ने अपनी रिपोर्ट कें रीय सरकार को प्रस्तुत कर दी है I
अतः अब कें रीय सरकार, सक्षम प्राधिकारी से उक्त रिपोर्ट के प्राप्त होने पर और उक्त अधिनियम की धारा 20ड की उपधारा (1) द्वारा प्रदत शक्तियों का प्रयोग करते हुए, यह घोषण करती है कि इससे उपाबद्ध अनुसूची मे विर्निर्दष्ट भूमि पूवोक्त प्रयोजन के लिए र्अर्जत की जाएगी I
और यह कि कें रीय सरकार उक्त अधिनियम कि धारा 20ड कि उप-धारा (2) के अनुसरण में यह घोषणा करती है कि राजपत्र मे इस अधिसूचना के प्रकाशित होने पर इससे उपाबद्ध अनुसूची में विर्निर्दष्ट भूमि सभी विलंगमों से मुक्त होकर कें रीय सरकार मे आत्यांकित रूप से निहित हो जाएगी I

NOTIFICATION
Mumbai, the 23rd December, 2025
Under clause 20E of the Railway (Amendment) Act 2008
S.O. 6015(E).—Whereas, by the notification of the Government of India in the Ministry of Railways (Railway Board), number, S.O 4254 (E) dated 22th September 2025 published in Gazette of India, Extraordinary, Part II, section 3 Sub-section (ii), (hereinafter referred to as the said notification ) and issued under sub-section (1) of section 20A of the Railway Act, 1989 (24 of 1989) and Railway (Amendment) Act, 2008 (11 of 2008) (hereinafter referred to the Railway (Amendment) Act 2008 (11 of 2008), the Central Government declares its intention to acquire the land specified in the schedule annexed to the said notification for the purpose of execution, maintenance, management and operation of Special Railway Project, "Devlali - Provision of C&W examination and stabling facilities for Kumbh Mela 2027" District Nashik in the State of Maharashtra, in the district of Nashik in the State of Maharashtra.
And whereas, the substance of the said notification was published in for SLAO/SDO NASHIK daily newspapers namely "Dainik Aapla Mahanagar (English)" & "Dainik Saimat (Marathi)" Dated 01-10-2025 & 30-09-2025 under sub section (4) of section 20A of the said Act.
And objections have been received in this village. The objections of the affected account holders on the said notification have been received within the time limit. Hearing on the said objections received was conducted by the competent authority Assistant Collector & Sub-Divisional Officer, Nashik on 19/11/2025. Therefore, stage-wise action has been taken and the demand of the account holders has been accepted.
And whereas, in pursuance of sub-section 20E of the said Act, the competent authority has submitted its report to the Central Government.
Now therefore, upon receipt of the report of the Competent Authority and in exercise of the powers conferred by sub-section (1) of section 20E of the said Act, the Central Government hereby declares that the lands specified in the schedule annexed hereto shall be acquired for the aforesaid purpose.
And further, in pursuance of sub-section (2) of section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the official Gazette, the land specified in the schedule annexed hereto shall vest absolutely in the Central government free from all encumbrances.
