का.आ. 114(अ).— यतः, के न्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 4143 (अ), दिनांक 19 नवंबर, 2019 तथा का.आ. 1507 (अ), दिनांक 12 मई, 2020 द्वारा के रल राज्य में क्रमशः राष्ट्रीय राजमार्ग संख्या 17 (नया एनएच-66) के किलोमीटर 230.400 से किलोमीटर 258.800 (वेंगलम जंक्शन से रामनट्टुकारा जंक्शन खंड) तक के खंड और राष्ट्रीय राजमार्ग संख्या 17 (नया एनएच-66) के किलोमीटर 258.800 से किलोमीटर 438.827 तक कर्नाटक/के रल सीमा- कासरगोड-कन्नूर-पोन्नानी- एडापल्ली खंड के शेष आंशिक खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसके पश्चात् 'प्राधिकरण' कहा जाए) को सुपुर्द किया है;

अतः, अब, राष्ट्रीय राजमार्ग शुल्क (दर अवधारण एवं संग्रहण) नियम, 2008 के नियम 3 (जिसे इसके पश्चात "नियम'' कहा जाए), के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें रीय सरकार एतदद्वारा, के रल राज्य में राष्ट्रीय राजमार्ग संख्या 66 के के डिजाइन किलोमीटर 230.400 से डिजाइन किलोमीटर 335.850 (विद्यमान किमी 230.400 से विद्यमान किमी 349.260) तक (वेंगलाम जंक्शन से कप्पिरिक्कड़ सेक्शन) चार या अधिक लेन खंड के उपयोग के लिए नीचे दी गई तालिका 1 के स्तंभ (1) में विर्निर्दष्ट वाहनों के प्रकार पर 90.078 किमी की निवल सड़क खंड लंबाई (सारणी-2) तथा 96.59 किमी (9.659 किलोमीटर की लंबाई वाली, सारणी-4) की समतुल्य संरचना लंबाई (60 मीटर से अधिक लंबाई वाली) के लिए यांत्रिक वाहनों पर सारणी 1 के स्तम्भ (2) में विर्निर्दष्ट दरों पर और 10 करोड़ रु. या उससे अधिक की लागत वाले 5.695 किमी लंबाई वाले बाईपास (सारणी-3) के लिए आधार दर के डेढ़ गुना दर पर शुल्क उद्ग्रहीत करती है एवं प्राधिकरण को अपने

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से उक्त शुल्क को संग्रहीत करने के लिए प्राधिकृ त करती है, अर्थात:-

1. इसके अंतर्गत उद्गृहीत और संग्रहीत शुल्क, ऐसे प्रयोक्ता शुल्क प्लाज़ाओं के अंतर्गत विर्निर्दष्ट निवल सड़क खंड लंबाई हेतु निम्नलिखित प्रयोक्ता शुल्क प्लाज़ाओं में देय और संदेय होगी, अर्थात;

2. उपयु र्क्त के अतिरिक्त, निम्नलिखित शुल्क प्लाज़ा पर 10 करोड़ रुपये या उससे अधिक लागत वाले बाईपास के उपयोग के लिए निम्नलिखित शुल्क भी देय होगा, जो ऐसे शुल्क प्लाज़ा के लिए विर्निर्दष्ट निवल बाईपास लंबाई के लिए होगा:

3. उपयु र्क्त के अतिरिक्त, निम्नलिखित शुल्क प्लाज़ा (प्लाज़ाओं) पर 60 मीटर से अधिक लंबाई वाली निम्नलिखित अवसंरचनाओं के उपयोग के लिए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके राजमार्ग की समतुल्य लंबाई में अवसंरचनाओं की लंबाई को परिर्वर्तत करके निम्नलिखित शुल्क भी देय और संदेय होगा:

4. गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और शुल्क प्लाज़ा से बीस कि.मी. की दूरी के भीतर निवास करने वाले व्यक्ति के लिए मासिक पास की दर वर्ष 2025-26 के लिए 340.00/-रूपए (तीन सौ चालीस रूपए मात्र) है और उक्त नियमों के प्रावधानों के अनुसार प्रतिवर्ष संशोधन के अध्यधीन है।

5. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्ः

6. शुल्क प्लाजा स्थित होने वाले जिले में पंजीकृ त वाणिज्यिक वाहनों (राष्ट्रीय परमिट के अधीन प्रचालित किए जा रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशते कि ऐसे वाणिज्यिक वाहनों के प्रयोग के लिए कोई र्सर्वस रोड या वैकल्पिक सड़क उपलब्ध न हो।

7. संबंधित श्रेणी के वाहनों के लिए विर्निर्दष्ट अनुज्ञेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेश के लिए, कथित नियमों के नियम 10 के उप नियम 1ए के अनुसार अनुप्रयोज्य शुल्क के समतुल्य शुल्क का भुगतान करने के लिए उत्तरदायी होगा और वह राजमार्ग खंड का प्रयोग करने के लिए तब तक हकदार नहीं होगा जब तक ऐसे यांत्रिक वाहन से लदा अतिभार हटाया नहीं जाता।

8. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छू ट-प्राप्त वाहनों की श्रेणी, र्सर्वस रोड, वैकल्पिक सड़क इत्यादि उक्त नियमों में विर्निर्दष्ट परिभाषाओं के अनुरूप होंगी।

9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रर्दर्शत किया जाएगा।

10. उपयु र्क्त तालिका-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर यांत्रिक वाहनों से शुल्क की वास्तविक राशि और छू टों की गणना प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रति वर्ष संशोधित किया जाएगा तथा तदनुसार उसे अंग्रेजी और क्षेत्रीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।

11. इस परियोजना की अनुमानित पू ंजीगत लागत 15,011.95 करोड़ रुपए है। चू ंकि भूमि

अधिग्रहण, उपयोगिता स्थानांतरण, पेड़ों को काटने, इत्यादि कामों को अभी पूरा किया जाना है, इसलिए,

पू ंजीगत लागत परिवर्तन के अध्यधीन है। प्राप्त प्रयोक्ता शुल्क के माध्यम से वसूल की गई पू ंजीगत लागत का

प्राधिकरण द्वारा रिकॉर्ड रखा जाएगा।

NOTIFICATION

New Delhi, the 7th January, 2026

S.O. 114(E).—Whereas by notification of the government of India in the Ministry of Road Transport and

Highways numbers S.O. 4143(E) dated the 19 th November, 2019 and S.O.1507(E), dated the 12th May, 2020, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from Kilometer 230.400 to Kilometer 258.800 (Vengalam junction to Ramanattukara junction section) of National Highway No.17 (New NH-66) and the remaining partial stretches of Karnataka/Kerala border- Kasaragod- Kannur- Ponnani- Edappalli section from Km. 258.800 to Km. 438.827 of National Highway No.17 (New NH-66) in the state of Kerala respectively to the National Highways Authority of India (hereinafter referred to as the "Authority");

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee at the rate specified in column (2) of the Table 1 for net road section length of 90.078 Km [Table -2] and for equivalent structure length (having length more than 60m) of 96.59 Km (having length of 9.659 Km [Table 4]) and at one and half times the base rate for bypasses having length of 5.695 km [Table 3] costing rupees ten crore or more on the type of vehicles specified in column (1) of the Table 1 below for use of four or more lane of (Venglam Junction to Kappirikkad section) from design kilometer 230.400 to design kilometer 335.850 (existing km 230.400 to existing km 349.260) of National Highway 66 in the State of Kerala and authorises the Authority to collect, either through its officials or through a contractor, the said fee, namely:-

1. The fee to be levied and collected hereunder shall be due and payable at the User Fee Plaza for net road length specified for such User Fee Plaza namely :-

2. In addition to above, the following fee shall also be due and payable for the use of the bypass costing Rs 10 crore or more at the following Fee Plaza for net bypass length specified for such Fee Plaza(s) : -

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.340.00 (Rupees Three Hundred and Forty only) for the year 2025-26 and is subject to revision every year as per the provisions of the said rules.

5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:-

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.

9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.

10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.

11. The estimated capital cost of the project is Rs. 15,011.95 Crores. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. The Authority shall maintain a record of the recovery of capital cost through user fee realised.
