सा.का.नि. 28(अ).— मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के अधीन यथा अपेक्षित कें द्रीय मोटर यान नियम, 1989 का और संशोधन करने के लिए प्रारूप नियम, भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना के द्वारा भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) द्वारा संख्यांक सा.का.नि 467(अ), तारीख 11 जुलाई, 2025 द्वारा प्रकाशित किए गए थे, जिसमें उक्त अधिसूचना को अंर्तर्वष्ट करने वाली राजपत्र की प्रतियां जनता को उपलब्ध कराए जाने की तारीख से तीस दिन की अवधि के अवसान से पूर्व उससे प्रभावित होने वाले सभी संभाव्य व्यक्तियों से आक्षेप और सुझाव आमंत्रित किए गए थे;
और, उक्त राजपत्र अधिसूचना की प्रतियां 14 जुलाई, 2025 को उपलब्ध करा दी गई थीं;
और उक्त प्रारूप नियमों के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर कें द्रीय सरकार द्वारा विचार किया गया है।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अतः, अब कें द्रीय सरकार, मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 64 के खंड (ज), (झ), (ट), (ढ) तथा (त) और धारा 88 की उपधारा 14 के खंड (ख) के उपखंड (v) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्रीय मोटर यान नियम, 1989 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-
1. संक्षिप्त नाम और प्रारंभ.- (1) इन नियमों का संक्षिप्त नाम कें द्रीय मोटर यान (दूसरा संशोधन) नियम, 2026 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।
2. कें द्रीय मोटर यान नियम, 1989 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 2 में,-
(क) खंड (यघ) में, "परिवहन।" शब्दों के स्थान पर, "परिवहन;" शब्द रखे जाएंगे;
(ख) खंड (यघ) के पश्चात्, निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात्:-
'(यङ) "असंदत्त उपयोगकर्ता फीस" से मोटर यान द्वारा राष्ट्रीय राजमार्ग के किसी खंड के उपयोग के लिए संदेय उपयोगकर्ता फीस अभिप्रेत है, जहां इलैक्ट्रॉनिक पथकर संग्रहण अवसंरचना ने ऐसे यान का रास्ता अभिलिखित किया है ककं तु राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 तथा तद्धीन बनाए गए नियमों के उपबंधों के अधीन उद्ग्रहीत लागू उपयोगकर्ता फीस प्राप्त नहीं की है।'।
3. उक्त नियमों के नियम 55 के उपनियम (2) में खंड (iv) के पश्चात्, निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात्:-
"(v) प्ररूप 28 में अनापत्ति प्रमाणपत्र।"।
4. उक्त नियमों के नियम 58 में,-
(क) उपनियम (3) में, "सम्यक् रूप से हस्ताक्षरित उस भाग को आवेदक को लौटा देगा" शब्दों के पश्चात्, "या पोर्टल पर इलैक्ट्रॉनिक रूप से भरे गए भाग - 3 को जारी करेगा" शब्द और अंक अंतःस्थापित किए जाएंगे;
(ख) उपनियम (4) में, "रजिस्ट्रीकर्ता प्राधिकारी को लौटा देगा।" शब्दों के स्थान पर, "रजिस्ट्रीकर्ता प्राधिकारी को लौटा देगा:" शब्द रखे जाएंगे;
(ग) उपनियम (4) के पश्चात्, निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात्:-
"परंतु यह कि रजिस्ट्रीकरण प्राधिकारी अनापत्ति प्रमाणपत्र तब तक अनुदत्त नहीं करेगा, जब तक आवेदक द्वारा असंदत्त उपयोगकर्ता फीस संदत्त नहीं की जाती।"।
5. उक्त नियमों के नियम 62 के उपनियम (1) में,-
(क) पांचवे परंतुक में, "रजिस्ट्रीकरण की तारीख।" शब्दों के स्थान पर,""रजिस्ट्रीकरण की तारीख:" शब्द रखे जाएंगे;
(ख) पांचवें परंतुक के पश्चात्, निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात्:-
"परंतु यह भी कि ठीक हालत में होने के प्रमाणपत्र का नवीकरण या उसे सृजित तब तक नहीं किया जाएगा, जब तक कि आवेदक द्वारा असंदत्त उपयोगकर्ता फीस संदत्त नहीं की जाती।"।
6. उक्त नियमों के नियम 90 में खंड (6) के पश्चात्, निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात्:-
"(7) यान की कोई असंदत्त उपयोगकर्ता फीस नहीं होगी।"।

7. उक्त नियमों के प्ररूप 28 में शीर्षक 'भाग 1 - आवेदन' के अधीन क्रम संख्या 10 और उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित क्रम संख्या और प्रविष्टियां अंतःस्थापित की जाएंगी, अर्थात्:-
"10क. क्या कोई असंदत्त उपयोगकर्ता फीस की मांग लंबित है, यदि है, तो ब्यौरा दें..........."।

NOTIFICATION
New Delhi, the 13th January, 2026
G.S.R. 28(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways vide number G.S.R 467(E), dated the 11th July, 2025, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette notification was made available to the public on 14th July, 2025;
And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by clauses (h), (i), (k), (n) and (p) of section 64 and sub-clause (v) of clause (b) of sub-section (14) of section 88 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: -
1. Short title and commencement - (1) These rules may be called as the Central Motor Vehicles (Second Amendment) Rules, 2026.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicle Rules, 1989 (hereinafter referred as the said rules), in rule 2,-
(a) in clause (zd), for the words "transport.", the words "transport;" shall be inserted;
(b) after clause (zd), the following clause shall be inserted, namely: –
'(ze) "unpaid user fee" means the user fee payable by a motor vehicle for use of a section of a National Highway, where the Electronic Toll Collection Infrastructure has recorded the passage of such vehicle but has not received the applicable user fee levied under the provisions of section 7 of the National Highways Act, 1956 (48 of 1956) and rules made thereunder.'.
3. In the said rules, in rule 55, in sub-rule (2), after clause (iv), the following clause shall be inserted, namely: - "(v) No objection certificate in Form 28.".

(a) in sub-rule (3), after the words "applicant duly signed", the words and letters "or issue the filled in Part-III electronically on the Portal" shall be inserted;
(b) in sub-rule (4), for the word "thereof.", the word "thereof:" shall be substituted;
(c) after sub-rule (4), the following proviso shall be inserted, namely: –
"Provided that the registering authority shall not grant the no-objection certificate until unpaid user fee is paid by the applicant.".
5. In the said rules, in rule 62, in sub-rule (1), –
(a) in the fifth proviso, for the words "date of registration.", the words "date of registration:" shall be substituted;
(b) after fifth proviso, the following proviso shall be inserted, namely: –
"Provided also that a certificate of fitness shall not be renewed or generated until unpaid user fee is paid by the applicant.".
6. In the said rules, in rule 90, after clause (6), the following clause shall be inserted, namely: –
"(7) The vehicle shall not have any unpaid user fee.".
7. In the said rules, in FORM 28, under the heading 'PART I – APPLICATION', after serial number 10. and entries relating thereto, the following serial number and entries shall be inserted, namely: –
"10A. Whether any demand of unpaid user fee is pending, if so, give details …………………………….".
