(रेलवे अधिनियम 1989 की धारा 20ए के तहत सूचना)

का.आ. 5053(अ).— रेलवे (संशोधन) अधिनियम, 1989 (24/89) (जिसे इसके बाद उक्त अधिनियम कहा गया है) की धारा 20ए की उप-धारा (1) द्वारा प्रदत्त शक्तियों के तहत, कें द्र सरकार इस बात से संतुष्ट होने के बाद कि सार्वजनिक उद्देश्य के लिए, भूमि, जिसका संक्षिप्त विवरण यहां संलग्न अनुसूची में दिया गया है, विशेष रेलवे परियोजना के निष्पादन के लिए आवश्यक है, अर्थात्, ओडिशा राज्य के जगतसिहपुर जिले में "खुर्दा रोड डिवीजन के तहत बड़बंध (BDBA)- पारादीप(PRDP) स्टेशन के बीच KM 491/17-19 पर आर.ओ.बी (रोड ओवर ब्रिज) संख्या सीपी-55 का निर्माण", इसके द्वारा ऐसी भूमि का अधिग्रहण करने का इरादा घोषित करती है।

उक्त भूमि में हितबद्ध कोई भी व्यक्ति, अधिसूचना के राजपत्र में प्रकाशन की तारीख से (30) तीस दिन की अवधि के भीतर, उक्त अधिनियम की धारा 20घ की उपधारा (1) के अधीन प्रयोजन के लिए ऐसी भूमि के अर्जन पर आपत्ति उठा सके गा।

GI/202THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC ii)] प्रत्येक आपत्ति, सक्षम प्राधिकारी अर्थात भूमि अधिग्रहण के लिए सक्षम प्राधिकारी (काला) विशेष भूमि अधिग्रहण अधिकारी, जगतसिहपुर को खुर्दा रोड डिवीजन के तहत बड़बंध (BDBA)- पारादीप(PRDP) स्टेशन के बीच KM 491/17-19 पर आर.ओ.बी (रोड ओवर ब्रिज) संख्या सीपी-55 के निर्माण के संबंध में लिखित रूप में आवेदन प्रस्तुत की जाएगी तथा ऐसे आपत्ति के आधार निर्धारित किया जाएंगा और सक्षम प्राधिकारी, आपत्तिकर्ता को चाहे वह व्यक्तिगत रुप से हो या फिर किसी विधि व्यवसायी के माध्यम से, सुनवाई का अवसर देगा, और ऐसे आपत्तियां सुनने के पश्चात् और आवश्यक आगे की जांच, यदि कोई हो, करने के पश्चात्, जैसा कि सक्षम प्राधिकारी आवश्यक समझे आपत्तियों को स्वीकार या अस्वीकार कर सके गा।

उक्त अधिनियम के 20घ की उप-धारा(2) के अंतर्गत सक्षम प्राधिकारी द्वारा जारी किया गया कोई भी आदेश को अंतिम माना जाएगा। इस अधिसूचना के अंतर्गत आने वाली भूमि की योजनाएं और अन्य विवरण उपलब्ध हैं और इच्छु क व्यक्ति द्वारा सक्षम प्राधिकारी के उपरोक्त कार्यालय में उनका निरीक्षण किया जा सकता है।

विशेष रेलवे परियोजना अर्थात् ओडिशा राज्य के जगतसिहपुर जिले में "खुर्दा रोड डिवीजन के तहत बड़बंध (BDBA)- पारादीप(PRDP) स्टेशन के बीच KM 491/17-19 पर आर.ओ.बी (रोड ओवर ब्रिज) संख्या सीपी-55 का निर्माण" के लिए संरचनाओं के साथ या बिना संरचनाओं के अधिग्रहित की जाने वाली भूमि का संक्षिप्त विवरण (अनुलग्नक-1) यहां

संलग्न है।

NOTIFICATION

Bhubaneswar, the th September

Notice under Section 20A of the Railways Act-

S.O. (E).— In exercise of powers conferred by sub-section (1) of section 20A of the Railways(Amendment)Act,1989(24/89) (hereinafter referred as the said Act.), the Central Government, after being satisfied that for the public purpose, the Land, brief description of which is given in the schedule annexed here to is required for the execution of Special Railway Project namely "Construction of Road Over Bridge in lieu of closing of manned L.C.No.CP-55 at KM 491/17-19 between the stations of Badabandha(BDBA)-Paradeep(PRDP) under Khurda Rd Division " in Jagatsinghpur district of Odisha state, hereby declares its intention to acquire such land.

Any person interested in the said land may within a period of (30) thirty days from the date of publication of the notification in the Official Gazette, raise objection to the acquisition of such land for the aforesaid purpose under sub-section (1) of section 20D of the said Act.

Every objection shall be made to the competent authority, namely Competent Authority for Land Acquisition(CALA) & Special Land Acquisition Officer (CALA) for Construction of ROB in lieu of closing of manned of L.C.No.CP-55 at KM 491/17-19 between the stations of Badabandha(BDBA)-Paradeep(PRDP) under Khurda Rd. Division in writing, and shall set out grounds thereof and competent authority shall give the objector an opportunity of being heard, either in person or through a legal practitioner, and may, after hearing all such objections and after making such further inquiry, if any, as the competent authority thinks necessary, by order, either allow or disallow the objections.

Any order made by the competent authority under sub-section (2) of 20D of the said Act shall be final. The land plans and other details of the land covered under this notification are available and can be inspected by the interested person at the aforesaid office of the competent authority.
