सा. का.नि. 807(अ).— भारतीय पत्तन अधिनियम, 2025 (2025 का 27) की धारा 79 की उपधारा (2) के खंड (क) और खंड (ख) के साथ पठित उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए समुद्री राज्य विकास परिषद द्वारा बनाए जाने के लिए प्रस्तावित विनियमों का प्रारूप उन सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है, एतद्द्वारा प्रकाशित किया जाता है; और एतद्द्वारा सूचना दी जाती है कि उक्त प्रारूप विनियमों पर 9 अक्टूबर, 2026 के पश्चात विचार किया जाएगा।
आपत्तियां और सुझाव, यदि कोई हों, श्री नवीन कु मार, अवर सचिव, भारत सरकार, पत्तन, पोत परिवहन और जलमार्ग मंत्रालय, कमरा संख्या 547, 5वां तल, परिवहन भवन, संसद मार्ग, नई दिल्ली–110001 को अथवा ई-मेल (uspd- [email protected] और [email protected]) पर 9 अक्टूबर, 2026 को या उससे पूर्व भेजे जा सकते हैं।
उपयु र्क्त विर्निर्दष्ट अवधि की समाप्ति से पूर्व उक्त प्रारूप विनियमों के संबंध में किसी व्यक्ति से प्राप्त होने वाली आपत्तियों और सुझावों पर विनियमों को अंतिम रूप दिए जाने से पूर्व सम्यक् रूप से विचार किया जाएगा।
1. संक्षिप्त नाम और प्रारंभ— (1) इन विनियमों के समुद्री राज्य विकास परिषद विनियम, 2026 कहा जाएगा।
(2) ये राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे।

2. परिभाषाएं— (1) इन विनियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,—
(क) 'अधिनियम' से भारतीय पत्तन अधिनियम, 2025 (2025 का 27) अभिप्रेत है;
(ख) 'सदस्य' से अधिनियम की धारा 3 की उपधारा (2) के अनुसार अधिसूचित समुद्री राज्य विकास परिषद के सदस्य अभिप्रेत हैं।
(2) उन शब्दों और पदों के , जो इन विनियमों में प्रयुक्त हैं और परिभाषित नहीं हैं ककं तु अधिनियम में परिभाषित हैं, वही अर्थ होंगे जो अधिनियम में क्रमशः उनके लिए नियत किए गए हैं।
3. परिषद की बैठकों में व्यक्तियों को आमंत्रित करना— (1) अध्यक्ष, बैठक की कार्यसूची को ध्यान में रखते हुए, कें द्रीय सरकार, राज्य सरकारों, संघ राज्य क्षेत्रों, कानूनी प्राधिकरणों, पत्तन प्राधिकरणों के प्रतिनिधियों, विशेषज्ञों, हितधारकों अथवा ऐसे किसी अन्य व्यक्ति को, जिसकी उपस्थिति आवश्यक या समीचीन समझी जाए, परिषद की ऐसी बैठकों में उपस्थित होने के लिए आमंत्रित कर सके गा।
(2) उप-विनियम (1) के अधीन आमंत्रित व्यक्ति बैठक के ऐसे विचार-विमर्श में भाग लेगा, जैसा कि आमंत्रण में उपर्दर्शत किया जाए।
(3) परिषद की बैठक में उपस्थित होने का आमंत्रण अधिमानतः इलेक्ट्रॉनिक माध्यम से अथवा अन्यथा लिखित रूप में, ऐसी समय-सीमा के भीतर और ऐसे प्रारूप में जारी किया जा सके गा, जैसा सदस्य सचिव अवधारित करे।
(4) जहां किसी राज्य सरकार से कोई नामर्निर्दष्ट सदस्य, किसी विशिष्ट बैठक में भाग नहीं ले पाता, परिषद की उस विशिष्ट बैठक में भाग लेने के लिए किसी अन्य मंत्री को नामर्निर्दष्ट किया जाए।
4. परिषद की बैठकों में कार्य का संचालन— (1) परिषद की बैठक, भौतिक, आभासी अथवा मिश्रित रीति सहित, इतनी बार और ऐसे स्थानों पर आयोजित की जाए जैसा अध्यक्ष के अनुदेशों के आधार पर सदस्य सचिव अवधारित करे।
(2) परिषद की बैठक के लिए गणर्पूर्त, परिषद की कु ल सदस्य संख्या का एक-तिहाई होगी।
(3) परिषद की प्रत्येक बैठक की कार्यवाही लिखित रूप में अभिलिखित की जाएगी और सदस्य सचिव द्वारा अनुमोदित की जाएगी।
(4) परिषद की प्रत्येक वित्तीय वर्ष में कम-से-कम एक बैठक आयोजित की जाए।
5. अवशिष्ट शक्तियां— परिषद की बैठकों के संचालन या कार्य-संव्यवहार से संबंधित कोई ऐसा विषय, जिसके लिए इन विनियमों में विर्निर्दष्ट रूप से उपबंध नहीं किया गया है, अध्यक्ष द्वारा विनिश्चित किया जाएगा और उसे लिखित रूप में अभिलिखित किया जाएगा।
6. विनियमों में संशोधन करने की शक्ति— अध्यक्ष को इस आशय का कार्यकारी आदेश जारी करके इन विनियमों में परिवर्तन, उपांतरण अथवा संशोधन करने की शक्ति होगी।

NOTIFICATION
New Delhi, the 10th September, 2026
G.S.R. 807(E). — Draft regulations proposed to be made by the Maritime State Development Council in exercise of the powers conferred under sub-section (1) read with clauses (a) and (b) of sub-section (2) of section 79 of the Indian Ports Act, 2025 (27 of 2025), are hereby published for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration after 9th October, 2026.

The objections and suggestions which may be received from any person with respect to the said draft regulations before the expiry of the period specified above shall be duly considered before finalisation of the regulations.
1. Short Title and Commencement. — (1) These regulations may be called the Maritime State Development Council Regulations, 2026.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions. — (1) In these regulations, unless the context otherwise requires—
(a) "Act" means the Indian Ports Act, 2025 (27 of 2025);
(b) "members" means the members of the Maritime State Development Council notified in accordance with sub-section (2) of section 3 of the Act.
(2) Words and expressions used in these regulations and not defined but defined in the Act, shall have the meanings respectively assigned to them in the Act.
3. Invitation of persons to meetings of the Council. — (1) The Chairperson may, having regard to the agenda of the meeting, invite such persons, including representatives of the Central Government, State Governments, Union territories, statutory authorities, port authorities, experts, stakeholders, or any other person whose attendance is considered necessary or expedient, to attend such meetings of the Council.
(2) A person invited under sub-regulation (1) shall participate in such deliberations of the meeting as indicated in the invitation.
(3) The invitation to attend a meeting of the Council may be issued preferably electronically or otherwise in writing, within such time and in such form as the Member Secretary may determine.
(4) Where a nominated Member from a State Government is unable to attend a particular meeting, another Minister may be nominated to attend that particular meeting of the Council.
4. Transaction of business at meetings of the Council. — (1) The Council shall meet at such times and places, including through physical, virtual, or hybrid modes, as the Member Secretary determines, based on the instructions of the Chairperson.
(2) The quorum for a meeting of the Council shall be one-third of the total membership of the Council.
(3) The proceedings of every meeting of the Council shall be recorded in writing and approved by the Member Secretary.
(4) The Council may meet at least once in every financial year.
5. Residuary powers. — Any matter relating to the conduct of meetings or transaction of business of the Council, not specifically provided for in these regulations, shall be decided by the Chairperson and shall be recorded in writing.
6. Power to amend regulations. — The Chairperson shall have the power to alter, modify, or amend these regulations by issuing an executive order to that effect.
