का.आ. 5069(अ).— पहचान स्थापित करने के लिए आधार संख्या का उपयोग व्यक्तियों को सुविधाजनक और निर्बाध रीति से सहायकी, लाभ और सेवाएं प्राप्त करने में सक्षम बनाता है, पहचान स्थापित करने के लिए अनेक दस्तावेजों की आवश्यकता को समाप्त करता है, प्रयििाओं को सरल बनाता है और पारर्दर्शता और दक्षता का संप्रवर्तन करता है:
और भारत सरकार के इलेक्ट्रॉनिक्स और सूचना प्रौद्योगिकी मंत्रालय ने भारतीय विशिष्ट पहचान प्राधिकरण से परामर्श के पश्चात्, तारीख 9 जनवरी 2023 के पत्र संख्या फा. सं. 13(17)/2022-ईजी-II द्वारा खाद्य और सार्वजनिक वितरण विभाग, उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्रालय, भारत सरकार को सुशासन के लिए आधार अधिप्रमाणन (सामाजिक कल्याण, नवाचार, ज्ञान) नियम, 2020 (जिसे इसमें इसके पश्चात् ''उक्त नियम'' कहा गया है) के नियम 3 के उप-नियम (1) में चिनिनत प्रयोजनों के लिए, यह अनुमति प्रदान की थी कि भांडागारण विकास एवं विनियामक प्राधिकरण (डब्ल्यूडीआरए) तथा उसके विनियमित भंडारगृहों को अधिप्रमाणन करने की अनुमति दी जाए तथा आधार संख्या धारक की पहचान स्थापित करने के लिए अधिप्रमाण न के दौरान आधार संख्या के उपयोग की अनुमति दी जाए और इसे आधार (वित्तीय और अन्य सहायकी, लाभ एवं सेवाओं की लक्षित प्रदायगी) अधिनियम, 2016 (2016 का 18) (जिसे इसमें इसके पश्चात् ''उक्त अधिनियम'' कहा गया है) की धारा 4 की उपधारा (4) के खंड (ख) के उप-खंड (ii) के साथ पठित उक्त नियमों के नियम 5 के अधीन अधिसूचित किया जाएगा।

और जमाकर्ताओं, भाण्डागारपाल और हितधारकों की पहचान सत्यापन के लिए आधार अधिप्रमाणन उक्त नियमों के नियम 3 के उप-नियम (1) के अधीन यथा विहित अनुसार किया जाएगा और उक्त प्रयोजन के लिए आधार अधिप्रमाणन का निष्पादन स्वैछिछक आधार पर होगा और भांडागारण विकास एवं विनियामक प्राधिकरण और इसके विनियमित भंडारगृह, इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से के वल नीचे दिए गए उद्देश्यों के लिए आधार अधिप्रमाणन करेंगे, अर्थात्:——
(क) आधार ई-के वाईसी के माध्यम से डब्ल्यूडीआरए पोर्टल और उसके विनियमित भंडारगृह मंच पर जमाकर्ताओं, भांडागारपाल और अन्य को सम्मिलित करना;
(ख) डब्ल्यूडीआरए पोर्टल और उसके विनियमित भंडारगृहों पर सेवा संव्यवहार का निष्पादन करना।
अतः अब, कें द्रीय सरकार उक्त अधिनियम की धारा 4 की उपधारा (4) के खंड (ख) के उपखंड (ii) के साथ पठित उक्त नियमों के नियम 5 के अनुसरण में, और उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्रालय की तारीख 10.02.2023 की अधिसूचना सा.आ. 698 (अ) जो भारत के राजपत्र, असाधारण, भाग-2, खंड 3, उपधारा (ii) में प्रकाशित हुई थी, को अधिािन्त करते हुए, उन बातों के सिवाय जिन्हें ऐसे अधिमिण से पहले किया गया है या जिनका लोप किया गया है, निम्नलिखित को अधिसूचित करती है, अर्थात्:—
1. (1) भांडागारण विकास एवं विनियामक प्राधिकरण तथा इसके विनियमित भंडारगृह, उक्त अधिनियम में यथा उपबंधित अधिप्रमाणन के उद्देश्य से आधार संख्या धारक की सहमति प्राप्त करेंगे।
(2) उक्त नियमों के नियम 3 के उप-नियम (2) के अनुसार, आधार अधिप्रमाणन स्वैछिछक आधार पर है, भांडागारण विकास एवं विनियामक प्राधिकरण और उसके विनियमित भंडारगृह, आधार संख्या धारक को पहचान करने के वैकल्पिक और व्यवहार्य साधनों की सूचना देंगे और आधार अधिप्रमाणन से इनकार करने या असमर्थ होने के कारण आधार संख्या धारक को किसी भी सेवा से वंचित नहीं करेंगे, नामत:—
(क) स्थायी लेखा संख्या;
(ख) ड्राइविंग लाइसेंस;
(ग) पासपोर्ट;
(घ) भारत सरकार के डाक विभाग द्वारा जारी फोटोयुक्त पता कार्ड;
(ङ) डाकघर या किसी सार्वजनिक क्षेत्र के अनुसूचित बैंक की फोटोयुक्त वतर्मान पासबुक;
(च) फोटोयुक्त किसान पासबुक;
(छ) मतदाता पहचान पत्र।
2. यह अधिसूचना राजपत्र में इसके प्रकाशन की तारीख से प्रभावी होगी।

S.O. 5069(E).— Whereas, the use of Aadhaar number to establish identity enables individuals to receive subsidies, benefits and services in a convenient and seamless manner, obviates the need for multiplicity of documents to establish identity, simplifies processes and promote transparency and efficiency:

And whereas the Ministry of Electronics and Information Technology, Government of India, after consultation with the Unique Identification Authority of India, had allowed vide its letter no. F. No. 13(17)/2022-EG-II, dated 9thJanuary 2023 to the Department of Food and Public Distribution, Ministry of Consumer Affairs, Food and Public Distribution, Government of India for the purposes prescribed under sub- rule (1) of rule 3 of the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020 (hereafter referred to as the said rules) that Warehousing Development and Regulatory Authority (WDRA) and its regulated repositories may be allowed to perform authentication and be permitted the use of Aadhaar number during authentication for establishing identity of Aadhaar number holder and notify the same under rule 5 of the said rules read with sub-clause (ii) of clause (b) of sub-section (4) of section 4 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016)(hereinafter referred to as the said Act):
And whereas, the Aadhaar authentication shall be performed for identity verification of depositors, warehousemen and stakeholders as prescribed under sub-rule (1) of rule 3 of the said rules and the performance of Aadhaar authentication for the said purpose shall be on voluntary basis and Warehousing Development and Regulatory Authority and its regulated repositories shall perform Aadhaar authentication solely for the purposes given below, with effect from the date of publication of this notification in the Official Gazette, namely:——
(a) Onboarding of depositors, warehouseman and others on WDRA portal and its regulated repositories platform through aadhaar e-KYC;
(b) performing service transactions on WDRA portal and its regulated repositories.
Now, therefore, in pursuance of rule 5 of the said rules,read with sub-clause (ii) of clause (b) of sub- section (4) of section 4 of the said Act and in supersession of the Notification of Ministry of Consumer Affairs, Food and Public Distribution,S.O 698 (E) dated 10.02.2023 published in Gazette of India, Extraordinary, Part-II, Section 3, Sub Section(ii), except as respects things done or omitted to be done before such supersession, the Central Government thereby notifies the following, namely:——
1. (1) The Warehousing Development and Regulatory Authority and its regulated repositories, as provided in the said Act, shall obtain the consent of the Aadhaar number holder for the purpose of authentication herein.
(2) As per sub-rule (2) of rule 3 of the said rules, Aadhaar authentication is on voluntary basis, the Warehousing Development and Regulatory Authority and its regulated repositories shall inform the Aadhaar number holder of alternate and viable means of identification and shall not deny any service to the Aadhaar number holder for refusing to, or being unable to, undergo Aadhaar authentication, namely:——
(a) PAN;
(b) Driving Licence;
(c) Passport;
(d) Address Card with photograph issued by Department of Posts, Government of India;
(e) Current Passbook of Post Office or any Public Sector Scheduled Bank having photograph;
(f ) Kisan Passbook having photograph;
(g) Voter Identity Card.
2. This notification shall come into effect from the date of its publication in the official Gazette.
