भारतीय दिवाला और शोधन अक्षमता बोर्ड (परिसमापन प्रयििा) (पांचवां संशोधन) विनियम, 2026
फा. सं. आई.बी.बी.आई./2026-27/जी.एन./आर.ई.जी154.—भारतीय दिवाला और शोधन अक्षमता बोर्ड, दिवाला और शोधन अक्षमता संहिता, 2016 (2016 का 31) की धारा 240 के साथ पठित धारा 196 की उपधारा (1) के खंड (कक) और (न) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय दिवाला और शोधन अक्षमता बोर्ड (परिसमापन प्रयििा) विनियमन, 2016 का और संशोधन करने के लिए निम्नलिखित विनियम बनाता है, अर्थात्: -
1. (1) इन विनियमों का संक्षिप्त नाम भारतीय दिवाला और शोधन अक्षमता बोर्ड (परिसमापन प्रयििा) (पांचवां संशोधन) विनियम, 2026 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. भारतीय दिवाला और शोधन अक्षमता बोर्ड (परिसमापन प्रयििा) विनियमन, 2016 के विनियम 31 में, उपविनियम (3) और (4) के स्थान पर निम्नलिखित उपविनियम रखा जाएगा, अर्थात्: -
"(3) जहाँ परिसमापक को ऐसी अतिरिक्त जानकारी मिलती है जिससे हितधारकों की सूची में की गई किसी प्रविष्टि का उपांतरण अपेक्षित हो, वहाँ वह ऐसी प्रविष्टि का उपांतरण कर सके गा और ऐसे उपांतरण की तारीख से तीस दिन के भीतर न्यायनिर्णायक प्राधिकरण को ऐसे उपांतरण के बारे में सूचित करेगा ।" 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] टिप्पण: भारतीय दिवाला और शोधन अक्षमता बोर्ड (परिसमापन प्रयििा) विनियमन, 2016, भारत के राजपत्र, असाधारण, भाग III, खण्ड 4, सं. 460, तारीख 15 दिसम्बर, 2016 में अधिसूचना सं. आई.बी.बी.आई./2016- 17/जी.एन./आर.ई. जी. 005, तारीख 15 दिसम्बर, 2016 द्वारा प्रकाशित किए गए थे और उनमें अंतिम संशोधन भारत के राजपत्र, असाधारण, भाग III, खण्ड 4, सं. 370, तारीख 2 जून, 2026 में अधिसूचना सं. आई.बी.बी.आई./2026-

(परिसमापन प्रयििा) (चौथा संशोधन) विनियम, 2026 द्वारा किया गया था ।

Insolvency and Bankruptcy Board of India (Liquidation Process) (Fifth Amendment)
Regulations, 2026.
F. No. IBBI/2026-27/GN/REG154.— In exercise of the powers conferred under clauses (aa) and (t) of sub-section (1) of section 196 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations to further amend the Insolvency and Bankruptcy Board of India (Liquidation Process) Regulations, 2016, namely:-
1. (1) These regulations may be called the Insolvency and Bankruptcy Board of India (Liquidation Process) (Fifth Amendment) Regulations, 2026.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Insolvency and Bankruptcy Board of India (Liquidation Process) Regulations, 2016, in regulation 31, for sub-regulations (3) and (4), following sub-regulation shall be substituted, namely : –
"(3) The liquidator may modify an entry in the list of stakeholders when he comes across additional information warranting such modification, and shall intimate the Adjudicating Authority regarding such modification, within thirty days of such modification."

Note: The Insolvency and Bankruptcy Board of India (Liquidation Process) Regulations, 2016 were published vide notification No. IBBI/2016-17/GN/REG005, dated 15th December, 2016 in the Gazette of India, Extraordinary, Part III, Section 4, vide No. 460 on 15th December, 2016 and were last amended by the Insolvency and Bankruptcy Board of India (Liquidation Process) (Fourth Amendment) Regulations, 2026 published vide notification No. IBBI/2026-27/GN/REG151., dated the 1st June, 2026 in the Gazette of India, Extraordinary, Part III, Section 4, No.370 on 2nd June, 2026.
