(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 2.
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 18.

A. PRODUCT UNDER CONSIDERATION
4. The product under consideration in the present application is "Glycine".
5. Glycine is a typically white material, odourless and sweet to the taste. In its dried form which is the form in which it is ordinarily sold, it is a free-flowing crystalline substance, like salt or sugar. Glycine is produced and sold in a variety of purity or grades and has multiple commercial names depending upon its level of purity or grade, in essence: crude, industrial, technical-grade, feed-grade, food-grade, EP grade or USP-grade and pharmaceutical- grade (injectable grade). The scope of the present investigation covers glycine of all grades.
6. Glycine is the smallest, simplest non-essential amino acid, functioning as a vital proteinogenic building block, inhibitory neurotransmitter in the central nervous system, and key component in collagen synthesis. Industrially, it is used as a flavour enhancer, buffering agent, pharmaceutical ingredient, and chemical intermediate. Glycine is sold in the market in different grades, ultimately determining the use case in addition to the price.
7. Applications of different grades of glycine are:
i) Pharmaceutical grade (injectable grade) glycine is used either as an excipient or an active
pharmaceutical ingredient ("API") in manufacturing pharmaceutical compounds.
ii) USP/IP grade glycine (also known as food grade) is sold for usage in products for human consumption
such as a sweetener or food enhancer.
iii) Technical grade glycine is sold for applications such as industrial applications, agriculture, and as a
chemical intermediate.
iv) Feed grade glycine is used as an amino acid supplement in poultry, livestock and pet diets.
8. The different grades of PUC have nearly similar specifications including purity, however for purposes of different applications the distinguishing factor is the additional quality testing for a specific use case. These standards are not binding or mandatory but provide for additional tests for certain grades.

The article produced by the applicant and that imported from the subject country is comparable in terms of physical and chemical characteristics, manufacturing process and technology, functions and uses, product specifications, pricing, distribution and marketing, and tariff classification of the subject good. The subject good and the article manufactured by the applicant are technically and commercially substitutable. The applicant has claimed that the consumers of the product under consideration are using the subject good and the article manufactured by the applicant interchangeably. Thus, for the purposes of initiation of the present investigation, the article produced by the applicant has been prima facie considered as like article to the product being imported from the subject country.
C. SUBJECT COUNTRY

domestic industry may be construed as referring to the rest of the producers"
16. The application has been filed by Avid Organics Pvt. Ltd. The applicant has submitted that they have not imported the subject good from the subject country and is not related to producers and exporters from the subject country. The applicant has submitted that their share in the total Indian production of the PUC during the POI is 66% .
17. As per the information available on record, the Authority considers that the Applicant constitutes an eligible domestic industry within the meaning of Rule 2(b) of the AD Rules and the application satisfies the requirement of Rule 5(3) of the AD Rules.
F. BASIS OF ALLEGED DUMPING
a. Normal Value for China PR
18. The applicant has claimed that China PR should be treated as a non-market economy and the normal value should be determined in terms of Rule- 7 of Annexure I of the AD Rules. The applicant has cited Para 8(2) of Annexure I of the AD Rules and has stated that the Chinese producers should be directed to demonstrate that market economy conditions prevail in the industry producing the subject good in terms of Para 8(3) of Annexure I of the AD Rules. The applicant has claimed that for China PR, normal value should be determined in accordance with Para 7 and 8 of Annexure I of the AD Rules.
19. The applicant has submitted that efforts were made to determine normal value on the basis of price or constructed value in a market economy third country. However, the applicant could not get reliable information regarding the information on price or cost in market economy in a third country. Therefore, Normal Value has been calculated by taking into account best available estimates of raw materials and cost of utilities with addition of other manufacturing and general and administrative overheads and reasonable profit margin.
10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]b. Export Price

Adjustments on account of ocean freight, marine insurance, and other expenses have been made.
c. Dumping Margin
21. The normal value and the export price have been compared at ex-factory level, which prima facie shows that the dumping margin is above the de-minimis level and is significant with respect to the product under consideration exported from the subject country. Thus, there is prima facie evidence that the product under consideration from the subject country is being dumped in the Indian market by the exporters from the subject country.
G. EVIDENCE OF INJURY AND CAUSAL LINK
