का.आ. 5208(अ).— यत:, कें द्र सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना का.आ 5100 (E) दिनांक 30.11.2023 द्वारा कें द्र सरकार ने पंजाब राज्य में संपूर्ण NH-205AG [एस.ए.एस. नगर के समीप NH-205A के साथ इसके जंक्शन से शुरू होने वाले तथा मोहाली, सैदपुरा (सरहिंद), फतेहगढ़ साहिब, मलेरकोटला को जोड़ने वाले और सहना (बरनाला) के समीप NH-754AD के साथ इसके जंक्शन पर समाप्त होने वाले खंड] को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसके बाद "प्राधिकरण" कहा गया है) को सुपुर्द किया है;

अतः, अब, राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रीय राजमार्ग शुल्क (दरों का निर्धारण और संग्रहण) नियम, 2008 (जिसे इसके बाद "नियम" कहा गया है) के नियम 3 के साथ पठित, के न्द्रीय सरकार इसके द्वारा पंजाब राज्य में राष्ट्रीय राजमार्ग संख्या 205AG पर किमी 0.000 से किमी 27.370 तक के चार या अधिक लेन वाले खंड के उपयोग के लिए नीचे तालिका 1 के कॉलम (1) में र्निर्दष्ट वाहनों पर, 26.612 [तालिका 3] की शुद्ध सड़क खंड लंबाई के लिए और 7.580 किमी [तालिका 5(a)] (जिसकी लंबाई 0.758 किमी [तालिका 5] है) की समतुल्य संरचना लंबाई (60 मीटर से अधिक लंबाई वाली) के लिए तालिका 1 के कॉलम (2) में र्निर्दष्ट दर पर शुल्क लगाती है और प्राधिकरण को, या तो अपने अधिकारियों के माध्यम से या किसी संविदाकार माध्यम से, उक्त शुल्क वसूलने के लिए अधिकृ त करती है, अर्थात्:-

1. इसके अंतर्गत उद्ग्रहीत और संग्रहीत शुल्क, ऐसे शुल्क प्लाजाओं के अंतर्गत विर्निर्दष्ट निवल सड़क की दूरी हेतु शुल्क प्लाजाओं में देय और संदेय होगी, अर्थात: -

*किमी 5.840 पर शुल्क प्लाजा का स्थान मोहाली-सरहिंद एक्सप्रेसवे के किमी 0.000 से/तक की टोलिंग लंबाई के लिए है।

2. उपयु र्क्त के अतिरिक्त, निम्नलिखित शुल्क प्लाजा पर 60 मीटर से अधिक लंबाई वाली निम्नलिखित संरचनाओं के उपयोग के लिए संरचनाओं की लंबाई को 10 के समतुल्य कारक से गुणा करके राजमार्ग की समतुल्य लंबाई में परिर्वर्तत करके निम्नलिखित शुल्क भी देय और संदेय होगा :-

3. कु ल प्रभावी लंबाई जिसके लिए निम्नलिखित शुल्क देय और संदेय होगा :

.4 विभिन्न प्रकार के यातायात आवागमन जिसके लिए वास्तविक तय की गई दूरी के आधार पर उपयोगकर्ता शुल्क लिया जाएगा, इस प्रकार हैं:

.5 परियोजना राजमार्ग में प्रवेश करने वाले वाहन को प्रवेश शुल्क प्लाजा पर दर्ज किया जाएगा और प्रवेश और निकास शुल्क प्लाजा के बीच वाहन द्वारा उपयोग किए गए मार्ग खंड के लिए उपयोगकर्ता शुल्क पैरा (4) के तहत उल्लिखित विवरण के अनुसार निकास शुल्क प्लाज़ा पर एकत्र किया जाएगा ।

.6 राजमार्ग खंड पर कई यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात: -

*बशते कि उपयोगकर्ता वापसी यात्रा करते समान प्रवेश और निकास शुल्क प्लाजा का उपयोग करे।

7. संबंधित श्रेणी के वाहनों के लिए विर्निर्दष्ट अनुज्ञेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेश के लिए, कथित नियमों के नियम 10 में विर्निर्दष्ट शुल्क के समतुल्य शुल्क का भुगतान करने के लिए उत्तरदायी होगा।

8. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छू ट प्राप्त वाहनों की श्रेणी, र्सर्वस रोड, वैकल्पिक सड़क इत्यादि उक्त नियमों में विर्निर्दष्ट परिभाषाओं के अनुरूप होंगी।

9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रर्दर्शत किया जाएगा।

10. उपयु र्क्त तालिका 1-में यथा उल्लिखित आधार वर्ष के लिए प्रति किमी शुल्क की आधार दर के आधार 08-2007 पर यांत्रिक वाहनों से शुल्क की वास्तविक राशि और छू टों की गणना प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रतिवर्ष संशोधित किया जाएगा तथा तदनुसार उसे अँग्रेजी और क्षेत्रीय भाषा के कम से कम एक–एक समाचार पत्र में प्रकाशित किया जाएगा।

11. इस परियोजना की अनुमानित पू ंजीगत लागत 2073.31 करोड़ रुपये है। चू ंकि, भूमि अधिग्रहण, उपयोगिता स्थानांतरण, पेड़ों को काटने, भविष्य में सुदृढ़ीकरण, क्षमता में वृद्धि इत्यादि कार्यकलापों को अभी पूरा किया जाना है, इसलिए पू ंजीगत लागत परिवर्तन के अध्यधीन है। प्राप्त प्रयोक्ता शुल्क के माध्यम से वसूल की गई पू ंजीगत लागत का प्राधिकरण द्वारा रिकार्ड रखा जाएगा।

NOTIFICATION

New Delhi, the 21st September, 2026

S.O. 5208(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. No.5100 (E) dated 30.11.2023 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted entire NH-205AG [stretch starting from its junction with NH-205A near SAS Nagar connecting Mohali, Saidpura (Sirhind), Fatehgarh Sahib, Maler Kotla and terminating at its junction with NH-754AD near Sehna (barnala)] in the state of Punjab to the National Highways Authority of India (hereinafter referred to as the "Authority");

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee at the rate specified in column (2) of the Table 1 for net road section length of 26.612 [Table 3] and for equivalent structure length (having length more than 60m) of 7.580 km [Table 5(a)] (having length of 0.758 km [Table 5]) on the vehicles specified in Column (1) of the Table 1 below for the use of four or more lane section from Km. 0.000 to Km. 27.370 on National Highway No. 205AG in the state of Punjab and authorises the Authority to collect, either through its officials or through a contractor, the said fee, namely:-

1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza for net road length specified for such Fee Plaza(s) namely: -

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10: -

4. The various types of traffic movements for which the user fee will be charged on the basis of actual distance travelled is as under:

5. The vehicle entering the project highway will be recorded at the Entry fee Plaza and user Fee will be collected at Exit Fee Plaza for the road section used by the vehicle between Entry and Exit Fee Plazas as per details mentioned under para (4).

6. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

*Provided that the user uses the same entry and exit fee plazas while performing the return journey.

7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in rule 10 of the said rules.

8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.

9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.

10. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.

11. The estimated capital cost of the project is Rs. 2073.31 Cr. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed. The Authority shall maintain a record of the recovery of capital cost through user fee realised.
