9. संबद्ध वस्तुओं को सीमा शुल्क टैरिफ अधिनियम, 1975 की प्रथम अनुसूची के अध्याय 39 के तहत शीर्षक 3907 के अंतर्गत वर्गीकृ त किया गया है। आवेदक ने दावा किया है कि पीयूसी का आयात एचएस कोड 39072010, 39072090, 39072910 तथा 39072990 के तहत किया जाता है, और इस दावे की जांच के दौरान जांच की जाएगी। विचाराधीन उत्पाद का दायरा उत्पाद के विवरण द्वारा निर्धारित होता है, न कि सीमा शुल्क वर्गीकरण द्वारा, जो के वल सांके तिक है और पीयूसी के दायरे पर बाध्यकारी नहीं है;

INITIATION NOTIFICATION
New Delhi, the 23rd September, 2026
SETU Case ID: AD/OI/067/2026
Subject: Initiation of anti-dumping investigation concerning imports of "Copolymer Polyol of
hydroxyl value >= 23.5" originating in or exported from China PR.
A. BACKGROUND
10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]2. The applicant has alleged that the subject goods are being imported into India at dumped prices and that such imports have caused material injury to the domestic industry. Accordingly, the applicant has requested for imposition of anti-dumping duty on imports of the subject goods from the subject country.
B. PREVIOUS INVESTIGATION AND PENDING PROCEEDINGS BEFORE THE
HON'BLE HIGH COURT OF GUJARAT
3. The Authority had earlier initiated an anti-dumping investigation concerning imports of the same product originating in or exported from China PR, vide Notification F. No. 6/40/2024-DGTR dated 30.09.2024, with April 2023 to March 2024 as the period of investigation. The Authority issued its Final Findings in that investigation vide Notification F. No. 6/40/2024-DGTR dated 26.09.2025. No anti-dumping duty has been imposed on the subject goods pursuant to the said Final Findings.
4. The Authority notes that the applicant has filed Special Civil Application No. 7230 of 2026 (M/s Expanded Polymer Systems Pvt. Ltd. v. Union of India & Anr.) before the Hon'ble High Court of Gujarat at Ahmedabad. By its order dated 08.06.2026 in the said proceedings, the Hon'ble High Court has, inter alia, directed that provisional assessment of imports concerning the product in issue be made for the time being, and has made it clear that the said direction will not create any equities in favour of the respondent. The said proceedings are pending before the Hon'ble High Court.
5. The Authority is aware of the aforesaid proceedings. The order dated 08.06.2026 does not restrain the Authority from initiating a fresh investigation, and the period of investigation in the present application is different from that of the earlier investigation. In these circumstances, the Authority finds no legal bar in proceeding with the initiation of the present investigation on the basis of the application received.
6. The initiation of the present investigation is, however, without prejudice to the proceedings pending before the Hon'ble High Court. The finality of the present proceedings shall be subject to the decision of the Hon'ble High Court in the aforesaid Special Civil Application, and to any action taken by the Central Government pursuant to the interim directions of the Hon'ble High Court regarding provisional assessment. The Authority shall take such further action in the present investigation as may be warranted in accordance with law in light of such decision or action.
C. PRODUCT UNDER CONSIDERATION
7. The product under consideration is "Copolymer Polyol of hydroxyl value >= 23.5". The PUC is also known as Polymer Polyol in market parlance.
8. The PUC is mainly used for manufacturing of Flexible Foam, which is majorly used in manufacturing of mattresses. It is also used for the manufacturing of bra-cups. It is a Polymer Polyol which improves the hardness of slab foam when added in the manufacturing process of slab polyurethane foam.
9. The subject goods are classified under Chapter 39 of the First Schedule to the Customs Tariff Act, 1975, under Heading 3907. The applicant has claimed that the PUC is imported under HS Codes 39072010, 39072090, 39072910 and 39072990, and this claim shall be examined during the investigation. The scope of the product under consideration is determined by the product description and not by the customs classification, which is indicative only and not binding on the scope of the PUC; goods meeting the description of the PUC shall be covered irrespective of the tariff item under Heading 3907 under which they are classified or imported. The applicable Indian standard for the PUC is IS 18174:2023 (Polyether Polyol), which is not mandatory. The unit of measurement considered for the present investigation is Metric Tons (MT).
10. The applicant has not proposed any Product Control Number (PCN) methodology at the present stage. The parties to the present investigation may provide their comments on the scope of the PUC and propose PCNs, if any, along with justification therefor, within 15 days of the initiation of this investigation.
D. LIKE ARTICLE
11. The applicant has stated that there are no significant differences in the article produced by the applicant and exported from the subject country. The article produced by the applicant and imported from China PR are comparable in terms of physical and chemical characteristics, manufacturing11 [भाग I—खण्ड 1] भारत का राजपत्र : असाधारण process and technology, functions and uses, product specifications, pricing, distribution and marketing, and tariff classification of the subject goods. The subject goods and the article manufactured by the applicant are technically and commercially substitutable. The applicant has claimed that consumers of the PUC are using the subject goods and the article manufactured by the applicant interchangeably. Thus, for the purposes of initiation of the present investigation, the subject goods produced by the applicant and the subject goods imported from the subject country are prima facie being treated as 'like article' to each other.
E. DOMESTIC INDUSTRY & STANDING
12. Rule 2(b) of the Rules defines domestic industry as follows:
"'domestic industry' means the domestic producers as a whole engaged in the
manufacture of the like article and any activity connected therewith or those whose
collective output of the said article constitutes a major proportion of the total
domestic production of that article except when such producers are related to the
exporters or importers of the alleged dumped article or are themselves importers
thereof in such case the 'domestic industry' may be construed as referring to the rest
of the producers"
13. The application has been filed by M/s Expanded Polymer Systems Pvt. Ltd. The applicant has claimed that it is the sole producer of the subject goods in India and that, as per the best available information, there are no other producers of the subject goods in India. The applicant accounts for 100% of the Indian production.
14. The applicant has also stated that it has not imported the subject goods from the subject country during the period of injury. Moreover, the applicant has stated that it is not related to any importer or exporter of the subject goods.
15. In view of the above, on the basis of the information available on record, the Authority considers that the applicant constitutes domestic industry as defined under Rule 2(b) of the Rules and that the application satisfies the requirements of standing in terms of Rule 5(3) of the Rules.
F. SUBJECT COUNTRY
16. The subject country for the present investigation is China PR.
G. PERIOD OF INVESTIGATION (POI)
17. The period of investigation ("POI") for the present investigation is from 1st April 2025 to 31st March 2026 (12 months). The injury investigation period covers the periods 2022-23, 2023-24, 2024-25 and the POI.
H. BASIS OF ALLEGED DUMPING
a) Normal value for China PR
18. The applicant has claimed that the producers from China PR must be asked to demonstrate that market economy conditions prevail in the industry with regard to the production and sale of the subject goods, in accordance with Para 7 of Annexure-I to the Rules. Unless the producers from China PR demonstrate that such market economy conditions prevail, the normal value for China PR is required to be determined in accordance with Annexure-I of the Rules.
19. For the purpose of the present initiation, the Authority has considered China PR to be a non-market economy and, in the absence of information on record for determining normal value on any other basis, has determined the normal value for China PR on the basis of the price payable in India. The normal value has been constructed based on the cost of production of the applicant, duly adjusted for selling, general and administrative expenses, along with a reasonable profit margin.
b) Export price
20. For the purpose of initiation, the export price of the subject goods has been determined by considering the CIF price of the subject goods as reported in the import data maintained by the DG Systems.
12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]Appropriate adjustments have been made, wherever claimed and considered necessary, on account of ocean freight, marine insurance, commission, inland freight, port expenses, bank charges, credit cost to arrive at the net ex-factory export price. The net export price so determined is considered appropriate for the purpose of initiation of the present investigation.
c) Dumping margin
21. The normal value and the export price have been compared at the ex-factory level, which prima facie indicates that the dumping margin in respect of the subject goods from the subject country is above the de minimis level and is significant. Thus, there is sufficient prima facie evidence that the subject goods originating in or exported from the subject country are being dumped in the Indian market.
I. INJURY AND CAUSAL LINK
22. The applicant has furnished information on various parameters relating to 'injury' to the domestic industry as prescribed under the Rules. The evidence provided by the applicant prima facie shows injury to the domestic industry that has been caused by the alleged dumped imports from China PR.
23. The applicant has provided information with respect to the injury suffered by it because of the alleged dumped imports. The volume of the subject imports from the subject country has increased in absolute terms as well as in relation to the consumption and production in India, and the share of the subject country in the demand has increased as compared to the base year, whereas the market share of the applicant has declined as compared to the base year. The price undercutting from the subject country is positive. The landed value of the subject imports is below the cost of sales of the applicant, and the applicant has claimed that the dumped imports have suppressed and depressed its prices and prevented it from increasing its prices to recover the full cost and achieve a reasonable rate of return. The applicant is suffering financial losses, cash losses and negative return on investment, its capacity remains under-utilized despite the increase in demand, and its inventories have increased.
24. The applicant has claimed that no factor other than the dumped imports from the subject country has caused injury to the domestic industry. There is sufficient prima facie evidence of material injury being caused to the applicant due to the alleged dumped imports from the subject country to justify the initiation of the anti-dumping investigation.
J. INITIATION OF THE ANTI-DUMPING INVESTIGATION
25. On the basis of the duly substantiated written application submitted by the applicant and having reached satisfaction, on the basis of the prima facie evidence submitted by the applicant, concerning the dumping of the product under consideration originating in or exported from the subject country, the consequential injury to the domestic industry as a result of the alleged dumping of the subject goods and the causal link between such injury and the dumped imports, and in accordance with Section 9A of the Act read with Rule 5 of the Rules, the Authority hereby initiates an anti-dumping investigation to determine the existence, degree and effect of the alleged dumping with respect to the product under consideration originating in or exported from the subject country and to recommend the appropriate amount of anti-dumping duty, which, if levied, would be adequate to remove the injury to the domestic industry. The initiation of the investigation is subject to the position stated in Section B above.
