का.आ. 5243(अ).— के न्रीय सरकार ने रेल अधिनियम, 1989 (1989 का 24) एवं रेलवे (संशोधन) अधिनियम 2008 (2008 का 11) (जिसे इसमें इसके पाित उक्त अधिनियम कहा गया है) की धारा-20'क की उप-धारा (1) के अधीन जारी, भारत के राजपत्र, असाधारण, भाग II, खण्ड 3, उप-खण्ड (ii) में प्रकाशित भारत सरकार के रेलमंत्रालय (रेलवेबोर्ड) की अधिसूचना संख्या का. आ. 388 (अ) ,431(अ) 782(अ) तारीख 22 मई 2026, 02जून 2026एवं 04 सितम्बर 2026 क्रमश: (जिसे इसमें इसके पाित उक्त अधिसूचना कहा गया है) द्वारा उक्त अधिसूचना से उपाबद्ध अनुसूची में विर्निर्दष्ट भूमि को मध्यप्रदेश राज्य के उज्जैन जिले में विशेष रेल परियोजना अर्थात "नईखेड़ी से चिंतामण गणेश को जोड़ने वाली नई बीजी उज्जैन बायपास लाइन "नाम की विशेष रेलपरियोजना के निष्पादन, अनुरक्षण, प्रबंधन और प्रचालन के लिए अपेक्षित है, ऐसी भूमि का अर्जन करने के आशय की घोषणा की थी।
और उक्त अधिसूचना का सार उक्त अधिनियम की धारा-20'क की उपधारा (4) के अधीन दैनिक सामाचार पत्रों अर्थात टाईम्स आफ इण्डीया , राज एक्सप्रेस अक्षर विश्व , दैनिक अवंतिका , में ओर फ्रीप्रेस जनरल में तारीख 30मई 2026, 15 जून 2026,एवं 12.09.2026 को क्रमश: प्रकाशित किया गया था। और सक्षम प्राधिकारी द्वारा कोई आक्षेप प्राप्त नहीं किया गया। धारा 20ड की उपधारा (1) के अनुसरण में सक्षम प्राधिकारी ने अपनी रिपोर्ट कें रीय सरकार को प्रस्तुत कर दी है।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब कें रीय सरकार, सक्षम प्राधिकारी से उक्त रिपोर्ट के प्राप्त होने पर और उक्त अधिनियम की धारा 20ड की उपधारा (1) द्वारा प्रदत शक्तियों का प्रयोग करते हुए यह घोषणा करती है कि इससे उपावद्ध अनुसूची में विर्निर्दष्ट भूमि पूवोक्त प्रयोजन के लिए र्अर्जत की जाएगी।
और यह कि कें रीय सरकार उक्त अधिनियम कि धारा-20(ड) कि उप-धारा (2) के अनुसरण में यह घोषणा करती है कि राजपत्र में इस अधिसूचना के प्रकाशित होने पर इससे उपाबद्ध अनु सूची में विर्निर्दष्ट भूमि सभी विल्लंगमो से मुक्त होकर कें रीय सरकार में पूर्णतया निहित हो जाएगी।

NOTIFICATION
Mumbai, the 24th September, 2026
S.O. 5243(E).— Where as by the Notification of the Government of India, in the Ministry of Railways (Railway Board), number S.O. 388(E), 431(E) and 782(E) dated 22 May 2026, 02 June 2026 and 04 September 2026, respectively published in Gazette of India Extraordinary. Part II, section-3, Sub-section (ii), of section 20A of the Railways Act,1989 (24of1989) (here in after referred to as the said Act),the Central Government, has declared its intention to acquire the land specified in the Schedule.
annexed to the said notification for execution, maintenance, management and operation of Special Railway Project, namely, "New BG Ujjain Bypass Line connecting Naikhedi to Chintaman Ganesh",in Ujjain District of the State of Madhya Pradesh.
And where as ,the substance of the said Notifications was published in Times of India, Raj Express, Akshar Vishva, Dainik Avantika and Free Press Journal, on 30 May 2026, 15 June 2026 and 12 September 2026, respectively. 2024 under sub-section (4) of Section 20A of the said Act. And, where as, Nil objection has been received by the competent authority.
And, where as, in pursuance of sub-section (1) of Section 20(E) of the said Act, the competent authority has submitted its report to the Central Government;
Now, therefore, upon receipt of the said report of the competent authority, and in exercise of the power conferred by sub-section (1) of Section 20(E) of the said Act, the Central Government hereby declares that the lands specified in the Schedule annexed here to shall be acquired for the afore said purpose.
And, further, in pursuance of sub-section (2) of Section 20 (E) of the said Act, the Central Government here by declares that on publication of this notification in the Official Gazette, the land specified in the Schedule annexed here to shall vest absolutely in the Central Government free from all encumbrances.
