का.आ. 5256(अ).— के न्द्रीय सरकार ने पेटर ोलियम और खनिज पाइपलाइन (भूमि में उपयोग के अधिकार का

अजजन) अधिनियम 1962 (1962 का 50) (जिसे इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 3 उप धारा (1) के अधीन जारी की गई, भारत सरकार के पेटर ोलियम और प्राकृ तिक गैस मंत्रालय की अधिसूचना जिसका प्रकाशन भारत के राजपत्र संख्या 5688 दिनांक 18.12.2025 का.आ. 5884(अ) दिनांक 16.12.2025 भाग (II) खण्ड (3), उपखण्ड (II) में किया गया है, इस अधिसूचना से संलग्न अनुसूची में विनिदिजष्ट उत्तर प्रदेश राज्य की तहसील सगड़ी जिला आजमगढ़ की भूमि में उत्तर प्रदेश राज्य में कांडला (गुजरात) से गोरखपुर (यूपी) तक एलपीजी पररवहन के लिए आई0एच0बी0 लिमिटेड द्वारा यििान्वति किए जा रहे ''कांडला (गुजरात) से गोरखपुर (यूपी) पररयोजनाʼʼ के सम्बन्ध में पाइपलाइन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अजजन करने के लिए अपने आशय की घोषणा की थी।

और उक्त राजपत्र अधिसूचनाओं की प्रतियाँ जनता को दिनांक 07.02.2026 तक उपलब्ध करा दी गई थी।

और उक्त अधिनियम की धारा 6 की उपधारा (1) के अनुसरण में श्री अबुल कलाम, सक्षम प्राधिकारी, आई0एच0बी0 लिमिटेड, कांडला-गोरखपुर एल.पी.जी. पाइपलाइन, लखनऊ (यू.पी.) ने के न्द्रीय सरकार को अपनी ररपोटज दे दी है।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और के न्द्रीय सरकार ने उक्त ररपोटज पर विचार करने के पश्चात् और यह समाधान हो जाने पर कि उक्त भूमि पाइपलाइन बिछाने के लिए अपेक्षित है, उसमें उपयोग के अधिकार का अजजन करने का विनिश्चय किया है।

अतः अब, के न्द्रीय सरकार उक्त अधिनियम की धारा 6 की उपधारा (1) द्वारा प्रदत्त शन्वक्तयों का प्रयोग करते हुए एतद् द्वारा घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिदिजष्ट भूमि में पाइपलाइन बिछाने के उपयोग का अधिकार अजिजत किया जाए।

और के न्द्रीय सरकार उक्त अधिनियम की धारा 6 की उपधारा (4) द्वारा प्रदत्त शन्वक्तयों का प्रयोग करते हुए, यह निदेश देती है कि उक्त भूमि में उपयोग का अधिकार इस घोषणा के प्रकाशन की तारीख से के न्द्रीय सरकार में निहित होने के बजाय सभी विल्लंगमों से मुक्त होकर आई0एच0बी0 लिमिटेड मे निहित होगा।

पेटर ोलियम और खनिज पाइपलाइन अधिनियम, 1962 की धारा 10 के अधीन किसी भी क्षतिपूतिज के लिए आई0एच0बी0 लिमिटेड पूणजतया उत्तरदायी होगी और पाइपलाइन से सम्बन्वन्धत किसी भी मामले पर के न्द्रीय सरकार के विरूद्ध कोई वाद, दावा, या कानूनी कायजवाही नही हो सके गी।

MINISTRY OF PETROLEUM AND NATURAL GAS

NOTIFICATION

New Delhi, the 23rd September, 2026 S.O. 5256(E).— Whereas by the notification of The Government of India in the Ministry of Petroleum and Natural Gas, Published in the Gazette No. 5688 Dated 18.12.2025, S.O. No. 5884(E) Dated 16.12.2025 Part-II, Section- 3, Sub-Section (ii) issued under Sub-Section (1) of Section 3 of the Petroleum and minerals pipeline (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (Hereinafter referred to as the said Act), the central Government declared its intention to acquire the right of user in the land situated in Tehsil Sagdi District Azamgarh in Uttar Pradesh State, Specified in the schedule appended to that notification for the purpose of laying pipeline for the transportation of LPG from Kandla to Gorakhpur by the IHB Ltd for implementing the Kandla to Gorakhpur LPG Pipeline Project.

And whereas the copies of the said Gazette notification were made available to the public up to 07 February 2026.

And whereas Shri Abul Kalam, Competent Authority, IHB Limited, Kandla Gorakhpur LPG Pipeline Project, Lucknow (UP) has under sub-section (1) of section 6 of the said Act, has submitted his report to Central Government.

And whereas, the Central Government after Considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of the user therein;

Now, therefore, in exercise of the powers conferred by Sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user of the said land for laying the pipeline shall, instead of vesting in the Central Government, vests on the date of publication of this declaration, in IHB Ltd, free from all encumbrances.

5 [भाग II—खण्ड ³(ii)] भारत का राजपत्र : असाधारण

IHB Ltd shall be exclusively liable for any compensation in terms of section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to pipeline.
