रेल अधिनियम 1989 की धारा 20E के तहत अधिसूचना

का.आ. 5307(अ).—के न्रीय सरकार ने, रेल अधिनियम 1989 (1989 का 24) जिसे इसमें इसके पश्चात (उक्त अधिनियम कहा गया है) की धारा 20क की उपधारा (4) के अधीन भारत के राजपत्र, असाधारण, भाग-II, खंड-3, उपखंड – (ii) में प्रकाशित भारत सरकार के रेल मंत्रालय की अधिसूचना संख्या 3440 तारीख 01 जुलाई 2026 (जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है) द्वारा उक्त अधिसूचना से उपबध्ध अनुसूची में विर्निर्दष्ट भूमि को, छत्तीसगढ़ राज्य के बलौदा बाज़ार - भाटापारा जिले में विशेष रेल परियोजना अर्थात खरसिया-नया रायपुर-परमलकसा 5 वीं एवं 6 वीं लाइन (278.00 किमी) के निष्पादन के लिए र्अर्जत करने के अपने आशय की घोषणा की थी,

और उक्त अधिनियम की धारा 20 क की उपधारा (4) के अधीन 20 क अधिसूचना का सार दैनिक समाचार पत्र, नव प्रदेश (हिंदी), रायपुर संस्करण दिनांक 12..07.2026, हरिभूमि (हिंदी), रायपुर संस्करण दिनांक 12.07.2026 एवं टाइम्स ऑफ़ इंडिया (अंग्रेजी), रायपुर संस्करण दिनांक 12.07.2026 में प्रकाशित किया गया था,

और निर्धारित समयावधि में दावा आपत्ति प्राप्त हुई और उक्त अधिनियम की धारा 20 घ के तहत सक्षम प्राधिकारी द्वारा प्रकरण का निराकरण किया गया ; उक्त अधिनियम की धारा 20 ड की उपधारा (1) के अनुसरण में सक्षम प्राधिकारी ने अपनी रिपोर्ट के न्रीय सरकार को प्रस्तुत कर दी है, अतः अब, के न्रीय सरकार सक्षम प्राधिकारी से उक्त रिपोर्ट प्राप्त होने पर और रेल अधिनियम, 1989 की धारा 20 ड की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह घोषणा करती

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] है इससे उपबद्ध अनुसूची में विर्निर्दष्ट भूमि पूवोक्त प्रयोजन के लिए र्अर्जत की जाएगी, और यह कि के न्रीय सरकार उक्त अधिनियम की धारा 20 ड के अनुसरण में यह घोषणा करती है इस अधिसूचना के राजपत्र में प्रकाशित होने पर इससे उपबध्ध अनुसूची में विर्निर्दष्ट भूमि सभी विल्लंगनो से मुक्त होकर के न्रीय सरकार में आत्यंतिक रूप से निहित हो जाएगी

खरसिया-नया रायपुर-परमलकसा 5 वीं एवं 6 वीं लाइन (278.00 किमी) परियोजना के निर्माण के लिए छत्तीसगढ़ राज्य के बलौदा बाज़ार - भाटापारा जिले के अंतर्गत अधिग्रहण किये जाने के लिए संरचना सहित या संरचना रहित भूमि का संक्षित विवरण ;

NOTIFICATION

Bilaspur, the 24th September, 2026

NOTIFICATION UNDER SECTION 20E OF THE RAILWAY ACT 1989

S.O. 5307(E).— Whereas by the notification of the Government of India, In the Ministry of Railways (Railway Board) number 3440, dated the 01 July 2026, published in the Gazette of India (Extra-Ordinary) Part-II section 3 sub section (ii), hereinafter referred to as the said notification) under subsection (1) of 20A of the Railway act,1989 (24 of 1989) (hereinafter referred to as the said Act), the central Government declared its intention to acquire the land specified in the schedule annexed to the said notification for execution of4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Special Railway Project, namely Kharsia - Naya Raipur - Parmalkasa 5th and 6th line (278.00 km.) in Baloda Bazar – Bhatapara District in the state of Chhattisgarh.

And, whereas the substance of the said notification 20A was published as per section 20A sub section (4) in the daily Newspapers, Nav Pradesh (Hindi) Raipur Edition dated 12.07.2026, Haribhumi (Hindi), Raipur Edition dated 12.07.2026 and Times of India (English) Raipur Edition dated 12.07.2026.

And whereas, objections were received within the set time period and disposed of by the Competent Authority under section 20D of the said Act; And, whereas, in pursuance of sub-section (1) of section 20E of the said act, the Competent Authority has submitted his report to the central Government; Now, therefore, upon receipt of the said report of the Competent Authority, and in exercise of the powers conferred by sub- section (1) of the section 20E of the said act 1989, the Central Government hereby declares that the lands specified in the schedule annexed hereto shall be acquired for the aforesaid purpose; And, further, in pursuance of sub-section (2) of section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all Encumbrances.
