सेतु के स आईडी - AD/OI/046/2026

4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]

iii.

6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] अधिक है।

INITIATION NOTIFICATION

New Delhi, the 25th September, 2026

SETU CASE ID-AD/OI/046/2026

Subject: Initiation of anti-dumping investigation concerning imports of T-Shaped Elevator/Lift Solid Guide Rails

from China PR.

1. F. No. 6/43/2026-DGTR.— Having regards to the Customs Tariff Act, 1975, as amended from time to time (hereinafter referred to as the 'Act') and the Customs Tariff (Identification, Assessment, and Collection of Anti- Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, as amended from time to time (hereinafter referred to as the 'Rules'), Savera India Riding Systems Company Private Limited (hereinafter referred to as the 'applicant') has filed an application before the Designated Authority (hereinafter referred to as the 'Authority'), for initiation of an anti-dumping investigation on imports of T-Shaped Elevator/Lift Solid Guide Rails (hereinafter referred to as the 'product under consideration' or the 'subject goods' or the 'PUC'), originating in or exported from China PR (hereinafter referred to as the 'subject country').

2. The applicant has alleged that material injury is being caused to the domestic industry due to the dumped imports of the subject goods from China PR and has requested for the imposition of anti-dumping duties on the imports of the subject goods, originating in or exported from the subject country.

3. The applicant has stated that an anti-dumping investigation concerning the same product under consideration and the same subject country was initiated vide Notification F. No. 6/14/2024-DGTR dated 29th June 2024, that the Authority recommended imposition of anti-dumping duty vide its final findings dated 27th August 2025, and that no anti-dumping duty came to be imposed pursuant thereto. The Authority notes that no anti-dumping duty is presently in force on the subject goods and that the present application is accordingly an application for initiation of an original investigation in terms of Rule 5 of the Rules. The Authority further notes that the determinations recorded in the earlier proceeding do not dispense with the requirement of prima facie evidence of dumping, injury and causal link in respect of the period of investigation now proposed, and that the present application has been examined afresh on the record presently available.

A. Product under consideration

4. The product under consideration in the present investigation is "T-Shaped Elevator/Lift Solid Guide Rails", also known in market parlance as Solid Lift Guide Rails or Solid Guide Rails.

5. The PUC forms the track that guides the elevator/lift car and, where applicable, the counterweight/balancing weight in vertical travel in the hoistway. It provides structural integrity and guidance, minimises vibration in the horizontal plane so as to provide a comfortable ride, and, by reason of its solid construction, enables the safety gear to stop and hold the car. The PUC is installed on the hoistway wall and is fixed thereto by clips and brackets. The applicant has also referred to ISO 8100-33:2022 (formerly ISO 7465:2007) and Indian Standard IS 17806:2022 in relation to T-type guide rails, and has stated that no quality control order has been issued making the said standard mandatory in India.

6. The scope of the PUC includes T-Shaped Elevator/Lift Solid Guide Rails of all types and dimensions up to and including 127 mm cross-sectional dimensional width, irrespective of customer-specific dimensions or nomenclature. The following are excluded from the scope of the PUC: (i) cold-drawn guide rails, being solid guide rails manufactured through a cold-drawing process which determines the final dimensions and modifies the mechanical properties and surface characteristics of the finished guide rails, usually designated as T65/A, T45/A and T50/A; and (ii) all hollow guide rails, whether open-profile or closed-profile, welded or non-welded, irrespective of dimensions, specifications or grade, including guide rails manufactured from formed sheet metal.

7. The applicant has submitted that the subject goods may be imported either with or without fishplates and that fishplates are outside the scope of the product under consideration. The applicant has also submitted that certain imports of the product under consideration have been made along with fishplates. Since fishplates fall outside the scope of the product under consideration, a fair comparison requires that the value and weight attributable to fishplates be excluded from the analysis. Accordingly, the exporters should be directed to provide a separate break-up of exports of guide rails supplied with fishplates, identifying the corresponding value and weight attributable to the fishplates.

8. The Authority notes that this issue is relevant both to the scope of the present investigation and to the fair comparison of prices, given that a portion of the imports entered India together with fishplates. In the present11 [भाग I—खण्ड 1] भारत का राजपत्र : असाधारण initiation, the product under consideration comprises only the solid guide rail, while fishplates imported along with the guide rails do not form part of the product under consideration. Accordingly, the producers/exporters from the subject country shall be required to furnish a separate breakup of their exports identifying the value and quantity attributable to guide rails and fishplates. The appropriate treatment of fishplates for determining the export price of the product under consideration shall be examined during the course of the investigation. Interested parties may submit their comments in this regard.

9. The unit of measurement considered in the present investigation for the product under consideration is Metric Tonnes (MT).

10. The product under consideration is classifiable under tariff items 8431 31 00, 8431 39 10 and 8431 39 90 of the First Schedule to the Customs Tariff Act, 1975. Certain imports of the subject goods have also been reported under tariff item 7308 90 90. The customs classification is indicative only and is not binding on the scope of the present investigation.

11. The applicant has proposed a Product Control Number ('PCN') methodology based on the model/type of the Solid Guide Rail. 'T' denotes the T-shaped profile, and the numerical designation represents the cross-sectional dimensional width in millimetres; suffixes such as '1B' or '2B' or 1/B denote design variations within a model.

*Under the 'Other' (OT) category, interested parties shall be required to report each individual commercial

model as a distinct entry, provided it is not explicitly covered in the preceding table.

12. All interested parties are advised to furnish their comments on the scope of the PUC and the proposed PCN methodology within 15 days from the date of transmission of the intimation letters, containing, inter alia, the non- confidential version of the application and the respective questionnaire(s), to the known interested parties and the diplomatic representative(s) of the subject country/countries.

B. Like article

13. The applicant has stated that there is no known difference between the subject goods produced by the applicant and those exported from China PR. The domestic product and the imported subject goods are comparable in terms of physical and chemical characteristics, functions and uses, pricing, distribution and marketing, and tariff classification; they are technically and commercially substitutable and are used interchangeably by consumers. Thus, for the purpose of initiation of the present investigation, the subject goods produced by the applicant are being treated as 'like article' to the product under consideration imported from the subject country.

C. Domestic industry & standing

14. The application has been filed by Savera India Riding Systems Company Private Limited. The applicant has stated that there are three known producers of the PUC in India, namely Savera India, N. Liftee Engineers and Nav12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] Durga Steel Corporation; that N. Liftee Engineers supports the application and has furnished the information prescribed under the applicable trade notices; and that Nav Durga Steel Corporation discontinued production of the PUC after 2022-23 and had no production during the POI. The applicant has claimed that it accounts for a major proportion of the total Indian production of the PUC and that, together with the supporter, the application is supported by the entirety of the known Indian production during the POI.

15. The applicant has disclosed that it imported limited quantities of the PUC from China PR during the injury period including the POI, and that certain producers/exporters of the PUC in China PR are its affiliates, of which two exported limited quantities to India during the said period. The Authority notes that these circumstances engage the proviso to Rule 2(b) of the Rules, under which a producer who is itself an importer of, or is related to an exporter of, the alleged dumped article may be construed as falling outside the scope of the domestic industry. The applicant has submitted that it continued manufacturing and selling the like article in India throughout the injury period. It has further contended that its limited imports were used for benchmarking, testing, and product engineering rather than resale. Furthermore, the applicant's affiliated entities accounted for only a small share of imports from the subject country, and the applicant itself requested anti-dumping duties on all imports from China PR, including those by its own affiliates. For the purpose of initiation, the Authority prima facie considers that exclusion of the applicant from the scope of the domestic industry is not warranted, and the volume, purpose and effect of the imports made by the applicant, and the nature and effect of the relationship with the affiliated producers/exporters, shall be examined in the course of the investigation.

16. Based on information available on record, the Authority is satisfied that the applicant constitutes domestic industry within the meaning of Rule 2(b). The application satisfies the requirements of standing in terms of Rule 5(3).

D. Subject country

17. The subject country in the present investigation is China PR.

E. Period of investigation

18. The applicant has proposed the period of investigation as 1st April 2025 to 31st March 2026, which is a period of 12 months. The Authority has considered the period of investigation as 1st April 2025 to 31st March 2026. The injury investigation period covers the financial years 2022-23, 2023-24, 2024-25 and the period of investigation.

F. Basis of alleged dumping

i. Normal value for China PR

19. The applicant has cited and relied upon Article 15(a) of China's Accession Protocol and has claimed that China PR should be treated as a non-market economy and that producers from China PR should be directed to demonstrate that market economy conditions prevail in the industry with regard to the production and sales of the product under consideration. Unless the producers from China PR show that such market economy conditions prevail, their normal value should be determined in accordance with paragraphs 7 and 8 of Annexure-I to the Anti- Dumping Rules, 1995.

20. The applicant has submitted that information relating to the cost and price of the PUC in a market economy third country is not available in the public domain, and that representative third-country export prices cannot reliably be used because the relevant tariff headings also cover other elevator/lift parts and product categories falling outside the scope of the PUC. The applicant has therefore claimed normal value for China PR in terms of paragraph 7 of Annexure-I, based on the weighted average cost of production of the applicant, adjusted to include a reasonable profit margin. The Authority notes that paragraph 7 of Annexure-I permits determination of normal value on any other reasonable basis, including the price actually paid or payable in India for the like product duly adjusted to include a reasonable profit margin, where the anterior bases specified therein are not available. The methodology as claimed by the applicant has been considered for the purpose of initiation, and the availability of a market economy third country basis, as well as the elements of the constructed normal value, shall be examined in the course of the investigation.

ii. Export price

21. The export price of the product under consideration has been determined by considering the CIF price of the product under consideration as reported in DG Systems transaction-wise import data. Adjustments have been claimed on account of ocean freight, marine insurance, bank charges, port expenses, inland freight, and loading and unloading charges to arrive at the ex-factory export price.

iii. Dumping margin

22. The normal value and export price have been compared at the ex-factory level, which prima facie establishes that the dumping margin in respect of the product under consideration imported from China PR is positive and above the de minimis level. There is sufficient prima facie evidence that the product under consideration is being dumped into the domestic market of India by exporters from the subject country.

G. Injury and causal link

23. The applicant has alleged that the dumped imports of the subject goods from China PR are causing material injury to the domestic industry and has furnished prima facie evidence in support thereof. The information furnished by the applicant and the DG Systems transaction-wise import data with the Authority prima facie shows that the demand for the subject goods in India grew over the injury period and that the volume of the subject imports increased in each year, both in absolute terms and in relation to the demand and the production in India, the subject imports remaining several times the total Indian production and accounting for the predominant share of the Indian market during the period of investigation, while imports from other sources were nil or negligible. The domestic industry was unable to increase its production, domestic sales and capacity utilisation commensurately with the growth in demand, its market share declined over the injury period, it operated with substantial unutilized capacity and its inventories remained materially above the level of the base year. The landed price of the subject imports remained below the selling price of the domestic industry resulting in significant price undercutting during the period of investigation. The selling price of the domestic industry declined more than its cost of sales and fell below its cost of sales during the last two years of the injury period. The profit before tax, profit before interest and tax and return on capital employed of the domestic industry declined in each year of the injury period and turned negative, and its cash profits declined to a marginal level during the period of investigation.

24. The Authority notes that the volume of the subject imports is not prima facie negligible, the subject country accounting for virtually the entire imports of the subject goods into India during the period of investigation. Having regard to Annexure-II to the Rules, the Authority prima facie considers, for the purpose of initiation, that there is sufficient evidence of material injury to the domestic industry, the adverse effect of the subject imports being manifested principally through their effect on the prices and volumes of the domestic industry, and of a causal link between the alleged dumping and such injury. The other known factors listed in Annexure-II to the Rules shall be examined in the course of the investigation so that injury, if any, caused by such factors is not attributed to the dumped imports.

H. Initiation of anti-dumping investigation

25. On the basis of the duly substantiated written application submitted by the applicant and having reached satisfaction based on the prima facie evidence submitted by the applicant concerning the dumping of the product under consideration originating in or exported from the subject country, the consequential material injury to the domestic industry as a result of the alleged dumping of the product under consideration and the causal link between such injury and the dumped imports, and in accordance with Section 9A of the Act read with Rule 5 of the AD Rules, the Authority, hereby, initiates an anti-dumping investigation to determine the existence, degree, and effect of the dumping with respect to the product under consideration originating in or exported from China PR and to recommend the appropriate amount of anti-dumping duty, which if levied, would be adequate to remove the injury to the domestic industry.

26. The applicant has requested the Authority to issue preliminary findings and to recommend imposition of provisional anti-dumping duty in terms of Rule 13 of the Rules, to recommend retrospective imposition of anti- dumping duty in terms of Rule 20(2)(b) of the Rules read with Section 9A of the Act. The Authority notes that these requests do not fall for determination at the stage of initiation. The same shall be considered, if and to the extent warranted, at the appropriate stage of the investigation, and the interested parties may furnish their comments thereon within the time limit prescribed in this notification.
