का.आ. 5324(अ).— यत:, कें द्र सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68 ) की धारा 11 के तहत जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1585 (अ), दिनांक 10 नवंबर, 2005 द्वारा मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 3 के 12.600 किमी से 84.700 किमी (इंदौर-खालघाट खंड) तक के खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसके बाद "प्राधिकरण" कहा जाए) को सुपुर्द किया है;
अतः अब, समय-समय पर संशोधित राष्ट्रीय राजमार्ग शुल्क (दर अवधारण एवं संग्रहण) नियम 2008 के नियम 3 (जिसे इसके बाद "नियम" कहा जाए) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और अधिसूचना का.आ. 2070 (अ) दिनांक 07.08.2009 और का.आ. 3098 (अ) दिनांक 30.09.2016, का.आ. 2180 (अ) दिनांक 22. जून, 2016, और का.आ. 3451(अ) दिनांक 15 नवंबर, 2016 के द्वारा जारी संशोधनों का अधिक्रमण करते हुए, कें द्र सरकार एतद्द्वारा मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 52 (पुराना एनएच 3) के डिज़ाइन किमी 0.000 से 77.320; (मौजूदा चेनज किमी 12.600 से 84.700 (बाईपास की अतिरिक्त लंबाई को ध्यान में रखते हुए लगाए गए किमी पत्थरों के अनुसार किमी 89+920) के इंदौर से खलघाट खंड के चार या अधिक लेन के उपयोग के लिए नीचे दी गई सारणी 1 के कॉलम (1) में विनिर्दिष्ट वाहनों के प्रकार पर 36.349 किमी की निवल सड़क

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] लंबाई [सारणी-2] और 7.77 किमी [सारणी-4] (0.777 किमी लंबाई वाली) की समतुल्य संरचना लंबाई (60 मीटर से अधिक) के लिए सारणी 1 के कॉलम (2) में विनिर्दिष्ट आधार दर से और दस करोड़ रुपये या उससे अधिक लागत वाले 41.464 किमी लंबाई वाले बाईपास [सारणी -3] के लिए आधार दर का डेढ़ गुणा की दर से शुल्क उद्गृहीत करती है और प्राधिकरण को अपने अधिकारियों या किसी संविदाकार के माध्यम से उक्त शुल्क को संग्रहीत करने के लिए प्राधिकृ त करती है, अर्थात :-

1. इसके अंतर्गत उद्गृहीत और संगृहीत शुल्क, ऐसे शुल्क प्लाजाओं के अंतर्गत विनिर्दिष्ट निवल सड़क की दूरी हेतु शुल्क प्लाजाओं में देय और संदेय होगी, अर्थात: -

4. गैर वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और शुल्क प्लाजा बीस किलोमीटर तक की दूरी के भीतर निवास करने वाले व्यक्ति के लिए मासिक पास की दर वर्ष 2026-27 के लिए 360.000 रुपये (तीन सौ साठ रुपये मात्र) है और उक्त नियमों के प्रावधानों के अनुसार प्रतिवर्ष संशोधन के लिए अध्यधीन है।
5. राजमार्ग खंड पर एकाधिक यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात:-

6. जिस जिले में शुल्क प्लाजा स्थित है, वहां पंजीकृ त वाणिज्यिक वाहन (राष्ट्रीय परमिट के तहत चलने वाले वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित दर का 50% होगा, बशर्ते ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड या वैकल्पिक सड़क उपलब्ध न हो।
7. संबंधित श्रेणी के वाहनों के लिए विनिर्दिष्ट अनुज्ञेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी को उक्त नियमों के नियम 10 में विनिर्दिष्ट शुल्क के समतुल्य शुल्क देना होगा।
6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]8. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छू ट प्राप्त वाहनों की श्रेणी, सर्विस रोड, वैकल्पिक सड़क
इत्यादि उक्त नियमों में विनिर्दिष्ट परिभाषाओं के अनुरूप होंगी।
9. उक्त नियमों के नियम 12 के अनुसार उपयोगकर्ताओं की जानकारी के लिए शुल्क दरें प्रदर्शित की जाएंगी।
र्क्त सारणी – 1 यथा उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किमी. शुल्क की आधार दर के आधार पर 10. उपयु
यांत्रिक वाहनों से शुल्क की वास्तविक राशि और छू टों की गणना प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर
की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रतिवर्ष संशोधित किया जाएगा तथा तदनुसार उसे अँग्रेजी और क्षेत्रीय भाषा के कम से कम एक–एक समाचार पत्र में प्रकाशित किया जाएगा।
11. इस परियोजना की अनुमानित पू ंजीगत लागत 1569.05 करोड़ रुपये है। प्राप्त प्रयोक्ता शुल्क के माध्यम से वसूल की
गई पू ंजीगत लागत का प्राधिकरण द्वारा रिकार्ड रखा जाएगा।

NOTIFICATION
New Delhi, the 28th September, 2026
S.O. 5324(E).— Whereas, by notification of the Government of India in the Ministry of Road Transport and Highways number S.O.1585 (E;), dated the 10th November, 2005, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government entrusted the section from Km. 12.600 to Km. 84.700 (Indore - Khalghat section) of National Highway No.3 in the State of Madhya Pradesh to the National Highways Authority of India (hereinafter referred to as the Authority);
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules") and in suppression to Gazette Notification S.O. 2070 (E) dated 07.08.2009 and amendments issued vide S.O. 3098(E) dated 30.09.2016, S.O. 2180(E) dated 22nd June 2016 & S.O. 3451(E) dated 15th November, 2016 the Central Government hereby levies the fee at the rate specified in column (2) of the Table 1 for net road section length of 36.349 km [Table-2] and for equivalent structure length (having length more than 60m) of 7.77 km (having aggregate length of 0.777 km [Table-4]) and at one and one half times the base rate for bypasses having aggregate length of 41.464 Km [Table-3] costing rupees ten crore or more on the type of vehicles specified in column (1) of the Table 1 below for the use of four or more lane of Indore to Khalghat section of NH – 52 from design kilometer 0.000 to 77.320 (Existing Ch Km 12.600 to Km. 84.700 (Km 89+920 as per installed KM Stones after considering the additional length of bypasses)) of National Highway number 52 (Old NH 3) in the State of Madhya Pradesh and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:-

3. In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalisation factor of 10: -

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs 360 (Three Hundred and Sixty Only) for the year 2026-27 and is subject to revision every year as per the provisions of the said rules.
9 [भाग II—खण्ड 3(ii)] भारत का राजपत्र : असाधारण5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: -

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in rule 10 of the said rules.
8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.
9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.
10. Based on the base rate of fee per Kilometre for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.
11. The estimated capital cost of the project is Rupees 1569.05 crores. The National Highway Authority of India shall maintain a record of the recovery of capital cost through user fee realised.
