(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] समक्ष चीन जन.
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]घ.
iii.

A. Product under consideration
3. The product under consideration in the present investigation is "Para-tert-Octyl ("PTOP") Phenol Formaldehyde Tackifier Resin". The Chemical Abstracts Service Registry Number associated with the PUC is 26678-93-3.
4. The PUC is a thermoplastic phenolic resin produced through the condensation of octyl phenol and formaldehyde and is generally supplied in the form of white, yellow to amber-coloured pastilles. The scope of the PUC includes PTOP formaldehyde tackifier resin irrespective of the manufacturing process employed, physical form (including pastilles, flakes, pellets, granules, lumps or any other form), packaging, labelling, nomenclature, commercial description or trade name under which the product is imported into India.
5. The PUC is used as a tackifier in rubber compounds to maintain adhesion between components prior to curing and vulcanisation. It is principally used in tyre manufacturing and is also used in conveyor belts and other industrial rubber products, hoses and tubing, footwear components, retread compounds, moulded rubber goods and other natural and synthetic rubber applications. It has been stated in the application that there is no mandatory BIS standard applicable to the manufacture, sale or import of the PUC in India, and that the PUC is freely importable.
6. The unit of measurement considered in the present investigation for the product under consideration is Weight (MT/KG).
7. The product under consideration is classifiable under tariff items 3909 40 20, 3909 40 30 and 3909 40 90 of the First Schedule to the Customs Tariff Act, 1975. The customs classification is indicative only and is not binding on the scope of the present investigation.
8. The applicants have not proposed a Product Control Number ("PCN") methodology. All interested parties are advised to furnish their comments on the scope of the PUC and PCN methodology, if any, within 15 days from the date of transmission of the intimation letters, containing, inter alia, the non- confidential version of the application and the respective questionnaire(s), to the known interested parties and the diplomatic representative(s) of the subject country/countries.
B. Like article
9. The applicants have stated that there is no known difference between the subject goods produced by them and those exported from China PR. The domestic product and the imported subject goods are comparable in terms of physical and chemical characteristics, functions and uses, pricing, distribution and marketing, and tariff classification; they are technically and commercially substitutable and are used interchangeably by consumers. Thus, for the purpose of initiation of the present investigation, the subject goods produced by the applicants are being treated as 'like article' to the product under consideration imported from the subject country.
C. Domestic industry & standing
10. The application has been filed by SI Group India Private Limited and Finorchem Limited. The applicants have stated that SI Group has been engaged in the manufacture and sale of the PUC in India for a substantial period of time, that Finorchem commenced commercial production of the PUC in February 2024 upon the commissioning of a new production line, and that the four other producers of the PUC in India account for a limited share of the total Indian production. There is no supporter of the application. The Authority notes that the collective output of the applicants constitutes a major proportion of the total Indian production of the like article and exceeds the proportion prescribed under Rule 5(3) of the Rules, and that no other Indian producer has expressed either support for or opposition to the application.
11. The applicants have disclosed that SI Group has an affiliated entity in the subject country, and have stated that the said entity did not export the subject goods to India, directly or indirectly, during the injury period including the POI, that neither applicant has imported the subject goods from the subject country and that neither is related to any importer of the subject goods in India.
12. Based on information available on record, the Authority is satisfied that the applicants constitute domestic industry within the meaning of Rule 2(b). The application satisfies the requirements of standing in terms of Rule 5(3).
D. Subject country
13. The subject country in the present investigation is China PR.
12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]E. Period of investigation
14. The applicants have proposed the period of investigation as 1st April 2025 to 31st March 2026, which is a period of 12 months. The Authority has considered the period of investigation as 1st April 2025 to 31st March 2026. The injury investigation period covers the financial years 2022-23, 2023- 24, 2024-25 and the period of investigation.
F. Basis of alleged dumping
i. Normal value for China PR
15. The applicants have cited and relied upon Article 15(a) of China's Accession Protocol and have claimed that China PR should be treated as a non-market economy and that producers from China PR should be directed to demonstrate that market economy conditions prevail in the industry with regard to the production and sales of the product under consideration. Unless the producers from China PR show that such market economy conditions prevail, their normal value should be determined in accordance with paragraphs 7 and 8 of Annexure-I to the Anti-Dumping Rules, 1995.
16. The applicants have submitted that information relating to the domestic selling price or the cost of production of the PUC in a market economy third country, and comparable representative prices of the like article when exported from such a third country to other countries including India, are not available in the public domain. The applicants have therefore constructed the normal value on the basis of the best available estimates of raw material and utility costs, together with other manufacturing and general and administrative overheads and a reasonable profit margin, so as to arrive at an ex-factory normal value. The Authority notes that paragraph 7 of Annexure-I permits the determination of normal value on any other reasonable basis, including the price actually paid or payable in India for the like product duly adjusted to include a reasonable profit margin, where the anterior bases specified therein are not available. The normal value methodology as claimed by the applicants has been considered for the purpose of initiation, and the availability of a market economy third country basis, as well as the elements of the constructed normal value, shall be examined in the course of the investigation.
ii. Export price
17. The export price of the product under consideration has been determined by considering the CIF price of the product under consideration as reported in DG Systems transaction-wise import data.
Appropriate adjustments have been considered on account of ocean freight, marine insurance, bank charges, port expenses, inland freight, and loading and unloading charges to arrive at the ex-factory export price.
iii. Dumping margin
18. The normal value and export price have been compared at the ex-factory level, which prima facie establishes that the dumping margin in respect of the product under consideration imported from China PR is positive and above the de minimis level. There is sufficient prima facie evidence that the product under consideration is being dumped into the domestic market of India by exporters from the subject country.
G. Injury and causal link
19. The applicants have alleged that the dumped imports of the subject goods from China PR are causing material injury to the domestic industry and have furnished prima facie evidence in support thereof.
The information furnished by the applicant and the DG Systems transaction-wise import data with the Authority prima facie shows that the subject imports remained at substantial levels throughout the injury period and increased during the period of investigation, both in absolute terms and in relation to the production and demand in India; that the market share of the subject country increased while that of the domestic industry declined; and that imports from all other sources were negligible.
The landed price of the subject imports remained below the selling price of the domestic industry in the period of investigation and undercut its prices. The selling price of the domestic industry declined in every year of the injury period while its cost of sales increased during the last two years, so that its selling price did not recover its cost of sales during the period of investigation. The production and domestic sales of the domestic industry, which had increased until 2024-25, declined during the period of investigation and its inventories increased, while its profits, cash profits and return on capital employed declined over the injury period and turned negative during the period of investigation.
20. The Authority notes that the volume of the subject imports is not prima facie negligible. Having regard to Annexure-II to the Rules, the Authority prima facie considers, for the purpose of initiation, that there is sufficient evidence of material injury to the domestic industry, the adverse effect of the subject imports being manifested through their prices and, during the period of investigation, through their volume and market share as well, and of a causal link between the alleged dumping and such injury.
H. Initiation of anti-dumping investigation
21. On the basis of the duly substantiated written application submitted by the applicants and having reached satisfaction based on the prima facie evidence submitted by the applicants concerning the dumping of the product under consideration originating in or exported from the subject country, the consequential material injury to the domestic industry as a result of the alleged dumping of the product under consideration and the causal link between such injury and the dumped imports, and in accordance with Section 9A of the Act read with Rule 5 of the AD Rules, the Authority, hereby, initiates an anti-dumping investigation to determine the existence, degree, and effect of the dumping with respect to the product under consideration originating in or exported from China PR and to recommend the appropriate amount of anti-dumping duty, which if levied, would be adequate to remove the injury to the domestic industry.
22. The applicants have requested the Authority to issue preliminary findings and to recommend imposition of provisional anti-dumping duty in terms of Rule 13 of the Rules, to recommend retrospective imposition of anti-dumping duty in terms of Rule 20(2)(b) of the Rules read with Section 9A of the Act. The Authority notes that these requests do not fall for determination at the stage of initiation. The same shall be considered, if and to the extent warranted, at the appropriate stage of the investigation, and the interested parties may furnish their comments thereon within the time limit prescribed in this notification.
