(1)2 THE GAZETTE OF INDIA : EXTR AOR DINAR Y [PART I—SEC.1] बाद "विचाराधीन उत्पाद" अथवा "संबद्ध वस्तु" अथवा "पीयूसी" कहा गया है) के आयातों के संबंध में पाटनरोधी जांच शुरू करने के लिए आवेदन दायर किया है।
4 THE GAZETTE OF INDIA : EXTR AOR DINAR Y [PART I—SEC.1]ii.
iii.

B. Like article
8. The applicant has stated that there are no known differences between the subject goods produced by the applicant and those exported from the People's Republic of China. The domestic product and the imported subject goods are comparable in terms of physical and chemical characteristics, functions and uses, pricing, distribution and marketing, and tariff classification; they are technically and commercially substitutable and are used interchangeably by consumers. Thus, for the purpose of initiation of the pre sent investigation, the subject goods produced by the applicant are being treated as 'like article' to the product under consideration imported from the subject countries.
C. Subject country
9. The applicant had alleged dumping from China PR and Hong Kong. However, upon examination of DGCI&S data, no imports of subject goods from Hong Kong were found during the POI. Accordingly, the subject country for the present investigation is China PR.
D. Period of investigation
10. The applicant has proposed the period of investigation as 1 st April 2025 to 31st March 2026, which is a period of 12 months. The Authority has considered the period of investigation as 1 st April 2025 to 31st March 2026. The injury investigation period covers the financial years 2022 -23, 2023-24, 2024-25 and the period of investigation.
E. Domestic industry and standing
11. The application has been filed by Lyfius Pharma Private Limited. The applicant has stated that there are no other producers of the PUC in India and that it is the sole eligible producer of the subject goods in India. The applicant has claimed that previously Penicillin G was manufactured in India, however, due to continuous onslaught of dumped imports, Indian Penicillin G industry was completely shut down. The applicant has commenced production of the like article in FY 2024-25.
12. Apart from the applicant, there is one other producer, namely Virchow Petrochemicals Private Limited ("Virchow"), of subject goods in India. The applicant has claimed that Virchow has imported significant quantities of subject goods in India and accordingly, should not be considered as part of the domestic industry. The Authority, however, for the purpose of initiation has considered Virchow as part of the domestic industry. The Authority further notes that even after inclusion of Virchow within the scope o f the domestic industry, the applicant constitutes major proportion in terms of Rule 2(b) of AD Rules, 1995. The applicant has also stated that it has not imported the subject goods during the POI.
13. Based on information available on record, the Authority is satisfied that the applicant constitutes domestic industry within the meaning of Rule 2(b) of AD Rules, 1995. The application satisfies the requirements of standing in terms of Rule 5(3) of AD Rules, 1995.
F. Basis of alleged dumping
i. Normal value for China PR
14. The applicant has cited and relied upon Article 15(a) of China's Accession Protocol and has claimed that China PR should be treated as a non-market economy and that producers from China PR should be directed to demonstrate that market economy conditions prevail in the industry with regard to the production and sales of the product under consideration. Unless the producers from China PR show that such market economy conditions prevail, their normal value should be determined in accordance with paragraphs 7 a nd 8 of Annexure-I to the AD Rules, 1995.
15. The applicant has submitted that information relating to the cost and price of the PUC in a market economy third country is not available in the public domain. Further, information pertaining to export prices from a third country to other countries is also not available. The Authority notes that paragraph 7 of Annexure I of AD Rules, 1995 permits determination of normal value on any other reasonable basis. The applicant has proposed to compute normal value based on any other reasonable basis i.e., based on the cost of production of the domestic industry and with reasonable addition of selling, general and administrative expenses. Accordingly, for the purposes of present initiation, normal value for China PR has been determined on any other reasonable basis in terms of Para 7 of Annexure-I, i.e., on the basis of domestic industry's cost of production, duly adjusted, with a reasonable addition for selling, general and administrative expenses and profit.
ii. Export price
16. The export price of the product under consideration has been determined by considering the CIF price of the product under consideration as reported DGCI&S import data. Adjustments have been claimed on account of ocean freight, ocean insurance, port expenses, commission, bank charges, credit cost and inland freight to arrive at the ex-factory export price.
iii. Dumping margin
17. The normal value and export price have been compared at the ex -factory level, which prima facie establishes that the dumping margin in respect of the product under consideration imported from China PR is positive and above the de minimis level. There is sufficient prima facie evidence that the product under consideration is being dumped into the domestic market of India by exporters from China PR.
G. Injury and causal link
18. The applicant has claimed that it is an unestablished producer and that dumped imports from China PR are materially retarding the establishment of the domestic industry. The applicant has claimed that it has not been able to achieve production and sales as per its expected performance. Further, capacity utilisation is low in relation to the demand for the PUC in India during the POI. The applicant has claimed that their actual performance during the POI falls short of the expected performance. Further, subject imports from China PR are entering into India below the cost of sales of the domestic industry. The applicant has been forced to reduce its prices to match the10 THE GAZETTE OF INDIA : EXTR AOR DINAR Y [PART I—SEC.1] landed price of dumped imports from the subject countries. Moreover, the applicant is incurring cash losses and has accumulated negative returns during the POI.
19. The Authority notes that the volume of the subject imports is above de minimis, with China PR accounting for virtually the entire imports of the subject goods into India during the period of investigation. Having regard to Annexure II to the AD Rules, 1995, the Authority considers, for the purpose of initiation, that there is suffic ient prima facie evidence of material retardation to the establishment of the domestic industry, the adverse effect of the subject imports being manifested principally through their effect on the volume and price parameters of the domestic industry, and of a causal link between the alleged dumping and such injury.
H. Initiation of anti-dumping investigation
20. On the basis of the duly substantiated written application submitted by the applicant and having reached satisfaction based on the prima facie evidence submitted by the applicant concerning the dumping of the product under consideration originating in or exported from China PR, the consequential material retardation to the establishment of the domestic industry as a result of the alleged dumping of the product under consideration and the causal link between such injury and the dumped imports, and in accordance with Section 9A of the Act read with Rule 5 of the AD Rules 1995, the Authority, hereby, initiates an anti-dumping investigation to determ ine the existence, degree, and effect of the dumping with respect to the product under consideration originating in or exported from China PR and to recommend the appropriate amount of anti-dumping duty, which if levied, would be adequate to remove the injury to the domestic industry.
21. The applicant has requested the Authority to issue preliminary findings and to recommend imposition of provisional anti-dumping duty in terms of Rule 13 of the AD Rules, 1995 The same shall be considered, if and to the extent warranted, at the appropriate stage of the investigation, and the interested parties may furnish their comments thereon within the time limit prescribed in this notification.
