का.आ. 5355(अ).— यतः, के न्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68), जिसे इसके पश्चात "उक्त अधिनियम'' कहा जाए, की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 795 (अ), दिनांक 01 अप्रैल 2008 द्वारा मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 52 (पुराना एनएच 3) के किलोमीटर 84.700 से किलोमीटर 167.500 (खलघाट - मध्य प्रदेश/महाराष्ट्र सीमा खंड) तक के खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसके पश्चात् 'प्राधिकरण' कहा जाए) को सुपुर्द किया है;
और यतः, प्राधिकरण ने उक्त अधिनियम की धारा 14 के प्रावधान के अनुसरण में, मध्य प्रदेश राज्य में निर्माण, प्रचालन और हस्तांतरण (बीओटी) के आधार पर मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 52 (पुराना एनएच 3) के किमी 84.700 - किमी 167.500 (नया चेनेज़ किमी 89.885 से 172.685 तक) (खलघाट - मध्य प्रदेश/महाराष्ट्र सीमा खंड) (जिसे इसके पश्चात उक्त खंड कहा जाए) तक विद्यमान 2 लेन सड़क को 4 लेन दोहरे कै रिजवे में मजबूत और चौड़ा करने सहित सुधार, प्रचालन और अनुरक्षण हेतु मेसर्स एसईडब्ल्यू नवयुग बड़वानी टोलवेज प्राइवेट लिमिटेड, जिसका पंजीकृ त कार्यालय 6-3-871, स्नेहलता, प्रथम तल, ग्रीनलैंड्स रोड, बेगमपेट, हैदराबाद - 500016, भारत में है (जिसे इसके पश्चात 'कं सेसनेयर' कहा जाए) के साथ करार किया था और का.आ. संख्या 243 (अ) दिनांक 16.01.2018 द्वारा संशोधित का.आ.

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 509 (अ), दिनांक 11/03/2011 के अनुसार सीमित रियायत अवधि के साथ कं सेसनेयर द्वारा प्रयोक्ता शुल्क के संग्रह के लिए प्रयोक्ता शुल्क अधिसूचना और प्रणाली जारी की थी, जो आने वाले महीनों में समाप्त होने वाली है।
और यतः, उक्त रियायतग्राही की रियायत अवधि समाप्त होने पर, उक्त खंड पर उपयोगकर्ता शुल्क का संग्रहण प्राधिकरण द्वारा अपने अधीन में ले लिया जाएगा। तदनुसार, यह अधिसूचना रियायतग्राही की रियायत अवधि समाप्ति के पश्चात लागू होगी।
अतः, अब, राष्ट्रीय राजमार्ग शुल्क (दर अवधारण एवं संग्रहण) नियम, 2008 के नियम 3 (जिसे इसके पश्चात "नियम'' कहा जाए) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और का.आ. संख्या 243 (अ) दिनांक 16.01.2018 द्वारा संशोधित दिनांक 11.03.2011 की अधिसूचना का.आ. संख्या 509 (अ) का अधिक्रमण करते हुए कें रीय सरकार एतदद्वारा, मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 52 (पुराना एनएच 3) के खलघाट - मध्य प्रदेश/महाराष्ट्र सीमा खंड के डिज़ाइन किलोमीटर 84.700 से किलोमीटर 167.500 तक (नया चेनेज़ किमी 89.885 से किमी 172.685 तक) के चार या अधिक लेन के उपयोग के लिए नीचे दी गई तालिका (1) के स्तंभ (1) में विर्निर्दष्ट वाहनों के प्रकार पर 69.294 कि.मी. (सारणी 2) की निवल सड़क खंड लंबाई तथा 11.89 कि.मी. (1.189 किलोमीटर की लंबाई वाली) (सारणी 4) समतुल्य संरचना लंबाई (60 मीटर से अधिक लम्बाई वाली) के लिए सारणी 1 के स्तम्भ (2) में विर्निर्दष्ट दरों पर और 10 करोड़ रू या उससे अधिक की लागत वाले 12.317 कि.मी.
(सारणी 3) लंबाई वाले बाईपास के लिए आधार दर के डेढ़ गुना पर शुल्क उद्ग्रहीत करती है एवं प्राधिकरण को विद्यमान रियायत अवधि की समाप्ति के आगामी तारीख से उक्त शुल्क अपने अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से संग्रहीत करने के लिए प्राधिकृ त करती है, अर्थात:-

1. इसके अंतर्गत उद्गृहीत और संग्रहीत शुल्क, ऐसे पथकर प्लाज़ाओं के अंतर्गत विर्निर्दष्ट दूरी हेतु निम्नलिखित पथकर प्लाज़ाओं में देय और संदेय होगी, अर्थात;

3. उपयु र्क्त के अतिरिक्त, निम्नलिखित शुल्क प्लाज़ा (प्लाज़ाओं) पर 60 मीटर से अधिक लंबाई वाली निम्नलिखित अवसंरचनाओं के उपयोग के लिए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके राजमार्ग की समतुल्य लंबाई में अवसंरचनाओं की लंबाई को परिर्वर्तत करके निम्नलिखित शुल्क भी देय और संदेय होगा:

4. गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और शुल्क प्लाज़ा से बीस कि.मी. की दूरी के भीतर निवास करने वाले व्यक्ति के लिए मासिक पास की दर वर्ष 2026-27 के लिए 360/-रूपए (तीन सौ साठ रूपए मात्र) है और उक्त नियमों के प्रावधानों के अनुसार प्रतिवर्ष संशोधन के अध्यधीन है।
5. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्ः

6. शुल्क प्लाजा स्थित होने वाले जिले में पंजीकृ त वाणिज्यिक वाहनों (राष्ट्रीय परमिट के अधीन प्रचालित किए जा रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशते कि ऐसे वाणिज्यिक वाहनों के प्रयोग के लिए कोई र्सर्वस रोड या वैकल्पिक सड़क उपलब्ध न हो।
7. सबंधित श्रेणी के वाहनों के लिए विर्निर्दष्ट अनुज्ञेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेश के लिए, कथित नियमों के नियम 10 के अनुसार अनुप्रयोज्य शुल्क के समतुल्य शुल्क का भुगतान करने के लिए उत्तरदायी होगा।

8. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छू ट-प्राप्त वाहनों की श्रेणी, र्सर्वस रोड, वैकल्पिक सड़क इत्यादि नियमों में विर्निर्दष्ट परिभाषाओं के अनुरूप होंगी।
9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रर्दर्शत किया जाएगा।
10. यांत्रिक वाहनों से शुल्क की वास्तविक राशि उपयु र्क्त तालिका-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर प्रभारित होगी और छू टों की गणना प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रति वर्ष संशोधित किया जाएगा तथा तदनुसार उसे अंग्रेजी और क्षेत्रीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।
11. इस परियोजना की अनुमानित पू ंजीगत लागत 1407.27 करोड़ रुपए है। प्राप्त प्रयोक्ता शुल्क के माध्यम से वसूल की गई पू ंजीगत लागत का प्राधिकरण द्वारा रिकॉर्ड रखा जाएगा।

NOTIFICATION
New Delhi, the 28th September, 2026
S.O. 5355(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O 795 (E), dated the 1st April 2008, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), hereinafter referred to as the said Act, the Central Government has entrusted the stretch from Km 84.700 to Km 167.500 (Khalghat - Madhya Pradesh /Maharashtra Border section) of National Highway No. 52 (Old NH 3) in the State of Madhya Pradesh to the National Highways Authority of India (herein after referred to as the "Authority");
And Whereas, pursuant to the provisions of section 14 of the said Act, the Authority had entered into an agreement with M/s SEW Navayuga Barwani Tollways Pvt. Ltd., having its registered office at 6-3-871, Snehalata, 1st Floor, Greenlands Road, Begumpet, Hyderabad - 500016, India (hereinafter referred to as the Concessionaire) for improvement, operation and maintenance including strengthening and widening of existing 2 lane road to 4 lane dual carriageway from Km 84.700 - Km 167.500 (New Ch. KM 89.885 to 172.685) (Khalghat - Madhya Pradesh /Maharashtra Border section) of the National Highways No. 52 (old NH 3) in the State of Madhya Pradesh (hereinafter referred to as the said section) on Build Operate and Transfer (BOT) basis, and vide S.O. 509 (E), Dated 11/03/2011, amended vide SO no. 243(E) dated 16.01.2018 had issued user fee notification and mechanism for the collection of user fee by the concessionaire with a limited concession period, which is due to be expired in coming months.
And Whereas, upon the expiry of the concession period of the said Concessionaire, the collection of user fee on the said section shall be taken over by the Authority. Accordingly, this notification shall come into force upon the expiry of the concession period of the Concessionaire.
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules") and in suppression to notification S.O. 509 (E), Dated 11.03.2011 and amendment vide SO no. 243(E) dated 16.01.2018, the Central Government hereby levies the fee at the rate specified in column (2) of the Table 1 for net road section length of 69.294 km [Table-2] and for equivalent structure length (having length more than 60m) of 11.89 km (having length of 1.189 km [Table-4]) and at one and one half times the base rate for bypasses having length of 12.317 km [Table-3] costing rupees ten crore or more on the type of vehicles specified in column (1) of the Table 1 below for the use of four or more lane of Khalghat – MP/Maharashtra Border Section of NH – 52 from kilometer 84.700 to kilometer 167.500 (New Ch. Km 89.885 to Km 172.685) of National Highway number 52 (old NH-3) in the6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] State of Madhya Pradesh and authorises the Authority to collect the said fee, with effect from the date following the expiry of the existing concession period, either through its officials or through a contractor, namely:-

3. In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10: -

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs 360/- (Three Hundred and Sixty Only) for the year 2026-27 and is subject to revision every year as per the provisions of the said rules.
5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: -

7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in rule 10 of the said rules.
8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.
9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.

Based on the base rate of fee per kilometre for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.
11. The estimated capital cost of the project is Rupees 1407.27 Crore. The Authority shall maintain a record of the recovery of capital cost through user fee realised.
