GI/2026THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC ] सब्सिडीरोधी/प्रतिसंतुलनकारी शुल्क जांच शुरू करने के लिए आवेदन दायर किया है।

The applicant has stated that there is no concluded or ongoing trade remedy investigation in respect of the product under consideration, and that in the countervailing duty investigation concerning imports of copper pipes and tubes which was concluded vide final finding 04/10/2020-DGTR dated 31st January 2022, the subject goods were excluded from the scope of the product under consideration on account of the absence of domestic production of such goods at that time. The Authority notes that no anti-dumping duty or countervailing duty is in force on the subject goods and that the present application is accordingly an application for initiation of an original investigation in terms of Rule of the Rules.

A. Allegation of subsidization

B. Consultation

In terms of Article 13 of the Agreement on Subsidies and Countervailing Measures (ASCM) pre-initiation consultations were held on 03.09.2026 with Government of Vietnam and 08.09.2025 with Government of Thailand. The comments of the representatives of the Government of Vietnam and Thailand have been taken on record. The Government of China did not avail the opportunity of pre-initiation consultations.

C. Product under consideration

The product under consideration in the present investigation is "Internally Grooved Copper Tubes and Pipes" also referred to as internally grooved tubes or IGT and known in market parlance as microfin tubes. The subject goods are tubes and pipes of copper having a series of grooves or ridges on the inner surface, which increase the heat transfer efficiency of the system in which they are used by increasing the internal surface area of the tube and enhancing the turbulence of the refrigerant flowing through it. The subject goods may be of refined copper or of copper alloys, are hollow products, coiled or not, having a uniform cross-section with only one enclosed void along their whole length and a uniform wall thickness, and may be supplied in any coiled form, including level wound coil, whether in ETS or ETW packaging, and jumbo coil.

The subject goods are produced by carrying out a further grooving operation on plain or smooth copper tubes and pipes. The applicant has stated that the subject goods require specialised machinery, technology and customer qualification, that they are supplied principally to manufacturers of air-conditioners and heat exchangers, and that they are not substitutable with plain copper tubes and pipes, which are used in plumbing, refrigeration and general engineering applications. For the purpose of initiation, plain or smooth copper tubes and pipes do not form part of the product under consideration. The interested parties may furnish their comments on the scope of the product under consideration.

The subject goods are principally used in the condensers of air-conditioners on account of their heat transfer properties, and are also used in air-conditioner evaporators, water heaters, automotive air-conditioners, heat pipe radiators of electronic products, solar equipment and water-cooled screw chilled water units.

The unit of measurement considered in the present investigation for the product under consideration is Metric Tonnes (MT).

The product under consideration is classifiable under tariff items 7411 10 00, 7411 21 00, 7411 22 00 and 7411 29 00 of the First Schedule to the Customs Tariff Act, 1975. The customs classification is indicative only and is not binding on the scope of the present investigation.

The applicant has not proposed a Product Control Number "PCN" methodology All interested parties are advised to furnish their comments on the scope of the PUC and PCN methodology, if required, within 15 days from the date of transmission of the intimationTHE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC ] letters, containing, inter alia, the non-confidential version of the application and the respective questionnaire(s), to the known interested parties and the diplomatic representative(s) of the subject country/countries.

D. Like article

The applicant has stated that there is no known difference between the subject goods produced by it and those exported from the subject countries. The domestic product and the imported subject goods are comparable in terms of physical and chemical characteristics, functions and uses, product specifications, manufacturing process and tariff classification;

they are technically and commercially substitutable and are used interchangeably by consumers. Thus, for the purpose of initiation of the present investigation, the subject goods produced by the applicant are being treated as 'like article' to the product under consideration imported from the subject countries.

E. Domestic industry & standing

The application has been filed by MetTube Copper India Private Limited. The applicant has stated that it was the only producer of the subject goods in India during the period of investigation, that Nissan Copper Limited discontinued production of the subject goods, that Global Copper Private Limited has not commenced production of the subject goods, and that the production of the subject goods by Hindalco Industries Limited and Ram Ratna Wires Limited commenced only after the end of the period of investigation. There is no supporter of the application and no Indian producer has opposed it. The Authority notes that the output of the applicant constitutes the whole of the Indian production of the like article and accordingly a major proportion thereof in terms of Rule 2(b) of the Rules.

The applicant has disclosed that it is not related to any producer/exporter of subject goods in the subject countries, that it is related to producer/exporter of subject goods in Malaysia, that it did not import the subject goods from the subject countries during the injury period including the period of investigation, that it imported the subject goods from Malaysia in 2023-24 and in the period of investigation, such imports being limited in quantity and occasioned by operational constraints in its plant. The applicant has further stated that the material so imported was further processed before sale and that the imports were not occasioned by any price consideration. Based on the material on record, the Authority prima facie considers that there are no grounds for believing or suspecting that the effect of the relationship is such as to cause the applicant to behave differently from non-related producers in terms of the Explanation to Rule 2(b) of the Rules, and that the imports so made do not change the character of the applicant as a producer of the like article. The exception in Rule 2(b) of the Rules is accordingly not attracted.

Based on information available on record, the Authority is prima facie satisfied that the applicant constitutes domestic industry within the meaning of Rule 2(b). The application satisfies the requirements of standing in terms of Rule 6(3).

It has been alleged that the above-mentioned schemes are subsidies since these involve a financial contribution from the governments of the respective subject countries or other regional or local governments of such respective countries, including public bodies and confer a benefit on the recipient (s). These are also alleged to be limited to certain enterprises or groups of enterprises and/or products and/or regions and therefore specific and countervailable. These are also in some cases alleged to be contingent upon the use of domestic over imported goods and/or contingent upon export performance

The producers/exporters are advised to provide information with respect to any other subsidy scheme that may have been availed by them.

The Authority reserves the right to investigate other subsidies, which may be found to exist and availed by the producers and exporters of the subject goods, during the course of investigation.

I. Injury and causal link

The applicant has alleged that the subsidized imports of the subject goods from the subject countries are materially retarding the establishment of the domestic industry in India and has furnished prima facie evidence in support thereof. The effects of the imports from the subject countries have been assessed cumulatively for the purpose of initiation in terms of paragraph (4) of Annexure-I to the Rules. The information furnished by the applicant and the DG Systems transaction-wise import data with the Authority prima facie show that the demand for the subject goods in India was met almost entirely through imports until the applicant commenced production, that the subject imports increased over the injury period and continued to account for the predominant share of the demand in India during the period of investigation, and that the domestic industry, in its first full year of production, was able to secure only a marginal share of that demand. The landed price of the subject imports remained below both the cost of sales and the net sales realisation of the domestic industry in each year in which it operated and undercut its prices. The domestic industry was unable to raise its selling price to the level of its cost of sales, its production of the subject goods remained a small proportion of the capacity installed for the grooving operation, its inventories increased, and its profits, cash profits and return on capital employed were negative in both years of its operation.

The Authority notes that the volume of the imports from each of the subject countries is not prima facie negligible. Having regard to Annexure-I to the Rules, the Authority prima facie considers, for the purpose of initiation, that there is sufficient evidence of material retardation of the establishment of the domestic industry, the adverse effect of the subject[भाग I—खण्ड ] भारत का राजपत्र : असाधारण imports being manifested through their effect on the prices of the domestic industry and on the volumes it has been able to secure, and of a causal link between the alleged subsidized imports and such injury.

J. Initiation of anti-subsidy investigation

On the basis of the duly substantiated written application submitted by the applicant and having reached satisfaction based on the prima facie evidence submitted by the applicant concerning existence of countervailable subsidies on production and export of the subject goods in the subject countries, the consequential material retardation of the establishment of the domestic industry as a result of the alleged subsidized imports and the causal link between such injury and the subsidized imports, and in accordance with Section 9 of the Act read with Rule 6 of the Rules, the Authority, hereby, initiates an anti-subsidy investigation to determine the existence, degree, and effect of the subsidization with respect to the product under consideration originating in or exported from China PR, Thailand and Viet Nam and to recommend the appropriate amount of anti-subsidy duty, which if levied, would be adequate to remove the injury to the domestic industry.

The applicant has requested the Authority to recommend the imposition of provisional anti- subsidy duty in terms of Rule 14 of the Rules, to provide an opportunity of oral hearing and to recommend the imposition of anti-subsidy duty for a period of five years. The Authority notes that these requests do not fall for determination at the stage of initiation. The same shall be considered, if and to the extent warranted, at the appropriate stage of the investigation, and the interested parties may furnish their comments thereon within the time limit prescribed in this notification.
