iii.

The product under consideration is classifiable under tariff item 2905 12 20 of the First Schedule to the Customs Tariff Act, 1975. The customs classification is indicative only and is not binding on the scope of the present investigation.

The applicant has not proposed a Product Control Number "PCN" methodology All interested parties are advised to furnish their comments on the scope of the PUC and the PCN methodology, if required, within 15 days from the date of transmission of the intimation letters, containing, inter alia, the non-confidential version of the application and the respective questionnaire(s), to the known interested parties and the diplomatic representative(s) of the subject country/countries.

B. Like article

The applicant has stated that there is no known difference between the subject goods produced by it and those imported from the subject countries, and that the route of manufacture does not render the products different. The domestic product and the imported subject goods are comparable in terms of physical and chemical characteristics, functions and uses, product specifications, pricing, distribution and marketing, and tariff classification;

they are technically and commercially substitutable and are used interchangeably by consumers. Thus, for the purpose of initiation of the present investigation, the subject goods produced by the applicant are being treated as 'like article' to the product under consideration imported from the subject countries.

C. Domestic industry & standing

The application has been filed by Deepak Fertilisers and Petrochemicals Corporation Limited. The applicant has stated that there is one other producer of the like article in India, namely Deepak Phenolics Limited, which has neither supported nor opposed the application, and that the applicant is not related to any exporter of the subject goods in the subject countries or to any importer of the subject goods in India. The Authority notes that the output of the applicant constitutes a major proportion of the total Indian production of theTHE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC ] like article and exceeds the proportion prescribed under Rule 5(3) of the Rules, and that no Indian producer has expressed opposition to the application.

The applicant has stated that it has not imported the subject goods from the subject countries during the period of investigation.

Based on information available on record, the Authority is satisfied that the applicant constitutes domestic industry within the meaning of Rule 2(b). The application satisfies the requirements of standing in terms of Rule 5(3).

D. Subject countries

The subject countries in the present investigation are the European Union, South Korea, Taiwan and the United States of America.

E. Period of investigation

The applicant has proposed the period of investigation as 1st April 2025 to 31st March 2026, which is a period of 12 months. The Authority has considered the period of investigation as 1st April 2025 to 31st March 2026. The injury investigation period covers the financial years 2022-23, 2023-24, 2024-25 and the period of investigation.

F. Basis of alleged dumping

i. Normal value

The applicant has stated that it made efforts to obtain the domestic selling prices of the like article in the subject countries, but that price lists and commercial invoices for sales in those markets were not reasonably available to it, and has claimed the normal value for each subject country on the basis of the price of imports of the subject goods into that country, adjusted to the ex-factory level.

The Authority notes that Section 9A(1)(c) of the Act specifies the comparable price in the ordinary course of trade for the like article when meant for consumption in the exporting country and, where such price is not available, a comparable representative price of the like article when exported from the exporting country to an appropriate third country or the cost of production in the country of origin with reasonable additions for administrative, selling and general costs and for profits. The Authority further notes, having also examined the sources available to it, that the domestic selling prices in the subject countries are not available on the record, that the trade data available for the purpose of a third-country export price is reported at a level of classification which covers goods other than the product under consideration and may not reliably reflect the price of the like article, and that the cost of production in the countries of origin is not available at this stage. For the purpose of initiation, the normal value in respect of each subject country has accordingly been determined on the facts available, the optimised cost of production of the like article in India having been adopted as the best information available, duly adjusted and with the addition of[भाग I—खण्ड ] भारत का राजपत्र : असाधारण a reasonable profit margin. The basis of the normal value shall be examined in the course of the investigation on the responses of the producers and exporters concerned.

ii. Export price

The export price of the product under consideration has been determined by considering the CIF price of the product under consideration as reported in DGCI&S transaction-wise import data. Appropriate adjustments, as claimed by the applicant, have been considered on account of ocean freight, marine insurance, commission, bank charges, port expenses, inland freight, credit cost and inventory carrying cost to arrive at the ex-factory export price.

iii. Dumping margin

The normal value and export price have been compared at the ex-factory level, which prima facie establishes that the dumping margin in respect of the product under consideration imported from each of the subject countries is positive and above the de minimis level.

There is sufficient prima facie evidence that the product under consideration is being dumped into the domestic market of India by exporters from the subject countries.

G. Injury and causal link

The applicant has alleged that the dumped imports of the subject goods from the subject countries are causing material injury to the domestic industry and has furnished prima facie evidence in support thereof. The effects of the imports from the subject countries have been assessed cumulatively for the purpose of initiation in terms of paragraph (iii) of Annexure-II to the Rules. The information furnished by the applicant and the DGCI&S transaction-wise import data with the Authority prima facie show that the subject imports increased over the injury period and during the period of investigation, both in absolute terms and in relation to the production and demand in India, and that their share in the total imports of the subject goods rose from about one-third in the base year to the predominant share during the period of investigation. The landed price of the subject imports remained below both the selling price and the cost of sales of the domestic industry in each year of the injury period and declined steeply during the period of investigation. The selling price of the domestic industry declined during the period of investigation by substantially more than its cost of sales and fell below its cost of sales, and its profits, cash profits and return on capital employed, which were positive in the two preceding years, turned negative during the period of investigation.

The Authority notes that the volume of the imports from each of the subject countries is not prima facie negligible. Having regard to Annexure-II to the Rules, the Authority prima facie considers, for the purpose of initiation, that there is sufficient evidence of material injury to the domestic industry and of a causal link between the alleged dumping and such injury.

THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC ]

H. Initiation of anti-dumping investigation

On the basis of the duly substantiated written application submitted by the applicant and having reached satisfaction based on the prima facie evidence submitted by the applicant concerning the dumping of the product under consideration originating in or exported from the subject countries, the consequential material injury to the domestic industry as a result of the alleged dumping of the product under consideration and the causal link between such injury and the dumped imports, and in accordance with Section 9A of the Act read with Rule 5 of the AD Rules, the Authority, hereby, initiates an anti-dumping investigation to determine the existence, degree, and effect of the dumping with respect to the product under consideration originating in or exported from the European Union, South Korea, Taiwan and the United States of America and to recommend the appropriate amount of anti-dumping duty, which if levied, would be adequate to remove the injury to the domestic industry.
