E. Domestic Industry and Standing
14. Rule 2(b) defines domestic industry as follows:
"domestic industry" means the domestic producers as a whole engaged in the manufacture of the
like article and any activity connected therewith or those whose collective output of the said article
constitutes a major proportion of the total domestic production of that article except when such

importers thereof in such case the term domestic industry may be construed as referring to the rest
of the producers".
15. The present application is filed by Ceramic Tableware & Kitchenware Manufacturer's Association. Clay Craft India Limited and Ceramic Tableware Private Limited have provided all relevant information for the purpose of the present application comprising more than 25% of total Indian Production. Following producers have supported the present application Umberto Ceramics International Private Limited, Clawiz Ceramicware LLP, Anurag Udhyog, D C Ceramic, Mudrika Ceramics India Pvt Ltd., Eva Ceramics, Krishna Ceracoats Industries (Krista), Sonaki Ceramic and Rughuvar (India) Ltd. The applicants along with supporters comprises more than 50% of total Indian Production.

F. Basis for Likelihood of Continuation or Recurrence of Dumping
Normal Value for China PR
17. The applicant has claimed that China PR should be treated as a non-market economy and the normal value should be determined in terms of Rule- 7 of Annexure I of the AD Rules. The applicant has cited Para 8(2) of Annexure I of the AD Rules and has stated that the Chinese producers should be directed to demonstrate that market economy conditions prevail in the industry producing the subject good in terms of Para 8(3) of Annexure I of the AD Rules. The applicant has claimed that for China PR, normal value should be determined in accordance with Para 7 and 8 of Annexure I of the AD Rules.
18. The applicant has submitted that efforts were made to determine normal value on the basis of price or constructed value in a market economy third country. However, the applicant could not get reliable information regarding the information on price or cost in market economy in a third country. Therefore, the normal value has been constructed based on cost of production of the applicant, duly adjusted for selling, general and administrative expenses, with reasonable profit. The same has been considered for the purpose of initiation of the investigation. There is sufficient evidence claimed by the applicant with regard to Normal value of subject good in China PR.
Export Price
19. The Applicant has determined the export price for the subject country by considering the volume and value of imports as per its market intelligence. However, for the purpose of the determining export price of subject good from subject country, DGCI&S data has been adopted for ascertaining ex-factory export price. Adjustments on account of Ocean freight, Marine insurance, Port expenses, Commission and Bank Charges in the concerned subject country have been made.
Dumping Margin
20. The normal value and the export price have been compared at ex-factory level, which prima facie shows that the dumping margin is above the de-minimis level and is significant with respect to the product under consideration exported from the subject country. Thus, there is prima facie evidence that the product under consideration from the subject country is being dumped in the Indian market by the exporters from the subject country.
G. Likelihood of Continuation or Recurrence of Injury and Casual Link
21. The present investigation being a sunset review, the Authority is required to examine whether the cessation or revocation of the duty in force would lead to a likelihood of continuation or recurrence of dumping and injury.
22. The applicant has provided prima facie evidence establishing that the subject imports have continued to cause injury to the domestic industry. The volume of subject imports has increased over the injury period. The subject imports have continued to undercut the prices of the domestic industry. Further, there is likelihood of continuation or recurrence of dumping and injury as India is a crucial market for Chinese producers as dumping has continued in India. Chinese producers have excess capacities and they are dumping in third country and have lost market due to imposition of anti-dumping duty in another jurisdiction. The Authority notes that there is sufficient prima facie evidence demonstrating likelihood of continuation or recurrence of dumping and consequent injury to the domestic industry in the event of cessation of current anti-dumping duties on imports of the subject goods from the subject country.
H. Initiation of Sunset Review Investigation
23. On the basis of the duly substantiated application filed by the applicant, and having satisfied itself, on the basis of the prima facie evidence substantiating the likelihood of continuation/ recurrence of dumping and consequent injury to the domestic industry in case of cessation of anti-dumping duty on imports of the subject goods from the subject country, and in accordance with Section 9A(5) of the Act, read with Rule 2312 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] (1B) of the Rules, the Authority hereby initiates a sunset review to examine whether the expiry of existing anti-dumping duty on imports of subject goods from the subject country is likely to lead to continuation or recurrence of dumping and injury to the domestic industry.
24. Since, an existing anti-dumping duty concerning imports of Ceramic Tableware and Kitchenware, excluding knives and toilet items is also applicable on Malaysia vide Notification No. 1612022- Customs (ADD) 24th May 2022, any continuation of duty will extend to the imports of subject goods originating in or exported from Malaysia.
I. Procedure
25. The sunset review will cover all aspects of the final findings published vide Notification F.No.14/05/2016-DGAD dated 8th December 2017 , F.No.7/33/2020-DGTR dated 3rd August, 2021 and final findings published vide Notification No. 7/20/2021-DGTR dated 10th March 2022, recommending imposition of anti-dumping duty on imports of subject goods originating in or exported from the subject country.
