सेतु मामला आईडी- AD/OI/050/2026

7558 GI/2026

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 2.

4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]

8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]

A. PRODUCT UNDER CONSIDERATION (PUC)

3. The product under consideration in the present investigation is 'Peroxosulphates', also known as 'Persulphates'. Persulphates are a group of closely related compounds which are produced as Alkali Metal Salts. These include Ammonium Persulphates (APS), Potassium Persulphates (PPS), and Sodium Persulphates (SPS).

4. The chemical formulas of the above-mentioned persulphates are (NH4)2S2O8, K2S2O8, and Na2S2O8, respectively. All three types of Persulphates have the same end-uses as an initiator and oxidizing agent in the textile and chemical industries. All three salts are one and the same product which has a 'white crystalline powder' appearance, is dry and soluble in water, decomposes slowly, and liberates oxygen while absorbing moisture.

5. The unit of measurement considered in the present investigation for the product under consideration is Metric Tons (MT).

6. The product under consideration is classified under Chapter 28 of the Customs Tariff Act, 1975 under subheading 2833 40 00. However, the product is also imported under 2833 29 90. The customs classifications are indicative only, and in no way binding on the scope of the investigation.

7. The applicants have contended that the three types of persulphates covered under the scope of product under consideration vary in terms of cost and price and may be treated as separate PCNs. Accordingly, following product control number (PCN) methodology is proposed:

Type of Persulphate Code
Ammonium Persulphate APS
Potassium Persulphate PPS
Sodium Persulphate SPS

8. The interested parties are advised to furnish their comments/suggestions on the scope of product under consideration and PCN methodology, if any, within 15 days from the date of transmission of the intimation letters, containing, inter alia, the non-confidential version of the application and the respective questionnaire(s), to the known interested parties and the diplomatic representative(s) of the subject country

B. LIKE ARTICLE

9. There is no known difference between the subject goods produced by the domestic industry and the product under consideration imported from the subject country. The subject goods produced by the domestic industry are comparable to the product under consideration imported from the subject country in all terms including, characteristics such as physical & chemical characteristics, manufacturing process & technology, functions & uses, product specifications, pricing, distribution & marketing and tariff classification. Both products are technically and commercially substitutable and the consumers use them interchangeably. Therefore, for the purpose of the present investigation, the subject goods produced by the domestic industry are being treated as "like article" to the subject goods imported from the subject country.

C. SUBJECT COUNTRY

10. The subject country in the present investigation is China PR.

D. PERIOD OF INVESTIGATION (POI)

11. The applicants have proposed the period from 1st April 2025 to 31st March 2026 (12 months) as the period of investigation. The injury investigation period will cover the period 1st April 2022 to 31st March 2023, 1st April 2023 to 31st March 2024, 1st April 2024 to 31st March 2025, and the period of investigation.

E. DOMESTIC INDUSTRY AND STANDING

12. The application has been filed by Calibre Chemicals Private Limited and UI-VR Private Limited. Apart from the applicants, the other known producers of the subject goods in India are Yoyo Chemicals, Aminisha Organics LLP, Gujarat Persalts Private Limited and Ana Industries. The applicants have submitted that Gujarat Persalts Private Limited and Ana Industries have stopped production of the subject goods. Yoyo Chemicals and Aminisha Organics LLP have supported the present application.

13. The applicants have certified that they have not imported the subject goods from the subject country during the period of investigation. The applicants have related entities in the subject country. However, these related entities did not export the subject goods to India during the period of investigation. Further, UI-VR imported negligible volume of imports of the subject goods from its related entity in Germany.

14. It is seen that both the applicants have also purchased certain quantities of the subject goods from the domestic market for resale, including goods imported by traders from the subject country. UI-VR made these purchases to maintain supplies to its existing customers when its manufacturing operations were affected. Calibre Chemicals made such purchases during the period when its production facilities for APS and SPS to meet the requirements of its existing customers and ensure continuity of supply. The Authority notes that these purchases were low in relation to the Indian demand and applicants' own production. In view of the above, the Authority, prima facie, considers that the relationships and domestic purchases do not render the applicants ineligible to constitute the domestic industry.

15. After examination of the application, the Authority notes that the applicants account for major proportion in the total Indian production of the like article during the period of investigation. Accordingly, the applicants prima facie constitute the domestic industry within the meaning of Rule 2(b) of the Anti-Dumping Rules, 1995, and the application satisfies the requirements of Rule 5(3) of the said Rules.

F. BASIS OF ALLEGED DUMPING

a. Normal Value for China PR

16. The applicants have claimed that China PR should be treated as a non-market economy and the normal value should be determined in terms of Rule- 7 of Annexure I of the Rules. The applicants have cited Para 8(2) of Annexure I of the Rules and has stated that the Chinese producers should be directed to demonstrate that market economy conditions prevail in the industry producing the subject goods in terms of Para 8(3) of Annexure I of the Rules. The applicants have claimed that for China PR, normal value should be determined in accordance with Para 7 and 8 of Annexure I of the Rules.

17. The applicants have submitted that attempted to get evidence of the price at which the product is being sold by the producers globally. The applicants have proposed determination of normal value for China PR on the basis of the consumption price in the USA, a market economy third country. For this purpose, the applicants have considered the export prices of APS and SPS by UI-VR Private Limited and PPS by Calibre Chemicals Private Limited to their respective related parties in the USA. The applicants have submitted that these exports were made at profitable prices and have accordingly considered them as the consumption prices in the USA. The interested parties may offer their comments on the normal value methodology proposed by the applicants. The Authority for the purpose of initiation of this investigation has considered normal value for China based on price payable in India considering the cost of production in India after duly adjustment of selling, general and administrative expenses and reasonable profit.

Export price for China

18. The export price of the product under consideration has been determined by considering the CIF price of the product under consideration as reported in DGCIS import data. Adjustments have been claimed for ocean freight, marine insurance, commission, bank charges, port expenses and handling charges.

b. Dumping margin

19. The normal value and the export price have been compared at ex-factory level, which prima facie establishes that the dumping margin with respect to the product under consideration imported from the subject country is not only above the de-minimis level but is significant. Thus, there is prima facie evidence that the product under consideration from the subject country is being dumped in the domestic market of India by the exporters from the subject country.

G. INJURY AND CAUSAL LINK

20. The applicants have provided prima facie evidence with respect to the injury suffered by the applicants due to the dumped imports. The volume of the subject imports from the subject country have increased over the injury period in both absolute as well as relative terms. The increase in imports was coupled with steep decline in import price. Imports are undercutting the prices of the domestic industry and causing price suppression in the domestic market. Despite increase in capacity and sufficient demand in the country, the applicants were unable to achieve a commensurate increase in production and domestic sales due to the adverse impact of the dumped imports. The applicants have further claimed that due to presence of subject goods, their performance has deteriorated in respect of profitability, ROI, cash profits.

H. INITIATION OF ANTI-DUMPING INVESTIGATION

21. On the basis of the duly substantiated written application submitted by the applicants and having reached satisfaction based on the prima facie evidence submitted by the applicants concerning the dumping of the product under consideration originating in or exported from the subject countries country, the consequential injury to the applicants as a result of the alleged dumping of the product under consideration and the causal link between such injury and the dumped imports, and in accordance with Section 9A of the Act read with Rule 5 of the AD Rules, the Authority, hereby, initiates an anti-dumping investigation to determine the existence, degree, and effect of the dumping with respect to the product under consideration originating in or exported from subject country and to recommend the appropriate amount of anti-dumping duty, which if levied, would be adequate to remove the injury to the domestic industry.
