रेलवे अधिनियम 1989 (24 of 1989) की धारा 20A के तहत

का.आ. 5444(अ).— के न्रीय सरकार, ने रेल अधिनियम, 1989 (1989 का 24), (जिसे इसमे इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 20 'ए' की उपधारा (1) के अधीन जारी, भारत के राजपत्र, असाधारण भाग II, खण्ड 3, उपखण्ड (II) तारीख 18 दिसंबर 2025 मे प्रकाशित भारत सरकार के रेल मंत्रालय (रेल्वे बोर्ड) की अधिसूचना संख्या का.

आ. 5878 (अ) तारीख 16 दिसंबर 2025 (जिसे इसमे इसके पश्चात उक्त अधिसूचना कहा गया है, द्वारा उक्त अधिसूचना से उपाबद्ध अनुसूची मे विनिरिष्ट भूमि को, मध्यप्र देश राज्य के बैतूल जिले मे विशेष रेल परियोजना अथार्त,, "नागपुर मंडल के नागपुर - इटारसी और नागपुर - बल्लारशाह अनुभाग के बीच लेवल क्रॉसिंग गेट्स के बदले आरओबी और आरयूबी (07 संख्या) प्रस्तावना निर्माण" परियोजना नाम की विशेष रेल परियोजना के निष्पादन के लिये आवश्यक है, ऐसी भूमि के अर्जन करने के आशय की घोषणा करती है I

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उक्त भूमि के लिये इच्छु क कोई व्यक्ति, राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से तीस दिन के भीतर, उक्त अधिनियम की धारा 20 D की उप-धारा (1) के अधीन उपयु र्क्त प्रयोजन के लिए ऐसी भूमि के अर्जन और उपयोग के संबंध में आक्षेप कर सके गा |

प्रत्येक ऐसा आक्षेप सक्षम प्राधिकारी अर्थात्, अनुविभागीय अधिकारी (राजस्व) बैतूल, तहसील बैतूल, जिला बैतूल को लिखित रुप मे किया और उसके आधार उपर्वर्णत करेगा और सक्षम प्राधिकारी आक्षेपकर्ता को व्यक्तिगत रूप से या विधी वयवसायी के माध्यम से सुनवाई का अवसर प्रदान करेगा और ऐसे आक्षेपों की सुनवाई करने तथा ऐसी जांच करने के पश्चात् यदि कोई हो, जिसे सक्षम प्राधिकारी आवश्यक समझे, आदेश द्वारा या तो आक्षेपों को अनुज्ञात कर सके गा या अननुज्ञात कर सके गा ।

उक्त अधिनियम की धारा 20 D की उप-धारा (2) के अधीन सक्षम प्राधिकारी द्वारा दिया गया आदेश अंतिम होगा;

इस अधिसूचना के अधीन आने वाली भूमि की भूमि योजना और अन्य ब्यौरे उपलब्ध हैं और इछु क व्यक्ति द्वारा सक्षम प्राधिकारी के उक्त उल्लेखित कार्यालय में उनका निरीक्षण किया जा सकता है ।

NOTIFICATION

Mumbai, the 1st October, 2026

(Addendum required in already published E-Gazette Notification No. 268644)

Under clause 20A of the Railways Act, 1989 (24 of 1989)

S.O. 5444(E).— Whereas, by notification of the Government of India, in the Ministry of Railways (Railway Board), number, S.O 5878 (E) Dated 16th December 2025 published in Gazette of India, Extraordinary Part II, Section 3 Sub - section (ii) dated 18th December 2025 (hereinafter referred to as the said notification) and issued under sub- section (1) of section 20(A) of the Railways Act, 1989 (24 of 1989) (herein after referred to as the said Act), the Central Government declares its intention to acquire the land specified in the schedule annexed to the said notification for the purpose of execution, maintenance, management and operation of Special Railway Project, namely, "Proposed construction of ROB & RUB (7 Nos.) in lieu of Level Crossing Gates between Nagpur – Itarsi and Nagpur – Ballarshah section of Nagpur Division" hereby declares its intention to acquired such land in the District of Betul in the State of Madhya Pradesh.

Any person interested in the said land may, within a period of thirty days from the date of publication of this notification in the Official Gazette, raise objection to the acquisition and use of such land for the aforesaid purpose under sub-section(I) of section 20D of the said Act.

Every such objection shall be made to the competent authority, namely, Sub – Divisional officer (Revenue) Betul, Tehsil Betul, District Betul in writing and shall set out the grounds thereof and the competent authority shall give the objector the opportunity of being heard, either in person or by legal practitioner and may, after hearing such objections and after making such further enquiry, if any, as the Competent Authority thinks necessary, by order, either allow or disallow the objections.

Any order made by the Competent Authority under sub-section (2) of section 20 D of the said Act shall be final.

The land plans and other details of the land covered under this notification are available and can be inspected by the interested person at the aforesaid office of the Competent Authority.
