सा.का.नि. 862(अ).— ओषधि नियम, 1945, (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) का और संशोधन के लिए कतिपय नियमों का प्रारूप, ओषधि और प्रसाधन सामग्री अधिनियम, 1940 (1940 का 23) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है।) की धारा 33व की उपधारा (1) अपेक्षानुसार, भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (1) में भारत सरकार के आयुष मंत्रालय की अधिसूचना संख्या सा.का.नि. 115(अ) तारीख 28 जनवरी, 2025 द्वारा प्रकाशित किया गया था, जिसमें उससे प्रभावित होने की संभावना वाले ऐसे सभी व्यक्तियों से, उस तारीख से, जिसको उक्त अधिसूचना वाले राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थी, तीस दिन की अवधि के अवसान से पूर्व आक्षेप और सुझाव मांगे गए थे।

और उक्त राजपत्र की प्रतियां जनता को 04 फरवरी, 2025 को उपलब्ध करा दी गई थीं;

और उक्त प्ररूप नियमों पर जनता से प्राप्त आपत्तियों और सुझावों पर कें द्रीय सरकार द्वारा विचार किया गया है;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अत:, कें द्रीय सरकार, ओषधि और प्रसाधन सामग्री अधिनियम, 1940 (1940 का 23) की धारा 33ढ़ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिनियम की धारा 33ग के अधीन गठित आयुवेदिक, सिद्ध और यूनानी ओषधि तकनीकी सलाहकार बोर्ड के साथ परामर्श के पश्चात्, ओषधि नियम, 1945 में संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-

1. संक्षिप्त नाम, और प्रारंभ. - (1) इन नियमों का संक्षिप्त नाम औषधि (तेरहवां संशोधन) नियम, 2026 है।

(2) ये, राजपत्र में उनके प्रकाशन की तारीख को प्रवृत होंगे।

2. ओषधि नियम 1945 में, अनुसूची ङ(झ) के स्थान पर निम्नलिखित को रखा जाएगा, अर्थात्:-

टिप्प्ण: उपरोक्त सूची में विशेष रूप से उल्लिखित नहीं किए गए किसी भी अन्य घटक में रासायनिक घटक के रूप में आसेनिक या मरक्यूरी शामिल हो तो उसे अनुसूची ङ(1) की औषधि माना जाएगा।

टिप्प्ण – मूल नियम भारत के राजपत्र में अधिसूचना संख्या एफ.28-10/45-एच(1) तारीख 21 दिसंबर, 1945 के माध्यम से प्रकाशित किए गए थे और अधिसूचना संख्या - जीएसआर 713 (अ) तारीख 6 अगस्त, 2026 के माध्यम से अंतिम बार संशोधित किए गए थे।

NOTIFICATION

New Delhi, the 15th September, 2026

G.S.R. 862(E).— Whereas the draft of certain rules further to amend the Drugs Rules, 1945 (hereinafter referred to as the said rules) was published as required under sub-section (1) of section 33N of the Drugs and Cosmetics Act, 1940 (23 of 1940) (hereinafter referred to as the said Act) vide notification of the Government of India in the Ministry of Ayush, number G.S.R. 115(E), dated the 28th January, 2025 in the Gazette of India, Extraordinary, Part-II, Section 3, sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

And whereas, the copies of the said Gazette were made available to the public on the 04th February 2025;

And whereas, objections and suggestions received from the public on the said draft rules have been considered by the Central Government;

Now, therefore, in exercise of the powers conferred by section 33N of the Drugs and Cosmetics Act, 1940 (23 of 1940), the Central Government, after consultation with the Ayurvedic, Siddha and the Unani Drugs Technical Advisory Board constituted under section 33 C of the said Act, hereby makes the following rules further to amend the Drugs Rules, 1945, namely: -

1. Short title, and commencement. - (1) These rules may be called the Drugs (Thirteenth Amendment) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette

2. In the Drug Rules 1945, for SCHEDULE E (I), the following Schedule shall be substituted, namely: -

"SCHEDULE E (I) [See rule 161 (2)] LIST OF POISONOUS SUBSTANCES UNDER AYURVEDA, SIDDHA, SOWA–RIGPA, UNANI SYSTEMS OF MEDICINE

I. Drugs of plant origin -

II. Drugs of animal origin -

III. Drugs of mineral origin -

*Prepared with various processes as mentioned in authoritative books prescribed under the first Schedule of Drugs and

Cosmetics Act, 1940.

Note: Any other ingredients not specifically mentioned in the above list containing arsenic or mercury as a chemical constituent shall be considered to be Schedule E (1) drug.".
