का.आ. 5554(अ).— यत:, कें द्र सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68 ), की धारा 11 के तहत जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या और का.आ. 55 दिनांक (अ), 05 जनवरी, 2026 (अ) द्वारा उत्तर प्रदेश और हरियाणा राज्यों में पूरा एनएच 709ए, अर्थात गढ़मुक्ते श्वर के पास एनएच-9 के जंक्शन से शुरू होकर मेरठ और बुढ़ाना को जोड़ने वाला राजमार्ग जो ताजपुर सिंभालका (शामली ररंग रोड पर) के पास एनएच-709बी में मिलता है और फिर उत्तर प्रदेश राज्य में टपराना (शामली ररंग रोड पर) के पास एनएच -709 एडी के जंक्शन से शुरू होकर करनाल, जींद और मु ंडल से गुज़रता है और हरियाणा राज्य में भिवानी के पास एनएच-709 के जंक्शन पर खत्म होता है; को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसके बाद "प्राधिकरण" कहा जाए) को सुपुर्द किया है;
अतः अब, समय-समय पर संशोधित राष्ट्रीय राजमार्ग शुल्क (दर अवधारण एवं संग्रहण) नियम 2008 के नियम 3 (जिसे इसके बाद "नियम" कहा जाए) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और मौजूदा प्रयोक्ता शुल्क अधिसूचना का.आ. 2046(अ) दिनांक 25.06.2020 अधिक्रमण करते हुए, कें द्र सरकार एतद्द्वारा हरियाणा राज्य में राष्ट्रीय राजमार्ग संख्या 709ए के भिवानी-मु ंधल-जिंद खंड (डिजाइन किलोमीटर 6.875 से 68.857 तक, वतर्मान किलोमीटर 6.875 से 68.857 तक) और जिंद-करनाल खंड (डिजाइन किलोमीटर 68.857 से 154.219 तक, वतर्मान किलोमीटर 68.660 से 153.700 तक) तथा हरियाणा/उत्तर प्रदेश सीमा तक करनाल-मेरठ खंड डिजाइन किलोमीटर 0.000 से 14.445 तक, वतर्मान किलोमीटर 153.700 से 168.145 तक) के उपयोग के लिए नीचे दी गई सारणी 1 के कॉलम (1) में विर्निर्दष्ट वाहनों के प्रकार पर चार या अधिक लेन वाले 34.774

3. गैर वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और शुल्क प्लाजा बीस किलोमीटर तक की दूरी के भीतर निवास करने वाले व्यक्ति के लिए मासिक पास की दर वर्ष 2026-27 के लिए 360.000 रुपये (तीन सौ साठ रुपये मात्र) है और उक्त नियमों के प्रावधानों के अनुसार प्रतिवर्ष संशोधन के लिए अध्यधीन है।
4. राजमार्ग खंड पर एकाधिक यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात:-

5. जिस जिले में शुल्क प्लाजा स्थित है, उस जिले में पंजीकृ त वाणिज्यिक वाहन (राष्ट्रीय परमिट के तहत चलने वाले वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित दर का 50% होगा, बशते ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सेवा सड़क या वैकल्पिक सड़क उपलब्ध न हो।
6. संबंधित श्रेणी के वाहनों के लिए विर्निर्दष्ट अनुज्ञेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेश के लिए उक्त नियमों के नियम 10 में विर्निर्दष्ट शुल्क के समतुल्य शुल्क का भुगतान करने के लिए उत्तरदायी होगा।
7. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छू ट प्राप्त वाहनों की श्रेणी, र्सर्वस रोड, वैकल्पिक सड़क इत्यादि उक्त नियमों में विर्निर्दष्ट परिभाषाओं के अनुरूप होंगी।
8. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रर्दर्शत किया जाएगा।
9. उपयु र्क्त सारणी – 1 में यथा उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किमी. शुल्क के आधार दर के आधार पर यांत्रिक वाहनों से शुल्क की वास्तविक राशि और छू टों की गणना प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रतिवर्ष संशोधित किया जाएगा तथा तदनुसार उसे अँग्रेजी और क्षेत्रीय भाषा के कम से कम एक–एक समाचार पत्र में प्रकाशित किया जाएगा।
10. इस परियोजना की अनुमानित पू ंजीगत लागत 1173.61 करोड़ रुपये है। चू ंकि, भूमि अधिग्रहण, उपयोगिता स्थानांतरण, पेड़ों को काटने, इत्यादि कार्यकलापों को अभी पूरा किया जाना है, इसलिए पू ंजीगत लागत परिवर्तन के अध्यधीन है। प्राप्त प्रयोक्ता शुल्क के माध्यम से वसूल की गई पू ंजीगत लागत का प्राधिकरण द्वारा रिकार्ड रखा जाएगा।

S.O. 5554(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and
Highways S.O. No. 55(E) dated 05.01.2026 issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the entire NH 709A in the State of Uttar Pradesh and Haryana i.e. the highway starting from its junction with NH-9 near Garhmukteswar connecting Meerut, Budhana, merging with NH-709B near Tajpur Simbhalka (on Shamli Ring Road) and again starting from Junction of NH-709AD near Taprana (on Shamli Ring Road) in the state of Uttar Pradesh, Karnal, Jind, Mundal and terminating at its junction with NH-709 near Bhiwani in the state of Haryana to the National Highways Authority of India (hereinafter referred to as the "Authority");
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 as amended from time to time (hereinafter referred to as the "rules") and in supersession of existing user fee notification S.O. 2046(E) dated 25.06.2020, the Central Government hereby levies the fee at the rate specified in column (2) of the Table 1 for net road section length of 34.774 km [Table 2] and for equivalent structure length (having more than 60m length) of 0.73 Km (having total length of 0.073 Km [Table 3]), for four or more lane and at 60% of base rate specified in column (2) of the Table 1 for net road length of 126.048 km [Table 2], and for equivalent length of two lane structure (having more than 60m length) of 8.94 Km (having total length of 0.894 Km, [Table 4]), for two lane with paved shoulders, on the type of vehicle specified in column (1) of Table 1, of Bhiwani-Mundhal-Jind section from Design Km 6.875 to Km 68.857 (Existing Km. 6.875 to Km 68.857) and Jind-Karnal section from design Km. 68.857 to Km. 154.219 (existing Km.68.660 to Km.153.700) and Karnal-Meerut upto Haryana/UP Border from Design Km. 0.000 to Km. 14.445 (Existing Km. 153.700 to Km. 168.145) of National Highway No. 709A in the State of Haryana and authorises the Authority to collect, either through its officials or through a contractor, the said fee, namely:-

2. In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalisation factor of 10: -

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs. 360/- (Rupees Three Hundred Sixty only) for the year 2026-2027 and is subject to revision every year as per the provisions of the said rules.
4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: -

5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in rule 10 of the said rules.
7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.
8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.
9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
10. The estimated capital cost of the project is Rupees 1173.61 crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. The Authority shall maintain a record of the recovery of capital cost through user fee realised.
