2. उपरोक्त नियुक्ति, केन्द्रीय प्रशानिक न्यायाधिकरण मुख्य खण्डपीठ, नई विल्ली में लम्बित थी अमृत लाल और अन्य द्वारा दाखिल आवेदन पत्र एम ० ए० ० 640/1998 तथा श्री सी ० डी० भाटिया और अन्य द्वारा दान्जिन आवेदन पत्र ओ ० ए ० सं ० 911/97 के निर्णय तथा वर्ष 1984 से 1986 के अवर सचिव की चयनसूची की ममीक्षा के निर्गय के अधीन होगी । 3. उपरोक्त उन्नत पद पर की गई नियुक्ति से उक्त अधिकार। को अवर सचिव के रूप में नियमित निगक्ति अथवा ग्रेड में वरिष्ठता के लिए कोई दावा प्राप्त नहीं होगा ।
4. उच्चतर ग्रेड में वास्तविक रिक्ति के लिए पदोन्नति मिलने पर उपरोक्त जधिकारी द्वारा उन्नन पद को खाली कर देने , रोत्रानिवृत्त होने , त्यागपत्र दे देने आदि की स्थिति में वह उन्नत पद स्वनः ही जाने मूल स्तर पर आ जाएगा ।
