संकल्प
संख्या 26/3/2000- सिं. सं. जबकि उत्तर प्रदेश , हरियाणा , राजस्थान, हिमाचल प्रदेश राज्यों और राष्ट्रीय राजधानी क्षेत्र दिल्ली द्वारा 12.5.1994 को हस्ताक्षरित समझौता ज्ञापन के समग्र ढांचे के भीतर ओखला तक यमुना नदी के उपलब्ध प्रवाहों के आबंटन के नियमन के लिए जल संसाधन मंत्रालय के दिनांक 11.3.1995 के संकल्प संख्या 10 ( 66 )/ 74 सिं.सं. के तहत ऊपरी यमुना नदी बोर्ड का गठन किया गया था ।
2. और जबकि अब उत्तर प्रदेश पुनर्गठन अधिनियम, 2000 के अनुसार 9 नवम्बर, 2000 से उत्तरांचल राज्य का सृजन हुआ है ।
3. और जबकि उत्तर प्रदेश पुनर्गठन अधिनियम , 2000 की धारा 79 (1 ) में यह व्यवस्था है कि नियत दिन को ऊपरी यमुना नदी और ओखला तक इसकी सहायक नदियों के सम्बन्ध में जल संसाधन परियोजनाओं के बारे में उत्तर प्रदेश के विद्यमान राज्य के कर्त्तव्य और देयताएं केन्द्र सरकार के साथ परामर्श करने के बाद उक्त राज्यों द्वारा किए गए समझौते द्वारा नियत किये जाने वाले अनुपात में तथा किये जाने वाले समायोजनों के अध्याधीन उत्तरवर्ती राज्यों के भी कर्त्तव्य और देयताएं होगी अथवा यदि नियत दिन के दो वर्ष के भीतर ऐसा कोई समझौता नहीं किया जाता है तो केन्द्रसरकार आदेश द्वारा परियोजना के उद्देश्यों को ध्यान में रखते हुए एक वर्ष के भीतर निर्धारित कर सकती है ।
4. और जबकि उत्तर प्रदेश पुनर्गठन अधिनियम, 2000 की धारा 84 ( 1 ) में यह व्यवस्था है कि दिनांक 12.5.1994 के समझौता ज्ञापन के तहत उत्तर प्रदेश के विद्यमान राज्य को नियत दिन से पहले आबंटित ओखला तक यमुना नदी के उपयोज्य जल संसाधन दो वर्ष की अवधि के भीतर आपसी समझौते द्वारा उत्तरवर्ती राज्यों के बीच आगे आबंटित किए आयेंगे, अथवा केन्द्रीय सरकार आदेश द्वारा एक वर्ष की और अवधि के भीतर उत्तरवर्ती राज्यों के बीच ऐसे जल संसाधनों का आबंटन निर्धारित करेगी । 5. और जबकि उत्तर प्रदेश पुनगर्ठन अधिनियम, 2000 की धारा 84 (2 ) में व्यवस्थाहै कि नियत दिन को उत्तरांचल राज्य को दिनांक 12.5.1994 के समझौता ज्ञापन के क्रियान्वयन के लिए ऊपरी यमुना नदी बोर्ड के सदस्य के रूप में शामिल किया जायेगा ।
6. अतः, अब , जल संसाधन मंत्रालय के दिनांक 11.3.95 के संकल्प संख्या 10(66 )/74-सिं.सं. के पैरा 6 और पैरा 7 में आंशिक संशोधन करते हुए नियत दिन अर्थात 9.11.2000 से उत्तरांचल राज्य द्वारा नामित अधिकारी, जो मुख्य अभियन्ता के स्तर से कम न हो, भी ऊपरी यमुना नदी बोर्ड, जिसका मुख्यालय राष्ट्रीय राजधानी क्षेत्र में होगा, के सदस्य होंगे और ऊपरी यमुना पुनरीक्षा समिति में उत्तरांचल के मुख्य मंत्री ( राष्ट्रपति शासन की दशा में राज्यपाल ) भी शामिल होंगे ।
आदेश
आदेश दिया जाता है कि इस संकल्प की एक- एक प्रति उत्तर प्रदेश , उत्तरांचल, हरियाणा, राजस्थान , हिमाचल प्रदेश राज्यों और राष्ट्रीय राजधानी क्षेत्र दिल्ली , राष्ट्रपति के निजी और सैन्य सचिवों, प्रधानमंत्री कार्यालय , भारत के नियंत्रक और महालेखा परीक्षक, योजना आयोग तथा केन्द्रसरकार के सभी मंत्रालयों/विभागों की सूचना के लिए भेज दी जाये । यह भी आदेश दिया जाता है कि यह संकल्प जन साधारण की जानकारी के लिए भारत के राजपत्र में प्रकाशित किया जाये और सम्बन्धित राज्य सरकारों से अनुरोध किया जाये कि इसे राज्य के राजपत्र में प्रकाशित किया जाये ।

RESOLUTION
No. 26/3/2000 -II .--Whereas the Upper Yamuna River Board was constituted vide Ministry of Water Resources Resolution No. 10(66) /74-11 dated 11-3-1995 for regulating the allocation of available flows of river Yamuna upto Okhla within the overall framework of Memorandum of Understanding signed by the States of Uttar Pradesh , Haryana , Rajasthan, Himachal Pradesh and NCT of Delhi on 12-5-1994.
2.And whereas the State of Uttaranchal hass since been created with effect from 9th November , 2000 in accordance with the Uttar Pradesh Reorganisation Act, 2000.
3. And whereas Section 79 ( 1 ) of the Uttar Pradesh Reorganizatioin Act , 2000 provides that the rights and liabilities of the existing State of Uttar Pradesh in respect of water resource projects in relation to Upper Yamuna River and its tributaries upto Okhla shall on the appointed day,be the rights and liabilities of the successor States in such proportion as may be fixed and subject to such adjustments asmaybe made; by agreement entered into by the said States after consultation with the Central Government , or , if no such agreement is entered into within two years of the appointed

आदेश
आदेश दिया जाता है कि यह संकल्प संबंधित सरकार और वित्त, गृह तथा कृषि मंत्रालयों और योजना आयोग को सूचनार्थ भेज दिया जाए।
यह भी आदेश दिया जाता है कि यह संकल्प भारत के राजपत्र मैं प्रकाशित किया जाये और आम जनता की सूचना के लिए संबंधित राज्य सरकार के राजपत्र में इसे प्रकाशित करने का अनुरोध किया जाए ।

4. And whereas Section 84 ( 1 ) of the Uttar Pradesh Reorganisation Act , 2000 provides that the utilisable water resources of the Yamuna River upto Okhla , as allocated , beforethe appointed day , to the existing State of Uttar Pradesh under the Memorandum of Understanding dated 12-5-1994 shall be further allocated between the successor States by mutual agreement within a period of two years , failing which , the Central Government shall , by order, determine the allocation of such water resource between the successor States within a further period of one year .
5. And whereas Section 84( 2) of the Uttar Pradesh Reorganisation Act , 2000 provides that the State of Uttaranchal shall, on the appointed day ,be inducted as a Member of the Upper Yamuna River Board constituted for implernentation of the Memorandum of Understanding dated 12-5-1994.
6. Now , therefore, in partial modification of para 6 and para 7 of the Ministry of Water Resources Resolution No. 10(66) /74-1.T . dated 11-3-95 a nominee of the state of Uttaranchal , not below the rank of Chief Engineer , will also be a member of the Upper Yamuna River Board , having its Head Quarters in the National Capital Region , and the Upper Yamuna Review Committee shall also comprise of Chief Minister ofUttaranchal (Governor in case of President's Rule) , with effect from the appointed day i.e. 9-11-2000 .
ORDER
Ordered that this Resolution be communicated to the State Governments of Uttar Pradesh , Uttaranchal, Haryana, Rajasthan , Himachal Pradesh and National Capital Territory ofDelhi , the Private and Military Secretaries to the President , PrimeMinister's Office, the Comptroller and Auditor General of India , the Planning Commission and all Ministries / Departments of Central Government for information .
