3. यतः मामले से संबद्ध सारवान तथ्यों और दस्तावेजों के श्रधार पर उक्त याचिका पर विचार करने के उपरान्त निर्वाचन श्रयोग ने, लोक प्रतिनिधित्व , अधिनियम , 1951 की धारा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए 3 अप्रैल , 2001 के अपने आदेश द्वारा उक्त अधिनियम की धारा 10क के अधीन उक्त डा. सी. नटेशन पर अध्यारोपित निग्र्हता शेप श्रवधि के लिए हटा दी है; और
4. अतः अब, आयोग के तारीख 7-9-2000 के आदेश सं . 76/त.ना. लो.स./ 99 की क्रम संख्या 3 में प्रकट हो रहा डा. नटेशन का नाम 3-4-2001 से प्रभावी उक्त आदेश मे हटा दिया ममझा जाएगा ।
आ.अ. 61 .--यतः डा. सी. नटेशन ,1-47 बी, पेरियाकुलम, गांधीपुरम ( उत्तर ) , सेंडामंगलम, नामाक्कल जिला, जिन्होंने तमिलनाडु से लोक सभा के लिए 1999 में हुए साधारण निर्वाचन में 15- रसिपुरम संसदीय निर्वाचन क्षेत्र में निर्वाचन लड़ा था, लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43) की धारा 10क के अधीन अपने निर्वाचन व्ययों का कोई भी लेखा दाखिल करने के कारण आयोग के तारीख 7-9-2000 के आदेश सं . 76/त. ना. लो. म./99 द्वारा निहित घोषित किया गया था और

आदेश से, 2. यतः उक्त डा. सी . नटेशन ने भारत निर्वाचन आयोग के ममक्ष उक्त निरर्हता को हटाने के लिए कारणों को बताने हुए एक अभ्यावेदन प्रस्तुन किया है; और

4. अतः अब, उक्त श्री सी. आर . भाष्करन का नाम , जो तारीख 7-8-1998 के आयोग के आदेश सं . 76/त.ना. वि . स./ 97 की क्रम संख्या पर प्रकट है , 14-4-2001 मे प्रभावी उक्त आदेश से हटा दिया गया समझा जायेगा ।

बाबू राम, मचिव O.N. 61. Whereas , Dr. C. Natesan , 1-47B Periyakulam Gandhipuram ( North ) , Sendamanglam, Namakkal District , who contested the General Elec- tion to Tamil Nadu Lok Sabha held in 1999 from 15- Rasipuram Parliamentary Constituency was disquali- fied under Section 10A of the Representation of the People Act , 1951 ( 43 of 1951 ) vide its order No. 76 TN -HP 99 , dated 7-9-2000 for not at all lodging the accounts of his election expenses ; and
ORDER New Delhi , the 14th April , 2001 2. Whereas , the said Dr. C. Natesan has submitted a petition before the Election Commission of India for the removal of the said disqualification giving reasons thereunder ; and
the Shri C. R. Bhaskaran , O.N. 62. Whereas , 35-Kailasanathar Koil Street , Big Natham Chengal- pattu , who contested the General Election to Tamil Nadu Legislative Assembly held in 1996 from 22 -Chengalpattu Assembly Constituency was disqualified under Section 10A of the Representation of the People Act, 1951 ( 43 of 1951 ) vide its order No. 76 / TN - LA 97 , dated 7-8-1998 for failure lodge an account of his election expenses as required by the said Act and the rules and orders thereunder ; and to made
of 3. Whereas , after considering the said petition and on the basis of the facts and documents relating to the case , the Election Commission, in exercise the powers conferred by Section 11 of the Represen- tation of the People Act, 1951 has vide its order dated 3rd April, 2001 removed the disqualification imposed under Section 10A of the said Act , on the said Dr. C. Natesan for the remaining period.
2. Whereas , the said Shur C. R. Bhaskaran has submitted a petition before the Election Commission of India for the removal of the said disqualification giving reasons thereunder ; and
4. Now, therefore , the name of the said Dr. C. Natesan appearing at Sl. No. 3 in Commission's under No. 76 TN- HP 99 , dated 7-9-2000 shall be deemed to have been omitted from the said order with effects from 3-4-2001 .

Whereas , after considering the said petition and on the basis of the facts and documents relating to the case, the Election Commission , in exercise of the powers conferred by Section 11 of the Representation of the People Act, 1951 has vide its order dated 14th April, 2001 removed the disqualification im- posed under Section 10A of the said Act , on the said Shri C. R. Bhaskaran ,

आ.श्र. 62.-यतः श्री सी. आर . भाष्करन, 35 -कैलास- नातर कोइल स्ट्रीट , बिग नाथम चेंगलपट्टू को जिन्होंने 1996 में हुए तमिलनाडुविधान सभा के साधारण निर्वाचन में 22-चेंगल- पट्ट विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ा था , श्रायोग के आदेश सं . 76/ त.मा. वि. म./ 97, तारीख 7-8-1998 द्वारा लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43) की धारा 10 क के अधीन उक्त अधिनियम तथा उसके अधी बनाए गए नियमों के अधीन यथा-अपेक्षित अपने निर्वाचन व्ययों का लेखा वाखिल करने में अमफल रहने के कारण निर- हित किया गया था; और
आदेश नई दिल्ली, 17 अप्रैल, 2001 2. यतः इस प्रकार श्री सी . आर. भाष्करन ने उसके कारण देते हुए उक्त निरर्हता को हटाने के लिए भारत निर्वाचन आयोग के सम्मुन्द्र एक अर्जी दाखिल की है; और
श्रा.अ. 63.-यतः सन् 1996 में 122-अन्धीपुर ( अ.जा. ) विधान सभा निर्वाचन क्षेत्र से तमिलनाडु विधान सभा के लिए साधारण निर्वाचन में निर्वाचन लड़ने वाली श्रीमती थी . शिवकामी, 208-थिरूपुर रोड , धर्मपुरी को लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 10क के अधीन तारीख 7-4-1999 के आयोग के आदेश संख्या 76/ त. ना. / 97 द्वारां उक्त अधिनियम तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहने के कारण विहित किया गया था;
3. यतः उक्त अर्जी पर विचार करने के बाद और मामले से संबंधित तथ्यों ओर दस्तावेजों पर विचार करने के बाद निर्वाचन आयोग ने लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त श्री सी. आर . भाष्करन पर उक्त अधिनियम की धारा 10क के अधीन अध्यारोपित निरर्हता को हटा दिया । [भाग II-- 3 ( iii ) ]
2. और यतः उक्त श्रीमती बी. शिवकामी ने भारत निर्वाचन आयोग के सम्मुखं एक अर्जी दी है जिसमें उक्त निरर्हता को हटाने के लिए कारण दिए गए हैं , और
3. यंतः उक्त अर्जी पर विचार करने के पश्चात् और इस मामले से संबंधित तथ्यों और दस्तावेजों के आधार पर निर्वाचन आयोग ने लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 11 का प्रयोग करते हुए तारीख 15 अप्रैल , 2001 के अपने आदेश द्वारा उक्त अधिनियम की धारा 10 क के अधीन उक्त श्रीमती वी . शिवकामी पर अध्यारोपित निरर्हता को हटा दिया है । 4. अतः अब आयोग के आदेश सं . 76/ त.ना. वि . स ./ 97 तारीख 7-4-1999 में क्रम संख्या 58 पर प्रकट उक्त श्रीमती वी . शिवकामी का नाम निरर्हता की शेप अवधि के लिए तारीख 15-4-2001 से प्रभावी उक्त श्रादेश से हटा दिया गया समझा जाएगा ।

General Election to the Tamil Nadu Legislative Assembly held in 1996 from 122 -Anthiyur ( SC) Assembly Constitutency was disqualified under Sec- tion 10A of the Representation of the People Act, 1951 (43 of 1951 ) vide its order No. 76 -TN- LA/ 97 , dated 7-4-1999 for failure to lodge an account her elcction expenses as required by the said and the rules and orders made thereunder ; and of Act 2. Whereas , the said Smt . V. Sivakami has sub- mitted a petition before the Election Commission of India for the removal of the said disqualification giv- ing reasons thereunder ; and
to 3. Whereas, after considering the said petition and on the basis of the facts and documents relating the case, the Election Commission, in exercise of the powers conferred by Section 11 of the Representa- tion of the People Act , 1951 has vide its order dated 15th April , 2001 removed the disqualification im- posed under Section 10A of the said Act , on the said Smt . V. Sivakami ,
4. Now, therefore , the name of the said Smt . V. Sivakami , appearingat Sl . No. 58 in Commission's order No. 76 / TN - LA 97 , dated 7-4-1999 shall be deemed to have been omitted from the said order with effect from 15-4-2001 for the remaining period of disqualification.
