No. 3934 - In exercise of the powers conferred by section 19 of the Bonking Companies

(Acquisition and Transfer of Undertakings) Act, 1980 (40 of 1980), the Board of Oriental

Bank of Commerce in consultation with the Reserve Bank of India and with the previous

sanction of the Central Government, hereby makes the following Regulations to amend

the Oriental Bank of Commerce Officer Employees' (Conduct) Regulations, 1982

namely >

1. (j) Those Regulations may be called the Oriental Bank of Commerce Officer

Employees' (Conduct) Amendment Regulations, 2001

(ii) They shall come into force on the date of their publication in the "Official

Gazette".

2. In the Oriental Bank of Commerce Officer Employees' (Conduct) Regulations,

1982, in regulation 20, for sub-regulation (4), the following shall be substituted,

namely: -

"(4) Every Offloer employee shall report to the competent authority every

transaction concerning movable property owned or held by him either in his name

or in the name of a member of his family if the value of such a property exceeds

Ra,25,OOOA.

Provided that the previous sanction of the competent authority shall be obtained if any such transaction is -

(a) with a person having official dealing with the Officer Employee; or

(b) otherwise than through a regular or reputed dealer".

with sub-section (2) of section 12 of the Banking Companies (Acquisition and Transfer of

Undertakings) Act, 1980 (40 of 1980) the Board of Directors of Andhra Bank, in consultation

with the Reserve Bank of India and with the previous sanction of the Central Government,

hereby makes the following regulations, namely :-

1. (I) These Regulations may be called the Andhra Bank Officer Employees' (Discipline

& Appeal) (Amendment) Regulations, 2001

(2) They shall come into force on the date of their publication In the Official

Gazette.

2. In the Andhra Bank Officer Employees' (Discipline & Appeal) Regulations, 1981,

(hereinafter referred to as the said regulation), In regulation 6, -

(i) for sub-regulation (3), the following sub-regulation shall be substituted, namely:-

(3) Where it Is proposed to hold an enquiry, the Disciplinary Authority shall, frame definite and distinct charges on the basis of the allegations against the Officer Employee and the Articles of charge, together with the statement of the allegations, list of documents relied on along with copy of such documents and list of witnesses along with copy of statement of witnesses, if any, on which they are based, shall be communicated In writing to the Officer Employee, who shall be required to submit, within such time as may be specified by the Disciplinary Authority (not exceeding 15 days), or wttNn such extended time as may be grunted by "*ie said authority, a written statement of his defence:

Provided that wherever it is not possible to furnish the copies of documents,

Disciplinary Authority shall allow the officer employee inspection of such documents

within a time specified In this b .half;

(li) for sub-rtgulatlon (10), the following shall be substituted, namely:-

(10) The Inquiring authority while ad|ourning the case as in Sub regulation (9), shall

also record by an order that the officer employee may for the purpose of preparing

defence -

(I) complete Inspection of the documents as in the list furnished to him

immediately and in any case not exceeding 5 days from the date of such order if he

had not done so earlier as provided for In the proviso to sub regulation (3);

(II) submit a list of documents and witnesses, that he wants for the inquiry;

(Hi) give notice within 10 days of the order or within such further time not

exceeding 10 days as the Inquiring Authority may allow for the discovery or

production of the documents referred to in item (ii).

Note: The relevancy of the documents and the examination of the witnesses referred to in

item (II) shall be given by the officer employee concerned

New Delhi, dated June 21, 2001 No.N-12/13/2/98-P&Di In exercise of the powers conferred by Section 97 of the Employees' State Insurance Act, 1948 (34 of 1948), the Employees* State Insurance Corporation hereby makes the following regulations to amend the

Employees' State Insurance (General) Regulations,' 1950, the same have been previously published in the Gazette of India, P a r t - I l l, Section 4 dated April 3, 1999 inviting objections/ suggestions, if any,, as required by Sutx-Section (l) of the said section, namely**

1. (i) These Regulations may be call*d the Employees' State Insurance (General) (Amendment,) Regulations, 2001, (ii) These will come into force w.e.f. the date of pv>•"• .cation in the official Gazette.

2. Sub-Regulation (2) of Regulation 103-A shall be substituted by the following*-

"(2) the person in respect of whom contributions have been paid in a contribution period for not less than seventy eight days in the said contribution period shall be entitled to medical benefit t i ll the end of the corresponding benefit cteriod."

"Provided that in case of a person who becomes an employee within the meaning of the Act, for the f i r st time, and for whom a shorter contribution period of less than 156 d^ys is available, he shall be entitled to medical benefit t i ll the end of th© corresponding benefit period if the contributions in respect of him were payable for not loss than half the number of days available for' working in such contribution period.¹¹'ART III—SEC 4] THE GAZETTE OF INDIA, JULY 28, 2001 (SRAVANA 6, 1921) 4T35 MProvided further 1:hat where a person suffering from

ANNEXURE

The following new paragraph is inserted after the existing paragraph in clause no. 16 of Reinvestment Plan, 1966.

Notwithstanding anything contained as aforesaid, the Trust may offer the following options to the members/unitholders under the Plan: -

1. cash payout of income distribution or

2. continuation in the Reinvestment Plan, 1966 and reinvestment of the amount of income distribution declared at the first sale price declared under Unit Scheme 1964 after the period of suspension of sales under Unit Scheme 1964, if any, ends or

3. allow the amount of income distribution to be invested in the units of any other scheme/plan of the Trust that may be open for sale at that time at the sale price applicable on the date of payment of income distribution or on any such other date as may be decided by the Trust or

4. any such other option/s as may be deemed appropriate by the Trust from time to time.

In the event of offering aforesaid options to the members/unitholders of Reinvestment Plan, 1966, and the members/unitholders of Reinvestment Plan, 1966 not responding within a daie to be fixed by the Trust for such purpose, the Trust will be at liberty to make cash payout of such income distribution to the concerned member/unitholder within a reasonable period or decide any such other alternative as may be considered appropriate by the Trust from time to time.
