नेशनल स्टाक एक्सचेंज आफ इंडिया लिमिटेड एनज्यभ ०३० (फ्यूचर्स और आप्णन खण्ड) व्यापारिक निनियन में विहित उपबंधों को यहां जीवे दी गई सीना तक संशोधित किया जाता है:--
1. परिभाषा अध्याय निम्नानुसार संशोधित किया गया है:
(क) 'प्रयोग' ओर "यूरोपीय शैली विकल्प संविदा" शब्दों की परिभाषा निम्नलिखित परिभायाओं से प्रतिस्थापित की जाती है :
1. अयोग
प्रयोग का अर्थ विकल्ण आप्शन) धारक द्वारा एक्सचेंज के नियमों, उप-नियमों ओर विनियमों के अनुसार और उनके अधीन अधिकार का आहवान करना है । 2. यूरोपीय शैली विकल्प संविदा
यूरोपीय शैली विकल्प संविदा का अर्थ एक ऐसी विकल्प संविदा है, जिनका प्रयोग समापन समय को अथवा उसके पूर्व समानं दिवस को किया जा सकता है । (ख) निम्नलिखित शब्द की परिभाषा उपयुक्त स्थान पर परिभाषा अध्याय में प्रविष्ट की जाती है :

निगमित कार्रवाई का अर्थ स्टाक विखंडन, स्टाक संमेकन, विलयन/ विलयन समापन की स्कीम, स्पिन-आफ, समामेलन, पूंजी पुनः संरचना ओर समान प्रवृत्तिकै ऐसे अन्य विशेषाधिकार अथवा घटनाएं , जिन्हें संगत प्राधिकारी द्वारा समय-समय पर निर्दिष्ट किया जाए, के परिणामस्वरूप लाभांश, बोनस, राइट्स शेयर, शेयरों का निर्गम है और उसमें ये शामिल हैं । 2. अध्याय- III में मोजूद विनियम 3.1.5 के बाद निम्नलिखित विनियम प्रविष्ट किया जाता है :
अन्तर्निहित प्रतिभूतिगों के जारीकर्ता द्वारा घोषित निगमित कार्रवाई कै अनुत्ररण में संगत प्राधिकारी एक्सचेंज के नियमों, उप-नियमों अंर विनियमों के अनुसार खुली हित और/ अथवा संविदा विशिष्ट में संशोधन सहित जैसा आवश्यक समझा जाए ऐसा संशोधन कर सकता है ।
3. अध्याय- III के मौजूदा विनियम 3.1 के बाद निम्नलिखित 'विनियम प्रविष्ट किया जाता हैं :

समनुदेशन का अर्थ विकल्प ( आप्शन ) संविदा का आवंटन है, जिसका प्रयोग उस कार्यविधि, जिसे समय- समय पर संगत प्राधिकारी द्वारा निदिष्ट किया जाए, के अनुसार दायित्व की पृति के लिए समान विकल्प संविदा में समान सौदा मूल्य पर किसी लघु स्थिति (पोजिशन ) के लिए किया जाता है । 2. प्रयोग
प्रयोग का अर्थ क्लिरिंग कारपोरेशन के नियमों, उप- नियमों और विनियमों के अनुसार और उनके अधीन विकल्प (ऑप्शन ) धारक द्वारा अधिकार का आह्वान करना है । 3. समापन समय
समापन सभय विकल्प संविदा के समापन दिन को कारोबार घंटों अथवा ऐसे अन्य समय, जिसे संगत प्राधिकारी द्वारा समय-समय पर निर्दिष्ट किया जाए, का समापन है । इस परिप्रेक्ष्य में कारोबार घटों में विकल्प संविदा के प्रयोग करने के प्रयोजनार्थ व्यापारिक घंटे के समापन के बाद किसी निर्दिष्ट एक्सचेंज द्वारा निर्दिष्ट समय शामिल होगा । 236

4. यूरोपीय विकलः सर्वदा
निपटान के लिए क्लियरिंग का रपोरेशन से उस प्रीमियम मूल्य को प्राप्त करने के हकदार है , जिभ पर विकल्प संविदा बेचीं गई थी ।
यूरोपीय गैली विकन्न संविदा का अर्थ एक विकल्प संविदा है, जिनका पतंग समापन नमन को अथवा उसके पूर्व सनापन दिन को किया है ।
5. फ्यूचर्म जैली प्रीभिन्न निपटान:
(क) प्रीमियम निपटान का तरीका दैनिक प्रीसियम निपटान दायित्व नकद में अथवा ऐसे अन्य रूप में जिसे संगत प्राधिकारी द्वारा निर्दिष्ट किया जाए, अदा किया जाएगा ।
(ख) प्रीमियम निपटान की शैली प्रीमियम निपटान की फ्यूचर्स शैली प्रीमियम निपटान काअर्थ फ्यूचर्स संविदाओं के लिए संगत प्राधिकारी गरा ययानिदिष्ट निपटान प्रणाली के आधार पर विकल्प सरितः का प्रीमियम निपटान है और इसमें संगत प्राधिकारी द्वार समय- समय पर निर्दिष्ट विनियमों के अनुसार दीर्घ और लघु विकल्प स्थिति (पोजिशन ) पर प्रारंभिक मार्जिन और बाजार निपटान को अंकन शामिल है ।
(ब ) निम्नलिखित शब्दों की परिभाषा को परिभाषा अध्याय में उपयुकत स्थानों में प्रविष्ट किया जाता है :
गैली प्रीमियम शैली अथवा फ्यूचर्स शैली अथवा संगत प्राधिकारी द्वारा समय-समय पर निर्दिष्ट की गई ऐसी अन्य शैली हो सकती है । क्लिरिंग कारपोरेशन उन सभी विकल्प संविदाओं, जिन्हें स्वीकार किया जाएगा और निपटाया जाएगा, के लिए प्रीमियम निपटान की शैत्री निर्दिष्ट करेगा । क्लिरिंग कारपोरेशन समय- समय पर प्रीमियम निपटान की एक अथवा अधिक शैली के लिए प्रीमियम निपटान की विधि निर्दिष्ट करेगा ।
1. निगमित कार्रवाई:
निगमित कार्रवाई का अर्थ स्टाक विभाजन, स्टाक समेकन, विलयन/ लयन हटाने की स्कीम, स्पिनऑफ, समा- मेलन, पूंजी पुनः पंञ्चना और संगत प्राधिकारी द्वारा समय- समय पर निर्दिष्य ममान प्रकृति के ऐसे विशेषाधिकार अथवा घटनाओं के पनिामस्वरूप लाभांश , वोनस , राइट शेयर, शेयरों, का निगंग है ।
2. प्रयोग निपटान कीमत
(ग) प्रीयिभम निपटान कीविधि संगत प्राधिकारी समय- समय पर प्रीमियम निपटान की निदिष्ट शैली के अनुसार प्रीमियम निपटान की विधि-निदिष्ट करेगा ।क्लिरिंग कारपोरेशन संबंधित क्लिरिंग सदस्योंद्वारा प्रीमियम निपटान की विधि के अनुसार स्वीकार सभी विकल्प संविदाओं के लिए देय अथवा प्राप्तव्य प्रीमियम निपटान राशि का हिसाव प्रत्येक व्यापारिक दिन की समाप्ति पर अथवा ऐसे अन्य समय, जिसे संगत प्राधिकारी द्वारा समय-समय पर निदिष्ट किया जाए, लगाएगा और उसे क्लिय- रिंग सदस्यों को सूचित करेगा । तदनुसार, ऐसे क्लिरिंग सदस्य प्रीमियम निपटान के लिए क्लिरिंग का रपोरेशन को ऐसी प्रीमियम निपटान राशि का भुगतान करेंगे अथवा उनसे प्राप्त करेंगे । प्रयोग निपजा के संबंध में प्रयोग निपटान कीमत प्रयोग के दिन को अन्तनिधि। प्रतिभूति का बंद मूल्य अथवा ऐसा अन्य मूल्य है जिसका गंथ संगत प्राधिकारी द्वारा समय-ममय पर किया जाए ।
3. प्रयोग निपटान मूल्य
(घ) प्रीमियम निपटान का समय संगत प्राधिकारी समय- समय पर प्रीमियम निपटान होने का दिन और समय निर्दिष्ट करेगा ।
5क . 2. प्रयोग
प्रयोग निपटान के संबंध में प्रयोग निपटान मूल्य का अर्थ निपटान के प्रयोजनार्थ विकल्प संविदा के व्यापार की प्रत्येक इकाई के लिए प्रयोग निपटान कीमत और सौदा कीमत के बीच का अंतर है ।
(क) प्रयोग की किस्म
4. अन्तनिन्ति खण्ड
किसी विकल्प संविदा के लिए प्रयोग की किस्म स्वैच्छिक अथवा स्त्रचालित अथवा अन्य किसी किस्म की हो सकती है , जिसे मंगत प्राधिकारो समय-समय पर निर्दिष्ट करे । अन्तनिहित खण्ड उल निदिष्ट एक्सचेंज के खंड का संदर्भ देता है, जहां संगत प्राधिकारी अन्तनिहित प्रतिभूति में लेन-देन स्वीकार कर सथता है ।
1. स्वैच्छिक प्रयोग
( II) अध्याय 5क को निम्नलिखित नए अध्याय 5क मे प्रतिस्थापित किया जाता है :
5क विकल्प संविदाओं का निपटान
स्वैच्छिक प्रयोग नियमों, उप-नियमों और विनियमों के अधीन किमीक्लिरिंग सदस्य द्वारा अपनी इच्छागक्ति पर विकल्प का प्रयोग है ।
5. क. 1. विकल्प संचित के लिए दैनिक प्रीमियम निपटान
2. स्वचालित प्रयोग
स्वचालित प्रयोग सभी राशि में सौदा मूल्य विकल्प संविदाओं का प्रयोग है , जिन्हें स्वतः ही अप्रत्यादेय रूप से नियमों , उप- नियमों और विनियमों के अधीन समापन तारीख को प्रयोग किया माना जाता है ।
प्रीमियम देय स्थिति (पोजिशन) वाले फ्यूचर्स और आप्शन क्लिरिंग सदस्य निपटान के लिए क्लियरिंग कारपोरेशन को वह प्रीमियम मूल्य, जिस पर विकल्प संविदा खरीदी गई थी, का भुगतान करने के लिए उत्तरदायी हैं । प्रीमियम प्राप्तव्य स्थिति ( पोजिशन ) महिन फ्यूचर्स और आप्शन क्लियरिंग सदस्य भाण- IV]

पूर्वोक्त के होते हुए भी, अगर कोई क्लिरिंग सदस्य राशि में सौदा मूल्य विकल्प संविदा का प्रयोग नहीं करना चाहता तो बिनियम 5क.2 (ग) के अनुसार उपयुक्त अनुदेश देगा ऐसे क्लिरिंग सदस्य का उत्तरदायित्व होगा ।
राशि में सौदा मूल्य के अतिरिक्त सौदा मूल्य पर विकल्प संविदा का प्रयोग संगत प्राधिकारी के विवेक पर और उन आवश्यकताओं, जिन्हें संगत प्राधिकारी द्वारा समय -समय पर निर्दिष्ट किया जाए, के अधीन होगा ।
(ख) प्रयोग कार्यतंत्र
प्रयोग कार्यतंत्र अंतस्म अथवा अंतिम अथका ऐसा अन्य कार्यतंत्र हो सकता है , जिसे संगत प्राधिकारी समय-समय पर निदिष्ट करे ।
1.. अंतरिम प्रयोग
अंतरिम प्रयोग समापन दिन अर्थवा ऐसे अन्य दिन और/ अथवा समय, जिसे संगत प्राधिकारी द्वारा समय- समय पर निंदिष्ट किया जाए, के पूर्व किसी भी समय किसी विकल्प संविदा का प्रयोग है । अंतरिम प्रयोग स्वैच्छिक है । ऐसी संविदा का निपटान प्रयोग निपटान 5क 4. 1 के लिए संगत प्राधिकारी द्वारा निर्दिष्ट प्रावधानों के अनुसार होगा ।
2. अ.तिम प्रयोग
अंतिम प्रयोग समापन । दन का समापन समय का अथवा उसके पूर्व अथवा ऐसे अन्य दिन और/अथवा समय , जिसे संगत प्राधिकारी द्वारा समय-समय पर निर्दिष्ट किया जाए, किसी विकल्प संविदा का प्रयोग है । अंतिम प्रयोग स्वचालित अथवा स्वैच्छिक हो सकता है ।
ऐसी संविदाओं का निपटान 5क 4.1 में प्रयोग निपटान के लिए संर्गत प्राधिकारी द्वारा निर्दिष्ट प्रावधानों के अनुसार किया जाएगा ।
(ग) प्रयोग कार्य विधिः
किसीभी क्लिरिंग सदस्य द्वारा विकल्प संविदा के प्रयोग केलिए कार्यविधि यहां इसके बाद यथानिर्दिष्ट अथवा ऐसी अन्य कार्यविधि, जिसे संगत प्राधिकारी द्वारा समय-समय पर निर्दिष्ट किया जाए; होगी ।
1. विलरिंग कारपोरेशन को प्रयोग की नोटिस संगत प्राधिकारी समय -समय पर निम्नलिखित के सहित विकल्प संविदा के प्रयोग से संबंधित प्रावधान निर्दिष्ट कर सकता है :
(क) सदस्यों की किस्म , जो प्रयोग कर सकते हैं । (ख) प्रयोग की नोटिस देने के लिए सुविधा/प्रणाली । (ग) दिनजब प्रयोग की नोटिस प्रस्तुत की जा सकती है । (घ) विकल्प संविदा का न्यूनतम लॉट आकार, जिसका प्रयोग किया जा सकता है ।
(ड) समयाविधि, जिसके भीतर प्रयोग की नोटिस प्रस्तुत की जा सकती है ।
237 (च) विकल्प संविदा की अधिकतम संबंद, जिनका प्रयोग किमी एक दिन प्रयवा अववि के भीतर किसी सदस्य अथवा बाजार के लिए किया जा सकता है । (छ) सौदा मूल्य (अर्थात रति में और अयवा राशि पर और/ अथवा राशि से बाहर) , जिगर विशल्प मंविदा का प्रयोग जिसका बहा ।
(ज) एभी अन्य गर्ने जिये यह मही नरत ।
प्रयोग के लिए नोटिस प्रयोग की रोटिन देने के दिन को व्यापारिक घंटे की समाप्ति अथवा ऐसे अन्य दिन , जिसे संगत प्राधिकारी द्वारा समय - बय पर रिपर हिली विकल्प संविदा में दीर्व स्थिति (पोजिशन ) ५र मानी जाएगी । कोई भीक्लिरिंग सदस्य नियगों, उप- दिमों और विनि- यमों के अधीन यथाप्रदत्त को छोड़कर इस प्रकार प्रस्तुत किसी भी प्रयोग नोटिस को रद्द अथवा संशोधित नहीं करे ।
2. क्लियरिंग कारखोरेशन द्वारा प्रथेा नोटि प्वीकार करना प्रयोग नोटिस , जिसे 5क. 2 ( ग) 1 में श्राः हणित प्रावधानों के अनुसार दिया गया हैं, पर संगतश्राहारी स्वीकृति के लिए विचार किया जा सकता है ।
संगत प्राधिकारी द्वारा प्रान्न ऐसी प्ररोग नोन को उस दिन, अथवा ऐसे अन्य दिन अथवा मनथ, जेने संग नराधिकारी द्वारा समय-समय पर निदिष्ट किया जाए, जब प्रयोग टिम दी गई है, को व्यापारिक घंटे की समाप्ति पर कार्यवाह करने के बाद मान्य अथवा अमान्य घोषित किया जाएगा । भी मान्य प्रयोग नोटिस संगत प्राधिकारी द्वारा स्वीव १२ को १ ९गी और अमान्य प्रयोग नोटिसें संगत प्राधिकारी ग्रास स्वतः अस्वीकृत हो जाएंगी ।
पूर्ववर्ती के होते हुए भी संगत प्राधिकारी बाजार के हित में किसी प्रयोग नोटिस को अमान्य घोषित कर सकता है जहां :
2.1 संगठा जिसने प्रयोग के लिए नोटिस दी है, के पास उस संविदा में उस समय जब ऐसी नोटिस पर संगत प्राधिकारी द्वारा कार्यवाही की जाती है, कोई खुनी दीर्घ स्थिति ( पोजिशन) नहीं है ।
2.2 अन्य कोई कारग
3. प्रयोग नोटिस का प्रतिसंहरण
जबतक संगत प्राधिकारी द्वारा प्रन्यथा अनुमति नहीं दी आए सभी मान्य प्रयोग नोटिसें प्रति संहरणीय होंगी ।
4. प्रयोग पर प्रतिबंध
संगत प्राधिकारी को किसी भी विकल्प संविदा में प्रयोग पर ऐसा प्रतिबंध अधिरोपित करने का प्राधिकार होगा , जिसे वह विकल्प संविदा अथवा अन्तर्निहित प्रतिभूतियों में उचित और क्रम- बद्ध बाजार बनाए रखने के हित में आवश्यक साझे अथवा अन्यथा जनहित में अथवा निवेशकों के संरक्षग अथवा अन्य किसी कारण , जिसे संगत प्राधिकारी नहीं समझे , के लिए उचित समझे । ऐसे प्रति- 238
बंध के उल्लघन में कोई भी प्रयोग स्वतः अमान्य हो जाएगा और प्रभावी नहीं होगा ।
5क्र . 3 समनुदेशन
(क) समनुदेशन विधियां
समनुदेशन विधियां समानुपातिक अथवा यादृच्छिक हो सकती है अथवा ऐसी अन्य विधियां हो सकती हैं, जिने संगत प्राधिकारी द्वारा समय - समय पर निर्दिष्ट किया जाए ।
1. समानुपातिक समनुदेशन
समानुपातिक समनुदेशन संगत विकल्प संविदः के लिए यथा- निर्दिष्ट बाजार लॉट में समानुपातिक रूप से प्रयुक्त विकल्प संविदा का संगत प्राधिकारी द्वारा समय - समय पर निर्दिष्ट कार्य- विधि के अनुसार समान श्रृंखला सहित विकल्प संविदा में एक अथवा एक से अधिक लघु स्थिति ( पोजिशन) को आवंटन है । 2. यादृच्छिक समनुदेशन
यादृच्छिक समनुदेशन संगत प्राधिकारी द्वारा समय-समय पर यथानिर्दिष्ट कार्यविधि के अनुसार संगत विकल्प संविदा के लिए यथानिदिष्ट बाजार लॉट में यादृच्छिक रूप में प्रयुक्त विकल्प संविदा का समान श्रृंखला सहित विकल्प संविदा में एक अथवा एक से अधिक लघु स्थिति ( पोजिशन ) को आवंटन है ।.
(ख) समनुदेशन कार्य विधि
संगत प्राधिकारी समनुदेशन कब किया जाए उनके दिन और अथवा समय तहित समनुदेशन कार्यविधि निर्दिष्ट कर सकता है । क्लिरिंग कारपोरेशन द्वारा मान्य के रूप में स्वीकृत प्रयोग नो- टिसें गमनुदेशन कार्यविधि के अनुमार दायित्वों की पूर्ति के लिए समान शृंखला वाली विकल्प संविदा में लघु स्थितियों (पोजिशन) के लिए क्लिरिंग सदस्यों के ग्राहकों अथवा व्यापारिक सदस्यों अथवा व्यापारिक सदस्यों के ग्राहकों को समनुदेशित की जाएंगी । ऐसी लघु स्थितियां (पोजिशन ) जिन्हें प्रयुक्त विकल्प संविदायें समनुदेशित की जाती हैं को निपटान के प्रयोजनार्थ ममनुदेशित विकल्प संविदाएं कहा जाएगा । समनुदेशित सदस्य विकल्प संविदा के लिए निर्दिष्ट प्रयोग निपटान कार्यविधि और नियमों, उप-नियमों और विनियमों के अनुसारं अपने दायित्व की पूर्ति करने का उत्तरदायी होगा ।
5क .4 प्रयोग निपटान
प्रयोग निपटान अंतरिम अथवा अंतिम हो सकता है । संगत प्रांधिकारी समय-समय पर अंतरिम प्रयोग निपटान और अंतिम प्रयोग निपटान के लिए कार्यविधि, तरीका , विधि, दिन, समय आदि निर्दिष्ट कर सकता है ।
5क.4.1 प्रयोग निपटान
संगत प्राधिकारी समय -समय पर प्रयोग की किस्म और निपटान का कार्यतंत्र निर्दिष्ट कर सकता है ।
5क . 4.1.1 निपटान का तरीका निपटान का तरीका या तो नकद निपटान अथवा अन्तर्निहित खंड में दायित्व के सृजन

अथवा ऐसे अन्य तरीकै , जिसे संगत गराधिकारी द्वारा समय-समय पर निर्दिष्ट किया जाए, द्वारा हो सकता है । अन्तर्निहित खंड में दायित्व के सृजन द्वारा निपटांन या तो नकदी आधारित अथवा सुपुर्दगी आधारित हो सकता है ।
5. क 4.1.2 निपटान की विधि :
4.1.2.1 नकद निपटान
4.1.2.1.1 प्रयुक्त विकल्प संविदा ओर लघु स्थिति (पोजिशन) , जिसे ऐसी प्रयुक्त विकला संविदा समनुदेशित की गई है, का निपटान प्रयोग निपटान मूल्य अथवा ऐसे अन्य मूल्य, जिसे संगत प्राधिकारीद्वारा समय-साथ पर निर्दिष्ट किया जाए, पर किया जाएगा ।
4.1.2.1.2क्लिरिंग सदस्य , जिसे विकल्प संविदा समनुदेशित की गई है , क्लिरिंग क। रपोरेशन को नियमों, उप- नियमों और विनियमों के अधीन विकल्प संविदा की प्रत्येक यूनिट के लिए प्रयोग निपटान मूल्य अदा करने का उत्तरदायी अथवा उससे उसे प्राप्त करने , जैसा भी मामला हो, का हकदार होगा । 4.1.2.1.3 क्लिरिंग सदस्ः, जिसने विकल्प संविदा का प्रयोग किया है, नियमों, उप- नियमों और विनियमों के अधीन विकल संविदा की प्रत्येक यूनिट के लिएक्लिरिंग कारपोरेशन को प्रयोग निपटान मूल्य अदा करने का उत्तरदायी होगा अथवा उसे प्राप्त करने का हकदार होगा ।
4.1.2.2 अनिहित प्रतिमूति और अन्तनिहित खंड में दायित्व के सूजन द्वारा निपटान क्लिरिंग कारपोरेशन अपने विवेक पर दोनों क्लिरिंग सदस्यों, जिन्होंने विकल्प अविदा का प्रयोग किया है ओर जिन्हें एसी प्रयुक्त विकल्प संविदः सननुदेशित की गईहै , के संबंध में संगत अन्तनिहिर खंड में अन्र्तानहित प्रति- भूति में दायित्व सृजित करने का हकदार होगा ।
विकल्प संविदा, जिसका प्रयोग किया गया है और लबु स्थिति (पोजिशन) जिसे ऐसी प्रयुक्त विकल्प संविदा समनुदेशिन की गई है, का निपटान विकल्प संविदा के सौदा मूल्य पर विक्रन्य संविदा द्वारा सूचित संगत अन्तनिहित खंड में अन्तनिहित प्रतिभूति की यूनिटों की समतुल्य संख्या में दायित्व सृजित करने की विधि अथवा ऐसी अन्य विधि, जिसे संगत प्राधिक। री द्वारा समय - समय पर निर्दिष्ट किया जाए, द्वारा किया जाएगा ।
क. सुपुर्दगी आधारित :
( 1 ) किसी प्रयुक्त विकल्प संविदा द्वारा सूचिन अन्तनिहित प्रतिभूति की यूनिटों की समतुल्य संख्या में दायित्व का सृजन विकल्प किस्म और शृंखला के अनुसार सौदा मूल्य पर क्लिरिंग कारपोरशन के संगत अन्तनिहित खंः में प्रयोग के दिन को अथवा उसके बाद किया जाएगा । सगत प्राधिकारी समय- समय पर वैध प्रयुक्त विकल्प संविदाओं वैः लिए अन्तर्निहित प्रतिभूति मेंदायित्व के सृजन का दिन और संमय निर्दिष्ट कर सकता है । भाग- IV ]
(2 ) समनुदेशिन विकल्प संविदा द्वारा सूचित अन्निहित प्रतिभूति के यूनिटों की समतुल्य संख्या में दायित्व का सूजन क्लिरिंग कारपोरशन के संगत अन्र्तानहित खंड में प्रयोग के दिन अयव। उसकै बाद सौदा मूल्य पर विकल्प किस्म और श्रृं जला के अनुसार किया जाएगा । संगत प्राधिकारी वैध ममनुदेशित विकल्प सविदाओं के लिए अन्तनिहित प्रतिभूति में दायित्वों के सृजन के लिए समय-समय पर दिन और समय निदिष्ट कर सकता है ।
(3) क्लिरिंग सदस्य, जिसने विकल्प संविदा का प्रयोग किया है अथवा विकल्प संविदा समनुदेशित की गई है, जैसा भी मामला हो , इस प्रकार सृजित सुपुर्दगी अथवा भुगतान दायित्व, जैसा भी मामला हो, क्लियरिंग कारपोरशन के पूरा करने का उतर- दायी होगा । ऐसे दायित्व की पूर्ति पर वह क्लियरिंग कारपोरेशन के अन्र्तानहित खंड के नियमों, उप - नियमों और विनियमों के अधीन और उनके अनुसार क्लिरिंग कारपोरेशन से निधियां अथवा अन्तनिहित प्रतिभूतियां, जैसा भी मामला हो, प्राप्त करने का हकदार होगा ।
(4) किसी विकल्प संविदा के संबंध में दायित्व क्लिरिंग कारपोरेशन के संगत अन्र्तानहित खंड में संगत अन्र्तानहित प्रति- भूति में दायित्व के सृजन पर स्वतः फ्यूचर्स और आप्शन खंड के नियमों, उप- नियमों और विनियमों के अनुसार निपटाया गया माना जाएगा तथापि बशर्ते कि अगर कोई क्लिरिंग सदस्य अन्तर्निहित खंड में इस प्रकार सृजित अपना दायित्व पुरा नहीं कर पाता तो नियमों, उप-नियमों और विनियमों के अनुसार ऐसे दायित्वों को पूरा करने के लिए फ्यूचर्स और आप्शन खंड की निपटान निधि का उपयोग किया जा सकता है ।
(5 ) किसी विकल्प संविदा के प्रयोग और समनुदेशन के अनुसरण मेंक्लिरिंग का रपोरेशन के संगत अन्तनिहित खंड में सृजित दायित्व क्लिरिंग कारपोरशन के ऐसे अन्तर्निहित खंड की नियमों, उप- नियमों और विनियमों के अनुसार निपटाया जाएगा । :
(ख) नकदी आधारित

( 4) विकल्प संविदा के प्रयोग और समनुदेशन के अनुसरण में क्लिरिंग कारपोरेशन के संगत अन्निहित खंड में क्लिर्या रग सदस्य की ओर से सृजित दायित्व क्लिरिंग कारपोरेशन के ऐसे अन्तनिहित खंड के नियमों, उप- नियमों और विनियमों के अनुसार निपटाया जाएगा ।
( 5) किसी विकल्प संविदा के संबंध में दायित्व क्लिरिंग कारपोरेशन के संगत अन्तर्निहित खंड में संगत अन्तनिहित प्रति- भूति में दायित्वों के सृजन पर स्वतः फ्यूचर्स औरऑप्शन खंड के नियमों, उप -नियमों और विनियमों के अनुसार निपटाया गया माना जाएगा । तथापि बशर्ते कि अगर कोई क्लिरिंग एदस्य अन्तनिहित खंड में इस प्रकार सृजित अपना दायित्व पूरा नहीं कर पाता तो नियमों, उप- नियमों और विनियमों के अनुसार ऐसे दायित्वों को पूरा करने के लिए फ्यूचर्स और ऑप्शन खंड की निपटान निधि का उपयोग किया जा सकता है । 5क. 4.1.3 निपटान का दिन और समय
संगत प्राधिकारी समय- समय पर उस दिन और समय , जब निपटान किया जाएगा, को निर्दिष्ट कर सकता है ।
5क .5 अन्तर्निहित प्रतिभूति में निगमित कार्रवाई के कारण विकल्प संविदा में स्थिति ( पोजीशन ) का समायोजन संगत प्राधिकारी समय -समय पर अन्तनिहित प्रतिभूति में निगमित कार्रवाई से उत्पन्न हुए अथवा उसके प्रासंगिक किसी खुली स्थिति ( पोजिशन ) में असमायोजन सहित स- नायोजन, किसी अथवा सभी विकल्प संविदा को समाप्त करने और/अथवा संगत विकल्प संविदाओं के लिए निपटान विधियों और कार्यविधियों के संबंध में उपबंध निदिष्ट कर सकता है ।
समायोजन-
समायोजन का अर्थ नियमों, उप- नियमों ओर विनियमों के अनुसार अन्तनिहित प्रतिभूति में निगमित कार्रवाई से उत्पन्न होने वाली अथवा उसके प्रासंगिक संगत विकल संविदा में खुली स्थिति (पोजिशन ) और अथवा संविदा विशिष्टि में संशोधन है । 5क . 6 क्लिरिंग प्रपत्त्र
(1) प्रयुक्त विकल्प संविदा और समनदेशित विकल्प संविदा का निपटान विकल्प संविदा द्वारा सूचित संगत अन्तनिहित खंड में दायित्व सृजित करने की विधिद्वारा प्रयोग के दिन अथवा उसके बाद किया जाएगा । संगत प्राधिकारी समय -समय पर वैध प्रयुक्त विकलन संविदाओं के लिए अन्तनिहित प्रतिभूति में दायित्व के सृजन के लिए दिन और समय निर्दिष्ट कर सकता है । ( 2) क्लिरिंग सदस्य, जिसे विकल्प संविदा समनुदेशित की गई है, उप-नियमों और विनियमों के अधीन विकल्प संविदा कीप्रत्येक यूनिट, जैसा भी मामला हो, के लिए क्लिर्यारंग कारपो- रेशन को प्रयोग निपटान मूल्य अदा करने का उत्तरदायी अथवा उससे प्राप्त करने का हकदार होगा ।
(3) क्लिरिंग सदस्य, जिसने विकल्प संविदा का प्रयोग किया है , नियमों, उप - नियमों और विनियमों के अधीन विकल्प मंविदा की प्रत्येक यूनिट, जैसा भी मामला हो, के लिए क्लिरिंग कारभारेगन को प्रयोग निपटान मूल्य अदा करने का उत्तरदायी अथवा उससे प्राप्त करने का हकदार होगा ।

सभी क्लिरिंग प्रपत्त्र संगत विनियम में अथवा उसके अतिरिक्त अथवा उसके संशोधन अथवा प्रतिस्थापन महित ऐसे अन्य प्रपत्त अथवा प्रपत्रों, जिसे संगत प्राधिकारी समय-समय पर निर्धारित करें, यथानिदिष्ट होंगे ।
5क . 7 निपटान दायित्व विवरण
क्लियरिंग कारपोरेशन क्लियरिंग सदस्यों और व्यापारिक सदस्योंको उन्हें प्रीमियम निपटान तैयार करने , विकल्प संविदाओं के विभिन्न किस्मों में लेन-देन से संबंधित अन्य निपटान दायित्व विवरण तैयार करने योग्य बनाने के लिए संगत आंकड़े डाउनलोड करना सुविधाजनक बनाएगा । 240
5क 8 भुगतान का तरीका
सभी फ्यूचर्स और ऑप्शन क्लियरिंग पदस्यों के पास नोमो दिष्ट भुगतान दिन को उनके निधि दायित्व की सीमा तक उनके क्लिरिंग खाते में निधियों का स्पष्ट शेष होगा । तथापि, बशर्ते कि संगत प्राधिकारी किनी अथवा सभी फ्यूचर्स और आप्पन क्लिरिंग सदस्यों के लिए निधियों के भुगतान का भिन्न-भिन्न तरीका निर्दिष्ट कर सकता है ।
5क . 9 निधियों की प्राप्ति
क्लिरिंग बैंक उन फ्यूचर्स और ऑप्शन क्लिरिंग सदस्यों, जिन्हेंक्लिरिंग कापोरेशन ने अनुदेशानुसार निधियां प्राप्त करना है, को क्लिरिंग खाते में जमा करेगा । किसी फ्यूचर्स और ऑप्शन क्लिरिंग सदस्य को देय सभी निधियां, सामान्यतया उसके बाते में जमा की जाएंगी जब तक ( क ) फ्यूचर्स और ऑप्शन क्लिरिंग सदस्य क्लिरिंग का रपोरेशन को निष्पादित नहीं करता अथवा (ख ) इनका मंगत प्राधिकारी द्वारा अन्यथा आदेश दिया जाता है । दायित्व तथापि बशर्ते कि संगत प्राधिकारी सभी अथवा किसी फ्यूचर्स और ऑप्शन क्लिरिंग सदस्यों के लिए निधियां जमा करने का विभिन्न तरीका निदिष्ट कर सकता है ।
(III ) विनियमों का मौजूदा विनियम 3. 12 निम्नलिखित विनियम से प्रतिस्थापित किया जाता है:
3.12 खुली स्थिति (पोजिशन)
कसी व्युत्पन्न संविदा की खरीद अथवा विक्री के लिए सभी संविदाएं खुली और प्रभावी रहेंगी तथा फ्यूचर्स और ऑप्शन क्लिरिंग सदस्यों और उनके संघटकों पर तब तक बाध्यकारी रहेंगी जब तक तक संविदा प्रतिसंतुलित करके अथवा ऐसी अन्य विधि, जिसे संगत प्रांधिकारी द्वारा समय -समय पर निदिष्ट किया 'जाए , परिसमाप्त नहीं की जाती; तथापि बशर्ते. कि सभी खुली स्थिति ( पोजिशन ) समापन दिवस के नाद मौजूद नहीं रहेंगी । ( IV) अध्याय 5 को छोड़कर, "फ्यूचर्स संविदा ", जहां भी इसका उल्लेख आता है, को उपरोक्त संशोधनों के परिणाम- स्वरूप " व्युत्पन्न संविदा " द्वारा प्रतिस्थापित किया जाता है । (V) यहां इसमें प्रयुक्त ' नियम, उप- नियम ओर विनियम' शब्द जब तक स्पष्टतया अन्यथा वर्णन नही किया जाएक्लिरिंग कारपोरेशन के फ्यूचर्स और ऑप्शन खंड के नियमों, उप-नियम विनियमों के संबंध में है और उनका अर्थ समय-समय पर लागू क्लिरिंग कारपोरेशन के फ्यूचर्स और आप्शन खंड के नियम , उप-नियम और विनियम होगा ।
(VI ) उपरोक्त संशोधनों से उत्पन्न हुए परिणामी संशोधन किए गए हैं ।

1. The definitions chapter has been amended as under :
(a) The definitions of the terms ' exercise ' and ' european style option contract' are substituted with the follow- ing definitions :
1. Exercise
Exercise means the invocation of right , in accor- dance with and subject to Rules , Byelaws and Regulations of Exchange , by the option holder .
2. European style option contract
European Style option contract means an option contract which may be exercised on the expiration day on or before the expiration time .
(b) The definition of the following term is inserted at appropriate place in the definitions chapter Corporate Actions
Corporate Actions mean and include divided , bonus . rights shares , issue of shares as a result of stock split , stock consolidations , schemes of mergers /demergers , spin- offs , amalgamations , capital restructuring and such other privileges or events of a. similar nature which may be specified by the Relevant Authority from time to time .
2.The following regulation is inserted after the existing Re- gulation 3.15 in the Chapter III :
Pursuant to the Corporate Actions announced by the issuer of the underlying securities , the Relevant Authority may make such modifications as may be deemed necessary including modifications in the open interest and/or contract specifications in accordance with the Rules , Byelaws and Regulations of the Exchange.
3. The following regulations are inserted after the existing Regulation 3.1 in the Chapter III :
3.2 Position Limit
The Relevant Authority may at any time in its abso- lute discretion prescribe maximum long and or short open positions for all or any of the F & O Trading Members and their clients including quantity and/or value for any or all Derivatives Contracts .
3.3 Action by the Relevant Authority
Upon a F&Q trading member/ any constituent of a F&O Trading Member failing to comply with any provisions of the Byelaws , Rules and Regulations of the Exchange/Clearing Corporation , itequirements of the Exchange/ Clearing Corporation including the requirements pertaining to the position limits as im posed by the Relevant Authority from time to time, the Relevant authority may as its discretion , either on its own or on the advice from the Clearing Cor- poration without notice, to the trading member close out open positions to the extent possible or take any such other measure or action , including withdrawal of trading facility , as may be deemed fit from time to time.

(1) The definitions chapter has been amended as under :
(a) The definitions of the terms 'assignment' , ' exercise' 'expiration time' , ' european style option contract and 'futures syle premium settlement' are substi- tuted with the following definitions:
1. Assignment
Assignment means an allocation of an option contract , which is exercised , to a short position in the same option contract , at the same strike price , for fulfilment of the obligation, in accordance with the procedure as may be specified by the Relevant Authority, from time to time .
2..Exercise
Exercise means the invocation of right , in accordance with and subject to Rules , Byelaws and Regulations of Clearing Corporation , by the option holder .
3. Expiration time
Expiration time is the close of business hours on the expiration day of the option contract or such other time as may be specified by the Relevant Authority from time to time. In this context , business hours shall include the time specified by the specified Exchange , after the close of the trading hours , for the purpose of exercising option contracts.
4. European style option contract
European Style option contract means an option contract which may be exercised on the expiration day on or before the expiration time .
5. Futures style premium settlement
Futures Style premium settlement means premium settle- ment of option contracts based on settlement system as specified by the relevant authority for futures contracts and will include initial margins and mark to market settlement on long and short option positions , in accordance with the Regulations as may be specifiedby the Relevant Authority from time to time .
(b) The definitions of the following terms are inserted at appropriate places in the definitions chapter :
1. Corporate Actions
Corporate Actions mean and include dividend , bonus , rights-shares, issue of shares as a result of stock split , stock consolidations, schemes of mergers/de -mergers , spin-oflis , amalgamations , capital restructuring and such other privi- leges or events of a similar nature which may be specified by the Relevnt Authority from time to time .
2. Exercise Settlement Price
Exercise Settlement price , in respect of Exercise Settle- ment, is the closing price of the underlying security on the day of exercise or such other price as may be decided by the relevant authority from time to time
3. Exercise Settlement Value
Exrcise Settlement Value , in respect of Exercise settle. ment , means the difference between the strike price and the exercise settlement price for each unit of trading of the option contract for the purpose of wettlement .
4. Underlying Segment
Underlying segment refers to the specified Exchange where the relevant authority may admit dealings in untierlying security . the SA. ( II) Chapter 5A is replaced with the following new chapter 5A SETTLEMENT OF OPTION CONTRACTS 5A.1 Daily . Premimum Settlement for Option contracts F& O Clearing Members with premium payable positions are obliged to effect pay- in to Clearing Corporation of the premium value at which the option contracts were pur- chased, towards settlement . F&O Clearing Members with premium receivable positions are entitled to receive the premium value at which the option contracts were sold , towards settlement , from Clearing Corporation .
(a ) Mode of premium settlement The daily premium settlement obligation shall be paid in cash or sach other form as may be specified by the relevant authority.
(b ) Style of premium settlement : The style of pre- mium settlement may be premium style or future style or such other style as may be specified by the relevant authority from time to time. Clearing Corporation will specify the style of premium settle- ment for all option contracts that are to be cleared and settled Clearing Corporation will from time to time, specify the method for premium settlement for one or more styles of premium settlement .
( c ) Method of premium settlement The relevant authority will from time to time specify the method of premium settlement, in accordance with the specified style of premium settlement . Clearing Corporation will arrive at the premium settlement amount payable or receivable by the respective Clearing Members at the end of each trading day or such other time, as may be specified by the relevant authority from time to time, for all option contracts admitted , in accordance with the method of premium settlement, and communicate the same to the Clearing Members . Accordingly , such Clearing Members will pay or receive stich premium settlement amount towards premium settlement to orfrom Clearing Corporaton.
( d) Time of premium settlement The relevant autho- rity will specify from time to time the day and time when Premium settlement will take place 5.A.2 Exercise
( a ) Type Exercise
Type of exercise for an option contract may be Voluntary or automatic or such other type as may be specified by the relevant authority from time to time.
1. Voluntary Exercise
Voluntary exercise is the execise of option contract by a Clearing Member , at his volition , subject to the Rules .
Bye- laws and Regulations.
2. Automatic Exercise
Automatic exercise is the exercise of all in- the- money strike price option contracts , which are automatically deemed to be irrevocably exercised, on the Expiration date , sübject to the Rules , Bye -laws and Regulations .
Notwithstanding the foregoing , if a Clearing Member de- sires not to exercise an in- the-money strike price option con- tract , it shall be the responsibility of such Clearing Member to give appropriate instructions in accordance with Regula- tion 5A . 2 ( c) .
Exercise of an option contract at a strike price other than in-the-money strike price shall be at the discretion of the relevant authority and subject to the reuqirements as may be specified by the relevant authority from time to time .
(b) Exercise Mechanisms
Exercise mechanism may be Interim or Final or such other mechanism as may he specified by the relevant authority from time to time .
1. Interim Exercise
Interim Exercise is the exercise of an option contract at anytime prior to expiration day or such other day and / or 242

4. Restrictions on Exercise
time as may be specified by the relevant authority from time to time Interim exercise is voluntary . Settlement of such contracts shall be in accordance with the provisions specifled by the relevant authority for Exercise Settlement 5A- 1.1 .
2. Final Exercise
The relevant authority shall have an authority to impose such restrictions on exercise in any option contract as it may deem necessary in the interest of maintaining a fair and orderly market in the option contract or in the underlyihng securities or otherwise may deem advisable in the public interest or for the protection of investors or any other reae- son as the relevant authority may deem fit . Any exercise in contravention of such restriction shall be automatically invalid and not enforceable .
Final Exercise is the exercise of an option contract on or before expiration time on expiraton day or such other day and/ or time as may be specified by the relevant authority from time to time . Final exercise may be voluntary . automatic or
5A.3 Assignment
( a) Assignment methods.
Settlement of such contracts shall be in accordance with the provisions specified by the relevant authority for Exercise Settlement in 5A4.1 .
( c) Exercise procedure
Assignment methods may be Proportional or Random or such other methods as may be specified by the relevant autho- rity from time to time .
1. Proportional Assigument
The procedure for exercise of an option contract by a Clearing Member shall be as specified hereinafter or such other procedure as may be specified by the relevant authority from time to time .
1. Notice of exercise to Clearing Corpoation
The relevant authority may specify from time to time the provisions regarding exercise of option contracts including :
Proportional Assignment is an allocation of exercised op- tion contracts , proportionally, in market lots , as specified for the relevant option contract , to one or more than one short positions in the option contract with the same series , in accordance with the procedure as may be specified by the relevant authority from time to time .
(a) type of members who may exercise .
(b) facility system for tendering notice of exercise
Random Assignment
(c) day's when exercise notice may be submitted .
(d) minimum lot size of option contracts which may be exercised.
(c) time period within which exercise notice may be submitted.
Random Assignment is an allocation of exercised option contracts , randomly , in market lots , as specified for the re- levant option contract, to one or more than one short posi- tion , in the option contract with the same series , in accord- unce with the procedure as may be specified by the relevant authority from time to time .
(b) Assignment proceduce
( f) maximum number of option contracts which may be exercised on a day or within a period, for a member or for the market .
The relevant authority may specify the assignment proce- dure, including day and /or time when assignment will take place.
( g ) strike price ( i.e. in- the -money and /or at -the money and/ or out-of-moncy ) at which the option tract may be exercised . con-
(h) such other conditions as it deems fit .
Notice for exercise shall be deemed tobe on long posi- tions in an option contract at the close of the day the notice of exercise has been tendered , or such other day/time as may be specified by the relevant authority from time to time .
Exercise notices accepted by Clearing Corporation as valid will be assigned in accordance with the Assignment proce- dure, to short positions in the option contracts , with the same series , to the clients of Clearing Members or Trading Members or clients of Trading Members , for fulfillment of obligations . Such short positions , to which the exercised option contracts are assigned, shall be termed as assigned option contracts for the purpose of settlement . The assign- cd Member shall be liable to fulfil his obligation in accord- ance with the Exercise settlement procedure specified for the option contract and the Rules . Bye - laws and Regulations.
No Clearing Member shall revoke or modify any exercise notice so submitted except as provided under the Rules , Bye- laws and Regulations .
5A.4 Exercise Settlement
2. Acceptance of Exercise notice by Clearing Corporation
An exercise notice which has been tendered in accordance with the provisions as detailed in 5A.2 ( c ) 1 may be consi- dered for acceptance by the relevant authority .
Exercise settlement may be Interim or Final . The Rele vant Authority may specify from time to time the procedure , mode , method, days , time etc. for Interim Exercise settle- ment and Final Exercise settlement .
5A4.1 Exercise Settlement
The Relevant Authority may specify the exercise type and mechanism of settlement from time to time .
Such exercise notices received by the relevant authority shall be declared as valid or invalid after processing , at the close of trading hours on the day on which the exercise notice has been tendered , or on such other day of time , as maybe specified by the relevant authority from time 10 time . All valid exercise notices will be accented by the relevant authority and invalid exercise notices shall automatically rejected by the relevant authority. stand
5A4.1.1 Mode of settlement Mode of settlement may be either cash settled or by creation of obligations in underlying segment or such other mode as may be specified by the Rele- vant Authority from time to time . Settlement by creation of obligations in underlying segment may be either cash based or delivery based .
Notwithstanding the foregoing , the relevant authority may. in the interest of market , declare as exercise notice as invalid where :
5A4.1.2 Method of Settlement
4.1.2 1 Cash settlement :
2.1 the entity who has tendered a notice for exercise has no open long positions in that contract, at the time when such notice is processed by the relevant authority .
2.2 any other reason.
3. Revocation of an exercise notice
4.1.2.1.1 An exere'sed option contract and the short post- tion, to which such exercised option contract has been assigned, shallbe settled at the exercise settlement price or such other price , as may be specified by the Relevant Authority from time to time .

(2) Clearing Member, who has been assigned the option contract, shan be nable to pay to or entitied to receive trom Clearung Corporation the exercise seitiement value for each unil of the option contract, as the case may be , subject to the Rules , Byelaws and Regulations .
4.1.2.1.2 Clearing Member , who has been assigned the op- tion contract, shall be liable to pay to or entitied to receive from Clearing Corporation the exercise sciement value for each unit of the option contract , as the case may be , sub- ject to the Rules, Byelaws and Regulations .
( 3 ) Cleaing Member , who has exercised the option coд- tract, shall be entitled to receive trom or hable to pay to Ciearing Corporation the exercise seitiement value for each unit of the option contract, as the case may be , subject to ine kuses , Byeraws and Regulations .
4.1.2.1.3 Clearing Moimber , who has exercised the option contract, shall be entitled to receive from, or liable to pay to, Clearing Corporation the exercise setticinent value for each unit of the option contract , as the case may be , sub- ject to the Rules , Byelaws and Regulations .
4.1.2.2 Settlement by Creation of Obligatiou in the under- lying security and underlying segment-
( 4) Obligations cicated on behalf of a Clearing member in the relevant underiying segment of Clearing Corporation , pursuant to the exercise and assignment of an option con- tract , shall be setued , as per the Rules , Bye - laws and Regulations of such underlying segment of Clearing Согрога- hon.
Clearing Corporation shall , at its discretion, be entitled to create obligations in the underlying security in the rele- vant underlying segment , in respect of both clearing mem- bers, who have exercised option contract and to whom such exercised option contracts have been assigned .
(5) Obrigations , in relation to an option contract, shall be deemed to have been settled, in accordance with the Rules , Bye- laws and Reginations of F & O Segment , ipso facto , upon creation of obugations in the relevant underlying secu- rity in the relevant underlying segment of Clearing Corpora- tion . Provided however it a Clearing Member fails to meet his obligations so created in the underlying Segment, the Seulement Fund of the Futures & Options Segment may be utused to meet such obligations in accordance with the Rules , Byelaws and Regulations .
An option contract , which has been exercised and the short position to which such exercised option contract has been assigned , shall be settled by the method of creating obligations in an equivalent number of units of the under- lying security , in the relevant underlying segment conveyed by the option contract , at the strike price of the option contract or such other method as may be specified by the Relevant Authority from time to time .
5A4.1.3 Day and Time of Settlement :
A. Delivery Based :
The Relevant Authority may specify from time to time the day and time when the settlement shall take place .
5.A.5 Adjustment of Positions in option contracts оn account of corporate actions in underlying security ( 1) Obligations in an equivalent number of units of the underlying security , conveyed by an exercised option con- tract, shall be created , in accordance with the option type and series , at the strike price, on or after the day of exer- cise, in the relevant underlying segment of Clearing Cor- poration. The Relevant Authority may specify from time to time the day and me for creation of obligations in the underlying security for valid exercised option contracts .
The Relevant Authority may from time to time specify the provisions , relating to adjustments , including non- adjust- ment, in open positions , discontinuing any or all option confacts and /or settlement methods and procedures for the relevant option contracts , arising out of or incidental to corporate actions in the underlying security .
Adjustment
( 2) Obligations in an equivalent number of units of the underlying security, conveyed by an assigned option con- tract , shall be created , in accordance with the option type and series , at the strike price , on or after the day of exer- cise, in the relevant underlying segment of Clearing Cor- poration . The Relevant Authority may specify from time to time the day and time for creation of obligation in the under- lying security for valid assigned option contracts .
Adjustment shall mean and include modrication in open positions and /or contract specifications in the relevant option contracts arising out of or incidental to corporate actions in the underiying security , in accordance with the Rules , Bye- laws and Regulations.
5A.6 Clearing Forms
All Clearing Forms shall be as sepcified in the relative regulation or in such other form or forms as the Relevant Authority may from time to time prescribe in addition thereto of in modification or substitution thereof .
5A.7 Settlement Obligations Statements
(3) The Clearing Member who has exercised or has been assigned, as the case may be , the option contract, shall be liable to fulfill the delivery or payment obligations , so сгеа- ted, as the case may be , to Clearing Corporation . On ful- fillment of such obligation , he shall be entitled to receive funds or underlying securities , as the case may be , from Clearing Corporation , subject to and in accordance the Rules, Byelaws and Regulations of the underlying seg- ment of Clearing Corporation . with
Clearing Corporation may facilitate download of relevant data to Clearing Members and Trading Members to enable them to generate Premium Settlement , Other Settlement Obligations Statements pertaining to transactions in different Linds of option contracts .
54.8 Modo of Payment
(4) Obligations , in relation to an option contract, shall be deomed to have been settled, in accordance with the Rules , Bye- laws and Regulations of F & O Segment , ipso facto, upon creation of obligations in the relevant underlying secu- rity in the relevant underlying segment of Clearing Corpora- tion. Provided however if a clearing Membe; fails to meet his obligations created in the underlying Segment, the Settlement Fund of the Futures & Options Seg- ment may be utilised to meet such obligations in accordance with the Rules , Byelaws and Regulations . SO
Ail F & O Clearing Members shall , on the designated pay - in-day , have clear balance of funds in their clearing account to the extent of their funds obligation . Provided however the Relevant Authority may specify different mode of payment of funds for all or any of the F& O Clearing Members .
5A.9 Receipt of Funds
(5 ) Obligations created in the relevant underlying seg- ment of Clearing Corporation, pursuant to the exercise and assignment of an option contract, shall be settled, as per the Rules, Bye -laws and Regulations of such underlying seg- ment of Clearing Corporation .
B. Cash Based :
The Clearing Bank shall credit the clearing accounts of the F& O Clearing Members who are due to receive funds as per the instructions of the Clearing Corporation . All funds due to a F& O Clearing Member shall normally be credited to his account unless ( a) the F& O Clearing Member docs not perform his obligations to the Clearing Corporation or (b) it is otherwise ordered by the Relevant Authority.
Provided however the Relevant Authority may specify different mode of funds credit for all or any of the F&O Clearing Members,
(1 ) An exercised option contract and assigned option con tract shall be settled by the method of creating obligations in the relevant underlying segment , conveyed by the option contract , on or after the day of exercise . The Relevant Authority may specify from time to time the day and time for creation of obligations in the underlving security for valid exercised option contiacts .

RESOLVED FURTHER THAT all the assets and liabili- ties of the Company as appearing in the latest Auditet Balance Sheet as on 31st March , 2001 be distributed / adjusted amongst the members of the Company whose name appear in the Register of Members as on date on a pro- rata basis as per their shave holding ratio .
(v) The term ' Rules , Bye -laws and Regulations' used here- in is in relationto Rules , Bye - laws and Regulations of F& O Segment of Clearing Corporation unless explicitly stated otherwise and shall mean and include the Rules , Bye -laws and Regulations of F&O Segment of Clearing Corporation in force from time to time .
( vi ) Consequential amendments arising out of the above amendments are carried out .
