का. नि. आ 20.-रक्षाः संकर्म अधिनियम, 1903 ( 1903 की 7 ) की धारा 3 द्वारा प्रदत्त शक्तियों का इस्तेमाल करते हुए केंद्र सरकार एतद्वारा घोषणा करती है कि नीचे दी गई अनुसूची में उल्लिखित भूमि पंजाब राज्य के जिला फिरोजपुर में 2 ए एस डी ( 17 एफ ए डी) काराबेगू के निकट होने के कारण इसे भवनों तथा अन्य बाधाओं से मुक्त रखे जाने के उद्देश्य से इसके उपयोग तथा अधिभोग पर उपर्युक्त अधिनियम की धारा 7 के खंड ( क) में निर्दिष्ट प्रतिबंध लगाया जाना आवश्यक है ।
2. उपर्युक्त भूमि की योजना से संबंधित रेखाचित्र नक्शे का निरीक्षण उपायुक्त, फिरोजपुर के कार्यालय में किया जा सकता है ।

S.R.O. 20. In exercise of the powers conferred by Section 3 of the Works of Defence Act , 1903 ( 7 of 1903 ) . the Central Government hereby declares that it is necesary to impose restrictions specified in clause ( a ) of Section 7 of the said Act upon the use and enjoyment of the land situated in the District of Ferozpur in the State of Punjab described in the Schdule below being land in the vicinity of 2 ASD ( 17 FAD) Kasubogu , in order that the said land may be kept free from buildings and other obstructions.
2. A sketch plan of the said land may be inspected in the Office of the Deputy Conumissioner. Ferozpur .

का. नि. आ. 21.-प्रादेशिक सेना एक्ट, 1948 ( 1948 का 56 ) की धारा 9 की उपधारा द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा प्रादेशिक सेना अधिनियम , 1948 में निम्नलिखित रुपांतरण तथा संशोधन करती है :-
1. ( 1 ) इन नियमों को प्रादेशिक सेना ( संशोधन ) अधिनियम, 2003 के नाम से जाना जाएगा ।
( 2 ) सरकारी गजट में उनके प्रकाशन की तिथि से इन नियमों को लागू माना जाएगा ।
2. प्रादेशिक सेना अधिनियम, 1948 के अन्तर्गत 129 ए के विनियमन के लिए निम्नलिखित विनियमन को इस नाम से जाना जाएगा । " 129 ए-प्रादेशिक सेना- प्रादेशिक सेना के कार्मिक कोररेजिमेंट से संबद्ध बैज तथा बटन धारण करेंगे । वर्तमान में कार्मिकों के कंधे पर लगाए जाने वाले टाइटिल के स्थान पर टी ए टाइटिल कंधे से नीचे लगाया जाएगा । यह नियम पैदल सेना पर लागू नहीं है । जहां यह अक्षर रेजीमेंट के नाम के साथ लिखे जाते हैं उदाहरण के तौर RAJPUT (TA) इस विषय पर निर्धारित नीति के अनुरूप ही कंधे के टाइटिल होंगे । प्रादेशिक सेना के साथ- साथ नियमित सेना के कार्मिक अपनी कोर/रेजीमेंट में पहनी जाने वाली ड्रेस के संबंध में निर्धारित नियमों का पालन करेंगे ।"

गौतम सान्याल , निदेशक ( जी) नोट:- इंफेंट्री बटालियन का पुनः पदनाम सेना मुख्यालय के 22 अगस्त, 1949 के पत्र संख्या 47833/ 1/एजी/ऑर्ग-1 ( डी ) के अंतर्गत अगस्त , 1949 से ए जी ब्रांच से शुरु किया गया था । जिसे प्रादेशक सेना अधिनियम , 1948 ( रिप्रिंट 1976 ) संशोधित सेना आदेश 24/93 के संदर्भ में पैरा 129 एके अधीन टी ए विनियमन में शामिल किया गया था ।

S.R.O. 21. In exercise of the powers conferred by Sub- section ( 1 ) of Section 9 of the Territorial Army Act , 1948 (56 of 1948 ) , the Central Government hereby makes the following adaptations and modifications in the Territorial Army Regulations 1948 , namely :-
1. ( 1 ) These regulations may be called Territorial Army ( Amendment ) Regulations , 2003 .
(2) They shall come in force on the date of their publication in the Official Gazette .
namely: 2. In the Territorial Army Regulations , 1948 , for regulation 129A , the following regulation shall be substituted " 129A DRESS - TERRITORIAL ARMY- Territorial Army personnel will wear the same dress including badges and buttons as of the Corps / Regts to whom they are affiliated . The letters " TA" will , however, worn below the shoulder titles except in the case of Infantry , where these letters will be suflixed to the name of the Regiment e.g. " RAJPUT( TA ) " in licu of their shoulder titles worn at present . The shoulder titles willbe as per the policy on the subject .
The personnel of the Regular Army seconded to the Territorial Army will continue tobe governed by the rules regarding dress of their parent Corps /Regiments . "

का. नि . आ. 22.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सेना सेवा कोर में (केन्द्रीय सिविल समूह ' ग ' पद ) भर्ती नियम, 1978 को जहां तक वे ज्येष्ठ वैज्ञानिक सहायक और कनिष्ठ वैज्ञानिक सहायक के पदों से संबंधित हैं , अधिक्रांत करते हुए, उन बातों के सिवाय जो ऐसे अधिक्रमण से पूर्व की गई हैं या करने से रह गई हैं , सेना सेवा कोर में ज्येष्ठ वैज्ञानिक सहायक और कनिष्ठ वैज्ञानिक सहायक के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सेना सेवा कोर ( साधारण केन्द्रीय सिविल समूह ' ख ' ) ( अराजपत्रित ) भर्तीनियम, 2003 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद - संख्या , वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति, आयु- सीमा और अर्हताएं. उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।
4. निरर्हता. वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा:
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ॥
5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबंद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
6. व्यावृत्ति.- इन नियमों की कोई बात ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों/ अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता
प्रोन्नति/प्रतिनियुक्ति /आमेलम द्वारा भर्ती की दशा में वे श्रेणियां जिनसे ग्रोम्मति/प्रतिनियुक्ति/आमेलन कियाजायेगा

प्रोन्नति
प्रोन्नति: ऐसे कनिष्ठ वैज्ञानिक सहायक जिन्होंने उस श्रेणी में तीन वर्ष नियमित सेवाकी हो ।
टिप्पण:- 1640-2900 रु. के पूर्व पुमरीक्षित वेतमान में, ज्येष्ठ वैज्ञानिक सहायक के पद के नियमित धारक की उपयुक्तता, उक्त पद के 6500-10,500 रु ० के पुनरीक्षित वेतमान में उन्नयन से पूर्व, प्रारंभिक रूप से उन्नत पद पर नियुक्तिके लिए सम्यकतः नियुक्त विभागीय प्रोम्नत समिति द्वारा निर्धारित की जाएगी । यदि उपयुक्त' निर्धारित किया जाता है तो वह प्रारंभिक गठन के समय उक्त पद पर नियुक्त किया गया समझा जाएगा । यदि उन्नत वेतनमान में नियुक्ति के लिए ' अनुपयुक्त' निर्धारित किया जाता है तो वह 5500-9000 रु० के पुनरीक्षित वेतनमान में बना रहेगा और उसके मामले का प्रतिवर्ष पुनर्विलोकन किया जाएगा ।
टिप्पण:-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में , जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर लीहै ।
यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना
भर्ती करने मेंकिन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

टिप्पण 2: अनुभव संबंधी अर्हता ( अर्हताएं) कर्मचारी चयन आयोग/सक्षम प्राधिकारी के विवेकानुसार अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर कर्मचारी चयन आयोग की यह रायहै कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं हैं । 18

एक वर्ष
प्रोन्नति: ऐसे ज्येष्ठ प्रयोगशाला सहायक जिन्होंने उस श्रेणी में तीन वर्ष नियमित सेवा की हो ।
50 प्रतिशत प्रोन्नति द्वारा 50 प्रतिशत प्रतिनियुक्ति/आमेलन द्वारा जिसके न हो सकने पर सीधी भर्ती द्वारा ।
टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी की ली है, विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जक कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोत्रति के लिए अपनी परि- वीक्षा की अवधि सफलतापूर्वक पूरी कर ली है , जिन्होंने ऐसे अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।
टिप्पण : 1 भर्ती की यह पद्धति उस समय तक स्थगित रखी जाएगी जब तक कि ज्येष्ठ प्रयोग शाला सहायक की पोषक श्रेणी में विद्यमान 10 पदधारी, इन पुन रीक्षित नियमों के अधिसूचित किए जाने की तारीख को इस श्रेणी में प्रोन्नति के आधार पर नियुक्त न कर दिए जाएं ।
टिप्प्ण: 2 सीधी भर्ती, कर्मचारी चयन आयोग द्वारा ।
टिप्पण 2 : कनिष्ठ वैज्ञानिक सहायक के पदों के नियमित धारकों के 1400-2300 रु. के पुनरीक्षित वेतनमान में इस पद के 5500-9000 रु. के पुनरीक्षित वेतनमान में इम पद के उन्नयन से पूर्व उपयुक्तता , प्रारंभिक रूप से उन्नत पद पर नियुक्ति के लिए सम्यकतः नियुक्त विभागीय प्रोन्नति समिति द्वारा निर्धारित की जाएगी । यदि ' उपयुक्त' निर्धारित किया जाता है तो वह प्रारंभिक गठन के समय नियुक्त किया गया समझा जाएगा । यदि उन्नत वेतनमान में नियुक्ति के लिए अनुपयुक्त निर्धारित किया जाता है तो वह 4500-7000 रु. के पुनरीक्षित वेतनमान में बना रहेगा और उसके मामले का पुनर्विलोकन प्रतिवर्ष किया जाएगा ।
प्रतिनियुक्ति/आमेलन:-
केन्द्रीय सरकार के ऐसे अधिकारी:
( क) ( i ) जो मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या ( ii ) जो मूल काडर/ विभाग में 5000-8000 रु. के या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में 3 वर्ष सेवा कर चुके हों और
(ख ) जो स्तंभ 8 के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं और अनुभव रखते हों ।
टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्तिपर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्तिप्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।
टिप्पण 2 : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया 3 वर्ष से अधिक नहीं होगी। प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहींहोगी।

संघ लोक सेवा आयोग से परामर्श आवश्यक नहीं । प्रोष्षतिपर विचार करने के लिए समूह ' ख ' विभागीय प्रोन्नति समिति:
1. भार साधक अधिकारी अभिलेख ( प्रदाय ) या यांत्रिक परिवहन- अध्यक्ष
2. ज्येष्ठ अभिलेख अधिकारी , सेना सेवा कोर अभिलेख ( प्रदाय )- सदस्य

In cexercise of the powers conferred by the proviso to articles 309 of the constitution, and in super- session of the Army Service Corps ( Central Group ' C ' Posts ) Recruitent rules , 1978 , in so far as they relate to the posts of Senior Scientific Assistant and Junior Scientific Assistant except as respects things donc or omitted to be done before such 19

supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Senior Scientific Assistant and Junior Scientific Assistant in Army Service Corps , namely :-
1. Shorttitle and commencement : ( 1 ) These rules may be called Army Service Corps (General Central Civil Group 'B ' Non Gazetted) posts Recruitment Rules, 2003.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number ofposts, classification and scale of pay :-The number of said posts , its classification and scale of pay attached thereto shall be as specified in columns (2 ) to (4 ) of the Schedule hereto annexed.
3. Method of recruitment , age limit and qualifications :-The method of recruitment to the said posts , age limit, qualifications and other matters relating thereto shall be as specified in columns (5 ) to ( 14 ) of the said schedule .
4. Disqualifications : -No person ,
(a) who has entered into or contracted a marriage with a person having a spouse living, or
(b) who, having a spouse living , has entered into or contracted a marriage with any person ,
(c) shall be eligible for appointment to any of the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation ofthis rule .
5. Power to relax: Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order , for reasons , to be rcorded in writing , and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect of any class or category of persons.
6. Saving : Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for Schedule Castes/the Schedule Tribes the Other Backward Classes, Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

Note : The suitability of the regular holder of the post of Senior Scien- tific Assistant in the pre-revised pay scale ofRs. 1640-2900 prior to the upgradation of the post to the revised pay Scale of Rs . 6500-10500 will be initially assessed by a duly appointed Departmental Promotion Coni- mittee for appointment to the upgraded post . If assessed ' Suitable' , lhe shall be deemed to have been appointedto the post at the initial constitution. Ifassessed ' Not suitable ' , for appoinment to the upgraded scale of pay, he shall continue to be in the revised scale of pay nf Rs. 5500-9000 and his casc would be reviewed every year .
Note : Where junior who have completed their eligibility/qualifying service are being considered their seniors would also be considered provided they are not short of requisite qualifying/ cligibiliy service by more than half of such qualifying/eligibility service or two years , which- ever is less , and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/cligibility service .

If assessed 'Not suitable for the appointment to the upgraded scale of pay, he shall continue to be in the revised scale of Rs . 4500-7000 and his case wouldbe revised cvery ycar.
Deputation/Absorption::
Officers of the Central Government .
(a)( i ) Holding analogous posts on regular basis in the parent cadre/ Department; or
(ii ) With three years ' service in the grade rendered after appointment thereto on regular basis in the scale ofpay of Rs . 5000-8000 or equivalent in the parent cadre/Departinent ; and
(b) Possessing the educational qualifications and experience prescribed for direct recruitments under Column 8 .
Note : The Departmental officers in the feeder catgegory who are in the direct line ofpromotion shall no 've cligible for consideration or appointment ondeputation . Similarly, deputationists shall not be eligible forconsideration for appointment by promotion.
