( 1 घ) ऐसे मामले , जिसकी जारीकर्ता द्वारा एक्सचेंज के साथ किए शाने वाले सूचीकरण करार में समय- समय पर बिशेष रूप से व्यवस्था की जाए , के संबंध में जारीकर्ता और संघटक के बीच उत्पन्न हुए दावों, मतभेदों अथवा विवादों को इन उप- नियमों और विनियमों के उपबंधों के अनुसार विवाचन को प्रस्तुत किया जाएगा ।
इन उप-नियमों और विनियमों के प्रयोजनार्थ "जारीकर्त्ता" शब्द का चहो अर्थ होगा, जो इन उप -नियमों यथा-परिभाषित हैं और " संघटक" शब्द का अर्थ वह निवेशक होगा , जिसने एक्स- चेंज पर जारोकर्ता के उन प्रतिभूतियों को खरीद अथवा बिक्री को है, जिसके संबंध में दावे मतभेद अथवा विवाद उत्पन्न हुए है ।
2. एक्सचेंज के नियम के अध्याय- IV में निम्नलिखित नियम को 13 ख के रूप में प्रविष्ट किया जाता हैं :

( 13ख) एक्सचेंज के किसी उप-नियम और नियम में कुछ विहित होते हुए भी अगर किसो व्यापारिक सदस्य का पंजीकरण सेबी द्वारा निलंबित कर दिया जाता है तो ऐसा व्यापारिक सदस्य स्वतः ही सेबी द्वारा इस प्रकार अधिरोपित निलंबन की अवधि के लिए अथवा ऐसे निलंबन के लागू रहने तक एक्सचेंज की व्यापारिक सदस्यता से निलंबित रहेगा । अउद्भुत

स्थगन, अगर कोई हो, लिखित में दर्ज किए जाने वाले प्रामाणिक कारणों से आपयादिक मामलों में विवाचक द्वारा प्रदान किया जाएगा ।
(ख ) विवाचन के पूरा होने का समय
विवाचन संदर्भ प्राप्त होने की तारीख से सामान्यतया 3 महीने के भीतर विवाचन निर्णय देगा ।
( ग ) विस्तार के लिए अनुरोध
निर्णय करने में लिए गए समय को प्रबंध निदेशक अथवा संबत प्राधिकारी द्वारा दोनों पक्षों अथवा विवाचक जैसर भी मामला हो, द्वारा 3 बार से अधिक नहीं बढ़ाया जा सकता । उपरोक्त तरीके से दिए गए विस्तार के होते भी विवाचकः संदर्भ प्राप्त होने की तारीख से छः महीने की अवधि के भीतर विवाचन निर्णय देगा अर्थात मिर्णत्र देने के समय में विस्तार अधिकतम तीन महीने की अवधि के लिए हो सकता है । ( घ ) संदर्भ प्राप्त होने की तारीख
इन उप- नियमों के प्रयोजनार्थ विवाचक से उस तारीख, जिस दिन विलाचक ने पहली सुनवाही की है, को संदर्भ प्राप्त किया गया माना जाएगा ।

1. The following Byelaw is inserted as Byelaw ID after the existing Byelaw 1C of Chapter XI of the Byelaws of the Exchange :

(1D) All claims , differences or disputes arising between an Issuer and a Constituent in respect of such mattens as may be specifically provided from time to time in the Listing Agreement as entered into by an Issuer with the Exchange shall be submitted to arbitration in accordance with the provisions of these Byelaws and Regulations.
For the purpose of these Byelaws and Regulations . the term 'Issuer' shall have the same meaning as defined in these Byelaws and the term 'Constituent ' shall mean the investor who has bought or sold, on the Exchange, the securities of the Issuer in respect of which the claim , differences or dispute has arisen.

2. The following Rule is proposed to be inserted as Rule 13B in Chapter IV of the Rules of the Exchange :

Effect of suspension of registration by SEBI
(13B) Notwithstanding anything contained in any of the Byelaws and Rules of the Exchange, if the regis- tration of a Trading Member is suspended by SEBI, such Trading Member shall ipso facto stand suspended from the trading membership of the Exchange for the period of suspension , so imposed by SEBI or till such suspension is in force .

NATIONAL STOCK EXCHANGE OF INDIA LIMITED Regd. Office : Exchange Plaza, C- 1 , Block G , Bandra-Kurla Complex, Bandra (East ) , Mumbai-400051 The provisions contained in the Byclaws of the Exchange are amended to the extent given boreunder :-
The existing Byelaw 13 of Chapter XI of the Byelaws of the Exchange is substituted with the following new Byelaw 13 :

13 ( a) Adjournment
Adjournment, if any , shaf be granted by the arbitrator only in exceptional cases, for bonafide reasons to be record- ed in writing.
(b) Time for completion of Arbitration
The arbitrator shall make the arbitrat award normally within 3 months from the date of entering upon the reference .
(c) Request for extension
The time taken to make the award may not be extended beyond 3 times , by the Managing Director or Relevant Authority on an application by cicher of the parties or the arbitrator , as the case may be.
Notwithstanding the extensions, granted in the above manner, the arbitrator shall make the arbitral award within a period of six months from the date of entering into refe rence i.e. extension of time of award can be for a maximum period of three months.
(d) Date of entering reference
For the purposes of these bye-laws , the arbitrator shali be deemed to have enterd upon a refference on the date on which the arbitrator has held the first hearing .
