अग्रवाल ने आयोग से सम्पर्क किया और तब उन्होंने यह बताया कि उनको. सम्बोधित सूचना उनके पुत्र श्री संजीव अग्रवाल ने प्राप्त की थी; और आदेश

4. यतः , श्री सुरेन्द्र मोहन अग्रवाल ने यह अभिवचन किया कि उनके पुत्र श्री संजीव अग्रवाल मानसिक रोग से पीड़ित हैं और यह कि श्री संजीव ने उन्हें आयोग की सूचना नहीं दी; और
5. यतः श्री सुरेन्द्र मोहन अग्रवाल ने उपरोक्त अभिवचन के समर्थन मेंसभी संबंधित चिकित्सा अभिलेखों को प्रस्तुत करते हुए निवेदन किया कि आयोग उन्हें व्यक्तिगत सुनवाई का अवसर प्रदान करें; और
6. यतः , आयोग ने दिनांक 20 नवम्बर, 2002 के श्री अग्रवाल के अभ्यावेदन पर विचार करने के पश्चात् उन्हें व्यक्तिगत सुनवाई का अवसर प्रदान करने का निर्णय लिया और उक्त सुनवाई 13 जनवरी , 2003के लिये निश्चित की; और
आ. अ. 11.- यतः फरवरी, 2002 में उत्तर प्रदेश राज्य की विधान सभा के लिये हुए साधारण निर्वाचन में, 273- जनरलगंज विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ ने वाले एक अभ्यर्थी , श्री सुरेन्द्र मोहन अग्रवाल को भारत निर्वाचन आयोग ने, जिला निर्वाचन अधिकारी , कानपुर नगर द्वारा भेजी गई रिपोर्ट के आधार पर , लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43) की धारा 10 ( क ) के तहत , दिनांक 7 नवम्बर, 2002 के अपने आदेश सं ० 76/उ ० प्र ०- वि ० स ०/ 2002 द्वारा , उक्त आदेश की तारीख से तीन वर्ष की कालावधिं के लिये , अपने निर्वाचन व्ययों का कोई भी लेखा दाखिल करने में असफल रहने के कारण निरर्ह घोषित कर दिया था; और
7. यतः 13 जनवरी, 2003 को श्री सुरेन्द्र मोहन अग्रवाल को व्यक्तिगत रूप में सुना गया था; और
2. यतः श्री सुरेन्द्र मोहन अग्रवाल ने दिनांक 20 नवम्बर, 2002 के अपने अभ्यावेदन द्वारा आयोग को यह बताया कि उन्हें आयोग को कोई भी सूचना प्राप्त नहीं हुई थी ; और
8. यतः प्रकरण के गुणावगुणों पर विचार करने के पश्चात्. आयोग ने यह निष्कर्ष निकाला है कि श्री सुरेन्द्र मोहन अग्रवाल द्वारा अपने निर्वाचन व्ययों का लेखा दाखिल करने में हुई असमर्थता साशयिका नहीं थी और यह उनके नियंत्रण में नहीं थी तथा उन पर धारा 10 ( क ) के तहत थोपी गई निरर्हता उन पर नहीं थोपी जानी चाहिये थी । 3. यतः आयोग के दिनांक 7 नवम्बर, 2002 के आदेश सं० 76/उ० प्र०--वि ० स०/2002 को प्राप्त करने के पश्चात् श्री सुरेन्द्र मोहन

9. अतः , निर्वाचन आयोग, एतद्वारा लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त अधिनियम की धारा 10 क के तहत दिनांक 7 नवम्बर, 2002 के आयोग के आदेश द्वारा श्री सुरेन्द्र मोहन अग्रवाल पर आरोपित निरर्हता को दिनांक 13 जनवरी , 2003 से शेष अवधि के लिये हटाता है ।

Ο . Ν . 11. Whereas Shri Surendra Mohan Aggarwal , a contesting candidate for the General Election to Uttar Pradesh Legislative Assembly from 273 - Generalganj Assembly Constituency , held in February 2002 , was disqualified by the Election Commission of India for failure to file the accounts of election expenses vide its order No. 76/UP- LA/ 2002 , dated 7th November , 2002 , under section 10A of the Represen- tation ofthe People Act, 1951 (43 of 1951 ) , for three years from the date of that order on the basis of report of District Election Officer , Kanpur Nagar intimating non- submission of account of election expenses by the said candidate .
And whereas , Shri Surendra Mohan Aggarwal has submitted a representation dated 20th November , 2002 wherein he had submitted that he had not received any notice from the Commission.
And whereas , Shri Surendra Mohan Aggarwal , after receiving the Commission's Order No. 76/UP - LA/2002 , dated 7th November , 2002 , contacted the Commission and was told that the notice intended to be served on him was received by his son Shri Sangeev Aggarwal :
And whereas , Shri Surendra Mohan Aggarwal , had pleaded that his son Sanjeev Aggarwal is suffering from mental illness and that the notice was not given to him by Shri Sanjeev;
And whereas , Shri Surendra Mohan Aggarwal had submitted all relevent medical records in support of his claim and has requested the Commission to give him an opportunity of being heard in person;
And whereas , the Commission , after considering Shri Aggarwal's representation dated 20th November , 2002 had decided to afford him an opportunity of personal hear- ing and fixed the hearing for 13th January, 2003;
Andwhereas , Shri Surendra Mohan Aggarwal was accordingly heard in person on 13th January, 2003 ;
And whereas , after considering, the case on its merits , the Commission has concluded that the failure to lodge the accounts of election expenses as required by law
[PART II-SEC . 3( iii) ] by Shri Surendra Mohan Aggarwal was not intentional and was beyond his control and the disqualification im- posed under section 10A of the Act on him should not have been imposed.
Accordingly, Election Commission , in exercise of its powers conferred by Section 11 of the Representation of the People Act , 1951 , hereby removes the disqualification of Shri Surendra Mohan Aggrawal imposed upon them by the Commission's Order dated 7th November, 2002 under section 10A of the said Act, for the remaining period w.e.f. 13thJanuary, 2003 .

आ. अ. 12.-लोक प्रतिनिधित्व अधिनियम , 1950 (1950 का 43 ) की धारा 13 क की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग कर्नाटक सरकार के परामर्श से एतद्वारा श्री दिलीप राउ , आई . ए. एस. के स्थान पर श्री अभिजीत दासगुप्ता, आई . ए. एस . (के. एन. 1975 ) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए कर्नाटक के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है ।
2. श्री अभिजीत दासगुप्ता, कर्नाटक सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे, जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे ।
3. श्री अभिजीत दासगुप्ता , मुख्य निर्वाचन अधिकारी , कर्नाटक के पद पर कार्य करते हुए कर्नाटक सरकार के अधीन किसी भी प्रकार काकोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार का सचिव पदाभिहित किया जायेगा।

2. Shri Abhijit Dasgupta shall cease to hold and hand over forthwith charge of all or any charges of work under the Government of Karnataka , which he may be holding before such assumption of office.

( डब्लू बी : 1982 ) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए पश्चिम बंगाल राज्यके मुख्य निर्वाचन अधिकारी के रूप में नामित करता है ।
2. श्री एसके. नुरुल हक, पश्चिम बंगाल सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे , जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे ।
