नई दिल्ली, 5 मार्च , 2003
आ.अ. 20.- यतः , सन् 1998 में हुए विधान सभा के लिए 162 - खारची विधानसभा के लिए 1998 में हुए साधारण निर्वाचन में निर्वाचन लड़ने वाले एक अभ्यर्थी श्री अन्नराज, गांव-रुगड़ी, पो. रायपुरिया, वाया- खिवाड़ा, जिला- पाली, राजस्थान को लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अधीन निर्वाचन आयोग के आदेश सं . 76/राज./2001/प. अनु. -1 दिनांक 7-3-2001 द्वारा उक्त अधिनियम और उसके आदेशों द्वारा अपेक्षित रीति में लेखा दाखिल करने में असफल रहने के कारण निरर्हित किया गया था; और
यतः , उक्त श्री अन्नराज ने लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 11 के अधीन आयोग के उक्त आदेश द्वारा उन पर लगाई गई निरर्हता हटाने के लिए एक अभ्यावेदन दाखिल किया और उसी समय जिला निर्वाचन अधिकारी , पाली के समक्ष अपने निर्वाचन व्ययों का लेखा दाखिल किया; और
यतः , जिला निर्वाचन अधिकारी , पाली ने यह सूचित किया कि अभ्यर्थी ने रीति से लेखा दाखिल कर दिया है; और
यतः , अभ्यर्थी द्वारा दी गई प्रस्तुतियों तथा सारवान तथ्यों पर विचार करने के पश्चात् आयोग ने लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए आयोग ने यह निर्णय किया कि उक्त अभ्यर्थी श्री अन्नराज पर लगाई गई निरर्हता इस तारीख से हटा दी जाए।
अतः , अब , आयोग ,के आदेश सं. 76/राज./2001/प. अनु.- 1 दिनांक7-3-2001 में क्र.सं. 2 पर लड़ने वाला उक्त श्री अन्न राज का नाम तारीख 5-3-2003 से हटा लिया समझा जायेगा ।

ORDER
New Delhi , the 5th March, 2003
O. N. 20. Whereas Shri Anna Raj , Village-Rogari, P.O. Raipuria Khiwara, District -Pali , Rajasthan a contesting candidate for the General Election to the Legislative Assembly of Rajasthan, held in 1998 from 162-Kharchi Assembly Constituency was disqualified by the Election Commission of India Vide its Order No. 76/RJ/2001 /W.S. - I dated 7-3-2001 , under section 10A of the Representation of the People Act, 1951 for failure to lodge his account ofelection expenses ; in the manner required by the said Act and the Rules and Ordef made thereunder ; and
Whereas, the said Shri Anna Raj filed a representation under section 11 of the Representation of People Act, 1951 for removal of disqualification imposed upon him by the Commission's aforesaid order and at the same time filed his account ofElection Expenses before District Election Officer, Pali.
Whereas, the District Election Officer, Pali has intimated that the Candidate had filed his account of election expenses which was in the manner; and
Whereas, after taking into consideration the submissions made by the candidate and all other material facts the Commission in exercise of the powers conferred by section 11 of the Representation of the People Act, 1951 , has decided to remove the disqualification imposed upon the above said candidate , Shri Anna Raj w.e.f. the date ofthis Order.
Now, therefore, the name of the said Shri Anna Raj is appearing at Sl . No. 2 in the Commission Order No. 76/RJ/2001 /W.S. - I dated 7-3-2001 shall be deemed to have been omitted from the said Order with effect from 5-3-2003.

आ.अ. 21.-लोक प्रतिनिधित्व अधिनियम, 1950 ( 1950 का 43 ) की धारा 13 क की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत निर्वाचन आयोग जम्मूऔर कश्मीर सरकार के परामर्श से एतद्वारा श्री पी . के. जैन, आई.ए.एस. के स्थान पर श्री बी.एल. निमेश, आई.ए.एस. (जे.के.: 1977 ) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए जम्मू और कश्मीर के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है ।
2. श्री बी. एल. निमेश, जम्मूऔर कश्मीर सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे , जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे ।
3. श्री बी. एल. निमेश, मुख्य निर्वाचन अधिकारी , जम्मूऔर कश्मीर के पद पर कार्य करते हुए जम्मूऔर कश्मीर सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार का सचिव पदाभिहित किया जाएगा ।

O.N. 21. In exercise of the power conferred by Sub - section ( 1 ) of Section 13A of the Representation of the People Act , 1950 (43 of 1950 ) the Election Commission of India in consultation with Government of Jammu & Kashmir hereby nominates Shri B. L. Nimesh, IAS ( JK : 77) , as the Chief Electoral Officer for the State of Jammu & Kashmir with effect from the date he takes over charge and until further orders vice Shri P. K. Jain , IAS .
2. Shri B. L. Nimesh shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Jammu & Kashmir, which he may be holding before such assumption of office.
3. Shri B. L. Nimesh while functioning as the Chief Electoral Officer , Jammu & Kashmir shall not hold any additional charge whatsoever under the Government of Jammu & Kashmir except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat.
