2 संबंधित सदस्य से इस बात की पुष्टि प्राप्त हो जाने पर कि उसने माध्यस्थम् ( आर्बिट्रेशन ) और समझौता अधिनियम , 1996 की धारा 34 के अंतर्गत निर्धारित समय के भीतर कोई अपील दायर नहीं की है , एक्सचेंज अवार्डी को भुगतान कर देगा। मध्यस्थ ( मध्यस्थों ) द्वारा स्थगन , यदि कोई हो, केवल विशिष्ट मामलों में ही प्रदान किया जायेगा , और वह भी वास्तविक कारणों हेतु- इन कारणों का लिखित रिकार्ड भी रखा जायेगा ।
3 यदि माध्यस्थम् ( आर्बिट्रेशन ) और समभ्झौता अधिनियम , 1996 की धारा 34 के अंतर्गत अपील की गयी हो और वह निर्णयाधीन हो तो इस प्रकार अलग खातें में रखी गयी राशि का भुगतान अवार्डी को न्यायालय के आदेशों के अनुसार किया जायेगा । 278(क )माध्यस्थम् ( आर्बिट्रेशन ) को पूरा किये जाने का समय
मध्यस्थ ( मध्यस्थों) आम तौर पर माध्यस्थम् ( आर्बिट्रेशन) अवार्ड, मामले को दर्ज किये जाने की तारीख से 3 महीनों की अवधि के भीतर देगा ।
278क अवधि बढ़ाये जाने का अनुरोध
4 अवार्ड की राशि को नामे लिखते समय एक्सचेंज अवार्डी को यह सूचित करेगा कि यदि न्यायालय द्वारा अवार्ड में संशोधन किया जाता है तो ऐसी स्थिति में ब्याज , कारोबार आदि की होने वाली हानि के लिए एक्सचेंज उत्तरदायी नहीं होगा , जिसमें यह भी उल्लेख किया जायेगा कि यदि अवार्डी को इसके बाद भी ब्याज की कोई और राशि देय होगी , उदाहरण के लिए सदस्य के खाते को नामे लिखने की तारीख से अवार्ड की राशि का अवार्डी को भुगतान किये जाने की तारीख तक देय ब्याज की राशि, तो वह संबंधित सदस्य से वसूल की जानी होगी और इस संबंध में एक्सचेंज उत्तरदायी नहीं होगा।
290( क )अनुपालन न किये जाने के परिणाम अवार्ड देने में लिये गये समय को , प्रबंध निदेशक अथवा संबद्ध प्राधिकारी द्वारा , जैसी भी स्थिति हो, किसी भी पार्टी या मध्यस्थ ( मध्यस्थों ) द्वारा , आवेदन के माध्यम से, 3 बार से आगे नहीं बढ़ाया जा सकता । उपर्युक्त रीति से , अवधि बढ़ाये जाने के बाबजूद भी , मध्यस्थ ( मध्यस्थों ) , माध्यस्थम् ( आर्बिट्रेशन ) अवार्ड मामले को दर्ज किये जाने की तारीख से छह महीनों की अवधि के भीतर देगा , अर्थात् अवार्ड की समयावधि को अधिकतम तीन महीनों की अवधि तक बढ़ाया जा
सकता है ।
278ख मामले को दर्ज किये जाने की तारीख
इन उप -विधियों के प्रयोजनों के लिए, मध्यस्थ ( मध्यस्थों) द्वारा किसी मामले को दर्ज किये जाने की तारीख वह समझी जायेगी , जिस तारीख को मध्यस्थ ( मध्यस्थों ) ने पहली सुनवाई की हो ।
282कः अवार्ड लागू करना
यदि कोई सदस्य जो अवार्ड में एक पार्टी हो , अवार्ड के निर्णय का पालन नहीं करता है तो एक्सचेंज उपनियम 282-क के प्रावधान के अनुसार अवार्ड को लागू कर देगा। दूसरी पार्टी ऐसा न किये जाने के कारण , अनिर्णीत विवाद, अथवा क्षतिपूर्ति या मुआवजे की राशि के लिए वाद के निपटारे के लिए अवार्ड पर कारवाई करने के लिए मामले को फिर से भी उठा सकती है । इसके अतिरिक्त चूक करने वाले सदस्य को दंडित करने की कार्रवाई के रूप में निदेशक बोर्ड द्वारा उसे निष्कासित किया जा सकता है ।

(2) On confirmation received from the concerned member that he has not filed any appeal within the time stipulated under section 34 of the Arbitration and Conciliation Act, 1996 the Exchange shall make the payment to the awardee.
Amendment in the Bye - laws of The Delhi Stock Exchange Association Ltd. by insertion of new Bye- laws No. 277A, 278A and 278B and amendment in existing Bye- law No. 278 ( a) and insertion of New Bye- law No. 282A and amendment in existing Bye - law No. 290(a ) duly approved by Securities and Exchange Board of India vide their letter No. SMD /SEAD/DSE/ 5212/03 dated 11th March , 2003 and SMD/DSE/ 3227/03 dated 7th February, 2003 respectively.
277A: Adjournment
Adjournment if any, shall be granted by the arbitrator (s) only in exceptional cases for bonafide reasons to be recorded in writing .
(3) If an appeal is filed against the award under section 34 of the Arbitration and Conciliation Act, 1996 and the same is pending, the amount so kept in the separate account shall be paid to the awardee in accordance with the orders ofthe court.
278(a): Time for completion of Arbitration
Thearbitrator (s ) shall make the arbitral award normally within 3 months from the date of entering upon the reference.
278A: Request for extension
The time taken to make the award may not be extended beyond 3 times , by the Managing Director or Relevant Authority on anapplication by either of the parties or the arbitrator (s) as the case may be .
(4) At the time of debiting the award amount , theExchange shall inform the awardee thatthe Exchange will not be liable for loss of interest , business etc. , in case the award is modified by the Court , indicating that if any amount of interest is still payable to the awardee e.g. from the date of debiting the member's account till the date of payment of the award amount to the awardee , the same shall be recoverable from the concerned member and the Exchange shall not be liable in this regard .
290(a) : Consequence of non -compliance Notwithstanding the extensions granted in the above manner, the arbitrator ( s ) shall make the arbitral award within a period of six months from the date of entering into reference i.e. extension of time can be for a maximum period of three months.
278B: Date of Entering Reference
For the purposes of these bye laws , the arbitrator( s ) shall be deemed to have entered upon a reference on the date on which the arbitrator (s ) has held the first hearing.
282A: Implementation of Award
Wherea member who is a party to arbitration fails to comply with the arbitral award, the Exchange shall implement the award as per the provision of bye- law 282A. The other party may also make a fresh reference to further award for determining the dispute cutstanding or the amount of damages or compensation payable by reason of such failure. Furthermore , the member in default may bepenalised by way of expulsion by the Board of Directors .
