"परन्तु यह तब जबकि , बाई-लॉज एवं रेगुलेशन में यथा उपबंधित व्यत्रहार ( डोल्स ) से उत्पन्न क्लीयरिंग एवं सेटलमेन्ट आपरेशन के फलस्वरूप सदस्य की एक्सचेंज में क्लीयरिंग हाउस के लिए आब्लीगेशन को पूर्ण करने में सदस्य की असफलता की दशा में , प्रासंगिक अधिकारी जिसमें गर्वोनग बोर्ड या गर्वानंग वोर्ड द्वारा गठित कमेटी या प्रशासक , जैसी भी स्थिति हो, ऐप्सी निबंधन एवं शर्ते जैसी प्रासंगिक प्राधिकारी समय- यय पर विनिदिष्ट करेंगे , सदस्य को डिफाल्टर घोषित किये बिना सेटलमेन्ट गारण्टी फण्ड का उपयोग कर सकेंगे । " उपरोक्त प्रस्ताव प्रकाशन की तिथि के 15 दिनीं के पश्चात् विचार में लाया जायेगा ।

उपरोक्त अधिसूचना के बिन्दु संख्या 1 में , यह असावधानी पूर्वक उल्लेख किया गया था कि उप- नियम 13 क और 13ख उप -नियम के अध्याय-XI की बजाये अध्याय-XII में प्रविष्ट किए जाते हैं । इसलिए , ' उप- नियम के अध्याय-XII' शब्दों के स्थान पर ' उप- नियम का अध्याय-XI' पढ़ा जाए ।

"Provided that in the event , a member fails to meet his . obligations to the Clearing House of the Exchange, arising out of clearing and settlement operations of such deals as provided in the Bye - laws and Regulacions , the relevant authority constitt: ting the Governing Board or the Committee constituted by the Governing Board or the Adminisrator as the case may be , may utilise the Settlement Guarantee Fund , without declaring the member defaulter under such terms and conditions as the relevant auhority may specify from time to time . "

CORRIGENDUM
1. " संविदा नोट यह निर्दिष्ट करेगा कि लेन-देन एक्सचेंज के उप-निययों, नियमों विनियमों के अधीन है" शब्दों के बाट एक्सचेंज के उप- नियमों के अध्याय- IX के उप- नियम 8 में आने वाले " और मुंबई के सिविल न्यायालय के क्षेत्राधिकार के अधीन" शब्दों को हटाया जाना प्रस्तावित है ।
The following corrections may be noted in the amend- ments to the Byelaws of the Exchange notified and published in page no. 182 of the Gazette of India ( No. 30 ) , Part IV dated July 27, 2002-
2. एक्सचेंज के उप- नियम के अध्याय-XI के उप-नियमों 2 और 3 में आने वाले " उप-नियम ( 1 ) , ( 1 क ) और ( 1ख ) " शब्दों को निम्नलिखित " उप- नियम ( 1 ) , ( 1 क ) , ( 1 ख ) और ( 1 घ ) " शब्दों से प्रतिस्थापित किया जाना प्रस्तावित है ।
In point no. I of the above notification , it was inadver- tantly mentioned that the Byelaws 13A and 13B are inserted in the Chapter XII of the Byelaws instead of Chapter XI . Hence , the words 'Chapter XII of the Byelaws' may be read as 'Chapter XI of the Byelaws .

2. The words " Byclaws ( 1 ) , ( 1A) and ( IB ) " appearing in Byelaws 2 and 3 of Chapter XI of the Byelaws of the Exchange are proposed to be substituted with the followin; words "Byelaws ( 1 ) , ( 1A) , ( 1B ) and (10)" .
3. The words " and Issuer " be inserted in between the words " If the Constituent chooses to appear by counsel, attorney or advocate , then the Trading Member" and the words "shall be granted a similar privilege " in Byelaw 12 of Chapter XI of the Bye- laws of the Exchange .
Consequential amendments , if any , arising out of the above suggested amendments are proposed to be made to Byelaws , Rules and Regulations of the Exchange .
As per the requirements of Rule 18 of the Securities Contracts (Regulation) Rules , 1957 , the proposed amend- ments to the Byelaws of National Stock Exchange , as given nereunder, are published for criticism in accordance with the provisions of Section 23 of the General Clauses Act , 1897 in the Official Gazette of India . Any person having any observations on the proposed amendments to the Byelaws can send the same in writingto Asst. Vice President (Legal ) , National Stock Exchange of India Limited at Exchange Plaza, C- 1 , Block G. Bandra - Kurla Complex , Bandra (East ) , Mumbai -400 051 within fifteen days from the date of the publication in the Gazette . The observations received after the aforementioned date will not be considered when the draft will be taken for consideration .
