"जब तक मामले की विशिष्ट परिस्थितियों के मद्देनजर , केन्द्रीय सरकार अम्यथाः निर्धारित न करे , कि बाह्य सेना में तैनाती के मामले को छोड़कर , उपयुक्त सेवा का कोई सदस्य जो छु‌ट्टी लेकर अथवा अभ्यथा, पाँच वर्ष से अधिक की अवधि के लिए निरन्तर डयुटी से अनुपस्थित रहता है , वह सेवा से त्यागपत्न दिया हुआ समझा जाएगा ।

परन्तु यह कि उप नियम ( 2 ) के प्रावधानों का आश्रय लेने से पहले सेवा के सदस्य को ऐसी अनुपस्थित के कारण स्पष्ट करने का समुचित अवसर दिया जाएगा । "

सं० 11020 / 27 / 95 -अ० भा० से० ( III )-अखिल भारतीय सेवा ( छुट्टी ) नियमावली, 1955 के नियम 7 ( 1 ) की शर्तों के अनुसार, उपर्युक्त सेवा के किसी सदस्य को निरंतर 5 वर्ष 4. उपर्युक्त अधिकारी को पहले भी एक कारण बहालो नोटिस दिनांक 12-07-2002 को जारी किया गया था और 20-08-2002 , 05-11-2002 , 05-02-2003 तथा 27-03-2008 को अनुस्मारक भेजे गए थे । इनके बावजूद उनसे कोई पावती अथवा उत्तर प्राप्त नहीं हुआ है । राज्य सरकार ने उनके अमेरिका स्थित निवास पर दिनांक 04-08-2002 को ज्ञापन संख्या 2427 /पी० ए ० आर ० (भा० प्र ० से० ) द्वारा एक नोटिस भेजा परन्तु वहां से कोई पावतीं नहीं मिली है ।

5. श्री सुभेन्दु राय, भारतीय प्रशासनिक सेवा (पश्चिम बंगाल: 76 ) को एतद्वारा एक कारण बताओ नोटिस जारी किया जाता है , उनसे यह भी पूछा गया है कि 5 वर्ष से अधिक की अवधि तक अनुपस्थित रहने के लिए उन्हें अखिल भारतीय মান 1- 21

सेक्स ( शुकुटी) नियमावली 1955 के नियम 7( 2 ) के उप- बत्वों के अनुसार भारतीय प्रशासनिक सेवा से त्यागपत्र दिया हुआ। क्यों नहीं समझा जाए । उनका उत्तर अधोहस्ताक्षरी को इस अधिसूचना के राजपत्त्र में प्रकाशित होने की तारीख से एक माह के भीतर पहुंच जाना चाहिए और ऐसा नहीं किए जाने पर इस विभाग द्वारा मामले में आगे की कार्यवाही उन्हें इस सम्बन्ध में कोई संदर्भ भेजे बिना ही की जाएगी और उपर्युक्त सेवा से उनका त्यागपत्त्र दिया हुआ समझा जाएगा ।

सं ० 11020/ 6/99 -अ ० भा० से० ( III ) -अधोहस्ताक्षरी को यह कहने का निदेश हुआ है कि अखिल भारतीय सेवा ( छुट्टी ) नियमावली, 1955 के नियम 7 ( 1 ) की शर्तों के अनुसार "सेवा के किसी सदस्य को निरन्तर 5 वर्ष से अधिक की अवधि के लिए किसी भी प्रकार की छुट्टी मंजूर नहीं की जायेगी । " उपयुक्त निथम 7 ( 2 ) में आगे यह भी प्रावधान है कि " जब तक मामले की विशिष्ट परिस्थितियों के मद्दे नजर , केन्द्रीय सरकार अन्यथा निर्धारित न करे , कि वाह्य सेवा में तैनाती के मामले को छोड़कर , उपर्युक्त सेवा का कोई सदस्य जो छुट्टी लेकर अर्थवा अन्यथा , पाँच वर्ष से अधिक की अवधि के लिए निरन्तर ड्यूटी से अनुपस्थित रहता है, वह सेवा से त्यागपत्र दिया हुआ समझा जायेगा ।

परन्तु यह कि उप नियम ( 2 ) के प्रावधानों का आश्रय लेने से पहले सेवा के सदस्य को ऐसी अनुपस्थिति के कारण स्पष्ट करने का समुचित अवसर दिया जाएगा । "

2. श्री एस० सी० अस्थाना भारतीय प्रशासनिक सेवा (उ० प्र० : 77 ) ने उत्तर प्रदेश सरकार के अधीन सेवा करते समय , संयुक्त राज्य अमेरिका ( यू० एस ० ए ० ) में उच्च अध्ययन करने के लिए छुट्टी का आवेदन दिया था । घे दिनांक 01-08-1990 से अपने संवर्ग से बाहर है । श्री एस० सी० अस्थाना ने उत्तर प्रदेश सरकार में अभी तक ड्यूटी के लिए सूचित नहीं किया है और 01-08-1990 से पाँच बर्ष से अधिक की अवधि से डयूटी से अनुपस्थित हैं । चूंकि ड्यूटी से लगातार अनुपस्थिति पाँच वर्ष से अधिक की अनधि की हो गई है अतः उपर्युक्त अनुपस्थिति अखिल भारतीय सेबा ( छुट्टी ) नियमावली 1955 के नियम 7 ( 2 ) के प्रावधान आकषित करती है ।

2. आप दिनांक 06-06-1994 से 31-03-1996 तक की दो वर्ष की अध्ययन छुट्टी मंजूर हो जाने के बाद दिनांक 06-06-1994 से लेकर अब तक बिना अनुमति के संवर्ग से बाहर हैं आपकी अनुपस्थिति लगातार पांच वर्ष से अधिक समय अवधि की हो गई है । यह अनुपस्थिति अखिल भारतीय सेवा ( छुट्टी) नियमावली, 1955 के नियम 7 ( 2 ) के प्रावधानों को आकर्षित करती है । अतः आपको ' कारण बताओ ' का निर्देश दिया जाता है कि अखिल भारतीय सेवा ( छूट्टी ) नियम, 1955 के नियम 7 ( 2 ) के प्रावधानों के अनुसार आपके विरुद्ध कार्रवाई क्यों न की जाए और आपका सेवा से त्यागपत्त्र दिया हुआ क्यों न समझा जाए ?

2. अब उक्त अधिनियम की धारा 16 की उप धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार श्री लक्षमन दास मुआल , सेवानिवृत अपर जिला और सात्त्र न्यायाधीश दिल्ली को फरवरी, 2003 के 18वें दिन (18-2-2003 ) से तीन वर्ष की अवधि के लिए दिल्ली मैट्री रेलवे से संबंध में उक्त अधिनियम के प्रयोजन से सक्षम प्राधिकारी नियुक्त करती है ।

In terms of Rule 7 ( 1 ) of the All India Service ( Leave ) Rules , 1955 , no member of the service shall be granted leave of any kind for a continuous period exceeding five years . Rure 7 (2) ibid provides that : - "Unless the Central Government , in view of the special circumstances of the case , determines otherwise , a member of the service who remains absent from duty for a conti- nuous period exceeding five years other than on foreign service , whether with or without leave , shall be deemed to have resigned from the service.

2. Shri S. C. Asthana, IAS ( UP : 77) , while serving the Government of U.P. , had applied for study leave to pursue imgner studies in USA . He has been away from the cadre w.e.f. 01-08-1990 . Shri S. C. Asthana has not so far reported back for duty to his cadre i.e. Government of U.P. and is absenting himself for a period exceeding five years since 01-08-1990. Since the continuous absence from auty has been for more than five years, it attracts the provision ofRule 7 ( 2) of the AlS ( Leave) Rules , 1955 quoted above.

3. A Show Cause Notice had in the past been issued on 28-2-2002 and despite reminders on 10-4-2002, 23-05-2002, 18-11-2002, 18-12-2002 , 24-02-2003 & 24-03-2003 neither acknowledgement nor reply has been received. The notice was forwarded for service by the Ministry of External Affairs at his last known address viz 105 , Winchestar Way , Harleysville, Pennsylvanai - 19838-3604 , U.S.A.

4. Shri S. C. Asthana , IAS (UP : 77) is, hereby, called upon to show cause as to why he should not be deemed to have resigned from the Indian Administrative Service in terms of provisions of Rule 7 (2) of the All India Services ( Leave) Rules, 1955 as mentioned above , for continuously remaining absent from duty for a period exceeding five years . II (UT) S.O. , dated the 5th June , 2002 , published in Gazette of India, Part I Section 1 , dated the 5th June , 2000, issued under sub - section ( 3 ) of section 1 of the Metro Railway (Construction of Works) Act, 1978 , ( 33 of 1978 ) , ( herein- after referred to as the said Act) , the Central Government declared that the said Act has applied to the metropolitan city of Delhi ;
