II ( खंड 11 ) और दिनांक 30.6.2003 के का.ज्ञा. सं. 20/9/2003 - सी.एस . 11 के अनुसरण में, राष्ट्रपति, ग्रामीण विकास मंत्रालय के केन्द्रीय सचिवालय आशुलिपिक सेवा संवर्ग के प्रधान निजी सचिव (२२३-स्थाने ) श्री आर. के. शर्मा को कार्यभार ग्रहण करने पर दिनांक 30.06.2003 के पूर्वाह्न से 31.12.2003 तक अथवा पद के नियमित आधार पर भरे जाने तक अथवा अगले आदेशों तक, जो भी पहले हो, त्रिधि कार्य विभाग , विधि और न्याय मंत्रालय के केन्द्रीय सचिवालय आशुलिपिक सेवा संवर्ग में विधि आयोग में तदर्थ आधार पर रु. 10,000--15,200/- के वेतनमान में प्रधान निजी सचिव के पद पर नियुक्त करते हैं ।

2. इस तदर्थ नियुक्ति के आधार पर वे प्रधान निजी सचिव के ग्रेड में नियमित नियुक्ति का कोई दावा नहीं कर सकेंगे और न ही उनके द्वारा तदर्थ आधार पर की गई यह सेवा ग्रेड में उनकी वरिष्ठता अथवा अगले उच्च ग्रेड में प्रोन्नति के लिए गिनी जाएगी ।

2. उपर्युक्त नियुक्ति का आदेश पूर्णतया तदर्थ आधार पर किया गया है और इसके कारण उक्त अधिकारी को ग्रेड में अनिश्चित समय तक कार्य करते रहने अथवा वरिष्ठता के लिए अथवा उच्च ग्रेड में पदोन्नति आदि के लिए कोई अधिकार नहीं मिलेगा । सरकार के पास संबंधित अधिकारी को कोई कारण बताए बिना अथवा सूचना आदि दिए बिना इस तदर्थ नियुक्ति को समाप्त करने का अधिकार है ।

यदि बाद में यह पाया जाता है कि कोई कर्मचारी इस परीक्षा को देने के लिए नियमों अथवा इस विषयक अनुदेशों के अधीन अथवा किसी अन्य कारण से पात्र नहीं था , तो उसकी प्रोन्नति को रद्द कर दिया जाएगा । उन कर्मचारियों के संबंध में , यदि कोई हो, जिनका इस परीक्षा में प्रवेश अनंतिम था, यह प्रोन्नति उनके द्वारा परीक्षा देने के लिए पात्रःण के संबंध में अंतिम निर्णय के अध्यधीन होगी ।

4. परिवीक्षा अवधि

यदि बाद में यह पाया जाता है कि कोई कर्मचारी इस परीक्षा को देने के लिए नियमों अथवा स त्रिषयक अनुदेशों के अधीन अथवा किसी अन्य कारण से पात्र नहीं था, तो उसकी प्रोन्नति को रद्द कर दिया जाएगा । उन कर्मचारियों के संबंध में, यदि कोई हो, जिनका इस परीक्षा में प्रवेश अनंतिम था, यह प्रोन्नति उनके द्वारा परीक्षा देने के लिए पात्रता के संबंध में अंतिम निर्णय के अध्यधीन होगी ।

4. परिवीक्षा अवधि

डाक सेवा समूह ' ख ' में पदोन्नत सभी कर्मचारी दो वर्षों के लिए परिवीक्षा पर रहेंगे और इस पद पर बने रहने के लिए उनकी उपयुक्तता पर निर्णय दो वर्षों की परिवीक्षा अवधि के पूरा होने के बाद लिया जाएगा । यदि इस अवधि के दौरान कोई कर्मचारी 30 दिनों से अधिक की अवधि के लिए अवकाश पर जाता है, तो अवकाश की अवधि के आधार पर परिवीक्षा अवधि को बढ़ा दिया जाएगा।

5. प्रशिक्षण

डाक सेवा मूह ' ख' में पदोन्नत सभी कर्मचारी दो वर्षों के लिए परिवीक्षा पर रहें । और इस पद पर बने रहने के लिए उनकी उपयुक्तता पर निर्णय दो वर्षों की परिवीक्षा अवधि के पूरा होने के बाद लिया जाएगा । यदि इस अवधि के दौरान कोई कर्मचाएं 30 दिनों से अधिक की अवधि के लिए अवकाश पर जाता है, तो अव काश की अवधि के आधार पर परिवीक्षा अवधि को बढ़ा दिया जाएंगा ।

5. प्रशिक्षण

फिलहाल डाक सेवा समूह ' ख ' में बिना किसी प्रशिक्षण के कर्मचारी को मीधी पदोन्नति दी जाएगी । तथापि, जब और जैसे निदेशक, पोस्टल स्टाफ कालेज , गाजियाबाद द्वारा अधिसूचित किया जाएगा , उन्हें निर्धारित प्रशिक्षण लेना होगा ।

6. वेतन निर्धारण के लिए विकल्प

फिलहाल डाक सेवा समूह ' ख ' में बिना किसी प्रशिक्षण के कर्मचारी को सीधी पदोन्नति दी जाएगी । तथापि, जब और जैसे निदेशक, पोस्टल स्टाफ कालेज, गाजियाबाद द्वारा अधिसूचित । कया जाएगा, उन्हें निर्धारित प्रशिक्षण लेना होगा ।

अधिकारी यदि एफ आर-22 ( 1 ) ( क ) के अन्तर्गत वेतन निर्धारण के. लिए तारीख चुनने के लिए विकल्प देना चाहते हैं, तो उन्हें पदोन्नति की तारीख से एक माह के अंदर विकल्प देना होगा ।

Sethuraman as Deputy Chairman, Calcutta Dock Labour Board in the pay scale of Rs . 18500-23900 ( Industrial D.A. pattern ) on deputation basis with effect from 5.5.2003 ( Forenoon ) upto 31.12.2003 or till supersession/merger of Calcutta Dock Labour Board with Kolkata Port Trust , whichever event occurs earlier.
