यू० सी० नांगिया , उप सचिव उपर्युक्त नियुक्ति बिल्कुल तदर्थ आधार पर की गई है और इससे उन्हें भविष्य में कभी उक्त ग्रेड में अनिश्चित समय तक बने रहने अथवा वरिष्ठता के लिए दावा करने का कोई अधिकार प्राप्त नहीं होगा । सरकार के पास किसी भी समय कोई कारण बताए बिना अथवा सूचना आदि दिए बिना इस तदर्थ नियुक्ति को समाप्त करने का अधिकार है । यह नियुक्ति उच्चतम न्यायालय में लंबित एस ० एल ० पी० 8828/2000 (यू० ओ ० आई ० बनाम श्री आर० एच० भालेकर) और अन्य न्यायिक आदेशों के परिणाम के अधीन होगी ।

3. वरिष्ठ अनुसंधान अधिकारी के ग्रेड में फ्लेक्सीबल कॉम्प्लीमेंटिंग स्कीम के तहत उपरोक्त अधिकारियों की पदोन्नति स्व-स्थाने और वैयक्तिक होगी और इसके कारण निचले ग्रेड में विशिष्ट पदरिक्ति नहीं होगी । संबंधित अधिकारियों द्वारा इस समय धारित पद को उच्च ग्रेड अर्थात वरिष्ठ अनुसंधान अधिकारी के पद पर उनके बने रहने की अवधि के दौरान उन्नयन किया हुआ माना जायगा तथा इन अधिकारियों द्वारा उच्छ पदों को छोड़ने पर उन्हें मूल स्तर पर अवनत मानां जाएगा । भण्ड 2 ]
