यहां ऊपर कुछ विहित होते हुए भी और व्यापारिक सदस्य तथा संघटक के बीच किसी दावे , विवाद और संघटक तथा व्यापारिक सदस्य के बीच इंटरनेट व्यापार से उत्पन्न हुए मतभेदों के संबंध में विशेष रूप से जब तक अन्यथा लिखित सहमति नहीं हो, विवाचन का स्थान उस क्षेत्र , जिसमें संघटक ने संगत व्यापार के समय साधारणतया निवास किया हो, के भीतर क्षेत्रीय विवाचन केन्द्र होगा तथा बशर्ते कि अनिवासी भारतीय संघटक के संबंध में विवाचन का स्थान उस क्षेत्र, जिसमें व्यापारिक सदस्य के पत्राचार का कार्यालय स्थित है, क्षेत्रीय विवाचन केन्द्र होगा । अउद्धृत
3. निम्नलिखित खण्ड विनियम 3.6.4 के रूप में प्रविष्ट किया जाता है : --

संविदा, टिप्पणी को एक से प्रारंभ करके अद्वितीय चल क्रम संख्या से संख्यांकित किया जाएगा, जिसे केवल प्रत्येक वित्तीय वर्ष ( यथा अप्रैल से मार्च ) के प्रारंभ में ही पुनः निर्धारित किया जाएगा । अगर व्यापारिक सदस्य केविभिन्नलेन-देन कार्यालयों के संबंध में पृथक श्रृंखलाएं रखी जाती है तो लेन - देन के कार्यालय का नाम अथवा कोड क्रम संख्या के पहले रखा जाएगा ।

कार्यवाही करने के लिए हुई लागत को पूरा करने के लिए प्रपत्र संख्या 1 अथवा प्रपत्र संख्या III , जैसा भी मामला हो , के साथ एक्सचेंज के पास राशि जमा करेंगी, बशर्ते कि जब संघटक होने वाले प्रतिवादी द्वारा तदनुसार राशिजमा करने में विफलता, अवहेलना अथवा अस्वीकृत हो , आवेदक तथापि निर्णय के अनुसार ऐसे प्रतिवादी से उसकी वसूली के अपने अधिकार को हानि पहुंचाए बिना ऐसी राशि जमा करने के लिए उत्तरदायी होगा । एक्सचेंज को व्यापारिक सदस्य से उसे देय राशियों से जमाराशि वसूल करने का अधिकार होगा अगर व्यापारिक सदस्य राशि जमा करने में विफल रहता है ।

5. मौजूदा विनियम 5.8 ( ख ) निम्नलिखित नए विनियम से प्रतिस्थापित किया जाता है : --

6. निम्नलिखित शब्द मौजूदा विनियम 4.4.14 से हटाए जाते हैं : -- उद्धृत
वह तब अतिशीघ्र व्यापारिक प्रणाली पर व्यापार रद्द करने का अनुरोध प्रस्तुत करेगा । वह ऐसा अनुरोध करने के लिए अतिशीघ्र विरोधी पार्टी को विधिवत सूचित भी करेगा ।

7. संविदा टिप्पणी के प्ररूप से शब्द ' कोड संख्या ' हटाए जाते हैं और शब्द ' व्यापारिक कोड और अद्वितीय ग्राहक कोड' समामेलित किए जाते हैं ।

2. The following clause is inserted as Regulation 5.3A .
QUOTE
Notwithstanding anything contained hereinabove and unless otherwise specifically agreed in writing between the Trading Member and the Constituent, in respect of any claims , disputesanddifferences arising out of internet trading between the constituent and trading member, the seat of arbitration shall be the Regional Arbitration Centre within the area in which the constituent ordinarily resided at the time of relevant trading , provided however in respect of a non - resident Indian constituent , the seat of arbitration shall be the Regional . Arbitration Centre in the area of which the correspondence office of the trading member is situated.

3. The following clause is inserted as Regulation 3.6.4 :-
QUOTE
The contract notes shall be numbered with unique running serial number commencing from one which shall be reset only at the beginning of every financial year (viz . April to March) . In case separate series are , maintained in respect of different dealing offices of the Trading Member , then the dealing office name or code shall be pre - fixed to the serial number.

4. The existing Regulation 5.8 ( a) is replaced with the following new Regulation:
QUOTE
The parties to the claim , difference or dispute shall bear cost of arbitration . For this purpose , both the parties to arbitration shall make a deposit with the Exchange along with FormNo. I or Form No. III as the case may be , for defraying the costs that may be incurred for conducting the arbitration proceeding provided when there is failure , neglect or refusal by Respondent, being a constituent , to make a deposit accordingly , the Applicant shall be responsible for making such deposit without prejudice however to its right to recover the same from such Respondent in terms of the award. The Exchange shall have the right to recover the deposit from the Trading member from the money due to it if the Trading Member fails make the deposit .

5. The existing Regulation 5.8 (b) is replaced with the following new Regulation :

The amount of deposit , which has to be deposited is determined by the amount of the claim and is as specified below:

6. The following words are deleted from the existing Regulation 4.4.14:

He shall then place the trade cancellation request on the Trading System at the earliest. He shall also duly inform the counter party at the earliest to inake such request . UNQUOTE
7. The words 'code number' are deleted and the words 'Trading code and Unique Client Code' are incorporated in the format of the Contract Note .
