( श्रीमती ) मृदुला बी. सत्यमूर्ति, वैज्ञानिक अधिकारी /डी , भाभा परमाणु अनुसंधान केन्द्र ( बीएआरसी ), मुंबई को उनकी बच्ची के यूएसए में उपचार हेतु दिनांक 21.06.1996 से 15.12.1997 तक की असाधारण छुट्टी प्रदान की थी, लेकिन छुट्टी खत्म होने के बाद भी उन्होंने डयूटी पर रिपोर्ट नहीं की और डयूटी पर रिपोर्ट करने के अनुदेशों के बावजूद दिनांक 16.12.1997 से अप्राधिकृत रूप से अनुपस्थित रही हैं;
और जबकि संघ लोक सेवा आयोग से परामर्श लिया गया और आयोग नेसभी संगत तथ्य एवं मामले के अन्य पक्षों पर सावधानीपूर्वक विचार करने भाग III-खण्ड 1]

( श्रीमती ) मृदुला बी. सत्यमूर्ति, वैज्ञानिक अधिकारी/डी , भाभा परमाणु अनुसंधान केन्द्र, मुंबई को तत्काल प्रभाव से " सेवा से बर्खास्त" करने का दंड लगाया है;

Satyamurti, Scientific Officer/D, Bhabha Atomic Research Centre , Mumbai , who was granted Extra Ordinary Leave from 21.6.1996 to 15.12.1997 for her daughter's treatment in USA did not report for duty on expiry of the leave and has been unauthorisedly absenting with effect from 16.12.1997 inspite of instructions to report for duty;
AND WHEREAS the said Dr. (Smt. ) Satyamurti by her aforesaid conduct , had shown lack of devotion to duty and had acted in a manner unbecoming of a Government servant, thereby contravening the provisions of sub - rules 1 ( ii ) and (1) ( iii ) of Rule 3 of Central Civil Services ( Conduct ) Rules , 1964;
AND WHEREAS the said Dr. (Smt . ) Satyamurti was informed of the charge and of the action proposed to be taken against her under Rule 14 of the Central Civil Services PART III- SEC . 1 ]

AND WHEREAS the said Dr. (Smt.) Satyamurti , vide her written statement of defence dated 28.11.99 accepted the charge;
AND WHEREAS after taking into consideration the records of the case and the written statement of defence submitted by Dr. (Smt.) Satyamurti and having regard to its own findings on the article of charge, the Disciplinary Authority came to the conclusion that it would notbe in the interest of work to sanction her leave indefinitely although her child is undergoing treatment in US. Considering the difficult situation she is in, a liberal view was taken in the matter and recommended that the penalty of 'compulsory retirement from service' with all admissible retirement benefits be imposed on Dr. ( Smt . ) Satyamurti;
AND WHEREAS, the Union Public Service Commission was consulted in the matter. After careful consideration of all relevant facts and records of the case, the Commission , vide its letter No. F.3/479/99- SI dated: 31.3.2000 advised that a formal inquiry need be conducted as the charge is hot accepted by the charged official unconditionally;
AND WHEREAS a formal inquiry under Rule 14 of the Central Civil Services ( Classification , Control and Appeal ) Rules, 1965 was ordered appointing an Inquiring Authority, vide Order. No. 1/15 (6)/99-Vig./374 dated 28.6.2000;
1413 NOW, THEREFORE, the President , on acceptance of the said advise of UPSC and in exercise of the powers conferred on him under rule 15 (4) of Central Civil Services (Classification , Control and Appeal ) Rules , 1965 hereby imposes the penalty of ' dismissal from service' on the said Dr. (Smt. ) Mridula B. Satyamurti , Scientific Officer/D, Bhabina Atomic Research Centre, Mumbai , with immediate effect.
The period of unauthorised absence from 16th_of December, 1997 till the date of issue of this order shall be treated as dies rion .
