आ. अ. 4.-यतः , गुजरात विधान सभा के लिए साधारण निर्वाचन, 2002 में, 69-दरियापुर- काजीपुर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाला एके अभ्यर्थी श्री केशुभाई अग्रवाल, बी-73 प्रफुलनगर, सुमिननगर, वस्त्राल, अहमदाबाद को, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अधीन जिला निर्वाचन अधिकारी , अहमदाबाद , गुजरात तारीख 09-07-2003 के पत्र द्वारा निर्वाचन व्ययों का लेखा दाखिल न करने के संबंध में दी गई रिपोर्ट के आधार पर भारत निर्वाचन आयोग ने तारीख 07-08-2003 के आदेश सं. 76/गुजः/2003 द्वारा निरर्हित किया गया था; और

यतः , आयोग को जिला निर्वाचन अधिकारी , अहमदाबाद से दिनांक 02-12-2003 की एक और रिपोर्ट प्राप्त हुई है और जिला निर्वाचन अधिकारी , अहमदाबाद की अद्यतन रिपोर्ट में निहित सभी महत्वपूर्ण तथ्यों पर विचार करने के बाद और लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 द्वारा प्रदत्त शक्तियों के प्रयोग में, आयोग ने यह निर्णय किया है कि उक्त अभ्यर्थी श्री केशुभाई अग्रवाल पर लगाई गई निरर्हता आरम्भ से हटाई जाती है ।

O.N. 4.--Whereas, Shri Kesubhai Agrawal , E73 , Prafulnagar , Suminnagar , Vastral, Ahmedabad a contesting candidate for the General Election to the Gujarat Legislatie Assembly - 2002 from 69 - Dariapur - Kazipur was disqualifted by the Election Commission of India vide its Order No. 76/GJ/.003 dated 07-08-2003 under Section 10A ofthe Representation ofthe People Act, 1951 , on the basis of report of District Eiction Officer, Ahmedabad, Gujarat intimating non submission ofaccount of election expenses by the said candidate vide iis latter dated 09-07-2003 , and

Whereas, the Commission has now received further eport dated 02-12-2003 from the District Election Officer , Ahmedabad, and after considering all material facts contained'n latest report of the District Election Officer , Ahmedabad and in exercise of the powers conferred by Section II of the epresentation of People Act, 1951 , the Commission has decided to revoke ab - initio the disqualification imposed upon he above said candidate , Shri Kesubhai Agrawal .

आ. अ. 5.-यतः , निर्वाचन आयोग का समाधान हो गया है कि नीचे की सरणी के स्तम्भ ( 2) में यथा विनिर्दिष्ट फरवरी , 2000 में हुए हरियाणा राज्य की विधान सभा के साधारण निर्वाचन के लिए जो स्तम्भ ( 3 ) में विनिर्वाष्टि निर्वाचन क्षेत्र से हुआ है स्तम्भ (4 ) में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिधित्व अधिनियम, 1951 तथ तद्धीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ ( 5 ) में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहा है ,

और जबकि, उक्त अभ्यर्थियों ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए या तो कोई कारण अथवा स्पष्टीकरण नहींदिया है या उनके द्वारा दिए गए अभ्यावेदनों पर, यदि कोई हो, विचार करने के पश्चात् निर्वाचन आयेग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायोचित्य नहीं है ।

अतः अब, निर्वाचन आयोग एतद्वारा उक्त अधिनियम की धारा 10 - क के अनुसरण में नीचे की सारणी के स्तम्भ ( 4 ) में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है ।

आ. अ. 6.- यतः , निर्वाचन आयोग का समाधान हो गया है कि 78- फतेहाबादं विधान सभा क्षेत्र से हरियाणा विधान सभा के उप निर्वाचन के लिए निर्वाचन लड़ने वाले श्री उपेन्द्र कुमार, मकान नं. 203 , भीमा बस्ती , फतेहाबाद, लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहा है ;

और श्री उपेन्द्र कुमार ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए या तो कोई कारण अथवा स्पष्टीकरण नहीं दिया है या उनके द्वारा दिए गए अभ्यावेदनों पर, यदि कोई हो, विचार करने के पश्चात् निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है ।

आ. अ. 9.-यतः , निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ ( 2 ) में निर्दिष्ट राजस्थान विधान सभाके उप-निर्वाचन के लिए जो स्तम्भ ( 3 ) में विनिर्दिष्ट निर्वाचनत्र क्षेत्र से हुआ है स्तम्भ ( 4 ) में उनके नाम के सामने विनिर्दिष्ट निर्वाचन लड़ने वाले अभ्यर्थी , लोक प्रतिनिधित्व अधिनियम, 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ ( 5 ) में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं;

और यतः , उक्त अभ्यर्थी ने निर्वाचन आयोग द्वारा सम्यक सूचना दिए जाने पर भी उक्त असफलता के लिए न तो कोई कारण और न ही स्पष्टीकरण दिया है अथवा उनके द्वारा दिए गए अभ्यावेदनों पर, यदि कोई हों, विचार करने के पश्चात् निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहींहै;

अतः अब , निर्वाचन आयोग उक्त व्यक्ति अधिनियम की धारा 10- क के अनुसरण में नीचे के स्तम्भ ( 4 ) में विनिर्दिष्ट संसद के किसी भी सदन के या किसी राज्य की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालाविध के लिए एतद्वारा निरर्हित घोषित करता है ।

आ. अ. 10.- लोक प्रतिनिधित्व अधिनियम, 1950 ( 1950 का 43 ) की धारा 13 - क की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत निर्वाचन आयोग पाँडिचेरी सरकार के परामर्श से श्री बी० विजयन, आई ०ए ० एस ० के स्थान पर श्री चेतन बी० सांघी , आई ० ए ०एस ० ( ए०जी० एम ०यू०-88 ) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए पाँडिचेरी संघ राज्य क्षेत्र के मुख्य निर्वाचन अधिकारी के रूप में एत‌द्वारा नामित करता है । उन्हें निर्वाचनों के संबंध में राज्य सचिवालय के उस विभाग में , सरकार के सचिव के रूप में भी पदाभिहित किया जाएगा ।

आयोग , पाँडिचेरी संघ राज्य क्षेत्र में पूर्णकालिक मुख्य निर्वाचन अधिकारी के लिए जोर नहीं दे रहा है, क्योंकि इस संघ राज्य क्षेत्र में दो से अधिक संसदीय निर्वाचन क्षेत्र नहीं हैं । जैसे ही साधारण निर्वाचन निकट होंगे, श्री चेतन बी० सांघी को सभी तथा प्रत्येक अतिरिक्त कार्य भार से मुक्त कर दिया जाएगा।

In exercise of the power conferred by sub - section (I ) of section 13A of the Representation of the People Act , 1950 (43 of 1950) the Election Commission of India in consultation with Government of Pondicherry hereby nominates Shri Chetan B. Sanghi , IAS ( AGMU: 88 ) as the Chief Electoral Officer for the Union Territory of Pondicherry with effect from the date he takes over charge and until further orders vice Shri B. Vijayan , IAS . He will also be designated as Secretary to the Govt . in the Deptt. in the State Secretariat dealing with elections .

2. The Commission is not insisting on a full time Chief Electoral Officer in Union Territory ofPondicherry as the Union Territory has not more than two Parliamentary Constituencies . As soon as general election becomes imminent, Sh . Chetan B. Sanghi shall be divested of all and every additional charge .
