एसबीडीक्र. 17/2003-04-- भारतीय स्टेट बैंक ( समनुषंगी बैंक ) अधिनियम, 1959 की धारा 25, उप धारा ( 1 ) के खंड ( ग) की अनुसार 'भारतीय स्टेट बैंक ने अधिसूचना क्र. एसव्हीडी/ 13/2003 दिनांक 8.10.2003 के द्वारा श्री सी. भट्टाचार्य, उप प्रबंध निदेशक एवं समूह कार्यपालक ( सहयोगी एवं अनुषंगी ) , भारतीय स्टेट बैंक, मुंबई को दिनांक 8.10.2003 से निम्नलिखित सहयोगी बैंकों के निदेशक के रूप में नामित किया था :--

संदर्भ सं.आई एस डी: 629: 2003-04

बैंकिंग कंपनी ( उपक्रमों का अर्जन और अंतरण) अधिनियम, 1980 ( 1980 का 40 ) की धारा 19 की उप- धारा (2) द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए , भारतीय रिज़र्व बैंक के साथ परामर्श करने के पश्चात् तथा केन्द्र सरकार की पूर्व मंजूरी के साथ कार्पोरेशन बैंक का निदेशक मंडल कार्पोरेशन बैंक सामान्य विनियम , 1998 में पुनः संशोधन करने के लिए एतद्वारा निम्नलिखित संशोधन करता है -

1. ( 1 ) . ये विनियम कार्पोरेशन बैंक सामान्य (संशोधन) विनियम , 2003 कहलाएँगे ।

A (2) ये विनियम सरकारी राजपत्र में इनके प्रकाशन की तिथि से प्रभावी होंगे ।

2. " कार्पोरेशन बैंक सामान्य विनियम , 1998 " का "कार्पोरेशन बैंक ( शेयर तथा बैठकें) विनियम , 1998 " के रूप में पुनर्नामकरण किया जाएगा ।

कार्पोरेशन बैंक (शेयर तथा बैठकें) विनियम , 1998 के विनियम 2 में पुनर्नामित विनियम - 3.

(i) खण्ड (ङ) निम्नलिखित से स्थानापित किया जाएगा, अर्थात्

" (ङ) ' समिति' का अर्थ विनियम 2ए के अधीन गठित समिति" है;

(ii) खण्ड (ञ) में अंत में निम्नलिखित शब्द और अंक सम्मिलित किये जाएंगे , अर्थात् "और डिपाजिटरी अधिनियम , 1996 ( 1996 का 22) की धारा 11 के अधीन डिपाजिटरी द्वारा हिताधिकारी मालिकों का रजिस्टर बनाए रखा जाएगा । "

4. विनियम 2 के पश्चात् निम्नलिखित नया विनियम शामिल किया जाएगा अर्थात् -

"2ए(i ) विनियम 67 के खण्ड ( ii ) में की गई व्यवस्था को छोड़कर बोर्ड इन विनियमों के प्रयोजनों के लिए, जैसे वह उचित समझता वैसे , जब कभी ज़रूरत पड़ती हैं तब समिति गठित कर सकता है जिसमें अध्यक्ष एवं प्रबंध निदेशक या और उनकी अनुपस्थिति में कार्यपालक निदेशक तथा अन्य दो निदेशक होते हैं;

( ii) इस विनियम के अधीन गठित समिति बोर्ड द्वारा निर्दिष्ट किये जानेवाले प्रक्रियागत नियमों का पालन करेगी । " भाग III- खण्ड 4j

5. विनियम 5 में खण्ड (v). हटाया जाएगा ।

6. विनियम 5 के पश्चात् निम्नलिखित विनियम शामिल किया जाएगा अर्थात् -

"5ए(i ) रजिस्टर स्वतः अनुक्रमणिका नहीं है तो, बैंक एक अनुक्रमणिका बनाकर रखेगा जो शेयरधारकों के नामों के कार्ड इन्डेक्स के रूप में होगा और शेयरधारकों के रजिस्टर में कोई परिवर्तन करने के दिनांक के पश्चात् चौदह दिनों के भीतर अनुक्रमणिका में भी ज़रूरी परिवर्तन करेगा ।

( ii) अनुक्रमणिका शेयरधारकों के रजिस्टर के साथ रखी जाएगी । "

7. विनियम 7 में, खण्ड ( ii ) में "फ़र्मों के मामले में" शब्दों के लिए "साझेदारी फर्मों के मामले में" शब्द प्रतिस्थापित किए जाएंगे ।

8. विनियम 8 में , खण्ड (ii ) के पश्चात् निम्नलिखित खण्ड शामिल किया जाएगा -

"( iii ) सूचना प्रौद्योगिकी अधिनियम, 2000 (2000 का 21 ) के अधीन इलेक्ट्रॉनिक रिकार्डों को सुरक्षित रखने के लिए नियत संरक्षणों के अधीन इलेक्ट्रॉनिक रूप में रजिस्टर बनाए रखा जाएगा । "

9. विनियम 11 में , खण्ड (ii ) में "प्रति 100 शब्दों के लिए रु.5/- के दर पर" शब्दों के लिए "प्रति 1000 शब्दों के लिए रु.5/- के दर पर अथवा बोर्ड जिस प्रकार निर्णय करे उस दर पर" शब्द प्रतिस्थापित किए जाएंगे ।

10. विनियम 12 निम्नलिखित से प्रतिस्थापित किया जाएगा

" 12. रजिस्टर को बंद करना बैंक लागू दिशानिर्देशों का अनुपालन और स्टॉक एक्सचेंज के साथ लिस्टिंग करार सुनिश्चित करने के पश्चात् भारत में प्रसारित होनेवाले कम से कम दो समाचार पत्रों में विज्ञापन के ज़रिये न्यूनतम सात दिनों की पूर्व सूचना देने के पश्चात् बैंक शेयरधारकों का रजिस्टर किसी भी अवधि या अवधियों के लिए बंद कर सकता है जो प्रतिवर्ष में कुल मिलाकर पैंतालीस दिनों से अधिक नहीं होगी , लेकिन किसी एक समय पर तीस दिनों से अधिक नहीं होगी , जो भी उसकी राय में जरूरी हो । "

11. विनियम 13 में,

(i) खण्ड ( ii ) में "मंडल द्वारा नियुक्त किसी अन्य अधिकारी " शब्दों के लिए "कोई अन्य अधिकारी जो वेतनमान II की श्रेणी से कम का न हो या कंपनी सचिव " शब्द प्रतिस्थापित किये जाएंगे;

(ii) खण्ड (v) हटाया जायगा ।

12. विनियम 15 में , "शेयर प्रमाणपत्रों का नवीकरण " शीर्ष को निम्नलिखित रूप में प्रतिस्थापित किया जाएगा :

" नया या अनुलिपि शेयर प्रमाणपत्र जारी करना । " 104

13. विनियम 17 में खण्ड ( iii ) और (iv) निम्नलिखित खण्डों से प्रतिस्थापित किए जाएंगे -

"(iii ) अंतरण दर्ज करने के लिए अनुरोध के साथ बैंक शेयर प्रमाणपत्र के साथ अंतरण - लिखत प्राप्त होने पर, मंडल या मंडल द्वारा नामोद्दिष्ट समिति, यह सत्यापन के लिए कि तकनीकी अपेक्षाओं का पूर्णतः पालन कर लिया गया है , अंतरण के उस लिखत को शेयर प्रमाणपत्र के साथ रजिस्ट्रार या शेयर अंतरण एजेंट को अग्रेषित करेगा । रजिस्ट्रार या शेयर अंतरण एजेंट अंतरण- लिखत को विधिवत् स्टांपित करके और सही ढंग से निष्पादित करके और वह जिससे संबंधित है उस शेयर प्रमाणपत्र के साथ बैंक को प्रस्तुत नहीं किया हुआ होने पर, अंतरण करने के लिए अंतरणकर्ता के स्वत्वाधिकार को दिखाने के लिए ऐसे अन्य साक्ष्य जो बोर्ड चाहता है वह न होने पर, अंतरण - लिखत, शेयर प्रमाणपत्र के साथ, यदि कुछ हो तो, पुनः प्रस्तुतीकरण के लिए अंतरिती को लौटाएगा ।

स्पष्टीकरण : - " तकनीकी अपेक्षाओं " का अर्थ है -

(क) अंतरण विलेख विधिवत् स्टांपित किया हुआ हो ;

(ख) अंतरण विलेख में उल्लिखित प्रमाणपत्र संख्या या प्रभेदक संख्या का शेयर प्रमाणपत्र के साथ मिलान हो;

(ग) अंतरणकर्ता के हस्ताक्षर का मिलान हो;

(घ) अंतरण-विलेख का साक्ष्यांकन हो । "

(iv) मंडल या मंडल द्वारा नामोद्दिष्ट समिति, इसके आगे विनियम 19 के अधीन अंतरण दर्ज करने से इनकार नहीं करती है तो , अंतरण को दर्ज करेगी ।

(v) विनियम 19 के अधीन शेयरों का अंतरण इनकार न हुआ होने पर, विधिवत् अंतरित शेयर- प्रमाणपत्र अंतरण -लिखत लॉज करने के दिनांक से साठ दिनों के अंदर अंतरिती को सुपुर्द किया जायगा ।

14. विनियम 19 में:-

(i) खण्ड (i ) में "मंडल " शब्द के लिए "मंडल या समिति" प्रतिस्थापित किये जाएंगे ;

(ii) खण्ड (i ) के परंतुक हटा दिये जाएंगे ;

(iii) खण्ड (ii) में -

(क) आरंभिक में "मंडल" शब्द के लिए "मंडल या समिति " शब्द प्रतिस्थापित किए जाएंगे 105 भाग III-खण्ड 4]

(ख) उपखण्ड ( आ) के लिए निम्नलिखित उपखण्ड प्रतिस्थापित किया जाएगा : -

" यदि यह अभिमत बना लिया गया है कि उप-विनियम में उल्लिखित किसी आधार पर ऐसा पंजीकरण अस्वीकृत किया जाना चाहिए (i ) अंतरण फार्म की प्राप्ति से 60 दिनों के भीतर या संबंधित स्टॉफ एक्सचेंज के साथ लिस्टिंग करार में बतायी गई अवधि के भीतर ऐसी अस्वीकृति का कारण बताते हुए लिखित सूचना द्वारा इसे अंतरणकर्ता और अंतरिती को सूचित करें । "

15. विनियम 21 में निम्नलिखित स्पष्टीकरण शामिल किया जाएगा :-

"स्पष्टीकरण- इस विनियम के प्रयोजन के लिए पंजीकरण के लिए शेयरधारक की अर्हता निम्नलिखित परिस्थितियों में समाप्त हो सकती है -

(क) यदि वह अवयस्क का अभिभावक है तो , अवयस्क के वयस्क होने पर;

(ख ) यदि वह कर्ता के रूप में शेयर रखता है तो, उसका कर्ता का पद समाप्त होने पर " ।

16. विनियम 32 में " इस प्रयोजन हेतु मंडल के एक प्रस्ताव द्वारा " शब्दों के लिए "इस प्रयोजन हेतु विनियम 31 के अधीन समपहरण की सूचना की समाप्ति के पश्चात् आयोजित की जानेवाली मंडल की अगली बैठक में उसके प्रस्ताव द्वारा " शब्द प्रतिस्थापित किए जाएँगे ।

17. विनियम 44 में " बैंक का अन्य किसी अधिकारी" शब्दों के लिए " कंपनी सचिव या कम से कम वेतनमान II के बैंक के अन्य किसी अधिकारी " शब्द प्रतिस्थापित किए जाएँगे ।

18. विनियम 46 में, खण्ड (ii ) के परंतुक में -

(i) "पावती सहित या उसके बिना पंजीकृत डाक से" शब्दों के लिए " पावती सहित या उसके बिना पंजीकृत डाक से अथवा कुरियर सेवा द्वारा अथवा इलेक्ट्रानिक विधि द्वारा " शब्द प्रतिस्थापित किए जाएँगे ;

(ii) " अथवा इलेक्ट्रानिक माध्यम जैसी भी स्थिति हो" शब्द "सामान्य डाक से" शब्दों के पश्चात् शामिल किये जाएँगे " ।

19. अध्याय III में -

1 (i) विनियम 47 में " एक या अधिक डिपाजिटरियों " शब्दों के लिए "डिपाज़िटरी अधिनियम , 1996 की धारा 2 (ङ) में परिभाषित किये अनुसार एक या अधिक डिपाजिटरी " शब्द प्रतिस्थापित किए जाएँगे ;

(ii) 48 से 55 विनियम हटा दिये जाएँगे । 106

[भाग III-खण्ड 4 20. विनियम 56 में , खण्ड (i ) में "किसी प्राधिकृत पदाधिकारी " शब्दों के लिए "ऐसा अधिकारी जो वेतनमान VII की श्रेणी से कम न हो या कंपनी सचिव " शब्द प्रतिस्थापित किए जाएँगे ।

21., विनियम 61 के पश्चात्, निम्नलिखित विनियम जोड़े जाएँगे :- "61क मतगणना में मतपत्र निरीक्षक

(i) जहाँ मतदान होना है वहाँ बैठक का अध्यक्ष मतदान में दिये गये मतों की संवीक्षः करने और उसके पश्चात् उसे रिपोर्ट देने के लिए दो मतपत्र -निरीक्षकों की नियुक्ति करेगा ।

(ii) बैठक के अध्यक्ष को मतदान का परिणाम घोषित होने के पहले किसी भी समय मतपत्र-निरीक्षकों को पद से हटाने एवं इस तरह हटाने या अन्य किसी वजह से मतपत्र-निरीक्षकों के पद में हुई रिक्ति को भरने का अधिकार होगा ।

(iii

) इस विनियम के अधीन नियुक्त किये दो मतपत्र-निरीक्षकों में से एक हमेशा; बैठक में उपस्थित शेयरधारक होगा (जो बैंक का अधिकारी या कर्मचारी नहीं होगा) बशर्ते कि ऐसा शेयरधारक मौजूद हो और नियुक्त होने के लिए तैयार हो ।

61ख मतदान आयोजित करने का तरीका और उसके परिणाम

(i) बैठक के अध्यक्ष को मतदान का तरीका विनियमित करने का अधिकार होगा । (ii) जिस प्रस्ताव पर मतदान आयोजित किया गया उस संकल्प पर मतदान का परिणाम ही बैठक का निर्णय माना जाएगा। "

22 . विनियम 62 में , खण्ड ( iii ) के पश्चात् निम्नलिखित खण्ड जोड़ा जाएगा;

" ( iv) शेयरधारक द्वारा कार्यवृत बही के निरीक्षण के लिए या किसी निर्दिष्ट बैठक के कार्यवृत्त की प्रति के लिए लिखित अनुरोध किये जाने पर, बैंक, शेयरधारक को यथास्थिति निरीक्षण करने देगा या कार्यवृत्त की प्रति देगा । "

23. विनियम 65 में खण्ड (ⅰ ) में , उपखण्ड ( अ) में " 100 ( एक सौ) शेयर धारक" शब्दों के स्थान पर "शेयरधारक जिसके पास 100 शेयर से कम न हो " शब्द प्रतिस्थापित किये जाएँगे ।

सं. एन -15/13/14/3/2002-यो. एवं वि. कर्मचारी राज्य बीमा निगम ( सामान्य ) विनियम 1950 के विनियम 95 - क के साथ पठित कर्मचारी राज्य बीमा अधिनियम, 1948 ( 1948 का 34 ) की धारा -46 ( 2 ) द्वारा प्रदत्त शक्तियों के अनुसरण में महानिदेशक ने 01 जनवरी, 2004 ऐसी तारीख के रूप में निश्चित की है जिससे उक्त विनियम- 95 - क तथा तमिलनाडू कर्मचारी राज्य बीमा नियम -1954 में निर्दिष्ट चिकित्ता हितलाभ तमिलनाडु राज्य में निम्मलिखित क्षेत्रों में बीमांकि व्यक्तियों के परिवारों पर लागू किए जाएंगे, अर्थात्ः-- " मदरै जिला में मदुरै दक्षिण तालुक के राजस्व ग्राम अछम्पतु, वडपलन्जी और करडिपट्टी के अधीन आने वाले क्षेत्र " ।

संयुक्त निदेशक ( यो. एवं वि. ) संख्या एन-12/13/4/2003-यो .एवं विः कर्मचारी राज्य बीमा अधिनियम , 1948( 1948 का 34)की धारा 97 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कर्मचारी राज्य बीमा निगम , कर्मचारी राज्य बीमा (साधारण) विनियम , 1950 में संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाता है जिन्हें उक्त धारा की उप धारा ( 1 )द्वारा यथा-अपेक्षित , आपत्तियां/ सुझाव आमंत्रित करते हुए , भारत के राजपत्र, भाग-3 , खण्ड-4 दिनांक 26 जुलाई , 2003 में पहले प्रकाशित किया गया था , अर्थात:-

1 . ( 1. ) ये विनियम कर्मचारी राज्य बीमा ( साधारण )(संशोधन)विनियम , 2003 कहलाएंगे । (2. ) ये शासकीय राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. कर्मचारी राज्य बीमा( साधारण ) विनियम , 1950 में--

1. विनियम 11 : जो व्यक्ति नियत दिन को नियोजन में हो उनके द्वारा घोषणा :

इस विनियम में ' के प्रायोजन के लिए अपेक्षित सही विशिष्टियां' शब्दों के बाद और ' देने की अपेक्षा करेगा ' शब्दों से पूर्व निम्नलिखित शब्द अन्तः स्थापित किए जाएं: -

'उसके व उसके कुटुम्ब के फोटो सहित'

2. विनियम-12: नियत दिन के पश्चात नियुक्त व्यक्तियों द्वारा घोषणाः

उप-दिनियम( 1 ) में " घोषणा प्ररूप के लिए जिनके अन्तर्गत अस्थाई पहचान-पत्र भी हैं अपेक्षित [भाग 111-खण्ड 4

3. विनियम 15कः कुटुम्ब का रजिस्ट्रीकरणः

इस विनियम में , ' अपने कुटुम्ब की बाबत' शब्दों के बाद और ' सही विशिष्टियां नियोजक को प्ररूप-1 ऊ में देगा' शब्दों से पूर्व निम्नलिखित शब्द अन्तःस्थापित किए जाएं:

4. विनियम 17: पहचान-पत्र:

इस विनियम लें 'प्ररूप में शब्दों के बाद और 'पहचान तैयार कराने को व्यवस्था' शब्दों से पूर्व निम्नलिखित शब्द अन्तः स्थापित किए जाएंः

तथा

"और ऐसे पत्र में ऐसे कुटुम्ब की विशिष्टियां" शब्दों के बाद और " देगा जो विनियम 95 क के अधीन चिकित्सा प्रसुविधा के हकदार हैं " शब्दों से पूर्व निम्नलिखित शब्द अन्तः स्थापित किए जाएं :

विश्वविद्यालय अनुदान आयोग अधिनियम, 1956 (1956 के 3 ) की धारा 22 की उप-धारा (3 ) द्वारा प्रदत्त अधिकारों के तहत व दिसंबर, 1985 तक संशोधित और गजट अधिसूचनाओं क्रमांक एफ.87-9 /58 (सीयूपी) दिनांक 1-12-1958 , एफ.33-72 / 59(सीयूपी) दिनांक 17-11-1960, एफ.33-87 /63 (सीयूपी) दिनांक 6-6-1964, एफ.33-87 /63(सीयूपी) दिनांक 27-4-1966, और एफ.1-59/66 (सीडीएन) दिनांक 18-6-1968, एफ. 1-59/66(सीडीएन) दिनांक 17-2-1969, एफ.1-59/66 (सीडीएन) दिनांक 22-12-1969 , एफ.1-59 /66(सीडीएन) दिनांक 26-2-1971 , एफ.1-59/66 (सीडीएन) दिनांक 15-11-1973, एफ.1-59 /66 (सीडीएन/ सीपी) दिनांक 18-7-1975 और एफ. 1-52 /97 (सीपीपी-11 ) दिनांक 24-6-1999 , एफ.1-52 /2000 (सीपीपी -11 ) दिनांक 21-11-2001 और एफ.1-52 /97(सीपीपी-11 ) दिनांक 3-10-2002 का अधिक्रमण करते हुए केंद्र सरकार की अनुमति से विश्वविद्यालय अनुदान आयोग (यूजीसी) एत्द द्वारा इस धारा के तहत डिग्रियों के लिए नामपद्यति विनिर्दिष्ट करती है । साथ ही साथ इन डिग्रियों को देने के लिए न्यूनतम आवश्यक अकादमिक मानदण्ड भी तय करती है ।

डिग्रियों का विनिर्देशन

1. कोई विश्वविद्यालय इस अधिसूचना की शतों का उल्लंघन करके डिग्री प्रदान नहीं कर सकेगा । विश्वविद्यालयों के लिए यह अनिवार्य होगा कि वे डिग्रियों की अनुमोदित नामपद्यति का अनुपालन करें तथा डिग्री देने से पहले निर्धारित न्यूनतम शिक्षण मानकों का पालन सुनिश्चित करें, जैसा कि इसके आगे निर्धारित किया गया है । किसी भी डिग्री, डिप्लोमा या सर्टिफिकेट के संबंध में किसी भी विदेशी विश्वविद्यालय से अकादमिक सहयोग या सहभागिता करने के लिए आयोग से पूर्व अनुमति लेना आवश्यक होगा, जैसा कि इसके आगे निर्धारित किया गया है ।

2. विश्वविद्यालय अनुदान आयोग अधिनियम, 1956 की धारा 22(3) के तहत डिग्रियों के लिए अनुमोदित नामपद्यति की समेकित सूची अलग से संलग्न है । विषय विशेष की दक्षता को अनुमोदित नामपद्यति के साथ कोष्ठक में दर्शाया जा सकता है । 116

3. विश्वविद्यालय अनुदान आयोग समय - समय पर इस सूची की समीक्षा करेगा, उसका अद्यतन करेगा तथा उसकी सूचना सभी विश्वविद्यालयों को देता रहेगा । अगर कोई विश्वविद्यालय नया डिग्री पाठ्यक्रम लागू करना चाहता है, तो उसे ऐसा पाठ्यक्रम शुरू करने से कम से कम छह महीने पहले यूजीसी से अनुमोदन प्राप्त करने के लिए आवेदन करना होगा ।

4. डिग्री के निर्धारित अध्ययन पाठ्यक्रम को विश्वविद्यालय या संस्थान की संबंधित अकादमिक समितियों जैसे अध्ययन बोर्ड, अकादमिक परिषद व शासी परिषद द्वारा औपचारिक रूप से अनुमोदित कराना आवश्यक है ।

5. सभी विश्वविद्यालय और उनसे संबद्ध कॉलेज पढ़ाई के न्यूनतम स्तर और डिग्री प्रदान करने के लिए निर्धारित मानकों का पालन करेंगे । वे यह भी सुनिश्चित करेंगे कि उनके यहां संबंधित वैधानिक या नियामक निकायों तथा यूजीसी, अखिल भारतीय तकनीकी शिक्षा परिषद, भारतीय आयुर्विज्ञान परिषद, भारतीय फार्मेसी परिषद, स्थापत्यकला परिषद, भारतीय बार काउंसिल , राष्ट्रीय अध्यापक शिक्षा परिषद, भारतीय दंत चिकित्सा परिषद और भारतीय नर्सिंग परिषद आदि द्वारा अधिसूचनाओं या नियमों के तहत निर्धारित योग्यता प्राप्त अध्यापक व आवश्यक आधारभूत सुविधाओं की व्यवस्था है ।

6. यूजीसी से मान्यताप्राप्त जिन डिग्रियों को विश्वविद्यालय या उससे संबंद्ध कॉलेज प्रदान कर रहे हैं , उसके लिए संबंधित वैधानिक या नियामक समितियों द्वारा निर्धारित अध्ययन के न्यूनतम मानदंडों और नियमों का उल्लेख प्रवेश विवरणिका में प्रमुख रूप से होना चाहिए ।

7. प्रत्येक विश्वविद्यालय और उससे संबंद्ध कॉलेजों को समय - समय पर पढ़ाई के न्यूनतम स्तर का पालन करने की सूचना यूजीसी द्वारा निर्धारित फॉर्म में भरकर यूजीसी को भेजनी होगी ।

8. यूजीसी समय- समय पर डिग्री देनेवाले विश्वविद्यालय और उससे संबंद्ध कॉलेजों, विस्तार /क्षेत्रीय / अध्ययन केंद्रों का निरीक्षण करा सकती है ।

9. अगर निरीक्षण के दौरान वहां कोई कमी पायी जाती है, तो यूजीसी संबंधित विश्वविद्यालय या उससे संबद्ध कॉलेज को उसे सुधारने व अनुपालन सुनिश्चित करने के लिए पर्याप्त अवसर दे सकती है ।

10. छात्रों के हित को ध्यान में रखते हुए किसी भी विश्वविद्यालय और उससे संबद्ध कॉलेजों के लिए यह जरूरी है कि वे किसी विदेशी विश्वविद्यालय से कोई भी अकादमिक सहयोग या सहभागिता के लिए यूजीसी से अनुमति लें । चाहें वह सहयोग डिग्री , डिप्लोमा और सर्टिफिकेट के लिए किसी फ्रैंचाइजी या अध्ययन केंद्र या आदान- प्रदान का हो । विश्वविद्यालय और उससे संबद्ध कॉलेजों का यह उत्तरदायित्व होगा कि वे किसी भी डिग्री, डिप्लोमा या सर्टिफिकेट कार्यक्रम में छात्रों 117 भारत का राजपत्र, जनवरी 31 , 2004 (माघ 11 , 1925)

को प्रवेश देने से पहले यह सुनिश्चित करें कि वह डिग्री /डिप्लोमा / सर्टिफिकेट यूजीसी द्वारा विधिवत रूप से विनिर्दिष्ट व अधिसूचित किया गया है ।

विश्वविद्यालय और उससे संबंद्ध कॉलेजों का यदि कोई सहयोग या सहभागिता पहले से ही है तो उसकी सूचना भी इस अधिसूचना के जारी होने के बाद छह महीनों के भीतर निर्धारित फॉर्म के द्वारा यूजीसी को दी जानी चाहिए ।

11. विनिर्देशों का पालन न करने पर विश्वविद्यालयों के लिए परिणामः

11.1 नियमों की अवहेलना करने वाले विश्वविद्यालय और उससे संबद्ध कॉलेजों को अनिर्दिष्ट डिग्री प्रदान करने वाले पाठ्यक्रम को आगे जारी रखने से रोक दिया जाएगा ।

11.2 अगर उसके बावजूद भी डिग्री दी जाती है, तो उसे यूजीसी पूरी जांच- पड़ताल के बाद अवैध करार दे सकती है । उसके बाद यूजीसी चूक करने वाले विश्वविद्यालय और उससे संबद्ध कॉलेजों और उनके द्वारा दी जा रही अनिर्दिष्ट डिग्री संबंधित सूचना को जनसाधारण के लिए प्रकाशित करेगी ।

11.3 संबंधित विश्वविद्यालयों का यह दायित्व होगा कि वे स्वयं और संबद्ध कॉलेजों में निर्धारित नियमों, मानदण्डों का अनुपालन सुनिश्चित करें और चूक करने वाले कॉलिजों के उल्लंघन की सीमा को ध्यान में रखकर उनकी संबद्धता रद्द करें ।

11.4 यूजीसी, उपधारा 11.2 के तहत जारी किये गये आदेश की प्रतिलिपि संबंधित विश्वविद्यालय को भेजेगी । आदेश की प्राप्ति के दिन से संबंधित पाठ्यक्रम को ले कर उस कॉलेज या संस्था की संबद्धता समाप्त कर दी जायेगी । ऐसी संबद्धता समाप्त होने की तिथि के बाद से उस संस्था को अगले तीन साल तक के लिए उस या उस तरह के डिग्री या स्नातकोत्तर डिग्री पाठ्यक्रम को चलाने की अनुमति नहीं दी जाएगी ।

11.5 डिग्री के लिए विनिर्देशों संबंधी प्रावधानों का उल्लंघन करने पर चूक करने वाले विश्वविद्यालय या उससे संबंद्ध कॉलेजों के खिलाफ यूजीसी अधिनियम की धारा 24 के तहत कार्रवाई भी की जायेगी ।

In exercise of the powers conferredby sub- section (2) of section 19 of the Banking Companies (Acquisition and Transfer of Undertakings) Act , 1980 (40 of 1980), the Board of Directors of Corporation Bank, after consultation with the Reserve Bank of Indla andwith the previous sanction of the Central Govemment, hereby makes the following amendments further to amend Corporation Bank General Regulations, 1996, namely,

1. (1) These regulations may be called the Corporation Bank General (Amendment) Regulations, 2003..

(2) They shall come into force on the date of their publication in the Official Gazette.

2. "Corporation Bank General Regulations , 1998" shall be renamed as "Corporation Bank (Shares and Meetings) Regulations , 1998".

3. In Regulation 2 of Corporation Bank (Shares and Meetings) Regulations, 1996, Regulation so renamed,.

() for clause(e) , the following shallbe substituted, namely:-

"(e) "Committee' means a Committee constituted under regulation 2A";

(ii) in clause (1) , the following words and figures shall be inserted at the end,namely:-

"and register of beneficial owners maintainedby and depositoryunder section 11 of the DepositoryAct, 1996 (22 of 1996)".

4. after regulation 2, the following new regulation shallbe inserted, namely: -

"2A(1) Except as provided in Clause (ii) of regulation 67, the Board may constitute , as and when necessary, a Committee consisting of the Chairman and Managing Director or in his absence Executive Director and two other directors as it may deem fit , for the purposes of these regulations;

(ii) The Committee constituted under this regulation shall observe such rulesof procedure as maybe specified by the Board"..

5. in regulation 5, Clause (v) shall be omitted.

6. After regulation 5, the following regulation shall be inserted namely:-

"5A(1 ) The Bank shall , unless the register is in such form as in itself to constitute an index, keep an index, which may be in form of a card index of the names of shareholders and shall , within fourteen days after the date on which any alteration is made in the register of shareholders , make the necessary alteration in theindex.

(11)- The index shall be kept with the register of shareholders" .

7. In regulation 7, in clause (ii ) for the words " in case of firms", the words "In case of partnership firms" shallbe substituted.

8. In regulation 8, after clause (ii) , the following clause shall be Inserted, namely:-

"(iii) The register in electronic form shallbe maintained subject to such safeguards as stipulated for securing electronic records under the Information TechnologyAct , 2000 (21 of 2000). "

9. In regulation 11 , in clause (ii) for the words" at the rate of Rs.5/- for every100 words", the words " at the rate of Rs.5/-or at such rate as the Board may decidefor every 1000 words " shallbe substituted.

10. For regulation 12, the following shall be substituted , namely:-

"12. Closing of the register - The Bank may, after ensuring compliance of the applicable guidelines and the listing agreementwith the Stock Exchanges , and after giving not less than seven days previous notice by advertisement in at least two newspapers circulating in India, close the register of shareholders for any period or periods not exceeding in the aggregate forty- five days in each year, but not exceeding thirty days at any one time as may in its opinion ,be necessary".

11. In regulation 13 ,

In clause (ii) for the words some other officer appointed by the Board", thewords " some other officer not below the rank of Scale II or the Company Secretary shall be substituted;,

(1) Clause (v) shallbe omitted.

12. In regulation 15, for the heading "Renewal of share certificate " the following shallbe substituted, namely..

"Issue of new or duplicate share certificate"..

13. In regulation 17, for the clauses (ili) and (iv) , the following clauses shallbe substituted, namely:-

"(III) Upon receipt by the Bank of an instrument of transfer along with a share certificate with a request to register the transfer, the Board or the Committee designatedby the Board shall forward the said instrument of transfer alongwith share certificate to the Registrar or Share TransferAgent for the purposes of verification that the technical requirements are complied with In their entirety. The Registrar or Share TransferAgent shall retum the instrument of transfer alongwith [PART III-SEC. 4 124

the share certificate , if any, to the transferee for resubmission unless the instrument of transfer is presented to the bank, duly stamped and properly executed for registration and is accompanied by the certificateofthe shares to which it relates and such other evidence as the Board may require to show the title of the transferor to make such transfer.

Explanation:- "Technical requirements " means

(a) Transfer deed shallbe duly stamped;

Certificate number or distinctive number mentioned in the transfer deed shali tally with the share certificate; (b)

(d) Transfer deed shall be witnessed."

(iv) TheBoard or the Committee designatedby the Board shall , unless it refuses to register the transfer under regulation 19 hereinafter, cause thetransfer tobe registered.

(v) Unless thetransfer of shares is refused under regulation 19 , the share certificate duly transferred shall be delivered to the transferee within sbdydays fromthe date of lodging of the instrument of transfer' .

14. In regulation19:-

(0) in clause (1) for the words "The Board may refuse" , the words "The Board orCommittee may refuse" shall be substituted;

(ii) Theproviso toclause (i) shall be omitted;

(iii) In clause(ii) -

(a) In the opening portion for the words "The Board shali " , the words "the Board or Committee shall shail be substituted

(b) For sub-clause (b), the following sub-clausebe substituted , namely:-

"Ifit has formed the opinion that such registration ought to be refused on any of the grounds mentioned in sub regulation(1) intimate the same to the Trarisferor and the Transfereeby notice In writing giving reasons for such refusal within 60 days fromthe receipt of transfer forn or within such period as may be laid down in the Listing Agreement with the concerned Stock Exchange".

15. Thefollowing Explanation shallbe inserted in regulation 21 , namely:-

"Explanation For the purposes of this regulation , a shareholder may cease tobe qualified for registration, -

(a) If he is a guardian of minor, on the minor attaining the majority;

(b) If heis holding shares as a Karta, on his ceasing to be a Karta".

16. In regulation 32, for the words " by a resolution of the Board to that effect " the words " by a resolution of the Board to that effect at its next meeting tobe held after the expiry of the notice of forfeiture under regulation 31 " shall be substituted.

17. In regulation 44, for the words " any other Officer of the Bank" , the words "Company Secretary or any other Officer of the Bank not below the rank of Scale II shall be substituted .

18. InRegulation 46, in proviso to the clause (ii), -

(i) for the words "by registered post , with or without acknowledgement due", the words "by registered post, with or without acknowledgement due or by courier service or in an electronic mode " shall be substituted;

(ii) The words " or electronic media , as the case may be shall be inserted after the words " ordinary course of post ".

19. InChapter III , -

(1) in regulation 47, for the words " one or more depository", the words "oneor more depository as defined in section 2(e) of the Depositories Act, 1996" shallbe substituted;

(il) regulations 48 to 55 shallbe omitted.

20. Inregulation 56, in clause (i ), for the words "any authorised official " the words "any officer not below the rank of Scale VII or Company Secretary shall be substituted.

21. After regulation 61 , the following regulations shall be inserted , namely:-

"61A Scrutineers at Poll

(!) Where a poll is to be taken , the Chairman of the meeting shall appoint two scrutineers to scrutinize the votes given on the poll and to report thereon to him.

(ii) The Chairman of the meeting shall have the power, at any time before the result of the poll is declared, to remove a scrutineers from the office and to fill the vacancy in the office of the scrutineers arising from such removal or from any other cause.

(iii) Of the two scrutineers appointed under this regulation one shall always be a shareholder (not being an Officer or employee of the Bank) present at the meeting; provided that such a shareholder is available and willing to be appointed.

61B . Manner of taking poll and result thereof.

(1) The Chairman of the meeting shall have power to regulate the manner in which a poll shall be taken.

(ii) The result ofthe poll shall be deemed to be the decision of the meeting on the resolution on which the poll was taken" .

22. In regulation 62, after clause (iii) , the following clause shallbe inserted, namely,

"(iv) Onwritten request made by a shareholder for inspection of the minute book orfor a copy of the minute of a specified meeting , the Bank shall allowthe inspection or furnish the copy of the minute , asthe casemay be, to the shareholder".

23. In regulation 65, in Clause ( i), in sub-clause (a) , for the words "holding 100 (onehundred) shares", the words "holding not less than 100 (one hundred) shares" shallbe substituted.

No.N -12/13/4/2003 -P&D: In exercise of powers conferredby Section 97 of Employees' State Insurance Act, 1948 (34 of 1948) , the Employees' State Insurance Corporation hereby makes the following Regulations to amend the Employees' State Insurance (General ) Regulations , 1950, the same having been previously published in the Gazette of India Part- III , Sec .4 dated July 26, 2003, inviting objections/suggestions , if any, as required by sub Section (1) of the said Section , namely: -

1. (i) These Regulations may be called the Employees' State Insurance (General ) (Amendment) Regulations, 2003.

(ii) These will come into force from the date of their publication in the official gazette.

2. In the Employees' State Insurance (General ) Regulations, 1950 -

1. Regulation 11. Declaration by persons in employment on appointed day-

In this Regulation , the following words shall be inserted between the words "either before or on the appointed day correct particulars" and "required for the purpose of Form 1" : "along with his /her photograph and that of his/her family"

2. Regulation 12 : Declaration by persons engaged after the appointedday:

Inthis Regulation , the following words shall be inserted between the words " an Identity Card prepared in Form -4 for each person " and " in respect of whom an insurance number is allotted " :

In exercise of the powers conferred by Sub- Section ( 3) of Section 22 of the University Grants Commission Act , 1956 (3 of 1956) as modified upto December, 1985 and in supersession of Gazette Notification No.F.87-9 /58 (CUP ) dated 1.12.58, F.33-72/59 ( CUP) dated 17.11.1960, F.33-87/63 ( CUP ) dated 6.6.1964, F.33-87/63 (CUP) dated 27.4.1966 and F.1-59/66 (CDN ) dated 18.6.1968 , F.1-59/66 ( CDN) dated 17.2.1969, F.1-59/66 ( CDN ) dated 22.12.1969, F.1-59/66 (CDN ) dated 26.2.1971 , F.1-59/66 ( CDN ) dated 15.11.1973, 1-59/66 (CDN /CP ) dated 18.07.1975 and F.1-52/97 (CPP-II ) dated 24.06 : 1999 , F.1-52 /2000 ( CPP-II ) dated 21.11.2001 and F.1-52/97 (CPP - II ) dated 03.10.2002 , the University Grants Commission ( UGC) with the approval of the Central Govemment hereby specifies the nomenclature of degrees for the purposes of the said section as also the mandatory requirements viz . minimum essential academic inputs required for awarding such degrees .

Specification of Degree:

1. No University shall confer a degree in violation to the provisions of this notification . It shall be mandatory for the Universities to adhere to the approved nomenclature of the degree (s ) and ensure the observance of the minimum standards of instruction before award of a degree as hereinafter prescribed. Academic collaborations with the foreign Universities for the grant of any degree/ diploma/ certificate shall also require prior approval of the commission as hereinafter prescribed.

2. The consolidated list of UGC approved nomenclature of degree (s ) for the purpose of Section 22 (3) of the University Grants Commission Act, 1956 is enclosed as Annexure . The approved nomenclature may be followed by the specific area of specialization to be reflected in the parentheses .

3. This list shall be reviewed and updated by the UGC from time to time under intimation to all the universities . If a university wishes to start a new course it shall approach the UGC for its approval six months prior to starting the degree programme.

4. The courses of study prescribed for the degree should have been formally approved by the respective academic bodies of the university / institution , such as- Board of Studies , Academic Councii and Governing Council .

5. All the universities ( including affiliated colleges thereto) shali observe the minimum standards of instruction and prescribed norms for the grant of a degree which shali be imparted by the duly qualified teaching staff and appropriate academic physical infrastructure facilities as prescribed by the concerned statutory / regulating bodies , such as University Grants Commission ( UGC ) , All India Council for Technical Education (AICTE) , Medical Council of india ( MCI ) , Pharmacy Council of India (PCI ) , Council for Architecture ( CoA) , Bar Council of India ( BCI ) , National Council for Teachers Education (NCTE ) , Dental Council of India ( DCI ) , Indian Nursing Council (INC) etc. in their respective notifications/ regulations.

6. The list of UGC approved degrees offered by a University and the minimum standards of instruction and norms prescribed as laid down by the concerned statutory / regulatory bodies shall be prominently published in the admission brochure of concerned University / affiliated College.

7. Each University shall furnish information relating to the conformity to the above standards of instructions ( including its affiliated colleges) to the UGC in the form prescribed from time to time for this purpose

8. The UGC may cause periodic inspection of the University and its affiliated colleges including extension / regional / study centers and such other facilities offering the courses leading to a degree.

9. After such inspection , the UGC may give reasonable opportunity to the defaulting University / affiliated colleges to rectify the identifieddeficiency/ non-conformity.

10. To safeguard the interest of the students , it wouldbe mandatory for a University or any college affiliated to it to seek prior approval of the University Grants Commission before entering into any academic collaboration such as franchise, study centre tie- up or the twinning arrangement etc. with any foreign university leading to award of any degree / diploma / certificate. It would be the responsibility of the concerned University / affiliated College to ensure that such a degree/diploma / certificate has been duly specified and notified by the commission before admitting the students to programs leading to such degree / diploma / certificate.

Existing Academic collaborations , if any, shall be reported by the respective University ( inclusive of affiliated colleges) to the commission in the form prescribed for this purpose within six months of the issue of this notification .

11. Consequences of failure of Universities to comply with these specifications:

11.1 . The defaulting University / Affiliated College shall be prohibited from offering any course for the award of unspecified degree .

11.2. Any degree awarded in contravention to this notification shall be deemed to be an unspecified degree and shall be declared as such by the UGC after duly satisfying itself as to the violation of this notification. The UGC shall give due publicity regarding the defaulting Universities/ colleges and unspecified degrees offeredby them for the information ofthe general public.

11.3. It shall be the responsibility of the respective University to keep a watch over the observance of prescribed norms by itself and by the affiliated colleges and disaffiliate the defaulting colleges to the extent of . 'violations.

11.4. The UGC shall forward a copy of the order made under the sub -section 11.2 to the university concerned, and on and from the date of receipt of a copy of such order by the university, the affiliation of such an institution, so far as it relates to the course of study specified in such order , shall stand terminated . On and from the date of termination of such affiliation , and for the period of three years thereafter , approval shall not be granted to that institution to start such or similar degree or post-graduate degree programme.

11.5. Contravention of the provisions relating to the specification of degrees as above shall also render the defaulting university and affiliated colleges liable for action as prescribed under Section 24 of the UGC Act.
