आ. अ. 20.-लोक प्रतिनिधित्व अधिनियम, 1950 ( 1950 का 43 ) की धारा 13 क की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत निर्वाचन आयोग छत्तीसगढ़ सरकार के परामर्श से एतद्वारा डा० के ० के ० चक्रवर्ती, आई० ए० एस० के स्थान पर श्री अशोक कुमार विजयवर्गीय, आई० ए० एस० ( सी ० एच० 69 ) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए, छत्तीसगढ़ राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है ।
2. श्री अशोक कुमार विजयवर्गीय, छत्तीसगढ़ सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे , जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे । 1
3. श्री अशोक कुमार विजयवर्गीय, मुख्य निर्वाचन अधिकारी छत्तीसगढ़ के पद पर कार्य करते हुए छत्तीसगढ़ सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी , सरकार का सचिव पदाभिहित किया जायेगा ।

ELECTION COMMISSION OF INDIA
New Delhi , the 19th February, 2004
O.N. 20. In exercise of the power conferred by Sub-section ( 1 ) of Section 13A of the Representation of the People Act, 1950 (43 of 1950) the Election Commission of India in consultation with Government of Chattisgarh hereby nominates Shri Ashok Kumar Vijayavargiya, IAS (CH - 69 ), as the Chief Electoral Officer for the State of Chattisgarh with effect from the date he takes over charge and until further orders vice Dr. K.K. Chakravarty, IAS .
2. Shri Ashok Kumar Vijayavargiya shall cease to hold and hand over forthwith the charge of all or any charges ofwork under the Government of Chattisgarh, which he may be holding before such assumption ofoffice.
3. Shri Ashok Kumar Vijayavargiya, while functioning as the Chief Electoral Officer, Chattisgarh shall not hold any additional charge whatsoever under the Government of Chattisgarh except that he should be designated Secretary to the Government in charge ofElection Department in the State Secretariat.

Balakrishnan , IAS (OR: 84 ), as the Chief Electoral Officer for the State of Orissa with effect from the date he takeş over charge and until further orders vice Shri L. Kindo, IAS .
2. Shri R. Balakrishnan, shall cease to hold and hand over forthwith the charge of all or any charges of work under theGovernment of Orissa, which he may be holding before such assumption of office.
3. Shri R. Balakrishnan , while functioning as the Chief Electoral Officer, Orissa shall not hold any additional charge whatsoever under the Government of Orissa except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat .

ElectionPetition No. 7 of 2000 praying that this court be pleased to
(i) order scrutiny and recounting of the ballot papers in respect of No. 26 , Karur Parliamentary Constituency.
(ii) issue a declaration that the election of the first respondent as the successful returned candidate form No.26 Karur Parliamentary Constituency is void and illegal and to set aside the same;
(iii) issue a declaration that the petitioner has been duly elected as a successful returned candidate in No. 26 Karur Parliamentary Constituency.
The above Election Petition coming on this day before this Court for hearing in the presence of Mr. Satish Parasaran, Counsel for the Petitioner and Mr. N. Srinivasan, Counsel for the first Respondent and respondents 2 to 16 herein not appearing in person or by advocate and upon reading the petition filed herein and the Counsel for the petitioner having made an endorsement to the effect in view of the dissolution of the Lok Sabha, the present petition has become infructuous (since the case of corrupt practice has already been rejected by this Hon'ble Court ) on instructions from the petitioner, it is humbly submitted that the petition may be disposed of as infructuous , this Court made the following order:-
The Learned Counsel appearing for the petitioner makes the following endorsement :
" In view of dissolution of the Lok Sabha the present petition has become infructuous (since the case of corrupt practicehas already been rejected by this Hon'ble Court) . On instructions from the petitioner, it is humbly submitted that the petition may be disposed of as infructuous ."
2. The said endorsement is recorded. In view of the same , this election petition is dismissed as one infructuous, leaving the parties to bear their costs.
3. The District Collector , Karur, is directed to take back the entire ballot papers , lying in this Court pursuant to the earlier order dated 7-11-2002, immediately.
