* उक्त स्थापना के सम्बन्ध में नियोजन हूँ जिसे इसके पश्चात नियोजक कहा गया है । सम्बन्धित क्षेत्रीय भकिय निधि आयुक्त को ऐसी विर्वारणयों भेजेगा और ऐसे लेखा रखेगा तथा निरीक्षण के रेसो सुविधाए प्रदान करेगा जो केन्द्रीय मक्रिय निधि आयुक्त, समय समय पर निर्दिष्ट करें । 1204

2. नियोजक ऐसे निरोक्षण प्रभारी का प्रत्येक मोत को समाप्ति के 15 दिन के भीतर संदाय करेगा जो केन्द्रीय सरकार , उक्त अधिनियम को धारा 17 को उपधारा हूँ - करके खण्ड- क के अधीन समय समय पर निर्देश करें ।

3. लाईफ कवरं स्कोम के प्रशासन में , जिसके अन्तर्गत लेखाओं का रखा जानां विवरिणयों का प्रस्तुत किया जाना प्रभार संदाय आदि भी है, होने वाले सभी व्यर्यों का वहन नियोजक द्वारा किया जाएगा ।

4. नियोजक, केन्द्रीय सरकार द्वारा अनुमोदन लाईफ कवर स्कोम के नियमों को एक प्रति और जब उसमें संशोधन किया जाये , लब उत्त संशोधन को प्रति तथा कर्मचारियों को बहु संख्या को भाषा में उसको मुख्य बांतों का अनुवाद स्थापना के सूचना पट्ट पर प्रदर्शित करेगा । 5. यदि कोई ऐसा कर्मचारी भकिय निधि का या उक्त अधिनियम के अधीन छूट प्राप्त किसी स्थापना को भक्रिय निधि का पहले से हो सदस्य है , उस को स्थापना में नियोजित किया जाता है तो नियाजक लाईफ कवर स्कीम के सदस्य के रूप में उसका नाम तुरन्त दर्ज करेगा ।

1 6. यदि उक्त स्कोम के अधीन कर्मचारियों का उपलब्ध लाभ ढायें जाते है, तो नियोजक लाईफ कवर स्कोम के अधीन कर्मचारियों को उपलब्ध लाभों में समुचित रूप से वृद्धि किय जाने की व्यवस्था करेगा, जो कि कर्मचारियों के लिए लाईफ' कवर स्कोम के अधिन उपलब्ध लाभो से अधिक अनुकूल हो जो उक्त स्कोम के अधिन अनुज्ञेय हैं ।

7. लाईफ कवर स्कोम में किसी बात के होते हुए भी यदि किसो कर्मचारी को मृत्यु पर इस स्कोम के अधीन सदेय राशि से कम है जो कर्मचारी को उस दशा में संदय होतो तब तक उक्त स्कोम के अधिन होता तो, नियोजक कर्मचारी के विधिक वारिंशश नाम निर्देशितों को प्रतिकार के रूप मे दोनो राशियों के अन्तर के बराबर राशि कर संदोया करेगा ।

8. लाईफ कवर स्कोम के उपबन्धों में कोई भी संशोधन सम्बन्धित क्षेत्रीय भविष्य निधि आयुक्त के पूर्व अनुमोदन के बिना नही किया जायेगा और जहां किंती संशोधन के कर्मचारियों के हित. पर प्रतिकूल प्रभाव पडने को संभावना हो, वहा क्षेत्रीय भविष्य निधि आयुक्त अपना अनुमोदन देने से पूर्व कर्मचारियों को अपना दृष्टिकोण स्पष्ट करने का युक्तुियक्त अवसर देगा ।

दि किसी कारणवंधा स्थापना के कर्मचारी को उस लाईफ कवर स्कोम के, ज़िंत स्थापना अपना चुको है अधीन रहजाता है या इस स्कीम के आधीन कर्मचारियों को प्राप्त होने वाले लाभ किसी राशि से कम हो जाते हैं तो यह रद्ध को जा सकती है ।

10. किसी व्यक्ति कम को दशा में उन मृत सदस्यों के नाम निदेशों या विधिक वारिसों को जो यदि यह छूट. दो गई होतो तो उक्त स्कोम के अन्तर्गत होते , बोमा लाभों के संदाय का उत्तर दायित्व नियोजक पर होगा ।

उक्त स्थापना के सम्बन्ध में नियोजक इस स्कोम के आधीन आने वाले किसी: को मृत्यु होने पर उसके हकदार नाम/ निर्देशितो/ विधिक वारिसों को बोमाकृत राशि प्राप्त होने के एक माह के भीतर सुनिशित करेगा ।

अनुसूचो । उक्त स्थापना के सम्बन्ध में नियोजन हूँ जिसे इसके पश्चात नियोजक कहा गया है । सम्बन्धित क्षेत्रीय भविष्य निधि आयुक्त कोः ऐसो विर्वारणयों भेजेगा और ऐसे लेखा रखेगा तथा निरीक्षण के रेतो सुविधाए प्रदान करेगा जो केन्द्रीय भकिय निधि आयुक्त, समय समय पर निर्दिष्ट करें ।

[भाग III- खण्ड 4 2. नियोजक ऐसे निरीक्षण प्रभारी का प्रत्येक मात को समाप्ति के 15 दिन के भीतर संदाय करेगा जो केन् द्रीय सरकार , उक्त अधिनियम को थारा 17 को उपधारा - कक खण्ड- क के अधीन समय समय पर निर्देश करें ।

3. लाईफ कवर स्कोम के प्रशासन में , जिसके अन्तर्गत लेखाओं का रखा जाना विवरिणयों का प्रस्तुत किया जाना प्रभार संदाय आदि भी. हे, होने वाले समो व्यर्यों का वहन नियोजक द्वारा किया जाएगा ।

4. नियोजक, केन्द्रीय सरकार द्वारा अनुमोदन लाईफ कवर स्कीम के नियमों की प्रति और जब उसमें संशोधन किया जाये, तब उसे संशोधन को प्रति तथा कर्मचारियों की बहू संख्या को भाषा में उसको मुख्य बातों का अनुवाद्र स्थापना के सूचना पट्ट पर प्रदर्शित करेगा । 5. यदि कोई ऐसा कर्मचारी भक्रिय निधि का या उक्त अधिनियम के अधीन छूट प्राप्त किसी स्थापना को भक्रिय निधि का पहले से हो सदस्य है , उस को स्थापना में नियोजित किया जाता है तो नियोजक लाईफ कवर स्कीम के सदस्य के रूप में उसका नाम तुरन्त दर्ज करेगा । 6. यदि उक्त स्कोम के अधीन कर्मचारियों का उपलब्ध लाभ दायें जाते है, तो नियोजक लाईफ कवर स्कीम के अधीन कर्मचारियों को उपलब्ध लाभों में समुचित रूप से वृद्धि किय जाने की व्यवस्था करेगा, जो कि कर्मचारियों के लिए लाईफ' कवर स्कीम के अधिन उपलब्ध लाभो से अधिक अनुकूल हो जो उक्त स्कोम के अधिन अनुमेय है ।

7. लाईफ कवर स्कोम में क्रिसी बात के होते हुए भी यदि किसी कर्मचारी को मृत्यु पर इस स्कोम के अधीन तदेय राशि से कम है जो कर्मचारी को उस दशा में संदय होती तब तक उक्त स्कोम के अधिन होता तो , नियोजक कर्मचारी के विधिक वरिश/ नाम निर्देशितों को प्रतिकार के रूप मे दोनो राशियों के अन्तर के बराबरराशि कर संदोयाकरेगा ।

8. लाईफ कवर स्कोम के उपबन्धों में कोई भी संशोधन सम्बन्धित क्षेत्रीय भक्रिय निधि आयुक्त के पुर्व अनुमोदन के बिना नही किया जायेगा और जहाँ किसी संशोधन के कर्मचारियों के हित पर प्रतिकूल प्रभाव पडने को संभावना हो, वहा क्षेत्रीय भक्रिय निधि आयुक्त अपना अनुमोदन देने से पूर्व कर्मचारियों को अपना दृष्टिकोण स्पष्ट करने का युक्तुियक्त अवसर देगा ।

2. यदि किसी कारणवा स्थापना के कर्मचारी को उस लाईक कवर कोम के , जिते स्थापना अपना चुको है अधीन रहजाता है या इस स्कोम के आधीन कर्मचारियों को प्राप्त होने वाले लाभ किसी राशि से कम हो जातेहैं तो यह रद्ध को जा सकती है ।

10. किसो व्यक्ति कम को दशा में उन मृत सदस्यों के नाम निदेशों या विधिक वारिसों को जो यदि यह छूट दो गई होतो तो उक्त स्कीम के अन्तर्गत होते , बोमा लाभों के संदाय का उत्तर दायित्व नियोजक पर होगा ।

उक्त स्थापना के सम्बन्ध में नियोजक इस स्कोम के आधीन आने वाले किसो को मृत्यु होने पर उसके हकदार नाम/ निर्देशितो/विधिक वारिसों को बोमाकृत राशि प्राप्त होने के एक माह के भीतर सुनिशिक्त करेगा ।

राष्ट्रीय सहकारी विकास निगम अधिनियम 1962 ( वर्ष 1962 की संख्या 26) की धारा - 23 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय सहकारी विकास निगम केन्द्रीय सरकार की पूर्व- स्वीकृति से राष्ट्रीय सहकारी विकास निगम सेवा विनियमावली-1967 में निम्न प्रकार से संशोधन करता है:-

(i) विनियम संख्या 13 ( 5) (i)( ख) में से निम्नलिखित प्रावधान हटाया जाएः "बशर्ते कि निगम में कार्यरत गुप " घ" के जिन कर्मचारियों ने निगम की सेवा में दिनांक 23 जुलाई, 1966 को अथवा उससे पूर्व प्रवेश किया है, उन पर इस धारा में से कुछ भी लागू नहीं होगा ।"

(ii) विनियम संख्या 13 ( 5) (ii ) में से निम्नलिखित प्रावधान हटाया जाएः "बशर्ते कि निगम में कार्यरत गुप "घ " के जिन कर्मचारियों ने निगम की सेवा में दिनांक 23 जुलाई, 1966 को अथवा उससे पूर्व प्रवेश किया है, उन पर इस धारा में से कुछ भी लागू नहीं होगा ।"

(iii) विनियम संख्या - 13 ( 5) में निम्न प्रकार से एक नई धारा " ( iii) " को सम्मिलित किया जाएः 66 इस विनियम में निहित किसी बात के होते हुए भी कोई कर्मचारी 20 वर्ष की सेवा पूर्ण करने के पश्चात किसी भी समय नियुक्ति प्राधिकारी को लिखित में 3 माह की सूचना देकर निगम की सेवाओं से स्वैच्छिक रूप में सेवानिवृत्त हो सकता है ।"

(iv) विनियम संख्या 13 ( 5) में निम्न प्रकार से एक नई धारा "(iv)" को सम्मिलित किया जाए : " धारा (ii) के अंतर्गत सेवानिवृत्त होने वाले. अथवा धारा (iii) के अंतर्गत स्वैच्छिक रूप में सेवानिवृत्त होने वाले किसी कर्मचारी की सेवानिवृत्ति की अभीष्ट तिथि को उसकी अर्हक सेवा ग्रेच्युटी प्राप्ति के उद्देश्यार्थ अधिकतम 5 वर्ष की अवधि तक बढ़ा दी जाएगी बशर्ते कि कर्मचारी द्वारा की गई कुल अर्हक सेवा की अवधि किसी भी मामले में 33 वर्ष से अधिक न हो और यह अधिवार्षिता की तिथि से बाहर न हो ।" भाग III-खण्ड 4]

(v) विनियम संख्या - 13 ( 5) में निम्न प्रकार से एक नई धारा "(v)" को सम्मिलित किया जाए : " धारा (ii ) के अंतर्गत सेवानिवृत्त होने वाले अथवा धारा (iii) के अंतर्गत स्वैच्छिक रूप में सेवानिवृत्त होने वाले किसी कर्मचारी के मामले में सक्षम प्राधिकारी समुचित तथा पर्याप्त कारणों से तीन माह की सूचना अवधि की शर्त में छूट दे सकते हैं ।"

(vi ) विनियम संख्या 13 ( 5) में निम्न प्रकार से एक नई धारा "(vi ) " को सम्मिलित किया जाएः " जिस कर्मचारी ने इस विनियम के अंतर्गत सेवानिवृत्ति का चयन करके इस संबंध में नियुक्ति प्राधिकारी को आवश्यक सूचना दे दी है, उसे उस प्राधिकारी के विशिष्ट अनुमोदन के बिना अपनी सूचना को वापिस लेने का अधिकार नही होगा ।"

" बशर्ते कि उस द्वारा अपनी सेवानिवृत्ति वापिस लेने का अनुरोध सेवानिवृत्ति की अभीष्ट तिथि से पूर्व किया जाएगा"

SCHEDULE I

1.. The employer in relation to each of the said establishment (hereinafter referred to as the employer ) sh 11 submit such returns th the Regional Provident Fund Commissioner concerned and maintain such accounts and provide such facilities for inspection , as the Central Provident Fund Commissioner may direct from time to time .

2. The employer shall pay such inspection charges as the Central Government may , from time to time , direct under clause ( 2) sub - section ( 3A) of section 17 of the said Act , within 15 days from the close of every month .

3. All expenses involved in the administration of the Life Cover Scheme including maintenance of accounts , submission of returns , inspec- tion charges etc. shall be borne by the employer .

4. The employer shall display on the Notice Board of the establish- ment , copy of the rules of the Life Cover Scheme as approved by the Central Government/Central Provident Fund Commissioner as and when amended , alongwith translation of the salient features thereof in the language of the majority of the employees .

5. Whereas an employee , who is already a member of the Employees ' Provident Fund or the Provident Fund of an establishment exempted under said Act , is employed in his establishment the employer shall immediat- ely admit him as a member of the Life Cover Saheme .

6 . The employer shall arrange to enhance the benefits available to the employers under the Life Cover Scheme appropriately if the benefits available to the employees under the said scheme are enhanced so that the benefits available under the Life Cover Scheme are more favourable to the employees than the benefits admissible under the said Scheme .

7 . Notwithstanding anything contained in the Life Cover Scheme , if on the death of an employee the amounts payable under the scheme less than the amount that would be payable had the employees been covered under the said scheme , the employer shall pay the difference to the nominee ( s ) /legal heir ( s ) of the employee as compensation .

8. No amendment of the provisions of the Life Cover Scheme shall be Made without the prior approval of the Regional Provident Fund Commissi- oner concerned and where any amendment is likely to effect adversely the interest of the employees the Regional Provident Fund? Commissioner shall before giving his approval , give a reasonable opportunity to the cmployee to cxplain their pe nt of view .

Where for any reason , the employees of the said establishment do not remain covered under the Life Cover Scheme of the said establishment as already adopted by the said establishment or the benefits to the employees under this Scheme are reduced in any manner , the exemption shall be liable to be cancelled.

10. The respnsiblity for payment of assurance benfits to the nominee ( s ) legal heir ( s ) of deceased member who would have been covered under the said Scheme but for grant of this exemption shall be that of the employer .

11, Upon the death of the member covered under the Life Cover Schems the employer in relation to said establishment shall ensure prompt payment of the sum assured to the nominee ( S ) Legal heir ( s ) of the deceased member entitled for it and in any case within one month from the receipt of claims complete in all respect .

In exercise of the powers conferred by Section 23 of the National Cooperative Development Corporation Act, 1962 (No.26 of 1962), the National Cooperative Development Corporation, with the previous sanction of the Central Government, hereby makes amendments to National Cooperative Development Corporation Service Regulations , 1967, as follows: -

(i) Delete the following proviso from Regulation 13 (5 )( i )(b ) :

"provided that nothing in this clause shall apply to Group ' D ' employees who entered the service of the Corporation on or before 23rd July, 1966" (!!) Delete the following proviso from Regulation 13 (5 )( ii ):

"Provided that nothing in this clause shall apply to Group ' D' employees who entered the service of the Corporation on or before 23rd July, 1966" (iii) Insert a new Clause " (iii )" in Regulation 13 (5 ) as follows:

"Notwithstanding anything contained in this Regulation, an employee, at any time, after, he has completed twenty years of service may, by giving notice of not less than three months in writing to the appointing authority, retire voluntarily from service." 1228

[PART III-SEC . 4 (iv) Insert a new Clause " ( iv) " in Regulation 13 (5 ) as follows: !

"The qualifying service as on the intended date of retirement of an employee retiring under Clause ( ii ) or retiring voluntarily under Clause (iii) shall be increased for the purpose of gratuity by a period not exceedin five years subject to the condition that the total qualifying service rendered by the employee does not in any case exceed thirty three years of service and it does not take him beyond the date of superannuation. "

(v) Insert a new Clause " (v) " in Regulation 13 (5 ) as follows:

" In the case of an employee intending to retire under Clause ( ii) or intending to voluntarily retire under Clause (iii) , the competent authority may, for good and sufficient reasons , relax the requirement of notice period of three months . "

(vi ) Insert new clause " ( vi ) " in Regulation 13 (5 ) as follows : -

"An employee who has elected to retire under this Regulation and has giventhe necessary notice to that effect to the appointing authority, shall be precluded from withdrawing his notice except with the specific approval of such authority: -

"Provided that the request for withdrawal shall be made before the intended date of his retirement . "

2. These amendments shall come into effect from the date of publication in the Gazette of India .
