सं० 11019/ 5 / 03-अ ० भा ० से०- ( III ) -अद्योहस्ताक्षरी को यह कहने का निदेश हुआ है कि अखिल भारतीय सेवा ( छुट्टी) नियमावली, 1955 के नियम 7 ( 2 ) के अनुसार " सेवा के किसी भी सदस्य को लगातार पांच वर्ष की अवधि से अधिक किसी भी प्रकार की छुट्टी मंजूर नहीं की जाएगी" । उपर्युक्त नियम 7(2) में आगे यह प्रावधान है कि:-

2. क्रम सं ० 3,7,9, 11, 12, 15, 16, 17,20,21,24,25,28 , 30, 31, 32, 34, 35, 36, 37, 39, 42, 43, 46, 47, 48, 49, 50 , 51,52 और 53 पर उल्लिखित भा ० पु ० से ० के परिवीक्षाथियों, जिनके नामों को तारांकित किया गया है, की भारतीय पुलिस सेवा में नियुक्ति अनन्तिम है तथा कार्मिक और प्रशिक्षण विभाग द्वारा आवश्यक अनापत्ति दिए जाने के अध्यधीन है ।

"जब तक कि केन्द्र सरकार मामले की विशेष परिस्थितियों ... के मद्देनजर अन्यथा तय न करे, सेवा का कोई सदस्य जो विदेश सेवा को छोड़कर , छुट्टी लेकर अथवा छु‌ट्टी लिए बिना , लगातार वर्ष की अवधि से अधिक ड्यूटी से अनुपस्थित रहता है तो उसे सेवा से त्याग पत्न दिया गया समझा जाएगा ।

परन्तु यह कि उप नियन ( 2 ) के प्रावधान लागू करने से पूर्व सेवा के सदस्य को ऐसी अनुपस्थिति का कारण स्पष्ट करने का उपयुक्त अवसर दिया जाएगा ।"

सं० 11019/ 43/ 20.03अ ० -पा०से०- ( III )-अधो हस्ताक्षरी को यह कहने का निदेश हुआ है कि अखिल भारतीय सेवा ( छुट्टी ) नियमावली, 1955 के नियम 7( 2 ) के अनुसार " सेवा के क्रिती भी सदस्य को लगातार पांच वर्ष की अवधि से अधिक, किसी भी प्रकार की छुट्टी मंजूर नहीं की जायगी" । उपयुक्त नियम 7( 2) में आगे यह प्रावधान है कि:

"जब तक कि केन्द्र सरकार मामले की विमष परिस्थितियों के मद्देनजर अन्यथा तय न करें, सेवा का कोई सदस्य जो विदेश सेवा को छोड़कर , छुट्टी लेकर अथवा छुट्टी लिए बिना, लगातार पांच वर्ष की अवधि से अधिक ड्यूटी से अनुपस्थित रहता है तो उसे सेब्रा से त्याग- पत्र दिया गया समाला जाएगा ।

परन्तु यह कि उप नियम ( 2 ) के प्रावधान लागू करने से पूर्व सेवा के सदस्य को ऐसी अनुपस्थित्ति का कारण स्पष्ट करने का उपयुक्त अवसर दिया जाएगा ।" 2. डॉ० जी एस जया भारतीय प्रशासनिक सेवा ( ए ० जी ० एम० यू० : 78 ) को 14 नवम्बर , 1993 से दो वर्ष की अवधि के लिए डब्ल्यू० आई ० पी ० ओ ० ( WIPO ) में विदेश नियुक्ति हेतु संवर्ग अनापत्ति प्रदान की गई थी । इस अवधि को 13 नवम्बर, 1998 तक तीन वर्ष के लिए आगे बढ़ा दिया गया था जब उन्होने विदेश सेवा में रहने की अधिकतम अनुमत्य पाँच वर्ष की सेवा पूरी कर ली थी । दिनांक 13 नवम्बर 1998 से 13 नवम्बर, 2003 तक पांच वर्ष की अवधि के लिए सेवा बुद्धि के उनके अनुरोध को अस्वीकार कर दिया गया क्योंकि उन्होंने विदेश सेवा प्रारंभ होने की तारीख को 25 वर्ष की सेवा पूरी नहीं की थी । डॉ० जया, भारतीय प्रशासनिक सेवा ( ए ० जी० एम० यू० : 78) दिनांक 14 नवम्बर, 1998 से डयूटी से अप्राधिकृत रूप से अनुपस्थित है । उन्होंने आज तक अपने संवर्ग अर्थात् भारत-सरकार , गृह मंत्रालय, नई दिल्ली में डयूटी के लिए रिपोर्ट नहीं किया है । वे दिनांक 14 नवम्बर, 1998 से, पांच वर्ष से भी अधिक अवधि से अपने संवर्ग से अनुपस्थित है । अतः इस संबंध में ऊपर उद्दत अखिल भारतीय सेवा ( छुट्टी) नियमावली, 1955 के नियम 7 ( 2 ) के प्रावधान लागू होते हैं ।

3. इस संबंध में डॉ ० जया को अन्तिम ज्ञात पते अर्थात् 12 रूइ मिशेल से पेट, 1206 जेनेवा, स्विटजरलैंड तथा औद्योगिक नीति और संवर्धन मंत्रालय , उद्योग भवन, नई दिल्ली के माध्यम से जहां वे प्रतिनियुक्ति पर थे, दिनांक 30 दिसम्बर , 2003 को एक कारण बताओ नोटिस जारी किया गया था । हालांकि, उनसे पांच वर्ष से अधिक समय से लगातार अनुपस्थिति का कारण स्पष्ट जरने वाला कोई उत्तर अभी तक प्राप्त नहीं हुआ है ।

2. श्रीएम० एस ० गिल, भारतीय प्रशासनिक सेवा (महाराष्ट्र: 86 ) को 17 मई, 1993 से दो वर्ष की अयश्चिः के लिए, विश्व बैंक से विदेश नियुक्ति हेतु संवयं अनापति प्रदान की गई थी । इस अवधि को 16 मई, 1998 तक तीन वर्ष के लिए आगे बढ़ा दिया गया था जब उन्होंने विदेश सेवा में रहने की अधिकतम अनुभत्य पांच वर्ष की सेवा पूरी कर ली थी । दिनांक 17 मई, 1998 से एक वर्ष तक सेवाकाल बढ़ाए जाने के उनके अनुरोध को स्वीकार नहीं किया गयाः क्योंकि पांच वर्ष के बाद सेवाकाल में वृद्धि अनुमत्य नहीं थी । श्री गिल, भारतीय प्रशासनिक सेवाः (महाराष्ट्र: 86) दिनांक 17 मई, 1998 से झूड़ी से अप्राधिकृत रूप से अनुपस्थित हैं । उन्होंने आज तक अपने संवर्ग में ड्यूटी के लिए रिपोर्ट नहीं किया है । थे दिनांक 17 मई , 1998 से, पांच वर्ष से भी अधिक अवधि से अपनी ड्यूटी से अनुपस्थित हैं । चूंकि डयूटी पर से लगातार अनुपस्थिति पांच वर्ष से भी अधिक समय की है, अतः इस संबंध में ऊपर उद्धृत अखिल भारतीय सेवा ( छुट्टी ) नियमावली, 1955 के नियम 7( 3) के प्रावधान लागू होते हैं ।

4. अतः डॉ जी० एस ० जया, भारतीय प्रशासनिक सेवा (ए०जी० एम ० यू० : 78 ) को एतद्‌द्वारा यह कारण बताओ नोटिस जारी किया जाता है कि पाँव्र वर्ष से अधिक समय से लगातार ड्यूटी से अनुरस्थित रहने के कारण, उपयुक्त अखिल भारतीय वा ( छुट्ट्टो ) नियमावली, 1955 के नियम 7 ( 2) के प्रावधानों के अनुसार भारतीय प्रशासनिक सेवा से उनका त्याग- पत्र दिया हुआ क्यों न समझा जाए । डॉ जी० एस ० जया का उत्तर, इस अधिसूवना के राजरत्र में प्रकाशित होने की तारीख से एक माह के भीतर अधोहस्ताक्षरी को प्राप्त हो जाना चाहिए और ऐसा न किए जाने पर यह मान लिया जाएगा कि उन्हें अपना कोई स्पष्टीकरण नहीं देना है और इस मामले में उपयुक्त नियम के अन्तरा त उनके द्वारा त्याग -पत्र दिया हुआ समझा जाने सबंधी कार्रवाही शुरू कर दी जाएगी ।

3. इस संबंध में श्री गिज को अन्तिम ज्ञात पत्ने अर्थात के द्वारा (केयर ऑफ) शेंगमन जाय , प्रबंध निदेशक, विश्व बैंक, वाशिंगटन डी० सी० 20433, संयुक्त राज्य अम्रीका पर और उनके संवर्ग नियंत्रक प्राधिकारी अर्थात् महाराष्ट्र राज्य सरकार के माध्यम से दिनांक 30 दिसम्बर, 2003 को एक कारण बताओ नोटिस जारी किया गया था । हालाकि , उनसे पांच वर्ष से अधिक समय से लगातार अनुपस्थिति का कारण स्पष्ट करने वाला कोई उत्तर अभी तक प्राप्त नहीं हुआ है । अकील अहमद , उप सचिन

विषय :-श्री एम ० एस ० गिल , भारतीय प्रशासनिक सेवा (महाराष्ट्र: 86) की दिनांक 16-05-1598 से संवर्ग से अप्राधिकृत अनुपस्थित-कारण बताओ नोटिस जारी किया जाना ।

4. अतः श्री एम ० एस ० गिल, भारतीय प्रशासनिक सेवा (महाराष्ट्र: 86 ) को एतद्वारा यह कारण बताओ नोटिस जारी किया जाता है कि पांच वर्ष से अधिक समय से लगातार ड्यूटी से अनुपस्थित रहने के कारण , क्रार्यक्ति अब्रिज भारतीय सेवा ( कुट्दी ) नियमावली, 1955 के नियम 7( 2 ) के मा भानां के अनुवार आरकीय प्रशासनिक सेवा से उनका त्याग श्रन भाइस का राजपत्र मार्च 27, 2004 ( चैत्र 7 , 1926 )

राष्ट्रपति , त्रिपुरा राज्य -सिविल सेवा संवर्ग के निम्नलिखित् सदस्यों को वर्ष , 2003 की रिक्तियों पर, भारतीय प्रहारानिक सेवा में परिवीक्षा पर , अगले आदेशों तक तत्काल प्रभाव से नियुक्त करते हैं और उन्हें भारतीय प्रशासनिक सेवा (संवर्ग ) नियम, 1954 के नियम 5 के उप -नियम ( 1 ) के अधीन संयुक्त मणिपुर-त्रिपुरा संवर्ग के त्रिपुरा खंड में आबंटित करते हैं:-- दिया हुआ क्यों न समझा जाए । श्री गिल का उत्तर, इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से एक माहू के भीतर अधोहस्ताक्षरी को प्राप्त हो जाना चाहिए और ऐसा नःकिए जाने पर यह मान लिया जाएगा कि उन्हें अपना कोई सवंष्टीकरण नहीं देना है और इस मामले में उपर्युक्त नियम के अंतर्गत उनके द्वारा त्याग - पत्त्रः दिया हुआ. समझा जाने संबंधी कार्रवाई शुरू कर दी जाएगी ।

4. परिवीक्षा अवधिः

2. सतर्कता अनुशासनिक मामला, यदि कोई हो ।

डाक सेवा ग्रुप " बी" में पदोन्नत किए बफवारी दी गर्ने के लिए परिवीक्षा पर होंगे तथा इस पद पर बने रहते के लिए उनकी उपयुक्तता का निर्णय परिवीक्षा के दो वर्ष पूरे होने पर होगा । इस अवधि के दौरान यदि कोई कर्मचारी 30 दिनों से अधिक अवधि के लिए छु‌ट्टी पर जाता है , तो छुट्टी की अवधि के आधार पर परिवीक्षा अवधि बढ़ जाएगी । 5. प्रशिक्षण

कर्मचारी, फिलहाल , बिना किसी प्रशिक्षण के डाक सेवा ग्रुप " बी" में सीधे पदोन्नत किए जाएंगे । तथापि, जब कभी निदेशक, पोस्टल स्टाफ कालेज , गाजियाबाद द्वारा अधिसूचित किया जाएगा, उन्हें निर्धारित प्रशिक्षण प्राप्त करेना होगा । *

6. वेतन निर्धारण के लिए विकल्प

यदि किसी कर्मचारी के खिलाफ इस कार्यालय के ज्ञापन सं ० 25-19/ 88-एसपीजी दिनांक 04-5-88 के साथ परि- जालित कार्मिक और प्रशिक्षण विभाग के का ० ज्ञा० सं ० 22011/2/ 86-स्था ० (क) दिनांक 12-01-88 में उल्लिखित कोई सतर्कता/अनुशासनिक मामला लम्बित हो जिसमें बाद में कार्मिक और प्रशिक्षण विभाग के ज्ञापन सं ० 22022/4 /91- स्था० ( क) दिनांक 14-9-92 द्वारा संशोधन किया गया था तथा इस कार्यालय के ज्ञापन सं० 25-19/88-एसपीजी दिनांक 13-10-92 के साथ परिचालि किया गया था , उसे इस कार्यालय से विशिष्ट आदेश प्राप्त किए बिना तैनाती के लिए कार्यमुक्त न किया जाए । जिन कर्मचारियों को कोई दण्ड दिया गया है, उन्हें तब तक पदोन्नत न किया जाए जब तक दण्ड की अवधि समाप्त नहीं हो जाती । इस संबंध में एक रिपोर्ट तत्काल प्रस्तुत की जाए ।

3. पात्रता के अध्यधीन पदोन्नति

यदि अधिकारी एफआर-22 ( i ) ( क) ( 1) के अधीन पेवन निर्धारण के लिए तारीख का चयन करने का विकल्प देना चाहता है, तो वह पदोन्नति की तारीख से एक. माह के भीतर ऐसा कर सकता है ।

5. प्रशिक्षण

सभी कर्मचारी , फिलहाल , बिना किसी प्रशिक्षण के डाक सेवा ग्रुप 'बी' में सीधे पदोन्नत किए जाएंगे । तथापि, जब कभी निदेशक , पोहन, गजिराबाद द्वारा अधिसूचित किया जाएगा , उन्हें निर्धारित प्रशिक्षण प्राप्त करना होगा ।

6. वेतन निर्धारण के लिए विकल्प

जो अधिकारी एफआर-22 ( 1 ) ( क ) ( 1 ) के अधीन वेतन निर्धारण के लिए तारीख का चयन करने का विकल्प देना चाहते हैं, थे पदोन्नति की तारीख से एक माह के भीतर ऐसा कर सकते हैं । 7. अपने मूल सकिल से बाहर आबंटित किए गए अधिकारी आबंटित सर्किल तत्काल तैनाती आदेश जारी करेंगे और ये आदेश हर हालत में 28-2-2004 तक जारी हो जाने चाहिएं । इस समय ये कर्मचारी जिन सर्किलों में काम कर रहे हैं, थे उन सर्किलों से जिनमें उन्हें तैनात किया गया है, तैनाती आदेश प्राप्त होने पर कर्मचारियों को कार्यमुक्त करेंगे । यदि कोई कर्मचारी पदोन्नत पद का कार्यभार ग्रहण करने का इच्छुक नहीं है, तो वह एक पखवाड़े की अवधि के भीतर लिखित में पदोन्नति प्रस्ताव ठुकरा सकता है । ऐसा न करने पर संबंधित मुख्य पोस्टमास्टर जनरल द्वारा उन्हें अनिवार्यतः कार्यमुक्त कर दिया जाएगा । संबंधित सर्किल के मुख्य पोस्टमास्टर जनरल अपने सकिल में अधिकारियों के कार्यभार ग्रहण करने तथा अधिकारियों को कार्यमुक्त करने के बारे में समेकित रूप में एक रिपोर्ट 10-10-2004 तक निदेशालय को अवश्य भेजेंगे ।

2. ओ० ए० सं ० 85/2002 और ओ ० ए० सं० 429/98 में माननीय केन्द्रीय प्रशासनिक अधिकरण , जयपुर पीठ द्वारा पारित 6 जनवरी , 2003 के सामान्य अ.देश के अनुपालन में एफ सी एस के अंतर्गत श्री आई ० के० शमी और डा० एम० एन० खान पर विचार करते हुए उन्हें वैज्ञानिक 'घ' के ग्रेड में नियुक्त किया गया है ।

3. एफसीएस के तहत वैज्ञानिक ' घ ' के ग्रेड में उपरोक्त अधिकारियों की पदोन्नति स्वस्थाने और संबंधित अधिकारियों के लिए वैर्याक्तक होगी तथा इस कारण से वैज्ञानिक 'ग' के निचले ग्रेड में कोई विशिष्ट रिक्ति नहीं होगी । संबंधित अधिका- रियों द्वारा वर्तमान में धारित पद उच्च ग्रेड अर्थात् वैज्ञानिक ' घ' 320

2. Dr. G.S.Jaiya, IAS ( AGMU: 78) was granted Cadre Clearance for Foreign assignment with WIPO for a period of two years from 14th November, 1993. This period was extendedby three years upto 13th November, 1998 when he completed the maximum permissible five years to be on foreign service . His request for extension for five years from 13th November , 1998 to 13th November , 2003 was rejected as he had not completed 25 years of service as on date of commencement of the foreign service. He is unauthorisedly absent from duty w.e.f. 14th November, 1998. Dr. Jaiya , IAS (AGMU: 78 ) has not reported back for duty to his cadre , as on date i.e. the Government of India, Ministry of Home Affairs , New Delhi . He is absent from his cadre for a period exceeding five years since 14th No- vember , 1998. Therefore , it attracts the provision of Rule 7(2) of the AIS (Leave) Rules , 1955 quoted above.

2. M.S. Gill , IAS (MH : 86) was granted Cadre Clearance for Foreign assignment with World Bank for a period of two years from 17th May, 1993. This period was extended by three years upto 16th May, 1998 when he completed the maximum permissible five years to be on foreign service . His request for extension for five years from 17th May, 1998 was rejected as extension beyond five years was not permissible . He is unauthorisedly absent from duty w.e.f. 17th May, 1998 . Shri Gill, IAS (MH : 86) has not reported back for duty to his cadre, as on date . He is absenting himself for a period exceeding five years since 17th May, 1998. Since the continuous absence from duty has been for more than five years , it attracts the provision of Rule 7(2) of the AIS (Leave) Rules , 1955 quoted above .

3. A Show Cause Notice was issued in this regard on 30.12.2003 at his last known address viz . 12 , Rue Michel . Servet , 1206 Geneva , Switzerland and through the Minis- try of Industrial Policy and Promotion , Udyog Bhawan, NewDelhi where he was on Central Deputation . However, no reply explaining the reasons for his continuous ab- sence for more than five years has been received .

3. A Show Cause Notice was issued in this regard on 30.12.2003 at his last known address viz . C/o Shengman Zhang, Managing Director. The World Bank, Washington D.C. 20433 , USA and through the Controlling Authority, i.e. Government of Maharashtra .. However , no reply explaining the reasons for his continuous absence for more than five years has been received .
