भारत सरकार के राजपत्र में 20 अप्रैल 1946 को प्रकाशित तथा 29 अप्रैल 1954 की अधिसूचना सं. एफ. ( 8 ) 70/बी 52 और भारत सरकार के दिनांक 21 फरवरी , 1990 के असाधारण राजपत्र सं . 67 के अंतर्गत यथा संशोधित लोक ऋण अधिनियम 1944 की धारा 28 के अंतर्गत भारत सरकार द्वारा बनाए गए लोक ऋण नियमावली 1946 के नियम 18 के अनुसरण फरवरी 2004 को समाप्त माह के लिए निम्नलिखित सूची खो गई आदि ऐसी प्रतिभूतियों के बारे में एतद्वारा विज्ञापित कीजाती है, जिसके संबंध में इस बात का विश्वास करने के लिए प्रथम दृष्टतया आधार मौजूद है कि प्रतिभूतियां खो गयी हैं और आवेदकों का दावा न्यायोचित है । नीचे लिखे गये संबंधित दावेदारों से इतर सभी व्यक्ति जिनका प्रतिभूतियों पर किसी प्रकार का दावा हो, तत्काल महाप्रबंधक, भारतीय रिजर्व बैंक केन्द्रीय कार्यालय , सरकारी और बैंक लेखा विभाग , केन्द्रीय ऋण प्रभाग , मुंबई 400 008 को संसूचित करें ।

सूची दो भागों में विभाजित की गई है । भाग ' क ' में अभी पहली बार विज्ञापित प्रतिभूतियां शामिल की गई हैं और भाग ' ख ' में पूर्व विज्ञापित प्रतिभूतियों की सूची दी गई है ।

राष्ट्रीय कृषि और ग्रामीण विकास बैंक [ नाबार्ड] अधिनियम 1981 की धारा 60 में प्रदान की गई शक्तियों का प्रयोग करते हुए राष्ट्रीय बैंक के निदेशक मण्डल ने केन्द्र सरकार से पूर्व में लिए गये अनुमोदन से और भारतीय रिजर्ब बैंक के परामर्श से राष्ट्रीय कृषि और ग्रामीण विकास बैंक [ बाण्ड्स का निर्गम एवं प्रबंधन] विनियमावली , 1987 में निम्नानुसार संशोधन किया गया है. ,

1[1] इन विनियमों को राष्ट्रीय कृषि और ग्रामीण विकास बैंक [बाण्ड्स का निर्गम एवं प्रबंधन] संशोधन विनियमावली, 2004 माना जाए .

[2] यह विनियम सरकारी राजपत्र में इनके प्रकाशन की तिथि से लागू हो जाएंगे .

2. राष्ट्रीय कृषि और ग्रामीण विकास बैंक [बाण्ड्स का निर्गम एवं प्रबंधन] विनियमावली, निदेशक मण्डल के अनुमोदन के अधीन राष्ट्रीय बैंक या रिजर्व बैंक के एसजीएल खाता में 1987 , [ " जिसे इसके बाद मुख्य विनियमावली " कहा जाएगा] के विनियम 3 [ 1 ] [ बी] से धारक के नाम जमा स्टाक... शब्दों को हटाया जाए .

3. निम्नलिखित उप-विनियम [3ए] को उप- नियम 3 [3 ] के बाद सन्निविष्ट किया जाएः भाग III-खण्ड 4]

2169 " 3 ए [ क] इस में विनिर्दिष्ट के विपरित होते हुए भी राष्ट्रीय बैंक , बाण्ड धारण करने के लिए पात्र व्यक्ति के अनुरोध पर बाण्ड धारण करने के लिए पात्र व्यक्ति के नाम से राष्ट्रीय बैंक द्वारा रखे गये खाते में प्रविष्ट के रुप में बाण्ड जारी कर सकता है " .

[ख. ] राष्ट्रीय बैंक की खाता बहियों में बाण्ड या तो आरंभ में बाण्ड के लिए अभिदान के समय या प्रामिसरी नोट या स्टाक के रुप में जारी किये गए बाण्ड्स के रुपांतरण के समय जारी किये जा सकते है .

[ग ] यदि बाण्ड पहले से ही प्रॉमिसरी नोट के रुप में जारी किया गया हो और बाण्ड धारक उसे राष्ट्रीय बैंक के खाते में प्रविष्टि के रुप में धारण करने में इच्छुक हो तो वह प्रपत्र XI में आवेदन करते हुए राष्ट्रीय बैंक के बही खाता में प्रविष्टि के रुप में बाण्ड धारण करने हेतु राष्ट्रीय बैंक के पक्ष में विधिवत रुप से पृष्ठांकित बाण्ड अभ्यर्पित करेगा.

[ घ] यदि बाण्ड, स्टाक प्रमाणपत्र के रुप में जारी किया गया है तो धारक , राष्ट्रीय बैंक द्वारा धारक के नाम रखे गये खाते में प्रविष्टि के रुप में बाण्ड धारण करने के लिए आवेदन के साथ राष्ट्रीय बैंक के पक्ष में बाण्ड्स हस्तांतरित करेगा.

[य] राष्ट्रीय बैंक द्वारा रखे गये खाते में प्रविष्टि के रुप में बाण्ड धारण करने वाला व्यक्ति प्रपत्र XII में आवेदन करके बाण्ड्स को प्रॉमिसरी नोट या स्टाक प्रमाणपत्र में हस्तांतरित या रुपांतरित कर सकता है .

[र] राष्ट्रीय बैंक के बही खाते में प्रविष्टि के रुप में बाण्ड जारी करने के लिए या प्रॉमिसरी नोट या स्टाक के रुप में पहले ही जारी किये गए बाण्ड्स को राष्ट्रीय बैंक के बही खाते में प्रविष्टि के रुप में या उलटा/प्रत्तिकमात रुपांतरित करने के लिए शुल्क प्रभार्य नहीं होगा.

[ल] जब तक अन्यथा प्रावधान ने किया जाए , राष्ट्रीय बैंक के बही खाते में प्रविष्टि के रूप में धारित या जारी बाण्ड्स, प्रपत्र XIII में हस्तांतरण के लिखत के निष्पादन से हस्तांतरणीय होंगे . राष्ट्रीय बैंक की बहियों में हस्तांतरिती का नाम जब तक दर्ज नहीं हो जाता जब तक ऐसे प्रकरणों में बाण्ड्सके हस्तांतरण के संबन्ध में हस्तातरणकर्ता को ही बाण्ड धारक समझा जाएगा . 4. मुख्य विनियमावली के विनियम 3 में उप विनियम 3 [ क ] के बाद 3 [ ख ] के रुप में निम्नलिखित विनियम शामिल किया जाएगा , यथाः

" 3 ख इसमें उपर विनिर्दिष्ट के होते भी और डिपॉजिटरीज अधिनियम , 1996 के प्रावधानों या आगे उसमें हुए अन्य संशोधनों के अधीन

बाण्ड में अभिदान या धारण करने वाले प्रत्येक व्यक्ति/ यों को डिपॉजिटरीज अधिनियम , 1996 केप्रावधानों के अंतर्गत आनेवाले डिपॉजिटरियों के साथ धारण करने का विकल्प होगा .

5. मुख्य विनियमावली के विनियम 3 , के उप- विनियम [4 ] की धारा [ i ] के बदले में निम्नलिखित विनियम जोड़ा जाएगा , यथा : -

3 [4 ] [ i ] " बाण्ड , राष्ट्रीय बैंक के अध्यक्ष या उनकी अनुपस्थिति में प्रबंध निदेशक या निदेशक मंडल द्वारा प्रधिकृत प्रधिकारी के हस्ताक्षर से जारी किया जाएगा जो कि मुद्रित , अंकित , अश्ममुद्रित या राष्ट्रीय बैंक द्वारा दिए जानेवाले दिशार्निदेशों के अनुसार अन्य किसी यांत्रिक प्रक्रिया से मुद्रित होगा. "

6. मुख्य विनियमावली के विनियम 4 में उपविनियम [ i ] के बाद निम्नलिखित उपबन्ध और स्पष्टीकरण शामिल किया जाएगा , यथाः-

"बशर्ते कि लाभकर्ता स्वामी/मालिक की ओर से/के पक्ष में पंजीकृत स्वामी/मालिक के रुप में धारण किये गए बाण्ड्स के सम्बन्ध में इस विनियमावली का कोई भी हिस्सा डिपॉजिटरी के लिए लागूनहीं होगा. "

स्पष्टीकरण : मुख्य विनियमावली के विनियम 3,4,7 और 21 और उसकी अनुसूची के और प्रपत्र XVI हेतु उस में उल्लेख किये गए भाग III-खण्ड4]

डिपॉजिटरीज अधिनियम , 1996 की धारा 2 के खण्ड [ i ] के उपखण्ड [ ए] [ ई] एवं [ आई] में उनके लिए क्रमशः निर्धारित अर्थ में " लाभकर्ता स्वामी/ मालिक डिपॉजिटरी " और " पंजीकृत स्वामी/मालिक " का अर्थ समान होगा.

7. मुख्य विनियमावली के उप विनियम 7 [ 2 ] के बाद निम्नलिखित उप विनियम 7 [3 ] और 7[4]

शमिल किये जाएंगे , यथाः-

7 [ 3 ] - ब्याज का भुगतान :

राष्ट्रीय बैंक और तत्कालीन एआरडीसी द्वारा जारी किये बाण्ड्स पर उपचित ब्याज की राशि को नजदीकतम रुपये में पूणांकित करके भुगतान किया जाएगा.

" 7 [ 4 ] राष्ट्रीय बैंक द्वारा ब्याज का भुगतान ब्याज वारंट जारी करके , खाते धारक के पक्ष में रेखित चेक द्वारा , इलेक्ट्रॉनिक क्लिअरींग सेवा के माध्यम से बैंक खाते में जमा करके या और प्रस्ताव दस्तावेज में विनिर्दिष्ट ऐसे विशिष्ट प्रकार से या राष्ट्रीय बैंक द्वारा किये गये निर्णय के अनुसार अन्य किसी विशेष पद्वात से किया जाएगा. "

8. मुख्य विनियमावली के विनियम 9 के स्थान पर निम्नलिखित विनियम शामिल किया जाएगा, यथा

9. प्रॉमिसरी नोट के रूप में जारी बाण्ड खो आदि जाने की सूचना :

प्रॉमिसरी नोट के रुप में जारी बाण्ड या उसके किसी अंश के खो जाने , नष्ट हो जाने , खराब हो जाने या विरुपण हो जाने की स्थिति में आवेदक/ धारक को अंग्रेजी और हिन्दी या उस राज्य की, जहाँ बाण्ड के खो जाने , चोरी हो जाने , नष्ट हो जाने , खराब हो जाने या विरुपण हो जाने की घटना घटी हो राजभाषा में प्रकाशित होनेवालें दो प्रमुख अखबारों में इस के बारे में तुरंत अधिसूचित करना होगा .

विविध राज्यों के प्रमुख अखबारों में कौन कौन से अखबारों का समावेश होगा, इस बात का निर्णय राष्ट्रीय बैंक समय समय पर लेगा.

यह अधिसूचना निम्नलिखित प्रारुप में , जैसे परिस्थिति अनुमति देती हो या समरुप मसौदे के अनुसार होनी चाहिए.

राष्ट्रीय कृषि और ग्रामीण विकास बैंक का खो गया */चुराया गया* / नष्ट किया गया */ खराब किया गया */विरुपित किया गया * बाण्ड. राष्ट्रीय कृषि और ग्रामीण विकास बैंक की श्रृंखला के रु रुपये जो मूलतः ------ % के बाण्ड्स , अनुक्रम संख्या के नाम जारी किये गये थे और अंत में आवेदक/ धारक को पृष्ठांकित किये थे जो बाद में किसी भी अन्य व्यक्ति के नाम पृष्ठांकित नहीं किये थे जो चोरी हो गये है*/ खो गये है*/खो गये है*/नष्ट हो गए है* /खराब हो गए है * /विरुपित हो गए है * ,

एतद्वारा सूचित किया जाता है कि उक्त बाण्ड एवं इस पर उपचित ब्याज के भुगतान को जारीकर्ता कार्यालय यथा , पीडीओ , भारतीय रिजर्व बैंक */राष्ट्रीय कृषि और ग्रामीण विकास बैंक , प्रधान कार्यालय , प्लॉट सी-24 , जी-ब्लॉक , बांद्रा कुर्ला काम्प्लेक्स , बांद्रा [ पूर्व] , मुंबई 400 051. ने रोक दिया है और आवेदक/धारक के नाम उक्त डुप्लिकेट बाण्ड जारी करने के लिए आवेदन किया गया है भाग III ----खण्ड 4]

जनता को उक्त बाण्ड के क्रय या किसी अन्य प्रकार के लेनदेन के सम्बन्ध में सावधान किया जाता है.

10 [ | ] विनियम 9 में निर्धारित अधिसूचना के प्रकाशन के बाद , निधर्धारित अधिकारी यदि तह बाण्ड के खो जाने , चोरी हो जाने , नष्ट हो जाने , खराब हो जाने या विरुपित हो जाने , जैसा भी मामला हो , या आवेदक/धारक के दावे की सत्यता से संतुष्ट हो तो डुप्लिकेट बाण्ड प्रमाणप जारी करने के अपने इरादे को विनियम 9 के अनुसार दो प्रमुख अखबारों में प्रकाशित करेगा. ऐसी सूचना निम्नलिखित प्रारूप में या परिस्थिति के अनुसार अन्य समरुण प्रारुप में होगी.

उपर्युक्त बाण्ड्/ स के संबंध में कोई भी व्यक्ति , जो दावा करता हो , वह भारतीय रिजर्व बैंक , [स्थान] /राष्ट्रीय बैंक, प्रधान कार्यालय को तिथि से 3 माह के भीतर की अवधि पीडीओ में सूचना भेजें/संपर्क करें. भारतीय रिजर्व बैंक/ राष्ट्रीय बैंक 3 माह की अवधि की समाप्ति पर डुप्लिकेट बाण्ड्/स जारी करने की कार्रवाई आरंभ करेगा और मूल बाण्ड्स को निरस्त माना जाएगा. जो भी व्यक्ति इस बाण्ड्/स की लेन देन करता हो तो लागत मूल्य और परिणामों के सम्बन्ध में केवल अपनी जिम्मेदारी पर करेगा और इस के लिए राष्ट्रीय बैंक/ भारतीय रिजर्व बैंक किसी भी प्रकार से जिम्मेदार नही होगा .

10. मुख्य विनियमावली के विनियम [ 10 ] के उप विनियम [3 ] को हटा दिया जाएगा .

11. मुख्य विनियमावली के विनियम 12 के बाद निम्नलिखित विनियम 12 ए जोडा जाएगा व्यथा 12 ए राष्ट्रीय बैंक का स्वनिर्णय :

विनियम 9,10,11 और 12 में विनिर्दिष्ट के होते हुए भी राष्ट्रीय बैंक जहाँ आवश्यक समझें, उसमें विनिर्दिष्ट डुप्लिकेट बाण्ड को जारी करने की क्रिया प्रणालियों को अपने विवेकानुसार निरस्त/रद्द करने का और ऐसे नियमों यथा क्षतिपूर्ति या अन्यथा के अधीन या राष्ट्रीय बैंक जैसा उचित समझे, डुप्लिकेट बाण्ड जारी करने का निर्णय राष्ट्रीय बैंक के लिए विधिगत होगा.

12. मुख्य विनियमावली के विनियम 15 के बाद निम्नलिखित विनियम 15 ए जोड़ा जाएगा , यथाः

15 ए- नामांकन

[ 1 ] विनियम 15 में विनिर्दिष्ट के होते हुए भी, जहाँ बाण्ड धारक एक या अधिक व्यक्ति हो वहाँ एकल धारक या जैसा भी मामला हो , सभी धारक मिलकर किसी भी व्यक्ति/व्यक्तियों को नामित कर सकता/सकते है जिसे/जिन्हे एकल धारक/समस्त धारकों की मृत्यु के उपरान्त बाण्ड्/स की देय राशि [भाग III-खण्ड 4

का भुगतान किया जा सके और इस विनियम के प्रावधानों के अधीन राष्ट्रीय बैंक द्वारा किया गया भुगतान , बाण्ड के संबन्ध में राष्ट्रीय बैंक को अपने दायित्व से पूर्णतः मुक्त करेगा.

बशर्ते कि जब दो या अधिक व्यक्ति बाण्ड धारक हो, नामिती , सभी धारकों की मृत्यु के उपरान्त ही साझ प्राप्त करने के लिए पात्र हो जाएगा.

आगे बशर्म कि इस विनियम में अंतर्निष्ट से बाण्ड की देय राशि के संबंध में नामिति के विरुध्द बाण्ड के मूल धारक/कों के किसी भी प्रतिनिधि के किसी भी प्रकार के दावे पर असर नहीं होगा.

2. यदि विनियम [ 1 ] के अधीन एक या एक से अधिक व्यक्ति/ यों को नामित किया गया हो , तो राशि को नामांकन में विनिर्दिष्ट के अनुसार नामितियों में विभाजित किया जाएगा. बशर्ते कि नामांकन बना नहीं रहता या ऐसा नामांकन देय राशि के छोटे से हिस्से के सम्बन्ध में हो पूर्ण राशि या उसके हिस्से का भुगतान , जिससे नामांकन का कोई सम्बन्ध न हो , विनियम 15 को उप विनियम [2 ] के अंतर्गत पात्र व्यक्तियों को किया जाएगा .

[3 ] उप विनियम [ 1 ] के अंतर्गत एकल धारक या जैसा भी मामला हो , सभी धारक मिलकर फार्म XIV में नामांकन कर सकते है.

14. धारक द्वारा व्यक्तिगत हैसियत से और न कि कार्यालय या अन्यथा के प्रतिनिधि की हैसियत से धारण किये गए बाण्ड के सम्बन्ध में ही नामांकन किया जा सकेगा.

[ 5 , जहाँ नामिति नाबालिग हो वहाँ एकल धारक या जैसा भी प्रकरण हो , सभी धारक मिलकर नामिति की नाबालिगता के दौरान बाण्ड की देय राशि प्राप्त करने के लिए किसी भी व्यक्ति [ जो बालिग हो] की नियुक्ति कर सकते हैं .

[6 ] जहाँ बाण्ड नाबालिग के नाम में धारण किया गया हो , नामांकन यदि हो , केवल नाबालिग की ओर से कार्रवाई करने के लिए विधिगत रुप से पात्र व्यक्ति द्वारा ही किया जा सकेगा .

[ 7 ] राष्ट्रीय बैंक को बाण्ड के साथ - साथ फार्म XIV में आवेदन करते हुए नामांकन को बदला जा सकता है या फार्म XV में आवेदन करते हुए नामांकन निरस्त किया जा सकता है .

[8] राष्ट्रीय बैंक की लेखा बहियों में नामांकन करना या नामांकन को बदली करना या निरस्त करना पंजीकृत करवाना होगा और बाण्ड पर इस के पंजीकरण को विनिर्दिष्ट करना होगा और नामांकन करने , निरस्त करने या बदली करने जैसा भी प्रकरण हों , सम्बन्धी ऐसा पंजीकरण [भाग III--खण्ड 4 2178

उसे जमा करने की तिथि से लागू माना जाएगा.

[9] बाण्ड के सम्बन्ध में इस विनियम के अंतर्गत किए गए और पंजीकृत नामांकन से नार्मार्मात द्वारा अधिग्रहित अधिकारों पर डुप्लिकेट बाण्ड जारी करने से कोई परिणाम नहीं होगा और नामिति को मूल बाण्ड के सम्बन्ध में मिले अधिकारों के समरुप अधिकार डुप्लिकेट बाण्ड के सम्बन्धमें भी मिलेगा.

13. मुख्य विनियमावली के विनियम 19 के उप विनियम [ बी] के स्थान पर निम्नलिखित को जोडा जाएगा , यथाः

11 19 [बी] विनियम 10 [ 1 ] के तहत जारी अधिसूचना के प्रकाशन की तिथि से 4 वर्ष बीत जाने के बाद डुप्लिकेट बाण्ड के प्रकरण में "

14. मुख्य विनियमावली के विनियम 21 के बाद निम्नलिखित विनियम 21 [ ए] जोडा जाएगा , यथा :

21 [ए] जब खाते में प्रविष्टि के रुप में जारी बाण्ड मूल राशि के भुगतान के लिए देय हो जाता है तो धारक को फार्म XVI में विानिर्दिष्ट विधिवत रुप से हस्ताक्षरित रसीद जारीकर्ता कार्यालय के पास जमा करनी होगी.

15. मुख्य विनियमावली की अनुसूची के फार्म XI से XVI तक के फार्म्स , फार्म X के बाद जोडे जाएंगे .

क्षतिपूर्ति विलेख

यह करारनामा द्वारा , इस के बाद जिन्हें " आभारी " ( Obligor ) [धारक का नाम]

माह के -दिन संबोधित किया जाएगा [ इस अभिव्यक्ति में प्रसंगानुसार आवश्यकता हो तो उनके कानूनी प्रतिनिधि, निष्पादक , वारिस , प्रशासक/उत्तराधिकारी और अधिन्यासी भी शामिल है] वर्ष 2004 के -में [स्थान] राष्ट्रीय कृषि और ग्रामीण विकास बैंक के पक्ष में , जिसकी स्थापना राष्ट्रीय कृषि और ग्रामीण विकास बैंक अधिनियम , 1981 के तहत की गई थी जिसे इसके बाद " राष्ट्रीय बैंक " सम्बोधित किया जाएगा . [ इस अभिव्यक्ति में प्रसंगानुसार आवश्यकता हो तो उनके अत्तराधिकारी और अधिन्यासी भी शामिल है ] .

जहाँ आभारी ने प्रतिशत के राष्ट्रीय कृषि और ग्रामीण विकास बैंक बाण्ड्स [ --- -श्रृंखला ] में अभिदान/ निवेश किया है.

और जहाँ भविष्य में " आभारी " द्वारा राष्ट्रीय कृषि और ग्रामीण विकास बाण्ड्स , राष्ट्रीय बैंक द्वारा रखे जानेवाले खाते में प्रॉमिसरी नोट के रुप में या स्टाक के रुप में जारी होनेवाले बाण्ड्स भी अधिग्रहित और/या में अभिदान किये जाने की संभावना है .

और जहाँ " आभारी " के अनुरोध पर अपनी सुविधा के लिए प्रॉमिसरी नोट्स के रुप में या राष्ट्रीय बैंक द्वारा रखे जाने वाले एसजीएल खाते में स्टाक के रुप में ऐसे सभी बाण्ड्स समय समय पर और हर समय रखने या/ और धारण करने की अनुमति " आभारी " को देने के लिए राष्ट्रीय बैंक सहमत है.

और बाण्ड धारक की हैसियत से " आभारी " के विकल्प पर यह विनिमेय होंगे.

और जहाँ राष्ट्रीय बैंक ने अपने बही खातों में अभिदान किए गए बाण्ड्स या आभारी द्वारा इस के बाद समय समय पर धारण किये गए और रखे गए बाण्ड्स के सम्बन्ध में एसजीएल खोलने की सहमती दर्शायी है .

और जहाँ बाण्ड धारक की हैसियत से आभारी द्वारा किये गए प्रतिवेदनों , आभारी राष्ट्रीय बैंक को समय समय पर दी जानेवाली प्रॉमिसरी नोटों के रुप में बाण्ड्स धारण करने के लिए सहमत है , के आधारपर ऐसे बाण्ड्स का रुपांतरण , बशर्ते कि आभारी राष्ट्रीय बैंक के पक्ष में विलेख निष्पादित करें कि उपर्युक्त बाण्ड्स की हानि हो जाने , खो जाने , दावें , कार्रवाई , कार्यवाही , लागत , प्रभार और व्ययों की पूर्णतः एवं स्पष्टतः क्षतिपूर्ति राष्ट्रीय बैंक को करने के लिए सहमत है , बाण्ड्स पर पृष्ठांकित स्वामित्व, संपत्ति या वैधता की ग्राहयता के बिना राष्ट्रीय बैंक करेगा .

और जहाँ आभारी ने ऐसे क्षतिपूर्ति विलेख को निष्पादित करने की सहमति दर्शायी है .

अब यह करारनामा साक्षी है कि उक्त करारनामें के अनुक्रम में और आभारी द्वारा राष्ट्रीय बैंक के साथ किये गए प्रतिज्ञापत्र के अनुसार इसके बाद आभारी समय समय पर और हर समय राष्ट्रीय बैंक और उसकी सम्पति की प्रभावी रुप से रक्षा और क्षतिपूर्ति करेगा और

[ भाग III-खण्ड 4 राष्टीय बैंक द्वारा वहन की जानेली दानि, हानि , दावें , कार्रवाई , माँग , कार्यवाही , लागत , प्रभार और व्यवों की क्षतिपूर्ति करेगा जिसे राष्ट्रीय बैंक के पास समय समय पर आभारी द्वारा जमा किये नाले और अंशदान किये जानवाले बाण्ड्स के दावें या मॉग के कारण या अभिदान करने के कारण उत्तान स्थिति हेतु या इसमें राष्ट्रीय बैंक द्वारा रखे गए एसजीएल खाता में स्टाक के रूप में रुपांतरित करेगा था उक्त एमजीएल खाता में धारण करेगा और राष्ट्रीय बैंक उपरोक्त सभी बाण्ड्स या उनसे से किसी भी बाण्ड्स को जिनके नाम हस्तांतरित करेगा उन बाण्ड्स पर देकर का भुगतान करेगा और हरतांतरण में ऐसी सभी बाण्ड्स और आभारी द्वारा प्राप्त ब्याज स्वरुप राशि शामिल है.

संख्या एचआरडी-1 ( 11 ) / 97 / ईई ( सी) /आरआर कर्मचारी भविष्य निधि और प्रकीर्ण उपबंध अधिनियम, 1952 (1952 का 19) की धारा 5 ( घ) की उपधारा 7 (क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय बोर्ड, सरकार के अनुमोदन से कर्मचारी भविष्य निधि संगठन के कार्यकारी अभियन्ता (सिविल) के पद पर भर्ती की पद्धति का नियमन करने के लिए निम्नलिखित नियम बनाता है, अर्थात : -

1. संक्षिप्त शीर्ष और प्रारम्भ

(i) ये नियम कर्मचारी भविष्य निधि संगठन कार्यकारी अभियन्ता (सिविल) भर्ती नियम, 2004 कहलायेंगे ।

ये सरकारी राजपत्र में प्रकाशन की तिथि से प्रवृत्त होंगे । (ii)

लागू होना 2.

ये नियम इन नियमों के साथ संलग्न अनुसूची के कालम 1 में विनिर्दिष्ट पदों पर लागू होंगे ।

3. पदों की संख्या, वर्गीकरण और वेतनमान

पदों की संख्या , उसका वर्गीकरण और इससे संबद्ध वेतनमान इस नियमावली के साथ संलग्न अनुसूची में उल्लिखित कालम 2 से 4 के अनुसार होंगे ।

4. अर्ती पद्धति, आयु सीमा और अन्य योग्यताएं इत्यादि

उक्त पद से संबंधित भर्ती की पद्धति, आयु सीमा , योग्यताएं और अन्य मामले, अनुसूची. में उल्लिखित कालम 5 से 14 के अनुसार होंगे ।

5. अयोग्यताएं

यह व्यक्ति पात्र नहीं होगा : -

(क) जिसने उस व्यक्ति से विवाह किया है, जिसका पति/ पत्नी जीवित है या

(ख) जिसने पति/ पत्नी जीवित होने पर किसी अन्य व्यक्ति से विवाह किया है । भाग III-खण्ड 4]

बशर्ते कि केन्द्रीय न्यासी बोर्ड, यदि इस बात से संतुष्ट है कि ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अंतर्गत ऐसा विवाह स्वीकार्य है और ऐसा करने के लिए अन्य आधार हैं , तो ऐसे किसी व्यक्ति को इस नियम के प्रचालन से छूट दे सकता है ।

6. छूट देने की शक्ति

जहां केन्द्रीय न्यासी बोर्ड का यह मत है कि यह आवश्यक है या ऐसा करना समीचीन होगा तो लिखित में कारणों को रिकार्ड करते हुए आदेश द्वारा और केन्द्र सरकार के साथ परामर्श करके किसी वर्ग या श्रेणी के व्यक्तियों के संबंध में इन नियमों के किसी उपबंध में छूट दे सकता है ।

7. अपवाद

इस संबंध में केन्द्रीय सरकार द्वारा समय समय पर जारी किये गये आदेशों के अनुसार ये नियम अनुसूचित जातियों, अनुसूचित जन जातियों, भूतपूर्व सैनिकों और अन्य विशेष वर्गों के व्यक्तियों को दिये जाने वाले आरक्षणों , आयु सीमा में छूट और रियायतों को प्रभावित नहीं करेंगे ।

समान पद धारण किये हो, या (i)

पदोन्नति / प्रतिनियुक्ति / स्थानांतरण द्वारा भर्ती होने के मामले में वे ग्रेड जिससे पदोन्नति । प्रतिनियुक्ति / स्थानांतरण किया जाना है ।

(ii) 8000-275-13500 रूपये के वेतनमान में पद धारण किये हो तथा उक्त ग्रेड में कम से कम 5 वर्ष की नियमित सेवा की हो, तथा

(iii) 6500-200-10500 के वेतनमान में पद धारण किये हो तथा उक्त ग्रेड में कम से कम 8 वर्ष की नियमित सेवा की हो ।

(सी)आर. आर: कर्मचारी भविष्य निधि और प्रकोर्स उपबंध अधिनियम, 1952 ( 1952 का 19) की धारा 5 (घ) की उपधारा 7 (क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय बोर्ड सरकार के अनुमोदन से कर्मचारी भविष्य निधि संगठन में सहायक अभियन्ता (सिविल ) के पद पर भर्ती की पद्धति का नियमन करने के लिए निम्नलिखित नियम बनाता है, अर्थात: -

उपरोक्त पद की संख्या, उसका वर्गीकरण और इससे संबद्ध वेतनमान इस नियमावली के साथ सलंग्न अनुसूची में उल्लिखित कालम 2 से 4 के अनुसार होंगे ।

4. भर्ती पद्धति आयु सीमा और अन्य योग्यताएं इत्यादि

उक्त पद से संबंधित भर्ती की पद्धति, आयु सीमा, योग्यताएं और कथित पद से संबंधित अन्य मामले, अनुसूची मे उल्लिखित कालम 5 से 14 के अनुसार होंगे ।

(i ) ये नियम कर्मचारी भविष्य निधि संगठन सहायक अभियन्ता (इलेक्ट्रिकल) गती नि कहलायेंगे ।

( ii) ये सरकारी राजपत्र में प्रकाशन की तिथि से प्रवृत होगे ।

2. लागूहोना ये नियम इन नियमों के साथ संलग्न अनुसूची के कॉलम में विनिर्दिष्ट पदों पर लागू होगे ।

3. पदों की संख्या, वर्गीकरण और वेतनमान

उपरोक्त पद की संख्या, उसका वर्गीकरण और इससे संबद्ध वेतनमान इस नियमावली के साथ सत्य अनुसूची में उल्लिखित कालम 2 से 4 के अनुसार होंगे ।

4. भर्ती पद्धति आयु सीमा और अन्य योग्यताएं इत्यादि

उक्त पद से संबंधित भर्ती की पद्धति, आयु सीमा, योग्यता और कथित पद से संबंधित अन्य मामलं. अनुसूची में उल्लिखित कालम 5 से 14 के अनुसार होंगे ।

5. अयोग्यताएं

वह व्यक्ति पात्र नहीं होगा : -

(क) जिसने उस व्यक्ति से विवाह किया है, जिसका पति पत्ना जीवित है या

(ख) जिसने पति पत्नी जीवित होने पर किसी अन्य व्यक्ति से विवाह किया है ।

बशर्ते कि केन्द्रीय न्यासी बोर्ड , यदि इस बात से संतुष्ट है कि ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अंतर्गत ऐसा स्वीकार्य हे ओर ऐसा करने के लिए अन्य आधार है तो किसी व्यक्ति को इस नियम के प्रचालन से छूट दे सकता है ।

6. छूट देने की शक्ति

जहां केन्द्रीय न्यासी बोर्ड का यह मत है कि यह आवश्यक है था ऐसा करना समीचीन होगा तो लिखित में कारणों को रिकार्ड करते हुए आदेश द्वारा ओर केन्द्र सरकार के साथ परामर्श करके किसी वर्ग या श्रेणी के व्यक्तियों के संबंध में इन नियमों के किसी उपबंध में छूट दे सकता है ।

7. अपवाद

इस संबंध में केन्द्रीय सरकार द्वारा समय समय पर जारी किये गय आदेशों के अनुसार दे नियम अनुसूचित जातियों, अनुसूचित जन जातियों . भूतपूर्व सोनकों और अन्य विशेष वर्गों के व्यक्तियों को दिय जाने वाले आरक्षणों, आयु सीमा में छूट और रियायतों को प्रभावित नहीं करेगे ।

In exercise of the powers conferred by Section 60 of the National Bank for Agriculture and Rural Development( NABARD) Act - 1981 , the Board of Directors of NABARD, with the previous approval of the Central Government and in consultation with RBI makes the following amendments to the National Bank for Agriculture and Rural Development ( Issue and Management of Bonds) Regulations 1987, viz. ,

1. (1) These Regulations may be called National Bank for Agriculture and Rural Development (Issue and Management of Bonds) Amendment Regulations, 2004 .

(2) They shall come into force on the date of their publication in the Official gazette .

2. In Regulation 3(1) (b) of the National Bank for Agriculture and Rural Development (Issue and Management of Bonds) Regulations, 1987, ( hereinafter referred to as "the Principal Regulations ") the words "or stock held at the credit of the holder in SGL Account maintained by the National Bank or the Reserve Bank subject to approval by the Board" ... shall be deleted.

3. The following sub- regulation (3A) shall be inserted after sub- regulation 3 (3),:

"3A( a)Notwithstanding anything to the contrary herein contained, the National Bank may at the request of the person entitled to hold the bonds, issue bonds in the form of an entry in an account to be maintained by the National Bank in the name of the person entitled to hold the Bonds .

(b) The bonds may be so issued in the form of an entry in the books of accounts of the National Bank either initially at the time of subscription to the bonds or subsequently by conversion of the bonds issued either in the form of a promissory note or stock .

(c) If a bond has already been issued in the form of a promissory note, the bond holder desirous of holding it in the form of an entry in an account with the National Bank shall make requisition in Form XI and surrender the bond duly endorsed in favour of the National Bank for the bond being held in the form of an entry in an account in the books of the National Bank .

(d) If the bond has been issued in the form of Stock Certificate, the holder shall transfer the bond in favour of the National Bank with a request that the bond may be held in the form of an entry in an account to be maintained by the National Bank in the name of the holder.

(e) A person holding bonds in the form of an entry in an account maintained by the National Bank may have the bonds transferred or converted in the form of a promissory note or a Stock Certificate by making an application in Form XII.

(f) No fee is chargeable for issuing bonds in the form of an entry in the account of the books of the National Bank or converting bonds already issued either in the form of a promissory note or stock in the form of an entry in the books of the National Bank or vice-versa.

(g) Unless otherwise provided, bonds issued or held in the form of an entry in the books of the National Bank shall be transferable by execution of an instrument of transfer in Form XIII . The transferor in such cases "hall be deemed to be the holder of the bonds to which the transfer relates till such time the name of the transferee is entered in the books of the National Bank".

4. In regulation 3 of the Principal Regulations, after sub- regulation 3A, the following shall be inserted as sub- regulation 3B, namely .

"3B. Notwithstanding anything contained herein above and subject to the provisions of the Depositories Act, 1996 or

11. After Regulation 12 of the Principal Regulations, the following Regulation 12A shall be inserted namely

12A, Discretion of the National Bank:

Notwithstanding anything contained in Regulation 9, 10, 11 and 12 where the National Bank deems fit, in any case, it shall be lawful for the National Bank in its discretion to dispense with all or any of the procedures prescribed therein regarding the issue of duplicate hond and issue duplicate bond upon such terms as to indemnity or otherwise, as it may deemfit.

12. After Regulation 15 of the Principal Regulation the following Regulation 15A shall be inserted namely :

15A - NOMINATION

(1) Notwithstanding anything contained in Regulation 15, where a bond is held by one or more persons, the sole holder or, as the case may be, all the holders together may nominate any person or persons to whom, in the event of the death of the sole holder or the death of all the holders, the amount 2212

due on the bond may be paid and the payment by the National Bank in accordance with the provisions of this regulation shall constitute a full discharge to the National Bank of its liability in respect of the bonds.

Provided that when a bond is held by two or more persons,

the nominee shall become entitled to receive the amount only on the death of all the holders.

Provided further that nothing contained in this Regulation shall affect any claim which any representative of a deceased holder/s of a bond may have against the nominee in respect of any amount due on the bond.

(2) If two or more persons are nominated under sub- regulation ( 1), the amount due on the bond shall be distributed amongst the nominees in the manner specified in the nomination , and in the absence of such specification, the amount shall be distributed equally among all the nominees . Provided, however, that if no nomination subsists or, if such nomination relates only to a part of the amount due, the whole amount or part thereof to which the nomination does not relate, shall be paid to the persons who may be entitled thereto under sub- regulation (2) of Regulation 15 .

(3) A nomination under sub- regulation ( 1) may be made by the sole holder or, as the case may be all the holders together in Form XIV.

(4) A nomination may be made only in respect of a bond which is held in the individual capacity of the holder and not in any representative capacity as the holder of an office or otherwise.

(5)Where the nominee is a minor, the sole holder or as the case may be, all the holders together may appoint any person ( not being a minor) to receive the amount due on the bond during the minority of the nominee.

(6) Where a bond is held in the name of a minor, the nomination, if any, shall be made by a person lawfully entitled to act on behalf of the minor,

(7) A nomination may be substituted by submitting an application in Form XIV or cancelled by submitting an application in Form XV, together with the bond to the National Bank.

(8) A nomination or a substitution or a cancellation of a nomination shall be registered in the books of the National Bank and the fact of registration shall be noted on the bond and, on such registration the said nomination, cancellation or substitution, as the case

may be, shall be deemed to be effective from the date on which it was submitted.

(9) The rights, which a nominee has acquired in relation to the bond under a nomination duly made and registered under this Regulation, shall not be affected by reason of the issue of a duplicate bond and the nominee shall have the same rights in relation to the duplicate bond as he had in relation to the original bond.

13. For sub - regulation(b) of Regulation 19 of the Principal Regulations, the following shall be substituted, namely:

"19(b) In case of duplicate bond after lapse of four years from the date of publication of the notification under Regulation 10(1). "

14. After Regulation 21 of the Principal Regulations, the following Regulation 21A shall be inserted, namely:

"21A When a bond in the form of an entry in the account becomes due for payment of principal, a duly signed receipt in Form XVI shall be furnished by the holder to the Office of issue' .

15. In the Schedule to Principal Regulations, the Forms numbered as XI to XVI shall be inserted after Form X.

DEED OF INDEMNITY

HRD / 1 ( 11 ) 97 /AE ( E) / RR: In exercise of the powers conferredby Sub- Section (7) ( a) of Section 5 ( D) of the Employees' Provident Fund and Miscellaneous Provisions Act , 1952 ( 19 of 1952 ) , the Central Board hereby with the approval of Government makes the following rules for regulating the method of recruitment to the post of Assistant Engineer ( Electrical ) in the Employees' Provident Fund Organisation , namely:

1. SHORT TITLE AND COMMENCEMENT

( 1 ) These rules may be called the Employees' Provident Fund Organisation , Assistant Engineer ( Electrical ) Recruitment Rules , 2004.

(11 ) They shall come into force from the date of issue.

2. APPLICATION

These rules shall apply to the post specified in column 1 of the Schedule annexed to these rules .

3. NUMBER OF POSTS , CLASSIFICATION AND SCALE OF PAY

The number of posts , their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the aforesaid Schedule.

4. METHOD OF RECRUITMENT , AGE LIMIT AND OTHER QUALIFICATIONS ETC.

The method of recruitment, age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule.

5. DISQUALIFICATION

No person: -

(a) who are entered into or contracted a marriage with a person having a spouse living , or;

(b) who , having a spouse living , has entered into or contracted a marriage with any person shall be eligible for appointment to the said post.

6. POWER TO RELAX

Where the Central Board is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing , and in consultation with the Central Government , relax any of the provisions of these rules with respect to any class or category of persons.

7. SAVINGS

Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex- Servicemen and other special categories of persons , in accordance with the orders issued by the Central Government from time to time inthis regard.
