स ० 14013/ 29/99-अ ० भा० से० ( III )--इस विभाग द्वारा जारी, दिनांक 02 जुलाई 2003 की अधिसूचना संख्या 14013/29/ 99- अ ० भा ० से०- III का, आंशिक संशोधन करते हुए , राष्ट्रपति, श्री बिरेन दता ( 1987 ) के भारतीय प्रशासनिक सेवा में किए गए स्थायीकरण को रद्द करते हैं क्योंकि उन्होंने भारतीय प्रशासनिक सेवा ( परिवीक्षा) नियम, 1954 के नियम 5 के उपबन्धों के अनुसार लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकादमी में निर्धारित प्रशिक्षण प्राप्त नहीं किया है । इससे पूर्व की अधिसूचना उनकी वास्तविक जन्म तिथि, अर्थात् 20-03-1949 के स्थान पर अनजाने में उनकी जन्म तिथि 20-03-1939 मानते हुए जारी की गई थी । तदनुसार, श्री बिरेन दत्ता द्वारा भारतीय प्रशासनिक सेवा ( परिवीक्षा ) नियम, 1954 के नियम 5 ( 1) में यथा निर्धारित प्रशिक्षण पूरा किया जाता अपेक्षित है । उनके द्वारा लाल बहादुर शास्त्री राष्ट्रीय प्रशास्न अकादमी में निर्धारित प्रशिक्षण पूरा किए जाने के पश्चात्उनके स्थायीकरण के संबंध में नए सिरे से एक अधिसूचना जारी की जाएगी ।

1996 उपरोक्त केन्द्रीय सचिवालय सेवा अधिकारियों को कार्मिक एवं प्रशिक्षण विभाग के दिनांक 21 अप्रैल , 2004 के कार्यालय ज्ञापन सं० 4/ 7/ 2003-सी ० एस०-1 के अनुपालन में शामिल किया गया है और यह निम्नलिखित शर्तों के अधीन है:-
[भाग च्ड 2 (i ) केन्द्रीय सचिवालय सेवा ग्रेड -1 में उपरोक्त अधिकारियों की वरिष्ठता आदेश के पश्चात् चयन सूची में उनके शामिल किये जाने का आदेश जारी होगा, चाहेग्रेड में उनकी नियुक्ति की वास्तविक तिथि कुछ भी हो । उपरोक्त दो चयन सूचियों में से अवर सचिव के पद पर अधिकारियों की नियुक्ति श्री आर ० के० ओक्षा एवं श्रीमती प्रीति श्रीवास्तव बनाम भारत संघ एवं अन्य द्वारा उच्च न्यायालय दिल्ली में दायर सिविल रिट याचिका के अंतिम फैसले के आधार पर होगी ।
(ii ) स्वीकृत सेवा एवं अवर सचिव के रूप में नोशनल आधार पर वेतन निर्धारित करने हेतु उपरोक्त अधिकारियों की नियुक्ति क्रमशः1-7-1995 तथा 1-7-1996 से प्रभावी मानी गई है ।
( iii ) इस विभाग के केन्द्रीय आदेश के अनुसार अधिकारी अवर सचिव के पद पर वास्तविक नियुक्ति की तिथि से वेतन पुर्ननिर्धारण के कारण हुए बकाया के हकदार होंगे । इसके अतिरिक्त, इन अधिकारियों को वित्तीय नियम- 22 के प्रावधानों के अंतर्गत वेतन निर्धारण हेतु विकल्प चुनने के अधिकार भी प्राप्त होगा । जबकि, जिन अधि- कारियों को उनकी चयन सूची वर्ष के 1 जुलाई से पहले तदर्थ अवर सचिव के रूप में पदोन्नत किया जा चुका है और जिन्होंने स्पिलिट विकल्प का लाभ उठा लिया है , बे पुनः विकल्प चुनने के पात्र नहीं होंगे ।

( ii ) यह तदर्थ पदोन्नति उन्हें इस ग्रेड में लगातार बने रहने अथवा नियमित नियुक्ति के लिए चयन सूची में सम्मिलित होने अथवा सलेक्शन ग्रेड में वरिष्ठता का दावा करने करने का अधिकार प्रदत्त नही करेगी ।
( iii ) तदर्थ नियुक्त व्यक्ति को स्थानांतरण जोकि इस बीच प्रशासनिक तात्कालिकताओं के कारण आवश्यक हो सकता है, के अलावा विभिन्न मंत्रालयों/ विभागों को पदों की विशिष्ट संख्या के आबंटन के समय अन्य मंत्रालय/ विभाग में स्थानांतरित किया जा सकता है । ( iv) अवर सचिव का पद जिसे श्री सचदेवा के लिए उपसचिव स्तर तक बढ़ाया गया था, का उनके द्वारा परित्याग किया जाएगा और अब तदर्थ मियुक्ति के अधिसूचित होने पर खाद्य प्रसंस्करण उद्योग मंत्रालय में उपसचिव पद की तदनुरुपी संख्या सृजित की गई मानी जाएगी ।

(iii) Ad - hoc appointee may be moved to another Ministry/Department as and when the allocation of specific number of posts to different Ministries / Departments is done apart from the transfer, which may in the meantime be necessitated due to administrative exigencies .
(iv) The post of under Secretary, which was upgraded to the level of Deputy Secretary as personal to Shri Sachdeva would be demitted by him and to the extent the ad- hoc appointment is now notified , a corresponding number of post of Deputy Secretary would be deemed to have been created in the Ministry of Food Processing Industries.
